Iconic coffee cup
Changes hands

Stepping into the Coffee Cup is like stepping back in time. Friends and families put down their phones and gather around small tables to share a meal. Pensacolians of all stripes chat and sip coffee at the bar. A handful of hardworking women take the orders, cook the food and generally run the show. But the landmark Pensacola restaurant is starting a new chapter, under new ownership. Restaurateur David Hambrick recently purchased the business from its former owner Roy Cooley. Cooley had owned the restaurant since 2000. Hambrick is the founder and owner of downtown restaurants Jaco’s Bayfront Bar & Grille and V Paul’s Italian Ristorante. He first moved to Pensacola in
1994 and worked as a Honda dealer as part of the Shottenkirk Automotive Group. After sale of the dealership and a brief flirtation with retirement, Hambrick decided to try his hand at the restaurant business. He opened Jaco’s in 2009 and V. Paul’s in 2014. The Coffee Cup first opened in 1945 and has been in business at 520 E. Cervantes Street ever since. It among the city’s oldest and most storied restau-
rants alongside Jerry’s Drive In and Oscar’s Restaurant in Brownsville. With its tile floor, solidnickel bar stools and original, 1945 griddle, the Coffee Cup embodies the image of classic Southern diner. Famous for its Nassau grits, the restaurant has served for decades as a gathering place local businessmen, politicians and generations of families. “Anybody that’s lived around Pensacola forever knows the Coffee Cup,” Hambrick said. “Families were raised here almost. I talk to 70- and 80-yearold people and they say, ‘We came here with my parents, we ate three or four times a week.’” Since closing on the sale, Hambrick has assured Coffee Cup regulars that he has no intention of changing the iconic eatery. “It’s the Coffee Cup, it doesn’t need to change,” Hambrick said. “That would kind of be – as far as we’re concerned – a big catastrophe.” Hambrick said the only up-
dates would be a new logo for the restaurant’s T-shirts, and any upgrades necessary to keep the building in working order. “Obviously everything in here is old, so as we work our way through the facility itself we’ll do a few things here and a few things there, but the core content of the building and the core atmosphere of it, we hope, doesn’t ever change,” he said. There’s a new face in the office as well. Jon Coffey is taking over as general manager of the restaurant. Coffey first began working for Hambrick as a server at V. Paul’s before working his way up to assistant manager at Jaco’s. When Hambrick was contemplating the purchase of the Coffee Cup, he envisioned Coffey serving as its general manager from the start. “If I’m going to be at an restaurant I might as well come to
a place where I’ve already got my name on the wall,” Coffey joked. Coffey said the customer loyalty at the Coffee Cup is unlike anything he’s seen thus far in his career. “I have 40 to 50 people that I see everyday, sit in the same place, order the same thing, every day. That type of customer loyalty and faithfulness is what I think makes the place very special,” he said. Hambrick is quickly becoming a regular himself, and said he’s partial to an order of scrambled eggs, tomato slices and a biscuit with honey. As for long-term plans, Hambrick hinted at his own retirement and suggested Coffey may one day own the restaurant himself. “It’s his opportunity to be in the food business for a lifetime if he wants it,” Hambrick said.

