Roxie le Rouge, an artistic burlesque performer, will take the stage. The provocative performer hails from New Orleans and delivers a devilish act. She’ll make her moves and you can move on to the poker tables, where you might meet Lady Luck in the outside casino area. Finally, the Red Room really heats up as you dance the night away to the Rowdies Rock live band. The PLT offers up plenty of party favors to bid on, from haircuts, to lunch with a celebrity, to a fine piece of jewelry. There’s something for everyone at the silent auction. Cabaret is the biggest fundraiser of the year for the Pensacola Little Theater. It’s crucial to the survival of the oldest continually operating community theater in the Southeastern United States. Since 1936, the Little Theater has been a staple in Pensacola. It has changed homes a few times, finally settling as a hub for the performing arts in its current home in 1996. The building was once a jail, but now the Pensacola Cultural Center houses the Little Theater, the Pensacola Ballet, the West Florida Literary Federation and even a church. PLT’s theater is made up of thousands of volunteers, bringing quality community theater to all of us. The theatre also offers acting, writing, and production classes. PLT is a hub for the creative, the fun, the adventuresome. On one night a year, PLT lets it hair down and throws a massive party. You don’t want to miss it. The Trial Court Administrator’s office is accepting applications for civil traffic infraction hearing officers for the traffic courts in Escambia and Santa Rosa Counties. Civil traffic infraction hearing officer’s services include, but are not limited to the following: Serve at the pleasure of the Chief Judge or his/her Designee. Hear and consider all civil traffic infraction proceedings, including parking ticket hearings. Preside over calendars scheduled at traffic court locations throughout Escambia and Santa Rosa Counties. Have the power to accept pleas from defendants, hear and rule on motions, decide the guilt or innocence of any person, adult or juvenile, charged with any civil traffic infraction; adjudicate or withhold adjudication in the same manner as a County Court Judge under the statutes, rules, and procedures, presently existing or as subsequently amended. Provide services pursuant to the Florida Statutes, the Rules of Court, the Code of Judicial Conduct, Administrative Order PA/PI-­‐CIR-­‐00-­‐13, and any other applicable administrative orders and relevant case law. All interested parties who are a member of the Florida bar in good standing will be required to complete a 40-­‐hour educational training program, offered by the Trial Court Administrator’s office, after they have been selected to serve as an officer. Additionally, each officer will be required to complete an approved annual four-­‐hour continuing education program in accordance with Traffic Court Rule 6.630. Civil traffic infraction hearing officers are compensated a fee in the amount of sixty five ($65) per hour for presiding over civil traffic infraction hearings. First patient receives kidney through Sacred Heart Health System and UF Health collaboration

A University of Florida Health transplant surgeon has performed Northwest Florida’s first kidney transplant as part of a collaboration between the Gainesville-based health system and Sacred Heart Health System in Pensacola. On Feb. 2, Renwick Avant, 47, of Pensacola, received a new kidney at the hands of UF Health’s Rick Stevens, M.D., Ph.D., FACS, FAST and Sacred Heart vascular surgeon Christopher LeCroy, M.D. The successful launch of the Sacred Heart and UF Health program was celebrated Wednesday in a ceremony attended by Mr. Avant as well as leaders and specialists from UF and Sacred Heart. “Partnering with Sacred Heart Health System is an opportunity to provide livesaving and life-extending care to end-stage kidney disease patients through kidney transplantation. Patients who live in the Pensacola area, hours away from other transplant centers, will clearly benefit from kidney transplant services at Sacred Heart,” said Kenneth Andreoni, M.D., an associate professor and chief in the division of transplantation surgery at the UF College of Medicine. “Traveling long distances can be quite difficult for people who are very ill, and the coordination of care can be daunting.” Diagnosed with end-stage renal disease in 2009 and on various transplant lists since 2011, Avant has had outpatient dialysis at least twice a week, four to five hours each ses-

