Smart Selections A peek inside Escambia County school lunches and how the ECSD Food Services department meets federal nutrition standards to promote healthy eating habits while staying within budget. By Dawn Gresko

What’s going on your child’s plate? While children are especially susceptible to the misconception that eating healthy requires giving up some (often unhealthy and sugar or fat-laden) favorite foods, it’s important to realize that these foods can be included in a healthy eating plan if consumed in moderation. However, since parents are not present to moderate what their children eat during school hours, this is where the local food services department steps in to enforce a balance between calorie and nutritional needs and the foods and beverages consumed by children. Northwest Florida’s Business Climate spoke with Jaleena Davis, director of the Food Services Department of the Escambia County School District (ECSD), for the scoop on meal budgets, federal and nutrition guidelines, and other factors that influence what local schools are offering your children for snacks and lunch meals. Healthy, well-balanced and nutritious eating promotes higher performance both in and out of the classroom, so ECSD Food Services has been working closely with the local Department of Health and school cafeterias across the county to ensure local youth are receiving smarter selections when it comes to school lunch for the right amount of nutrients to sustain a healthy lifestyle beyond the school campus. According to the National School Lunch Program (NSLP), a federallyassisted meal program operating in over 100,000 public and non-profit private schools, including over 56 sites in Escambia County, all school lunches must meet meal pattern and nutrition standards based on the latest Dietary Guidelines for Americans. Currently, the meal patterns outlined by national dietary guidelines are designed to increase the availability of fruits, vegetables, and whole grains in the school menu, and decrease the level of sodium and fats in all meal offerings. The meal patterns also set specific calorie limits to make sure children from kindergarten through fifth grade, sixth through eighth grade, and ninth through 12th grade receive age-appropriate meals. Although all school lunches across states and counties must meet federal meal requirements, decisions about what specific foods to serve and how they are prepared are made by local school food authorities, such as our own Department of Food Services. School districts and independent schools that choose to take part in the NSLP get cash subsidies and foods from the U.S. Department of Agriculture (USDA) for each meal

they serve. In return, they must meet federal requirements and offer free or reduced-price lunches to eligible children. In regards to budget, ECSD Food Services receives an annual amount of $20 million, which is allocated between 56 sites in the county according to the number of meals served. When purchasing food for school lunches from vendors, Food Services aims not to exceed spending more than $1.50 per lunch meal. On average, a total of 20,000 meals are served in Escambia County per day. The USDA provides financial support to schools in the form of cash reimbursement for each meal served. As of the 2014-2015 fiscal year, the current basic cash reimbursement rates, if school food authorities served less than 60 percent free and reduced price lunches during the second preceding school year, are as follows: $2.93 per free lunch, $2.53 per reduced lunch, $0.28 per paid lunch. On Feb. 1, 2013, the USDA proposed changes to provide healthier food options in schools called “Smart Snacks in School,” which became the newest addition to federal requirements that all schools under the NSLP must meet. The new standards were put in place to make sure healthy options were offered throughout schools, extending beyond the lunchroom to vending machines and snack bars. The proposal suggested more snack foods with whole grains, low fat dairy, fruits, vegetables and proteins as the main ingredient. Also, the proposal requires schools to offer snack foods lower in fat, sugar and sodium content. Even products from cafeteria stations for Chik-Fil-A, Dominos, and Subway must comply with the new USDA guidelines. As for lunch meal patterns on the local level, Escambia County bases servings for fruits, veggies, whole grains, protein and sodium, according to a student’s grade level. The amount is also based on the average calorie intake for a five day school week. All food items across grade levels should have nutrition labels, or manufacturer specification, which indicate zero grams of trans fat per serving. Also, servings for all grade levels should contain saturated fat less than 10 percent of total calories consumed. For elementary students in grades kindergarten through fifth grade, the daily number of calories can be anywhere between 550 to 650 per student meal, while sodium should be less than 640 mg. Each middle school lunch may not exceed 700 calories, and sodium intake should be less than 710 mg. Each high school lunch may

not exceed 850 calories, or contain sodium over 740 mg. Today’s school meals provide plenty of variety and alternatives for students to choose from, and many menu items have been added because of student responses to foodpreference surveys and taste-testing. A “good,” or well-balanced, lunch is considered a combination of foods providing approximately a third of the daily requirements for vitamins, minerals, protein, carbohydrates and fats. All students are encouraged to take charge of their diet by making smart selections for their lunch meal and choosing at least three out of the five offered components of every lunch meal with the idea that “three is good, four is better, and five is best” promoted to assure greater variety of nutrient intake. To further encourage healthy eating habits, the Florida Department of Agriculture (FDA) has held produce shows in Escambia County to allow select students from all grade levels to taste fresh produce and new recipes using those fresh food items. Moreover, Food Services participates in the Fresh Fruit and Vegetable Program that allows some schools to offer fresh fruits and vegetables as snacks during the week with an educational component teaching children the important difference between processed and fresh produce. “We also partner with the local Department of Health to provide the Let’s Go Program in select elementary schools,” said Davis. “The program encompasses healthy food choices and increasing physical activity in our youth.” All of these efforts are geared toward lowering childhood obesity rates in Escambia County. Data from the latest 2014-2015 school year revealed that over 15 percent (15.70 percent) of Escambia County students who were screened were clinically obese. However, the good news is that this is a decrease from the pre-