County Launches ‘Know Your Zone’ Panhandle Tiger Bay Club Shows Hurricane Evacuation Lookup Appreciation to Sailors and Marines with $1000 Donation to Navy-Marine Corps Relief Society Admiral Harry Harris, Commander, U.S. Pacific Command, addressed the Panhandle Tiger Bay Club May 9, at the Pensacola Country Club. Admiral Harris, a graduate of Booker T. Washington High School, discussed ongoing military and naval operations in the Indo-Pacific region. Admiral Harris also took time to reflect on how growing up in Pensacola, especially an event where he heard General “Chappie” James speak, shaped his naval career. Admiral Harris was introduced to the audience by Panhandle Tiger Bay Club member retired Admiral Robert Kelly. In addition to his prepared remarks, Admiral Harris took questions from the audience of approximately 120 club members and guests. The Panhandle Tiger Bay Club used Escambia County Emergency Management has launched a new “Know Your Zone” website for residents to look up their hurricane evacuation zone and storm surge impacts, just in time for the 2018 hurricane season. The new evacuation lookup tool is mobile responsive, features an improved address search tool and clearly shows residents the impact of storm surge simulations for each level of possible called evacuations. The online lookup tool and map can be accessed at www.myescambia. com/knowyourzone. With the new storm surge tool, residents can: • See if their home is located in evacuation zone A, B, C, D, E or None • View a storm surge simulation for each evacuation level and how water will impact their property • View the impacts of storm surge on the entire neighborhood around that specific property by selecting “Show Neighborhood Impact”
• Look up shelter locations and evacuation routes • Read facts about storm surge and related hazards Knowing your evacuation zone is one of the most important hurricane preparation steps you can take. It is very important that you look up your evacuation zone each year to find out if and when you should evacuate, even if you have looked it up in the past, as zones can change. Most importantly, do not rely on previous storm experience. Just because you weathered the last storm, does not mean you will weather this one. Every storm is different, even if it is the same category. Categories only measure wind speed and not storm surge, so it does not tell the whole story. While wind can be very destructive, storm surge is often the killer – think “run from water, hide from wind.” A category one storm can have much more deadly storm surge than a category three; it
depends on that particular system. While hurricane evacuation zones are based on storm surge, they also take into account other public safety factors such as being cut off from first responder support. Properties on barrier islands are all considered to be in a level A evacuation zone due to the risk to the bridge and to citizens being isolated, even if the “Know Your Zone” application does not show any storm surge on the parcel for that evacuation level. It is vital that in the event of a storm, you listen to local emergency management officials and follow any evacuation orders issued. Escambia County Emergency Management was able to create the new storm surge lookup tool in house using program code generously provided by Pinellas County, Fla. One Hundredth Watchman Procedure Performed by Baptist Heart and Vascular Institute Baptist Heart and Vascular Institute (BHVI) has performed its 100th Watchman procedure. The procedure was completed May 17. This is a tremendous milestone for BHVI and a great benefit to the people in the Northwest Florida area who need this level of advanced care, said Victor Hall, vice president, Baptist Heart and Vascular Institute. Patients who may be considered for the Watchman procedure have non-valvular atrial fibrillation, issues with long-term warfarin use and are at increased risk for stroke. Atrial fibrillation, or AFib, occurs when the upper chambers of the heart beat out of coordination with the lower chambers, causing sporadic heart palpitations that can allow blood to stagnate in the left atrial appendage (LAA) and eventually clot. These clots can break away and enter the blood stream, caus-
ing a stroke. AFib patients are five times greater risk for stroke. Because of this risk, many AFib patients take warfarin, an anti-coagulant or blood thinner. The Watchman device is a self-expanding nickel titanium frame with fixation anchors and is covered by a surgical fabric. It looks like a tiny jelly fish. The device can be threaded through a vein in the leg and into the heart where it is implanted at the opening of the LAA. This serves as a barrier to prevent clots from entering into the blood stream. The procedure is performed under general anesthesia in the catheterization laboratory and usually lasts about an hour followed by a 24-hour hospital stay. Florida’s Top Elementary and Middle School Physical Education Programs are in ECSD Schools

Beulah Elementary has Todd Aulger, Whitney Voeltz and Karen Sawyers serving as their PE Teachers. Ferry Pass Middle School has Dustin Brenton, Kris Lapata and Candy Prince serving as their PE Teachers. This prestigious award is only given to one school at each level in the state each year. A program is selected based on the quality of instruction, adherence to a rigorous and well-rounded curriculum aligned to state and national standards, implementation of special health and wellness events and programs, family and community relationships and student/ teacher interactions. “We have many schools with incredible programs that are raising the bar and changing the perception of Physical Education,” Casandra Waller, ECSD Specialist for Physical Education Health, Wellness and Driver Education, said. “This is not your old-school PE anymore, and these two programs in particular are amazing examples of what the new Physical Education looks like. On behalf of our entire district and community, we are proud and thankful for what the Physical Education teachers have done to provide optimal experiences for our students.”