sion. Hoping to decrease his wait time to receive a new kidney, Avant transferred to Sacred Heart in November 2016. Sacred Heart is a member of Ascension, the country’s largest nonprofit health system. “The transplant procedure went very smoothly,” said Stevens, who is also a professor in the UF College of Medicine’s division of transplantation surgery. “We had practiced every aspect of patient flow many times. For our first case, we could not have had a better patient than Mr. Avant. You don’t realize how many people are involved in the process; it touches almost every aspect of the hospital. Performing the surgery and seeing the incredible care the entire team provided was very rewarding.” In October 2016, UF Health and Sacred Heart Health System launched a collaborative kidney transplant program to benefit thousands of people across the Southeast currently awaiting a lifesaving transplant. The program is led by Stevens and Sacred Heart transplant nephrologist Douglas Scott Keith, M.D., FAST. “The collaboration between UF and Sacred Heart brings together the best of universitybased and community-based medicine to provide excellent, state-of-the-art patient care,” said Michael L. Good, M.D., dean of the UF College of Medicine. “This will benefit the citizens of our state, especially those who live in the western Panhandle.” Added Susan Davis, president and CEO of Sacred Heart

Health System, “This is truly an extension of our mission to provide lifesaving care to those who desperately need it, like Mr. Avant. We are honored to collaborate with UF Health to provide the only kidney transplant program in Northwest Florida, which will increase access to care for patients with end-stage renal disease.” Avant said he looks forward to spending time with his wife, Jennifer, and their two children and returning to work. He hopes to pick up a favorite hobby soon as well. “I coached Little League Baseball for 18 years but I had to stop when I went on dialysis,” Avant said. “I’d like to start to coach again, now that I’m feeling better and I have the time.” Avant said that he required dialysis three days a week, with each treatment taking about five hours. “It was like a part-time job,” he said. Throughout the southeastern United States, the average time on a wait list for patients needing a kidney transplant is 73 months, according to the Scientific Registry of Transplant Recipients. Previously, Northwest Florida residents had to travel to Gainesville, Birmingham or New Orleans to undergo kidney transplants, including the required presurgery and follow-up care. “Our collaboration with Sacred Heart in kidney transplant, as well as in other areas, makes a difference in addressing crucial health care needs that have until now been unavailable to patients

Greater Pensacola Chamber To Recommend Projects For Triumph Gulf Coast Funding On March 7, the Greater Pensacola Chamber of Commerce announced that it will be recommending projects to be considered for funding by Triumph Gulf Coast. The Chamber will research and study potential projects and provide its recommendations later this year. “Triumph Gulf Coast provides a unique opportunity for Escambia County to develop projects that will diversify our economy, strengthen our infrastructure and further develop our workforce.” said Chamber Policy Chairman Justin Beck. “With the assurances we have received from the legislative leadership concerning the first Triumph payment coming to Northwest Florida, it is now time to focus

on identifying projects that will meet the needs of our local businesses so that they can thrive in the future economy.” The Chamber’s Policy Committee has already begun its initial analysis of local economic development, infrastructure and workforce development projects. However, the Chamber will look to collaborate with other community stakeholders before making its final recommendations. “We want input from the community so we can recommend projects that have wide support and will positively impact the greatest number of our citizens.” Beck stated. Triumph Gulf Coast is a nonprofit corporation created by the Florida Legislature to administer funds recovered by

the Attorney General for economic damage to the state resulting from the Deepwater Horizon oil spill. The corporation was directed to create and administer a trust or “recovery fund” for the benefit of the eight counties disproportionately affected by the Deepwater Horizon oil spill. Per state law, the principal of the fund is derived from seventy-five percent of all monies received from the settlement. The first payment of $400 million has been received by the state of Florida, meaning $300 million is due to be distributed to Triumph Gulf Coast. Legislation has been filed in both chambers of the Florida Legislature to further clarify the intent of the monies received by Triumph Gulf Coast.