vious 2013-2014 school year, when over 17 percent (17.22 percent) of students screened fell under the category of obese. “Our Food Services Department follows federal meal guidelines to help students either maintain or obtain an appropriate weight,” explained Jaleena Davis. “The meals offer a variety and demonstrate appropriate portion sizes, as well as the importance of having items from all food groups.” ECSD Food Services works closely with food suppliers, such as US Foods Montgomery, Kelly Foods, Sysco, Butlers, Southeastern produce, Big Charlies’, and Flowers Bakery. Although Food Services does not work directly with farmers, produce vendors will alert the department when products coming in are local—meaning the products came anywhere from Mobile, Ala. and Jacksonville, Fla. to areas along the southern Alabama and Georgia borders. In the case of a product recall from any one of its vendors, Food Services receives a notification from either the vendor or USDA. Once the notification has been received, Food Services immediately checks both the warehouse and school site inventory for the recalled product, and, if the

product is in stock at any one of our area’s schools, it is pulled from inventory immediately and not served to students. In addition to complying with USDA requirements for the NSLP, ECSD Food Services works closely to follow standards that are up to par with those of the FDA, Florida Department of Agriculture and Consumer Services (FLDACS), School Nutrition Association (SNA), American Diabetes Association (ADA), and American Heart Association (AHA). This all done with the aim of enhancing the Food Services department’s vision of providing excellence in food and nutrition services, as well as promoting nutritious school meals and making nutrition education programs available for all children regardless of economic status, cultural background, or special needs. UWF Legal Studies students visit Florida Supreme Court

This spring, University of West Florida legal studies students had their day in court. The trip was a long time coming, according to Dr. Kimberly McCorkle, chair of the UWF Department of Legal Studies, Public Administration and Sport Management. Plans came together when oral arguments at the Florida Supreme Court coincided with UWF’s spring break. Moving forward, the trip will become an annual experience available to UWF legal studies students. Participating students were able to make

the trip at no cost as a result of donations from the legal studies advisory board. Expenses included travel, meals and an overnight hotel stay, followed by a full day in court. The trip was open to UWF legal studies majors and minors. Priority was given to students enrolled in Legal Advocacy, the capstone course for majors taken by graduating seniors. Thirty-four students attended, led by three faculty members including McCorkle, associate professor Dr. Susan Harrell and assistant professor Dr. Charlie Penrod. UWF adjunct profes-

sor Valencia Davis, who works as the chief law clerk for Chief Justice Jorge Labarga, helped to facilitate the trip. “The Florida Supreme Court is open to the public, but I don’t know of other undergraduate programs that have had a full-day experience like this,” said McCorkle, who is also an administrative fellow in the UWF Division of Academic Affairs. “It was so well-received by our students and such an exceptional learning experience.” Students spent the entire day in Tallahassee, beginning with an orientation about how the Florida Supreme Court works, the types of cases it hears and over which it has jurisdiction. The chief justice recognized UWF and welcomed the students at the beginning of the court session. Before lunch, they observed four oral arguments, including one for a death penalty case. “To say we got to watch a case that had an impact on life or death is not overstating it,” McCorkle said. “We also had the opportunity to observe three lawyer discipline cases, which was a valuable lesson in professionalism, as most of our students aspire to go to law school and

become lawyers.” After lunch, the students had the opportunity to meet three of the justices, who took off their black robes and spoke candidly about how they got there and what it was like. McCorkle likens it to going backstage with rock stars after a concert. Chief Justice Labarga, along with Justices Peggy Quince and James Perry, stayed with UWF students for an hour answering questions. Next, students conducted a hypothetical Fourth Amendment search and seizure case, with some actually sitting in the justice’s chair and others at the counselors’ tables. “Here at UWF, there is a renewed focus university-wide on experiential learning, which is so important because they can see that what they are learning matters, and how it matters,” McCorkle said. “It introduces them to what they will be doing in their profession and enriches them so much.” Legal studies major Haleigh Pascoe says the trip gave her a new perspective on the legal system and opened her eyes to new areas of law she may want to practice. “It’s my personal belief that experience is the best teacher. Sitting in a classroom and absorbing the information presented to you by your professors is helpful to an extent, but experiences are the things you remember for the rest of your life,” Pascoe said. “These kinds of opportunities allow students to solidify and apply the concepts they’ve learned in class, which serves to further understanding.” To learn more about the UWF legal studies program, visit uwf.edu/legalstudies.