It is quite an honor to have one program win a state award, but for a school district to have two programs selected as the best in their category in the same year is exciting. “We are beyond words,” Waller added. “Exercise has proven to increase memory, lengthen attention span, boost decision making skills, improve multi-tasking and planning,” Matthew Taylor, Assistant Principal at Beulah Elementary School, said. “Our coaches do an excellent job at planning structured games that challenge students athletic ability while motivating them to learn how to persevere when unable to do something. All these skills help our children become better students and more productive citizens of our community.” Just last year, Escambia County celebrated when Samantha Harrison at Booker T. Washington High School was named as the SHAPE Florida High School Physical Education Teacher of the Year. “As a district and department we are pushing the envelope in Physical Education,” Waller said. “Our Physical Education teachers are stepping out of their comfort zones daily to implement new activities, incorporate technology and get all students involved in learning how to live a healthy lifestyle. The state is watching Escambia County School District as we continue to blaze the path for what quality physical education should look like.”

Fiesta of Five Flags Returns to Celebrate Founding of Pensacola
Kugelman Family Donates QuarterMillion Dollars to Children’s Hospital Construction of the new Studer Family Children’s Hospital at Sacred Heart took a big leap forward today, thanks to a quartermillion dollar donation from the Kugelman Family Foundation. The Kugelman Family Foundation has given $250,000 towards the new four-story children’s hospital on Sacred Heart’s Pensacola campus. To recognize the support and ongoing relationship, Sacred Heart will recognize the Kugelman Family Foundation on the gift shop of the new Children’s Hospital. Sacred Heart is part of Ascension, the largest non-profit health system in the U.S. and the world’s largest Catholic health system. Sacred Heart recognized the Kugelman family today in a ceremony at The Children’s Hospital. Matriarch Jane Kugelman, age 91, and her late husband, Jack, have four daughters, eight grandchildren and fourteen great grandchildren. This most recent gift was given in honor of Jack, who according to Jane, believed strongly in “helping a vast array of people be better off.” “If you’ve led a fulfilled life and you’re fortunate, you give to someone else,” Jane Kugelman said. “I want our family to be a part of the future of Sacred Heart. This Children’s Hospital will have a positive impact on the lives of many children and their families across our region for years to come.” A long-time supporter
of Sacred Heart, the Kugelman Family Foundation gifted The Children’s Hospital with its first pediatric critical care transport unit. This specially equipped vehicle is used to bring critically ill and injured babies and children from across the Gulf Coast to The Children’s Hospital for lifesaving care. Jane and Jack’s granddaughter Jane Lauter also serves on the board of directors for the Sacred Heart Foundation. The Studer Family Children’s Hospital at Sacred Heart is the region’s only children’s hospital, serving families across northwest Florida, south Alabama and south Georgia. Construction of the new four-story children’s hospital is expected to be complete in spring 2019. The new children’s hospital will increase access to specialized pediatric and maternity care and consolidate inpatient pediatric services in one convenient location. The new children’s hospital will include a pediatric emergency department and trauma center, pediatric procedure rooms, 72-bed neonatal intensive care unit, medical/surgical beds, pediatric imaging department, pediatric satellite pharmacy, pediatric inpatient rehabilitation gym, child life playrooms, outdoor gardens and a new familyfriendly dining venue. “We are honored to have the support of the Kugelmans as we progress towards the final phase of construction of the new Children’s Hospital,”

