CICLOVÍA:
wide open streets by Tanner Yea Among the hills and valleys of Colombia’s capital city of Bogotá, people bike, skateboard, rollerskate, and walk car-less streets every Sunday in an event called Ciclovía. Meaning ‘cycleway’ in Spanish, Ciclovía is an event that started in 1974 in Bogotá to allow people to enjoy activities, exercise and more in the wide city streets, without vehicles. On March 25, the Ciclovía tradition continues in downtown Pensacola with CiclovÍa Open Streets—an event designed to open the streets to foot traffic and get people moving. Pensacola joins a long list of worldwide cities who have held the event, including Los Angeles, Brussels, Miami and Delhi. From 9 am to 2 pm, Main Street will close to traffic from Gulf Power to Maritime Park, and Palafox Street will close from the pier to Garden Street. Instead of cars, these streets will contain open foot traffic, food trucks, activity tents, urban ‘parklet’ greenspaces, Zumba classes and more. This will all be in an effort to build a stronger, more active community within Pensacola. Sally Rosendahl is the Volunteer Founder of the event, and said she originally got the idea from attending a Ciclovía event in Panama City, Panama. “It has grown now into a worldwide event almost exclusively through grassroots movements,” said Rosendahl. “Someone goes to one and comes back, say-
ing ‘we need to have one in our city’—which is what actually happened to me.” The event is being sponsored by local and state organizations, including the Department of Health, LiveWell Northwest Florida, UWF, the UWF Historic Trust, Pensacola Parks and Recreation, Human Healthcare, Visit Pensacola and the West Florida Regional Planning Council. Local business such as CycleSports and Waterboyz are also supporting the event, offering repair services, workshops and information. “We’ll be set up at the Wahoo’s stadium parking lot with some ramps and rails,” said Sean Fell, founder of Waterboyz. “We’ll have info on our summer camps and the new skatepark.” Ciclovía Open Streets will be the largest street closure in the city’s history, and will serve as a way to open up the community to foot traffic and enable the city to be more active. Despite its beginnings as a mainly bikeoriented event, it is open to anyone—skaters, rollerblad-
ers and even just walkers. “The theme is community. We encourage people to wear t-shirts that tie them to the community,” said Rosendahl. “We want a sea of UWF shirts, Baptist Hospital shirts—anything that ties you to the community.” Rosendahl said that Pensacola is joining a long list of cities that are beginning to look at their streets with a different set of eyes. City streets take up massive amounts of physical space, and Ciclovia Open Streets is meant to change the idea that they are only meant to be driven on. “Streets are for people, too,” she said. The physical activity aspect of the event is also important. Rosendahl said that in Escambia and Santa Rosa counties, six out of 10 residents are overweight, while three out of 10 are obese. According to the Robert Wood Johnson Foundation —an organization which offers health grants and program—Escambia ranks 55 out of Florida’s 67 counties for quality of life and longevity. “I hope people who go to this event realize that exercise is something that’s been missing in their lives,” said Brian Stone, co-owner of CycleSports. One of the local bike shops sponsoring the event, CycleSports is helping provide minor repairs and maintenance for bikes during Open Streets. “I do feel there is a growing demand in Pensacola for promot-
ing a quality of life culture.” According to Rosendahl, they hope the success of this event fuels more Ciclovia Open Streets, with the goal eventually being to have similar events on a monthly basis. The economic, cultural and health impact is set to benefit not just the Ci-

The Trial Court Administrator’s office is accepting applications for civil traffic infraction hearing officers for the traffic courts in Escambia and Santa Rosa Counties. Civil traffic infraction hearing officer’s services include, but are not limited to the following: Serve at the pleasure of the Chief Judge or his/her Designee. Hear and consider all civil traffic infraction proceedings, including parking ticket hearings. Preside over calendars scheduled at traffic court locations throughout Escambia and Santa Rosa Counties. Have the power to accept pleas from defendants, hear and rule on motions, decide the guilt or innocence of any person, adult or juvenile, charged with any civil traffic infraction; adjudicate or withhold adjudication in the same manner as a County Court Judge under the statutes, rules, and procedures, presently existing or as subsequently amended. Provide services pursuant to the Florida Statutes, the Rules of Court, the Code of Judicial Conduct, Administrative Order PA/PI-‐CIR-‐00-‐13, and any other applicable administrative orders and relevant case law. All interested parties who are a member of the Florida bar in good standing will be required to complete a 40-‐hour educational training program, offered by the Trial Court Administrator’s office, after they have been selected to serve as an officer. Additionally, each officer will be required to complete an approved annual four-‐hour continuing education program in accordance with Traffic Court Rule 6.630. Civil traffic infraction hearing officers are compensated a fee in the amount of sixty five ($65) per hour for presiding over civil traffic infraction hearings. UWF receives donation to fund music students’ participation in competitions