Uwf Innovation Institute Awards Elementary Class With New Matter Mod-T 3D Printer The University of West Florida Innovation Institute and FloridaShines awarded Cassie Mense’s fourth-grade class at Myrtle Grove Elementary School with a New Matter MODt 3D printer today for winning FloridaShines’ first 3D printing contest. Mense gave her students the assignment to research engineers who had made a significant contribution to science and to create and print a model of that person. The winning entry was a model of NASA/JPL Engineer Bobak Ferdowski. Ferdowski caught the attention of the world during the landing of the Curiosity rover on Mars. “At the Institute, we focus on areas of high social importance, with a particular emphasis on education, to explore, design, prototype and deliver innovation for education and learning,” said Dr. Karen Rasmussen, assistant provost and chief academic strategist at the UWF Innovation Institute. “That is why we hosted the contest. Besides it being tons of

fun, 3D design and printing can help students learn to think differently, be creative and achieve goals through experimentation and stepby-step improvement.” Other winners in the K-12 division include Austin Ryan Clary, for his “Pyramid of Giza” puzzle, which earned second place. The winners in the state college division came from Pensacola State College. The first-place prize of 3D printing software was awarded to a group of robotics students for a robotic pancake ladle, and the second place was a tie between Todd Moody for an antenna fixture and Jacob Lee Underwood for an automatic closet light. Third place went to a group of carpentry students for a model of a tiny house. “At New Matter, we’re constantly striving to make 3D printing more accessible for educators and their students and we’re thrilled to donate a MOD-t to FloridaShines for their exciting contest,” said Steve Schell, co-founder and chief ex-

ecutive officer at New Matter. “We’re eager to see how the students at Myrtle Grove Elementary School use their new MOD-t, and we’re looking forward to supporting them as they begin the next leg of their educational journey.” In the fall of 2016, the Institute and FloridaShines hosted the statewide 3D printing contest for Florida students of all ages. The contest was open to all currently enrolled students at Florida’s public, private, charter and home schools, ranging from kindergarten to graduate school. All entries will be added to the 3D model collection in the Florida Orange Grove open educational resource repository. The Orange Grove is Florida’s digital repository for instructional resources. BONDING QUESTION HOVERS OVER EDUCATION PROJECTS By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA

If Florida lawmakers don’t agree to borrow money to pay for school construction and maintenance projects, they will come up about $36 million short of what state education officials have requested for a key program next year. State economists made their final estimate last week on money available in the 201718 fiscal year for the Public Education Capital Outlay, or PECO, program, which is funded by the gross-receipts tax on utility services, including electricity and communications. They looked at two scenarios: one without bonding and the other with bonds. With no bonds, the econo-

mists estimated PECO would generate $337 million in cash that could be used for projects in the kindergarten-through12th grade system, state colleges and universities. That funding could be supplemented with other revenue. But if it is not, it will fall short of the $373 million PECO request from state education officials. Bonding would change all of that. The economists project Florida has the capacity to borrow more than $2.5 billion in the next budget year, although that is a very unlikely scenario. But in this year’s budget, lawmakers did agree to borrow $275 million, the first PECO bonds since 2011, resulting in a $625 million PECO program when supplemented with cash. Florida has a history of major PECO bonds, reaching a peak of $1.4 billion in bor-

rowing during the 2006-2007 budget year. That changed with the election of Gov. Rick Scott in 2010, as Scott aggressively looked to limit state borrowing, resulting in a major drop in state debt. That drop was aided by historically low interest rates that allowed the state to refinance much of its debt at a lower cost. But as lawmakers begin crafting a new state budget in the coming weeks, House Speaker Richard Corcoran, R-Land O’ Lakes, has voiced opposition to new PECO bonding, while Senate President Joe Negron, R-Stuart, said he is open to a “reasonable” amount of bonding. With Scott’s record of limited borrowing, a major PECO bonding plan is unlikely and a more modest plan remains in doubt.