The Fiesta Celebration is an annual series of events to celebrate the founding of Pensacola in 1559 by Spanish conquistador, Don Tristan de Luna. DeLuna established Pensacola as the first European settlement in the United States. This celebration is one of the oldest and largest heritage festivals in the state of Florida. The 69th anniversary celebration will take place May 30 through June 8. Join the crowd June 1 in downtown Pensacola for the Grand Fiesta Day Parade. TAX HOLIDAY TO TRIM COST OF STOCKING UP FOR FUTURE STORMS By JIM TURNER THE NEWS SERVICE OF FLORIDA TALLAHASSEE – With a sales-tax “holiday” starting next week, retailers are expecting big spending on disaster-preparedness supplies by Floridians who have fresh memories of Hurricane Irma. The six-month hurricane season arrives June 1, along with a weeklong period in which state and local sales taxes will be lifted on a list of disaster supplies. The discount period, for example, means about 90 cents to $1.05 in sales taxes will not be applied to a $15 package of batteries or $45 to $52 is left off the purchase of a generator that costs $750. Expanded from three days last year, the tax holiday has drawn added attention after Florida experienced hurricanes in 2016 and 2017 following more than a decade without a direct hit. Hurricane Hermine hit parts of north Florida in 2016 and was followed by the devastating Irma in 2017. “Now after being hit by Irma and everything that happened last year, people are well aware of what they need and what they didn’t have last year,” James Miller of the Florida Retail Federation said. “They’re going to load up this year. We expect it to be very fruitful for retailers, and consumers are going to be able to save a lot of money on their end as well.” Not as ingrained in the shopping culture as back-toschool tax holidays, which the state has made a nearly annual event since 1998, the “disaster preparedness”
holiday period is projected to cut state revenue by $4.6 million. Local governments will experience a $1.2 million reduction in revenue, according to state economists. “Retailers are going to be rolling out a bunch of discounts, especially the big-box stores will have a lot of deals going on,” Miller said. “They want to capture as much of the audience as they can. It’s going to be very popular, and people are going to be going in and out of the stores.” Miller’s optimism for the tax holiday, which will run from June 1 to June 7, is that many Floridians will recall the rush on supplies that occurred as Hurricane Irma barreled through the Caribbean Sea toward Florida last September before impacting nearly all of the state. “People can load up early on in the year,” Miller said. “You don’t have to wait later on in the summer, when potentially a hurricane is coming or has already hit and it’s kind of almost too late to do that kind of stuff.” Floridians are also expected to get a hurricane season wakeup call this weekend as a subtropical storm named Alberto churned Friday over the northwestern Caribbean Sea just east of Mexico’s Yucatan Peninsula. On Thursday, the National Oceanic and Atmospheric Administration released what it considered an outlook for a slightly above-average hurricane season, which means 10 to 16 named storms, of which five to nine are expected to reach hurricane status. The busy 2017 season saw 17 named storms, of which 10 became hurricanes, with six reaching the major storm
status. Mark Wool, the warning coordination meteorologist at the National Weather Service’s Tallahassee office, said the pre-season outlook is intended to serve as reminder that people need to do storm planning. “You want to be self-sufficient for up to 72 hours,” Wool said. “You want to have non-perishable food items. Batteries. Battery-operated flashlights and radios. You want to make sure you’ve got a first-aid kit. Enough prescription medications to get through the event. HORSE BREEDERS AND TRACK BATTLE OVER SLOTS LICENSE
By DARA KAM THE NEWS SERVICE OF FLORIDA TALLAHASSEE – Thoroughbred breeders and trainers are accusing gambling regulators of erring when they allowed Calder Race Course to keep its lucrative slot-machine license after demolishing the grandstand where bettors once watched horses compete. But during an administrative hearing, lawyers for Calder accused the horsemen of trying to force the track to build a glitzy new stadium despite the dramatic decline in horse betting that prompted the destruction of the aged facility two years ago. The challenge highlights the growing tension between the greyhound and horse industries and racetrack operators, who have sought to do away with live racing while keeping more-profitable gambling activities such as slots and poker, a process known as “decoupling.” The Florida Horsemen’s Benevolent and Protective Association filed the complaint against state gambling regulators last year, after the Division of Pari-Mutuel Wagering renewed the slots license for the Miami Gardens casino. Under Florida law, slot-machine gaming