The University of West Florida recently celebrated a donation of more than $27,500 to the Department of Music in support of the Larry Butler Memorial Music Award. The funds were raised from ticket sales and donations at the Nashville Songwriters’ Hall of Fame Show as part of the Frank Brown International Songwriters Festival, hosted by UWF in November 2016. The donation will help fund student participation in academic competitions and performance-related travel experiences, including the Lancaster International Piano Festival in Pennsylvania, the Interharmony International Music Festival in Germany and Italy, and the UWF Ireland Experience Program. The Larry Butler Memorial Music Award was created in 2015 by Peggy Butler in memory of her husband, a Grammy Award-winning songwriter and producer and Pensacola native. Nearly $54,000 has been raised by the Butler family and
friends to support the Department of Music. “Peggy Butler is truly passionate about our department and our students,” said Dr. Sheila Dunn, chair of the Department of Music. “She is committed to changing the lives of young musicians, and with this additional funding, we can broaden the possibilities of the kinds of activities that we can support and increase the number of students that we are able to award.” Larry Butler worked with renowned recording artists, such as Johnny Cash and Kenny Rogers, during his career in Nashville, and continued to show appreciation for his hometown through his generosity, including holding a benefit concert to raise money for the rebuilding effort following Hurricane Ivan. Peggy Butler said the award was created to meld three of Butler’s passions – music, Pensacola and UWF. “It is important that arts and music education funds
we work so hard to raise support for events like CyberThon that make scholarships possible. This really is at the heart of our AFCEA mission.” One of the key contributors making the scholarships possible is the Escambia County Sheriff’s Office, which donated $25,000 from the State Law Enforcement Trust Fund to CyberThon 2017. “By supporting these students we are developing a cyber-skilled workforce prepared for high demand careers in law enforcement, the military and in the private sector,” said Escambia County Sheriff David Morgan. Additional major sponsors of CyberThon 2017 included AMTIS, CSRA, GBSI, Gulf Power, Innovation Coast, Navy Federal Credit Union, SCSS, TechSoft, the UWF Center for Cybersecurity, and the U.S. Department of Homeland Security. More than 140 local students from dozens of schools across Northwest Florida participated in CyberThon 2017, which featured a “capture the flag” style competition for the first time in the event’s three-year history. The current Spotlight on Art Show Aspects of Photography runs through March 25. Featured Artists include James Emery – Photography and Chuck Lisner – Photography. Emery and LIsner are displaying a variety of subject images, both natural and enhanced. Their images not only reflect their views on how the images are most effectively presented to the general lege and high school divipublic, but also to other sions respectively. After artists and photographers. quadrupling in size to 81 students in 2016, CyberThon attendance and impact nearly doubled again in 2017 with 141 total elementary through college students attending. While the success of CyberThon was a catalyst for these scholarship awards, students who apply are not limited to cybersecurity studies. Any local high school senior bound for college in a science, technology, engineering or math track is eligible to apply. The AFCEA Pensacola Board of Directors will award up to 10 scholarships of $1,000 each. Pensacola AFCEA chapter offers funding to 2017 high school graduates Local high school students pursuing advanced education in a STEM field (Science, Technology, Engineering or Math) are now eligible for new funding in the form of AFCEA scholarships. The AFCEA Blue Angels Pensacola Chapter is making $10,000 in college funds available to local high school graduates as a result of generous sponsor support of CyberThon 2017. CyberThon, hosted in January at the National Naval Aviation Museum and the National Flight Academy, gave high school and college students hands-on experience in cyber defense and engagement procedures. Cybersecurity professionals from the military, technology companies, and academic institutions volunteered as team leaders to mentor students in the cybersecurity team challenge event created to grow Pensacola’s IT and cybersecurity workforce. “Support for CyberThon has grown each year, and we are thrilled to be able to invest in the futures of students as a result,” said chapter president Randy Ramos. “One of the primary goals of AFCEA Pensacola is to help build an employable workforce and advance STEM education in our community, which is why