The debate over bonding has to be put in the context of the $373 million PECO request, which education advocates say is a conservative number that does not reflect the true construction and maintenance needs for public schools, state colleges and universities. For instance, the official PECO request for state universities is $124 million, but does not include a $284 million list of “supplemental” construction and maintenance projects also approved by the state Board of Governors, which oversees the university system. The 12 universities last September identified more than $500 million in construction needs for the 2017-18 budget year, which was the list used by the Board of Governors to develop its more modest request. Similar needs have been

identified by the 28 state colleges, with the official PECO request reflecting $55 million in construction projects out of a three-year list of $167 million. The three-year list doesn’t include more than $600 million in other construction and maintenance needs identified by the colleges. The need for school construction in some of Florida’s smallest, rural counties will go unmet if lawmakers only fund the official PECO list. As part of a program where the state provides funding in small counties that lack major tax bases, the PECO request includes $16 million to finish public school projects in Hamilton and Taylor counties. PROSECUTORS VOW TO KEEP SEEKING DEATH SENTENCES By DARA KAM THE NEWS SERVICE OF FLORIDA

A day after a newly elected prosecutor said she would not seek the death penalty in capital cases, the remainder of Florida’s 20 state attorneys affirmed Friday they intend to pursue death sentences when appropriate. The statement by the Florida Prosecuting Attorneys Association came as a number of African-American leaders declared their support for 9th Judicial Circuit State Attorney Aramis Ayala, who sparked a statewide outcry Thursday over her decision not to seek the death penalty in the case of accused cop-killer Markeith Loyd --- or in any other case. Within hours of her announcement Thursday, an outraged Gov. Rick Scott reassigned the case of Loyd --accused of killing his pregnant ex-girlfriend and shooting an Orlando police officer execution-style --- to Brad King, an Ocala-area state attorney who is an outspoken proponent of the death penalty. On Friday, prosecutors other than Ayala voted to “affirm the responsibility of enforcing the laws of Florida,” which they maintain is “paramount to our oath of office.” “Throughout 19 of the 20 circuits of Florida, the death penalty will continue to be sought in those cases which qualify for its implementation,” the association said in

a statement provided to The News Service of Florida after the vote. “The victims’ families of Florida deserve our dedication to implement all the laws of Florida. That is why the people of Florida have elected us.” Ayala’s office participated in the conference call but did not vote, a source with the prosecutors said. The vote by the association came after Orlando-area black church leaders and deathpenalty opponents, including the mother of a woman allegedly slain by Loyd, offered a show of support Friday for Ayala, who ousted incumbent Jeff Ashton in a Democratic primary in August. Speaking to reporters Thursday about her decision not to pursue the death penalty, Ayala --- the first black elected state attorney in Florida --cited research showing death sentences are not a deterrent to crime, are prohibitively costly and do a disservice to victims’ families, who may wait decades without seeing those convicted of killing their loved ones finally executed. Pursuing the death penalty “is not in the best interest of this community or the best interest of justice,” Ayala, whose circuit is made up of Orange and Osceola counties, said Thursday. Her decision infuriated a number of Republican lawmakers and elected officials, including Scott and Attorney General Pam Bondi, but, cou-

pled with Scott’s reassignment of the Loyd case, may elevate Florida’s already-embattled death penalty as a civil rights issue in the coming months. Of the 396 inmates on Death Row, 154 --- or nearly 40 percent --- are black, according to the Death Penalty Information Center. The ratio of African-Americans awaiting execution is more than double the percentage of blacks in the state’s overall population. As further evidence of the divide, nearly two-thirds of blacks nationally oppose the death penalty, compared with 49 percent support among whites, according to a Pew Research Center survey conducted last fall. A coalition of community leaders, most of them African-Americans, held a news conference Friday morning on the steps of the Orange County Courthouse to declare their support for Ayala, who made her announcement at the same location the previous day. “Studies consistently find right here in Florida troubling racial disparities in how the death sentence is applied,” said James T. Morris, pastor of the Carter Tabernacle C.M.E. Church in Orlando. “This sends a troubling message, a message that some lives matter more than others. … You cannot be committed to racial justice and still embrace the death penalty.” Stephanie Dixon, whose pregnant daughter Sade was allegedly gunned down by ex-