areas must be “contiguous and connected to the live gaming facility.” The complaint alleges that the renewal of Calder’s slot-machine license after the grandstand was torn down amounts to an “unadopted rule.” In general, the horsemen want slots players to be able to view live races, believing that seeing the activity will enhance the odds that gamblers will also wager on horses. When Calder added slots in 2010, the area where gamblers played the machines was connected to the live gaming facility, the parties involved in the case agreed. But after the 400,000-plus square foot grandstand was razed in 2016, only a partially covered sidewalk now connects the slots area and the live racing area, Bradford Beilly, the horsemen’s lawyer, argued. The destruction of the grandstand “materially changed” the configuration of the track, Beilly told Administrative Law Judge Lawrence P. Stevenson. “There is nothing between the slots facility anymore and whatever Calder deems to be its live gaming facility,” he said. But James Lewis, a lawyer who represents the state Division of Pari-Mutuel Wa-
gering, said that “but for the demolition of the grandstand, Calder’s layout remains the same.” The “contiguous and connected” requirement is fulfilled “by a sidewalk,” he said. The complaint about the alleged unadopted rule is “a red herring,” attorney Wilbur Brewton, who represents Calder, said. “What this case is really all about is that the horsemen want to dictate how Calder should operate its pari-mutuel business” and “tell Calder to build an air-conditioned grandstand building,” he said. According to testimony Tuesday and court records, Calder began tearing down the grandstand in 2015, about a year after its parent company, Churchill Downs, reached a deal with The Stronach Group, which owns Gulfstream Park. Under the agreement, Gulfstream – which is eight miles away – runs 40 races a year at Calder, the minimum number of live races required for Calder to maintain its slots license. The tracks, which are also required to have revenue-sharing agreements with horsemen’s associations, cut a deal with the Florida Horsemen’s Benevolent and Protective Association in which the breeders and trainers receive 10 percent of the revenue generated by the slots at the Calder site, according to testimony Tuesday. That amounts to about $8 million a year from the $80 million that Calder generates in revenue from slots, Calder President and General Manager Maureen Adams told the judge. The track decided to “outsource” the races because it was losing about $5.5 million a year on the horse races, Adams said. When asked if she was concerned that tearing down the grandstand could put Calder’s slots license at risk, Adams answered, “Absolutely not.” Beilly also raised the decoupling issue with Adams, asking her – over Brewton’s objections – if Calder wanted to eliminate live racing. “We have actively participated with all other pari-mutuels in South Florida in a
quest to have the legislation changed so that we could be free to either conduct parimutuel wagering or not, based on customer demand and whether or not the customer demand is there and whether or not the activity could be profitable,” she said. The horsemen’s association first notified gambling regulators about concerns regarding Calder’s slots license in October 2016, after the demolition was completed, according to court records. Division employees – including two investigators – visited the site after the demolition but did not launch any official inquiries into whether the changes would affect the slots license, according to testimony. But Beilly said that gambling regulators never formally ruled that the walkway met the requirements of the law. “Where on record did anybody at the division make a conclusion, other than issuing licenses, that they (Calder) remained in compliance once the facility was knocked down?” Beilly asked. The judge didn’t give any indication of how he might rule in the case, but said it seemed “that basically not a whole lot of thought was given to” the demolition. “The investigator went out and said, eh, it’s contiguous. It wasn’t a big deal to the division until your client made it an issue,” Stevenson told Beilly, adding that regulators treated the elimination of the grandstand as if “it wasn’t a big deal.” “…That’s what I’m going to walk away with, that impression, for better or worse,” the judge said, describing gambling regulators’ attitude toward the demolition. “It’s contiguous. It hasn’t moved. The grandstand’s gone. Nothing else has moved. That may be good enough.” Stevenson said he is “up in the air” about his conclusions, and that his impression could benefit either side. “Depends on whether I think it’s a big deal or not, to knock down the grandstand,” he said. After the hearing, Beilly maintained that the post-grandstand track does not meet the statute’s requirements.