Uwf Dance Marathon Exceeds Fundraising Goals For Children’s Hospital More than $43,000 was raised at the fifth annual University of West Florida Dance Marathon in support of Children’s Miracle Network Hospitals, a nonprofit organization that raises funds and awareness for approximately 170 pediatric hospitals in North America. All proceeds from the 10-hour event at the UWF Commons Conference Center will be donated to the Studer Family Children’s Hospital at Sacred Heart Hospital in Pensacola. The Miracle Network Dance Marathon is held at more than 300 locations across the country each year to ensure no child or family fights pediatric illness or injury alone. This was the second year Fraternity and Sorority Life staff members advised

the Dance Marathon executive board. Last year, the event raised $11,300, up from $3,500 in 2015. “I am elated with the rise in success of Dance Marathon,” said Dr. Kevin Bailey, vice president of student affairs. “The students have done a phenomenal job of making this event something they and UWF can be proud of, and this is only the beginning.” Aubrey Frazier, assistant director for leadership, service and fraternity/sorority life, said the connection students established with the “Miracle Kids” inspired the fundraising effort. The Dance Marathon executive board members visited Studer Children’s Hospital and interacted with the children before the event. “It’s amazing we
were able to raise so much money, but it’s also amazing to see how much they cared about the cause,” Frazier said. UWF sophomore Ashley Sepessy described interacting with “Miracle Kids” as a rewarding experience. Sepessy befriended a high school sophomore during her visits to the hospital. “She would tell me all about her life and her boy problems,” said Sepessy, who served as morale director on the Dance Marathon executive board. “We colored together, and it was just a really good way to spend time together.” “Miracle Kids” participated in the Dance Marathon and shared their stories with the crowd. The ages of the children ranged from infants to 18. One of the highlights
of the night for Sepessy was teaching the children how to line dance. Jake Tomlin, graduate assistant for Fraternity and Sorority Life, said 343 students danced at the event. Students danced in two shifts at the Commons Conference Center and stood on their feet for a total of 10 hours as a gesture for those who can’t. UWF fraternities and sororities, along with other student organizations, raised funds as teams. The Alpha Delta Pi sorority won the “Miracle Ball” competition by raising nearly $8,000. Cox Charities To Award Nearly $30,000 To Southeast Region Schools
Cox Communications has announced that its employees will award up to $30,000 to public and private schools in its Southeast Region through the Cox Charities Innovation in Education grants. The grant applications are now available to teachers (grades Pre-K-12) at https://coxcharitiessoutheast.com/ and will be accepted through March 31, 2017. Applicants will be notified of their funding status before the close of the 2016-2017 school year. Grant recipients will receive payments at the start of the 2017-2018 school year. The Cox Charities Innovation in Education Program provides grants of up to $5,000 each to

Southeast Region schools to fund classroom programs and curriculum that encourage and promote students’ ingenuity and imagination through the innovative use of technology. State college presidents on Friday expressed dismay that the 28-school system is being targeted for threequarters of the cuts in the Florida Senate’s initial plan to trim $131 million in higher-education spending. “It is of great concern that the first thing out of the chute is a 74 percent reduction impacting the Florida college system and it is directed at programs that support our most atrisk student populations,” said Ed Meadows, president of Pensacola State College and the chairman of the Council of Presidents, which represents all the state colleges. The suggested cuts include a $55 million reduction in remedial education, the suspension of $30 million in performance funding for the colleges and the suspension of $10 million in incentive funds aimed at producing more students with technical and industry certifications. College