boyfriend Loyd, endorsed Ayala’s decision not to pursue the death penalty in the case but instead to seek a life sentence. “You have to understand that we want closure. And with closure doesn’t mean to be dragged in and out of court with appeals and everything else,” Dixon said. “He will never see the light of day again. … If he doesn’t die of natural causes, I’m quite sure he will be tortured for his hideous crimes.” For some, Scott’s swift removal of Ayala as Loyd’s prosecutor came in stark contrast to the drawn-out case of George Zimmerman, a neighborhood watch volunteer accused in 2012 of killing unarmed teenager Trayvon Martin, who was black. Scott waited months before appointing a special prosecutor in that Seminole County case. “I think the facts of this case --- that the prosecutor is black, that the victim is black, the victim’s family wanted the death penalty to be waived and the governor appointed a new prosecutor --- clearly (Scott) is overstepping what he should be doing morally, and I can only think he is bowing to the law-enforcement community,” said Florida International University law professor Stephen Harper, head of the school’s Death Penalty Clinic. State Rep. Shevrin Jones, a black Democrat from West Park, blasted Scott for “picking and choosing” when to

use his executive authority to override constitutionally elected officials like Ayala. “It’s wrong on so many levels,” Jones said in a telephone interview Friday. “I call him out on that now because it’s not right. It’s not fair and we in the black community we see that as a problem. Shame on the governor for using his powers in this situation, but not using his powers in ways that he should have in others.” Some fear that Scott’s removal of Ayala in a highprofile case could have far-reaching political implications, resulting in more prosecutors --- who have discretion in whether to pursue the death penalty --- opting to seek death sentences death due to fear of retaliation. “Now we have an example of a prosecutor who is supposed to have broad discretion over who they charge, and if they don’t exercise discretion in the way that higher government officials approve of, they’re removed from their responsibility. And that puts political responsibility on each of the state attorneys,” 10th Judicial Circuit Public Defender Rex Dimmig said in a telephone interview Friday. “Unquestionably that is a factor that will be in their mind. The question will be whether or not they’re able to exercise their discretion without giving weight to that factor, and that will be a very difficult thing for them to do.”

He said where the system “stands out” and has won national awards is with its ability to graduate students with twoyear degrees who then finish four-year degrees at state universities, the so-called “2plus-2 articulation” system. But Galvano said that changed 15 years ago when state colleges received approval to start four-year, or baccalaureate, degree programs. In the past, the colleges were known as community colleges. “What we have seen in recent years, since the authorization of the baccalaureate degrees, is a proliferation of these type of degrees,” Galvano said. Senate analysts said 27 of the 28 state colleges offer a total of 179 four-year degrees. And Galvano said some of those degrees don’t seem to be in line with “workforce demands in communities and regions,” which was

the primary purpose of allowing the schools to have four-year degree programs. To address that issue, the bill would impose a cap on the baccalaureate degree programs. That has been one of the most controversial issues for state college leaders, who argue the four-year degree programs remain a minor part of their mission and that they are serving more “non-traditional” students, including many part-time students, older students and minority students. As part of ongoing negotiations about the bill, the Senate panel eased off on the cap somewhat, raising the trigger to limit four-year enrollments when baccalaureate students represent 10 percent of the overall school enrollment, up from an original 8 percent. The amendment came from Sen. Gary Farmer, a Fort Lauderdale Democrat who said his analysis

showed state colleges were serving critical local workforce needs while not harming university enrollment. “Our universities are thriving and, frankly, they are packed,” Farmer said. In another adjustment, the Senate subcommittee backed off a “one-year” notice provision that colleges would have to file if they wanted to propose a new baccalaureate program. The amended bill creates a six-month “notice of interest,” followed by a “notice of intent” that would have to be filed 100 days before submitting the proposal to the Division of Florida Colleges. The bill also would rename the college system as the Florida Community College system and create a 13-member State Board of Community Colleges to oversee the 28 schools, similar to the Board of Governors, which oversees the 12 state universities. The

state college system previously had a separate oversight board, but it was abolished in 2003 and the colleges were moved under the state Board of Education, which also oversees the K-12 system. Ann McGee, president of Seminole State College, said the 28 college presidents appreciated the changes the Senate has made in the bill, while suggesting they want to see more modifications. “The baccalaureates are very important to us,” McGee said. “We pledged to work with you as we go forward on this bill because we want to be all about access for our students and success for our students because we know how important that is.” The bill next heads to the Senate Appropriations Committee. A similar bill (HB 929) has not been heard in the House.