SPLIT RULINGS CONTINUE ON “STAND YOUR GROUND” LAW CHANGE
By JIM SAUNDERS THE NEWS SERVICE OF FLORIDA TALLAHASSEE – Amid requests for the Florida Supreme Court to wade into the issue, a south Florida appeals court Wednesday ruled against a defendant in one in a series of cases about how to carry out a controversial 2017 change to the state’s “stand your ground” self-defense law. The ruling by a panel of the Third District Court of Appeal was the third time this month that appellate courts have grappled with the issue of the 2017 change – with courts coming to different conclusions. The change shifted a key burden of proof from defendants to prosecutors in “stand your ground” cases, and the issue in the appeals is whether that change should apply retroactively to defendants whose cases were pending before the 2017 law passed. The Third District Court of Appeal in the case May 16 of defendant Justin Bailey and in a May 11 decision involving defendant Tashara Love sided with prosecutors in finding that the change should not apply retroactively. But the Second District Court of Appeal, in a May 4 ruling in a Hillsborough County case, said the change is retroactive, a decision that could help defendants arguing that they acted in self-defense. Love’s attorneys quickly filed a brief last week asking the Florida Supreme Court to take up the issue. “This case presents an issue of statewide importance impacting countless criminal prosecutions: whether the 2017
amendment to the “Stand Your Ground” law applies to all pending cases or only those arising after its enactment,” Love’s attorneys wrote in the brief. The “stand your ground” law says people are justified in using deadly force and do not have a “duty to retreat” if they believe it is necessary to prevent death or great bodily harm. When the defense is successfully raised in pre-trial hearings, defendants are granted immunity from prosecution. Before the 2017 change, the Florida Supreme Court had ruled defendants had the burden of proof in pre-trial hearings to show they should be shielded from prosecution. With backing from groups such as the National Rifle Association, the 2017 change shifted the burden from defendants to prosecutors to prove whether self-defense claims are justified. The ruling by the Third District Court of Appeal, which hears issues from Miami-Dade and Monroe counties, gave few details of the Bailey case. But it said a lower court in December 2016 rejected Bailey’s argument that he should be shielded from prosecution because of the “stand your ground” law. “Under the version of the statute existing on the date of the offense (and at the time of the evidentiary hearing), Bailey shouldered the burden of proof, requiring him to establish his entitlement to statutory immunity by a preponderance of the evidence,” the May 16 ruling by appealscourt judges Kevin Emas, Thomas Logue and Norma
Lindsey said. “The trial court concluded in its order that Bailey ‘failed to prove by the preponderance of the evidence that he is immune from prosecution.’ ” As Bailey appealed the ruling, the Legislature and Gov. Rick Scott shifted the burden of proof to prosecutors. Bailey’s attorneys argued that the change should be applied to his case. But in turning down Bailey, the May 16 panel pointed to the May 11 ruling in the Love case, which stemmed from a 2015 shooting during an altercation outside a Miami-Dade County nightclub. “Following our precedent in Love, we therefore hold that the June 9, 2017 amendment does not apply to Bailey’s case, and Bailey is not entitled to a new evidentiary hearing on that basis,” the May 16 ruling said. But in the Hillsborough County case earlier in the month, a panel of the Second District Court of Appeal said the burden-of-proof change should apply retroactively to Tymothy Ray Martin, who was convicted of felony battery in a 2016 altercation involving his girlfriend. Martin had sought to use the “stand your ground” law to be shielded from prosecution, but a judge denied his request in a pretrial hearing. Martin appealed his conviction, and the appeal was pending when the Legislature and Scott made the change. The Second District Court of Appeal and the Third District Court of Appeal have asked the Supreme Court to resolve the retroactivity issue – a move known as “certifying” a question to the Supreme Court.