presidents were also concerned that their system’s cuts represented more than 74 percent of the $131 million total, while the state university reductions represented 10 percent and the private college cuts represented 5 percent. But Meadows noted the budget process is still in its early stages. “We hope to work with the Senate in the coming weeks to lessen the impact it could have on our ability to serve our students,” he told the other presidents Friday during their monthly meeting. The budget cuts were revealed Wednesday by the Senate Higher Education Appropriations Subcommittee. Sen. Bill Galvano, R-Bradenton, who heads the panel, said the proposal is the start of the Senate’s budget deliberations. “We just finished the first week and there is a
lot to discuss and that’s why I sent my initial proposed list to the committee,” Galvano said. The Senate higher-education panel, like other budget subcommittees, has been methodically reviewing annual expenditures and had asked program advocates to file reports justifying the funding. Some of the advocates did not respond to the Senate. “Many of the cuts are based on no response at all and others are based on very weak responses,” Galvano said. Not all of the proposed cuts will be included in the Senate’s final highereducation spending plan. But Galvano said program advocates “are going to have to make a new case for them or they (the cuts) will stand.” The largest cut isn’t a matter of program justification but instead is centered on a complex debate over the role of remedial, or developmental, education in the state college system. Four years ago, the Legislature enacted a law that sought to limit the number of remedial courses being offered by the colleges, with the intent of moving more students into college-credit classes and eventually on to a degree. The law has had an impact on the system, with the latest estimate showing a headcount of 14,000 students in state college remedial classes, down a third from 21,000 in the 2014-15 academic year. With the 2013 law taking full effect, Galvano said, the expectation is that the funding for remedial classes should be dropping, reflecting the proposed $55 million cut. But the college presidents said the proposed reduction represents about half of their remedial funding. Edwin Massey, president of Indian River State College, said while the 2013 law has resulted in lower headcounts for remedial students, “the number of
students coming to us that need developmental education has not declined.” He said the student whose math skills may be lacking is enrolled in an algebra class but also given extra support with tutors, counseling and technical tracking. “That really adds up to additional costs rather than less costs,” Massey said. He also said many of the students needing remedial help are older students who have been out of school for a while, noting 41 percent of the remedial students on his campus are 25 or older. The college presidents also raised questions about any cuts affecting workforce initiatives, including the suspension of a $10 million incentive program designed to increase the number of students earning technical and industry certifications. Meadows said the incentive money is used to pay for things like covering the cost of an industry certification test for a student who is in line for a local job. “It’s going to have a negative impact on the availability of skilled workers in our local communities,” he said. Jim Murdaugh, president of Tallahassee Community College, said he did not understand a $181,000 cut in a truck-driver training program launched at his school after local businesses said they were “desperately looking” for drivers. “What’s the rationale behind cutting a program that puts people to work?” he asked. The remedial education courses, the industry certifications and other initiatives on the chopping block provide “opportunities to students who are not necessarily above average,” Murdaugh said. “We are their hope and we are their opportunity,” Murdaugh said. “The impact (of the cuts) is to slam the door on opportunity. I hope that is not the intention.”

Pointing to his family and a “job that I love,” Tampa Mayor Bob Buckhorn announced Thursday he will not seek the Democratic nomination for governor next year. Buckhorn has long been discussed as a potential candidate to succeed Republican Gov. Rick Scott, who cannot run for a third term in 2018. But in a Facebook post early Thursday, Buckhorn cited a combination of factors for his decision to stay out of the race. “While I absolutely believe that the State of Florida needs a course correction and a new direction, the timing for me and my family would be a challenge,” the Facebook post said. “As the father of two daughters who are 15 and 11, the all consuming task of running for Governor would cause me to miss the milestones in their lives that I could never get back.