A bill that would create a new board to oversee the state college system, place limits on students enrolled in baccalaureate-degree programs and revamp the approval process for four-year degrees at state colleges advanced Wednesday in the Senate. The Senate Higher Education Appropriations Subcommittee unanimously approved the bill (SB 374), sponsored by Sen. Dorothy Hukill, RPort Orange, after changing some provisions that have drawn opposition from the state college advocates. Subcommittee Chairman Bill Galvano, a Bradenton Republican who is handling the legislation as Hukill recovers from surgery, said Florida has “a very good college system.”

BILL COULD PUT BRAKES ON RAIL PLANS By JIM TURNER THE NEWS SERVICE OF FLORIDA

A legislative proposal that would place regulations on passenger rail service could derail plans to link Orlando and Miami, a representative for All Aboard Florida’s Brightline service warned as a Senate committee approved the measure Tuesday. Also, the proposal could result in “many years of legal and administrative” challenges, Rusty Roberts, vice president of government affairs for All Aboard Florida, told members of the Transportation Committee. However, Sen. Debbie Mayfield, a Vero Beach Re-

publican sponsoring the legislation (SB 386), contended the proposal doesn’t target any particular rail service. “This is about setting a framework so other highspeed rail companies that come in, we have that framework set into place,” said Mayfield of the measure, which would give the Florida Department of Transportation oversight where not preempted by federal law. The measure also would require private passenger rail to cover the costs of installing and maintaining safety technology at crossings unless such contracts are agreed to by local governments. During her presentation to the committee, May-

The committee vote came after Brightline announced plans Friday to begin operating a 30-minute route between West Palm Beach and Fort Lauderdale in late July. A wholly-owned subsidiary of Florida East Coast Industries, Brightline intends to expand the service to Miami in late August. Brightline is eventually planned to travel between Miami and Orlando. However, the service, which could be

two years away from expanding north through the Treasure Coast on a route to Orlando, faces lawsuits from Martin and Indian River counties. Roberts said Mayfield’s measure “unconstitutionally” targets his company and “unlawfully” interferes with private contracts. “What this bill does is create a climate for many years of legal and administrative challenges, which has been the stated motive of rail opponents so far,” Roberts said. “We believe, if passed, this bill will jeopardize Florida’s opportunity to connect major metropolitan centers with an express intercity passenger system.” Roberts added that the

regulations threaten the company’s plans to expand to Orlando and could hinder future connections to Tampa and Jacksonville. “This is the true goal of those who support this legislation, to keep this private enterprise from bringing a much-needed transportation option to our growing state,” Roberts said. Roberts said after the meeting “the South Florida segment should be OK. It’s phase two that they’re targeting.” The company plans to run at speeds up to 79 mph between Miami and West Palm Beach. When the northern route is opened, Brightline trains are expected to travel up to 110 mph from Jupiter to Cocoa and then at 125 mph to Orlando.

ers and simultaneously to recover the costs of providing that service including a reasonable and adequate rate of return on invested capital.” “If Gulf is rendered unable to meet its obligations to the customers and shareholders due to inadequate rates, both stakeholder groups will suffer,” the document said. “The customers will suffer from less reliable service and eventually higher costs of electricity than would otherwise be the case, while the shareholders will suffer from an inadequate and confiscatory return on investment and will seek other places to invest their money.” But the proposed increase has drawn objections from the state Office of Public Counsel, which represents consumers in utility cases, and other parties ranging from Walmart to the Sierra Club. The Office of Public Counsel and other opponents have argued,

in part, that Gulf’s base rates should decrease by about $2 million --- not increase. “The ultimate issue to be addressed by the (Public Service Commission) in this proceeding is whether Gulf Power Company needs any additional revenues in order to provide safe, adequate, reliable service, to recover its legitimate costs of providing such service, and to have an opportunity to earn a fair and reasonable return on its legitimate investment in assets used and useful in serving Gulf’s retail customers,” Walmart said in a filing last month. “The evidence offered by intervenor parties … shows that, in total, the answer to this question is that Gulf can indeed fulfill its duty to provide safe, adequate, reliable service with no rate increase at all and probably with a modest overall rate reduction of approximately $2 million per year.”