“Furthermore, I have a job that I love. A job unlike many jobs in politics requires that I show up and do what I was hired to do. As the CEO of 4400 great city employees, we are focused on furthering the amazing transformation of Tampa that has occurred over the last 6 years. It is a job that I trained for, aspired to and am eternally grateful to the citizens of Tampa who gave me this opportunity.” Buckhorn’s announcement came a little more than a week after Tallahassee Mayor Andrew Gillum formally launched his Democratic campaign for governor. That was followed a day later by Orlando businessman Chris King saying he also would run. Other Democrats considering the race include former Congresswoman Gwen Graham of Tallahassee, Orlando trial attorney John Morgan and Miami Beach Mayor Philip Levine. Agriculture Commis-

Locked in a battle with Gov. Rick Scott, House Speaker Richard Corcoran on Friday got what he believes are more than symbolic votes to kill the business-recruitment agency Enterprise Florida and revamp tourismmarketer Visit Florida. But Scott quickly returned fire by saying bipartisan House votes on two bills would harm Florida’s economy and slow job creation. Questions also remain about the issues in the Senate, where companion bills have not been filed and some leaders have expressed support for business-recruitment programs and tourism spending. Corcoran, however, downplayed those questions, as the 60-day annual legislative session finished its first week. “We’re dealing with the Legislature,” Corcoran told reporters. “To say on week one that a House priority, where we believe firmly we’re right on the policy, we’re right on the principle, doesn’t have life in the Senate, is not remotely in the ballpark of truth.” The House voted 87-28 on a proposal (HB 7005) that would abolish Enterprise Florida and a number of other economic development programs, such as the Office of Film & Entertainment and the Quick Action Closing Fund Program. The House also voted 80-35 to approve a separate measure (HB 9) that would overhaul the structure and contract-reporting requirements of Visit Florida. After the votes, Scott issued a release that agreed the agencies need to be more transparent, but he repeated his refrain that the House bills are “job killing legislation.” “Many politicians who voted for these bills say they are for jobs and tourism,” Scott said in the statement. “But, I want to be very clear --- a vote for these bills was a vote to kill tourism and jobs in Florida.” Scott and Corcoran,
R- Land O’ Lakes, have butted heads for months over the future of the agencies, which the governor credits for contributing to state job growth and record increases in tourism. In his proposed 20172018 budget, Scott called for sending $85 million to Enterprise Florida for business incentives and $76 million to Visit Florida. Last year, lawmakers approved $78 million for Visit Florida but rejected Scott’s request for $250 million for Enterprise Florida. Corcoran has hammered such business incentives as “corporate welfare” and “de facto socialism” and has attributed the state’s tourism numbers to improvements in the economy and disposable income. Rep. Paul Renner, a Palm Coast Republican who sponsored both bills, said many of the jobs promised in exchange for past incentives have never materialized. “We also have a budgetary obligation, and I think the statement has been made today, by a wide margin, by Republicans and Democrats, that this is not where we should be spending other people’s money,” Renner said after Friday’s floor session. “There are better, higher uses for that money, whether it’s public safety, whether it’s quality education, or infrastructure.” On the House floor, Renner said the Visit Florida bill is intended to “rein in” the agency, which has been criticized by lawmakers for deals such as a controversial $1 million contract with Miami hip-hop artist Armando Christian Perez, better known as Pitbull. “This bill is about one thing and one thing only, it’s about accountability, and whether Visit Florida is willing to submit to some level of accountability,” Renner said. “We’re not here … to talk about other state agencies and this government, they haven’t been on the front page of the newspapers the way Visit Florida has.” In arguing against eco-

nomic incentives tied to Enterprise Florida, Rep. Jose Oliva, R-Miami Lakes, said the deals go against free-market philosophy and favor large corporations that have learned to work the system. But not every House Republican was convinced. Rep. Jay Fant, a Jacksonville Republican who voted against both bills, said he understands the philosophy behind abolishing Enterprise Florida and supports making internal changes. But he said the positives of the economic programs outweigh the criticism. “I fear killing this program will hurt people,” Fant said. “I will not be a part of this.” The proposal to eliminate Enterprise Florida would transfer existing deals and some programs to to the state Department of Economic Opportunity. For Visit Florida, the proposed changes would require the agency to post all contracts online; freeze agency employees’ benefits at current levels and prohibit bonuses; remove public-records exemptions from marketing and research projects; and require approval from the governor for all out-of-state and international travel. The changes also would require the Senate to confirm the governor’s appointment of the agency’s president and allow the Joint Legislative Budget Commission, House speaker or Senate president to reject contracts worth more than $750,000. The Visit Florida proposal would leave the question of the agency’s funding to budget negotiations between the House and Senate. Ken Lawson, who was named president and CEO of Visit Florida in January, said the agency has already moved to become more transparent, but the House proposal “unnecessarily grows government regulation.” “This bill jeopardizes the record-breaking success of Florida’s tourism industry and the 1.4 million jobs the industry supports,” Lawson said in a prepared statement.

A legislative fix to a state election law struck down in federal court was unanimously approved Thursday by the House Government Accountability Committee and now moves to the full House. Under the bill (HB 105), a voter whose signature on a mail-in ballot doesn’t match the one on file with elections authorities could fill out an affidavit to fix the error. A state law passed in 2004 allows voters to remedy a rejected mail-in ballot if they omit their signature, but not if their signatures are deemed not to match. In October, a federal judge ruled in favor of Democratic plaintiffs who challenged the law ahead of last year’s elections. In a blistering decision, U.S. District Judge Mark Walker called the law “indefensible” and apt to disenfranchise voters. The court issued an injunction on behalf of the Florida Democratic Party
and Democratic National Committee, ordering Secretary of State Ken Detzner to notify the state’s 67 county elections supervisors to treat mismatchedsignature voters the same as no-signature voters during the 2016 vote. The measure approved by the House committee Thursday --- sponsored by House Minority Leader Janet Cruz, D-Tampa --brings Florida law in line with Walker’s decision. It requires elections officials to make a good-faith effort to contact voters who cast rejected ballots before 5 p.m. on the day before the election, so the voters can submit an affidavit amending their ballot. The measure leaves it up to the discretion of elections officials as to how to contact affected voters. It also says officials must allow a Florida driver’s license or state identification card to be used to verify a mail-in ballot. Rep. Neil Combee, RAuburndale, said many voters --- especially elderly voters with arthritis, hand tremors, or other
physical maladies --- often struggle to reproduce their original on-file signatures, sometimes submitted decades before. “We struggled trying to determine what to do with ballots that obviously just did not match,” said Combee, who twice sat on county canvassing boards responsible for verifying and counting ballots. “This gives people a chance to fix the problem if there is one.” Backers of the nowinvalidated 2004 law that eliminated a ballot cure for mismatched signatures had argued the change was necessary to curtail voter fraud. Walker, appointed to the U.S. District Court for the Northern District of Florida by President Barack Obama in 2012, dismissed that idea in his ruling last year. “In fact, letting mismatched-signature voters cure their vote by proving their identity further prevents voter fraud --- it allows supervisors of elections to confirm the identity of that voter before their vote is counted,” Walker wrote.

For the second time in a year, a former Democratic state lawmaker is facing a federal indictment for allegedly using campaign funds to cover personal expenses. United States Attorney A. Lee Bentley III announced Thursday that former Rep. Dwayne Taylor of Daytona Beach has been charged with nine counts of wire fraud in connection with a scheme to funnel money from his campaign to personal funds. Taylor could face a maximum of 20 years in prison on each of the nine counts, though as a practical matter, first-time offenders virtually never receive the maximum sentence. Prosecutors are also seeking $62,834, “representing the amount of proceeds obtained as a result of the offense,” though the amounts withdrawn from the campaign in the nine counts listed in the indictment totaled $2,440. According to the indictment, Taylor “would withdraw cash from the Dwayne L. Taylor Campaign Accounts at automated teller machines (ATMs) ... and, within min-
utes or hours, deposit the same or a similar amount of cash into one of TAYLOR’s personal accounts.” Taylor used at least one check for similar reasons, the indictment said. Taylor is accused of using the funds for personal expenses and then filing fake or inflated campaign expense reports to cover his alleged misuse of the money. The indictment does not specify what the funds were spent on. Bentley is the U.S. attorney in the Middle District of Florida. Under Florida law, campaign money may not be used to defray normal living expenses, other than for transportation, meals, and lodging that is campaign-related. Taylor served as his campaign’s treasurer in 2012 and 2014, when he was seeking re-election to the House, according to the indictment, which deals with funds from those two campaigns. The case was investigated by the Federal Bureau of Investigation. Taylor did not immediately respond to attempts to reach him for comment. A Daytona Beach city commissioner before going to the Legislature, Taylor was first elected to the House in 2008. Tay-
lor briefly considered opposing then-Rep. Mark Pafford for leader of the House Democrats after the party lost six seats in the 2014 elections, but pulled out of the race while saying he couldn’t work with the leadership of the state party. Taylor ran unsuccessfully for Congress in 2016, losing the Democratic primary in District 6. The charges are similar to those against former Rep. Reggie Fullwood, who pleaded guilty last year to one count of wire fraud and one count of failure to file an income tax return. Another 12 counts of the indictment, which was unsealed in April, will be dismissed as part of an agreement with prosecutors. According to that indictment, from at least September 2010 to about December 2011, Fullwood electronically transferred money from the “Reggie Fullwood Campaign” bank account to an account of a Fullwood-owned entity called Rhino Harbor, LLC and used the funds for personal expenses. To conceal the embezzlement of campaign funds, the indictment alleged that Fullwood submitted fraudulent campaign expenditure reports to the state.