Public Service Commission hearings in base-rate cases are highly technical and include detailed information about utility finances and operations. Gulf’s current base rates stem from a settlement of a 2013 rate case. A key issue in many rate cases --- and likely in the upcoming Gulf hearing --- is setting a “return on equity,” a measure of profitability. In its proposal, Gulf is seeking an 11 percent return on equity, while the Office of Public Counsel argues the rate should be 8.875 percent. Another issue in the case involves whether costs related to a Georgia power plant, known as Plant Scherer, should be included in the base rates. Gulf and other utilities have owned stakes in the plant. In the past, Gulf sold electricity generated at the plant on the wholesale market but now uses power from the

plant for its retail customers. “Gulf is requesting that the (Public Service) Commission now include in retail rates the portion of (the plant) that is no longer committed under long-term off-system wholesale contracts,” Gulf said in the document filed last month. “This action is necessary to honor the regulatory compact that contemplates that Gulf is entitled to the opportunity to earn a fair return on prudent investments that are used and useful in the public service.” But the other parties in the case are fighting the proposal to include the costs in base rates. The Office of Public Counsel, for instance, argued that “Gulf is asking the commission to let it put a 30-yearold coal plant in retail rate base after its shareholders had wrung out all of the profit from it in the wholesale market place since it was acquired but never needed for retail rates.”

Wine & Spirits --- needs to make it through one more committee in the House and awaits a floor vote in the Senate (SB 106). House sponsor Bryan Avila, R-Hialeah, rejected claims by opponents that his legislation, three years in the making, will increase access to liquor by minors and harm existing businesses. “While shopping at Publix is a pleasure, certainly their argument is not,” Avila said. “The only reason the antiquated law is being opposed is to maintain the status quo.” Before the vote, Avila proposed an amendment that would sort alcohol licenses into two categories, one for businesses that seek to remain stand-alone for liquor, the other imposing fees --- based on

county population --- for those that want to sell liquor in the same stores as other goods. Avila said he’s also considering additional changes for when the proposal goes to the Commerce Committee. That could include requiring cashiers to be 18 or older when liquor is purchased and increasing penalties on businesses that are found selling to minors. He also indicated he is open to proposals in the Senate bill that would require small bottles, 6.8 ounces or less, to be displayed only behind the counter and phasing in the law over a four-year period. Still, the House bill, which appeared to stall a week ago, remains controversial for many. “The losers are clearly go-

ing to be the small businesses,” said Rep. Kathleen Peters, a Treasure Island Republican who voted against the bill. Thomas Culligan, representing Publix, said in opposing the measure that the supermarket chain may be able to support a delayed implementation. Publix has opened stand-alone liquor stores in many shopping centers that also include grocery stores. “We’ve invested so much in the stores that we have built out in the state,” Culligan said. “We also have a number of leases that we’d like to see expire if this does happen.” Pat McClellan, owner of the Flora-Bama lounge and package store in the Panhandle, said the change would result in a greater ability for mi-

Proponents contend abolishing the “outdated” law is necessary to provide more convenience to shoppers, reduce regulations and save money for businesses. Joseph Salzverg, a lobbyist for Target, said the change would allow the Minnesotabased company to meet customers’ needs and expectations. “The way Target structures their business model is a racetrack type of shopping,” Salzverg said. “That’s why we don’t currently operate bifurcated stores in the state of Florida.”

Latvala, who serves on the Commerce and Tourism Committee and is the powerful chairman of the Senate Appropriations Committee, declined after Monday’s meeting to discuss what might have been said in behind-the-scenes talks with any other senator. Even if Lee is unsuccessful in repealing the program, it appears highly unlikely that stadium projects will get state funding this year. House leaders have been vehemently opposed to dipping into the funding pool for projects that make it through a review by the Florida Department of Economic Opportunity.