Florida juries would have to unanimously decide that defendants convicted of capital crimes should be put to death for the sentence to be imposed, under a measure that lawmakers rushed to pass during the first week of the annual legislative session. The proposal, given final approval Friday by the House, is the Legislature’s second attempt to comply with a series of court rulings that for more than a year have blocked executions and prevented deathpenalty cases from moving forward. It also would remove Florida from an “outlier” status as one of just two states that do not require unanimity for death sentences to be imposed. The 112-3 vote in the House puts the proposal in the hands of Gov. Rick Scott, whose record of signing more death warrants than any other Florida governor was suspended after a U.S. Supreme Court ruling early last year in a case known as Hurst v. Florida. The 8-1 Hurst decision, premised on a 2002 ruling in a case known as Ring v. Arizona, found that Florida’s system of allowing judges, instead of juries, to find the facts necessary to impose the death penalty was an unconstitutional violation of the Sixth Amendment right to trial by jury. The Legislature hurriedly passed a law during the 2016 session to address the Hurst ruling and required, among other things, that at least 10 of 12 jurors recommend death for the sentence to be imposed. But a majority of the Florida Supreme Court struck down the new law in October, deciding that it, too, was unconstitutional because it did not require unanimous jury recommendations for death sentences. The issue deals only with the sentencing phase of capital cases, not the guilt phase, which requires unanimous jury verdicts. The rulings in Hurst and a handful of other cases have caused consterna-
tion for defense lawyers, prosecutors and judges, who have been split on whether or not they could move forward with capital trials before the Legislature fixed the statute. More than half of the state’s nearly 400 Death Row inmates may be eligible for new sentencing hearings as a result of a pair of Florida Supreme Court orders related to the original Hurst decision. Adding to the confusion, the state court recently reversed a previous decision and ruled that capital trials could proceed, even without a legislative fix. But that opinion did not slow down lawmakers --- who last year ignored warnings from public defenders and others that 10-2 recommendations for death would not survive the scrutiny of the court --- from rushing the statutory change through the process. “Your positive vote today allows cases to move forward and for victims and their families to continue to have access to justice,” House Judiciary Chairman Chris Sprowls, a Palm Harbor Republican and former prosecutor, said prior to Friday’s vote. The Senate unanimously approved the measure (SB 280) a day earlier. If Scott signs the measure as expected, he could start signing death warrants again; the Florida Supreme Court indefinitely put on hold two executions ordered by Scott early last year. “This will fix the immediate problems raised by Hurst, and it will put Florida in line with most of the other states that have the death penalty,” said Florida International University law professor Stephen Harper, who runs the school’s Death Penalty Clinic. Harper predicted that Scott would resume signing death warrants once --- and if --- he signs the law, “but there’s still litigation to go in those cases.” But challenges to the state’s death penalty law, related to the Hurst decisions, as well as a new