The money, which comes from sales taxes, has been unsuccessfully sought in the past for improvements at EverBank Field in Jacksonville, Daytona International Speedway, Hard Rock Stadium in Miami-Dade County and construction of a soccer stadium in Orlando. Lee noted that the owners of each of those facilities completed the work without the state’s contribution. “This piece of (2014) legislation was nothing but found money for those organizations,” Lee said. For the current year, House leaders have already rejected the lone request for state money from Raymond James Stadium in Tampa. When Lee filed the legislation, House Speaker Richard Corcoran quickly announced his support for the repeal. “Florida has the tax environment, the weather, and the fans to support multiple sports franchises without raiding taxpayer pockets,” Corcoran said at the time. “Those who

own the game should not be able to take money from those who don’t attend the game.” Corcoran, who was among 27 House members voting against the 2014 law, oversaw House

Lee said he was informed in a “private conversation” prior to the meeting that his proposal wasn’t going to be moved. For example, instead of a sugary candy bar, consider a naturally sweet slice of watermelon for a cholesterol-free, fat-free way to satisfy cravings at only 80 calories per 2-cup serving. Watermelon contains fiber and water, and packs a wealth of health benefits, including strong levels of vitamins A, C and B6. Stay well hydrated. During the warmer spring and summer months, it’s easy to let water consumption slide because you’re focused on entertaining and outdoor activities. However, the warm air can be hard on your body, so it’s important to keep that water flowing year-around. Watermelon Protein Bites

Recipe courtesy of Anya Shinall of Anya’s Eats 1 cup pitted dates, soaked purified water 1 1/2 cups sprouted watermelon seeds, divided, plus additional for garnish 1 tablespoon coconut butter 1 cup fresh watermelon, chopped 1/8-1/4 cup roughly chopped beets (optional) Chop dates in half. Place dates in bowl of purified water and soak 1-2 hours. Remove dates from water bowl and place them into food processor. Pulse a few times then add 1 cup water­melon seeds, coconut butter and watermelon. Add chopped beets, if using. Blend until well combined, scraping sides of food processor as you go. Add remaining watermelon seeds and pulse, leaving some seeds chunky. For smoother texture, continue to blend. Remove mixture from food processor, place in small bowl and cover, allowing to cool in refrigerator 30 minutes. Remove mixture from fridge. With fingertips slightly wet, roll mixture into balls and place on a plate. Once done rolling, add watermelon seeds to top. Place watermelon bites in freezer 1-2 hours, or until frozen.

Island Fruit Salad Servings: 2

2 tablespoons water 2 tablespoons coconut sugar 1/2 lime (1 tablespoon), juiced 1 1/2 teaspoons rum extract 2 kiwis, peeled and diced 1 orange, sectioned and halved 2 cups seedless watermelon, chopped 2 teaspoons flaked, sweetened coconut

In small bowl, combine water and coconut sugar; microwave 20 seconds. Stir to completely dis­solve sugar. Let cool. Once cool, add lime juice and rum extract. In medium bowl, add kiwi, orange and watermelon. Pour rum juice over top and thoroughly toss. Let sit 30 minutes to allow flavors to blend. Divide fruit salad into two bowls and sprinkle with coconut.

Steel-Cut Oats with Watermelon

Servings: 2 1 cup 1 percent milk, plus additional (optional) 1 cup water 1/2 cup steel-cut oats 3/4 cup diced seedless watermelon 2 tablespoons dried tart cherries or cranberries 2 tablespoons chopped pecans 2 tablespoons maple syrup In medium saucepan over high heat, bring 1 cup milk and water to gentle boil. Pour in oats. Stir; return to gentle boil then reduce heat to simmer, stirring occasionally, 20-30 minutes. While oats are cooking, in small bowl, combine watermelon, dried fruit, nuts and maple syrup. Portion out oats and top with watermelon mixture. Add additional milk, if desired.