lethal-injection process and litigation spurred by new death warrants make it unlikely that executions will resume immediately. Some death-penalty experts maintain that, even with the unanimous jury recommendations, Florida’s law remains problematic. Requiring unanimous jury recommendations is “only one step in a long journey,” said 10th Judicial Circuit Assistant Public Defender Pete Mills. “Florida’s death penalty still has problems of constitutional magnitude, including but not limited to the failure to limit the scope of its application, racial disparities, geographic disparities, and execution of the mentally ill,” Mills, chairman of the Florida Public Defenders Association Death Penalty Steering Committee, told The News Service of Florida on Friday. Florida also leads the country in the number of Death Row inmates who have been exonerated, Mills said. Critics also argue that state law is not narrow enough to capture “the worst of the worst” for whom the death penalty should be reserved. “Sooner or later this is another issue that’s going to come up before the Supreme Court and it’s going to throw the Florida system back into chaos,” Harper said. But Sprowls maintained that the courts’ only problem with the Florida statute centered on the issue of jury unanimity, something the U.S. Supreme Court did not address in its Hurst ruling last year. The Florida court “went a little outside the scope of that opinion from the U.S. Supreme Court” by ruling on unanimity, Sprowls told his colleagues during floor debate Friday. “The reason I think that that’s important for us all is, clearly they were willing to look at all of the aspects of the death penalty statute, and the only aspect that they raised a constitutional concern about was this one,” he said.

Berries and Cream Fluted Pound Cake
Recipe courtesy of Baker’s Advantage/Alissa Wallers 4 sticks butter, room temperature 3 cups sugar 6 eggs 4 teaspoons vanilla extract 3 1/2 cups flour 2 teaspoons baking powder 1 teaspoon salt 1/2 cup milk, at room temperature nonstick cooking spray Heat oven to 350 F. With stand or handheld mixer, cream butter and sugar until light and fluffy. Add eggs one at a time, scraping between each egg. Add vanilla extract. Sift flour, baking powder and salt together. Add flour mixture to mixing bowl and slowly add milk while mixing. Mix until just combined. Spray Fillables Fluted Cake Pan with nonstick cooking spray. Carefully spread Vanilla Frosting over top of berries and cake. Place top layer of cake on top of frosting. Drizzle warmed up Vanilla Frosting over top of cake. Decorate top with berries.
Brownie Cake Cones
Recipe courtesy of Baker’s Advantage/Alissa Wallers 3 ounces unsweetened chocolate 2 sticks butter 1/2 cup cocoa powder 2 1/2 cups sugar 3 eggs 1 tablespoon vanilla extract 1 1/2 cups flour 1/2 teaspoon salt 2 teaspoons baking powder nonstick cooking spray Vanilla Frosting (recipe at right) or ice cream Heat oven to 350 F. In double boiler, melt chocolate and butter. When melted, place in large bowl and whisk in cocoa powder until smooth. Add sugar and mix. Combine eggs and vanilla; gently mix with fork or whisk to break up eggs. Add eggs and vanilla to batter. Sift together flour, salt and baking powder. Fold in flour until just combined. Spray Fillables 8 Cup Cake Cone Pan with nonstick cooking spray. Fill bottom pan with batter to line in middle of pan then place insert on top and snap together. Place on middle of rack in oven and bake 15-18 minutes. Allow to cool before removing from pan. Filling suggestions: n Graham crackers, chocolate chips and marshmallows n Whipped cream and berries n Ice cream or pudding Add fillings inside cone, top with Vanilla Frosting or ice cream, and serve.

Vanilla Frosting
Recipe courtesy of Baker’s Advantage/Alissa Wallers 3 sticks butter, unsalted and at room temperature 6 cups powdered sugar 2 teaspoons vanilla extract 1/2 teaspoon salt 1/4 cup heavy cream Using handheld or stand mixer, cream butter on high, about 3 minutes. Add powdered sugar 1/2 cup at a time, mixing on medium between each addition. Scrape bowl well. Add remaining ingredients; mix on low until incorporated. Turn mixer to high and beat frosting until light and fluffy, about 5 minutes. Use immediately or store in airtight container in refrigerator. Note: Frosting must be at room temperature prior to using.