Pensacola’s Skilled Nursing Center is Statewide Photo Contest Winner A photo taken at Rosewood Healthcare and Rehabilitation Center in Pensacola has been named among the best in the state from among 21 finalists in a statewide photo contest hosted by the Florida Health Care Association (FHCA). More than 10,000 votes were cast for entries in three different categories and the winning photo, “Not Just a Nurse, That’s Her Daughter” received the most support in the Portraits category in online voting across Florida. “We received so many phenomenal photos that show the true nature of Florida’s skilled nursing centers,” said Emmett Reed, FHCA’s executive director. “These photos demonstrate how long term care centers span the life experiences of those who need us, from young children at a youth-focused center to a 103-year old woman whose energy inspires us all.” The winning photo depicts a resident

of the facility lying in her bed while her RN, Jennifer, stares into her eyes lovingly. Jennifer is not just the woman’s nurse, but also her daughter, facing the difficult task of caring for a resident who is also her family member. It was taken by Daniel L. Dolgin, a licensed psychologist who provides care and support to residents at Rosewood Healthcare and Rehabilitation Center, located at 3107 North H Street in Pensacola. The photo was voted #1 in the Health Related Services category, while amassing the sixth most votes among all categories across the state. Photographer Dolgin wins a $50 gift card for submitting the top entry in the Health Related Services category. “While interacting with residents, I have always seen amazing images that I wished to capture,” a proud Dolgin said. “This photograph shows an image I’ve seen often at Rosewood. It is a difficult

situation for both mother and daughter, and I thank Jennifer for allowing me to photograph what she so lovingly does every day.” The photo contest was open to amateur photographers who live, work, or volunteer in an FHCA member care center or who work for an FHCA associate member. Submissions were to depict some aspect of daily life in a care center in the categories Health-Related Services, Activities & Events, and Portraits. Over a period of more than three weeks, contest photos were displayed through Facebook, attracting votes in the form of “likes.” Winners in other categories were: Palm Garden of Sun City Center (Sun City Center), which won in the Portraits category; and Plantation Nursing and Rehab/Kidz Korner (Plantation), which led the voting in the Activities & Events category and received the most votes overall statewide.

UWF Professor Appointed to Governor’s Council for Early Childhood Intervention UWF assistant professor Dr. Sara Evans has been appointed by Gov. Rick Scott to the Florida Interagency Coordinating Council for Infants and Toddlers, a statewide agency that assists and advises the Early Steps program. Early Steps serves families of infants and toddlers who have developmental delays by providing individualized family support plans. Early intervention helps caregivers develop the skills to help their children learn and grow. Evans, an assistant professor in the UWF Department of Criminology and Criminal Justice, has studied childhood behavior since she began graduate school in 2005.

“This knowledge informs my ability to serve on this council,” Evans said. “I am also the parent of a child with Down syndrome who has been receiving services through the Pensacola Early Steps office for almost three years. I can provide a unique perspective as someone who has very recently worked with a local office in Florida.” Evans will assist FICCIT by informing policy makers, legislators and service providers to improve the implementation and development of these services. Her scholarly research in the area of child development will help to contextualize the broader influences that children using early intervention services are subject to,

above and beyond any special needs they may have. “Personally, this appointment is very meaningful because of my experience with our local early intervention office. We were very fortunate to have capable, kind and considerate people to work with in Pensacola, and I want to help assist the council in ensuring that all families across the state also have a positive experience,” Evans said. Evans’ appointment is just one example of the work that faculty in criminology and criminal justice do to engage with the community and state at-large, she notes. Many other faculty members also serve in public service roles that help make this

Cordova Lanes is Hosting a Fundraiser to Help Raise Funds to Fight Child Abuse Gulf Coast Kid’s House served over 3,100 child abuse victims in 2015. After hearing this at a church gathering Steve Reynolds, owner of Cordova Lanes, wanted to do something to help those children and to prevent child abuse. “Stacey Kostevicki about broke my heart when she shared how that many chil-

dren from our neighborhoods were treated at their facility last year and I knew I needed to get involved,” said Reynolds. Kostevicki, Executive Director for Gulf Coast Kid’s House, spoke at Cokesbury United Methodist Church in the spring. So, Cordova Lanes is putting on a bowling fundraiser to help make

a difference for those kids on June 25 at 2 pm. Teams of four can rent a lane for $40 or an individual player can sign up for just $10 and 100 percent of the proceeds will go to Gulf Coast Kid’s House. STATE, SEMINOLES PRESS ARGUMENTS IN GAMBLING DISPUTE By DARA KAM AND JIM SAUNDERS THE NEWS SERVICE OF FLORIDA Accusing the state of essentially reneging on a 2010 deal, the Seminole Tribe of Florida is asking a federal judge to declare that tribal casinos have permission to keep operating banked card games, including blackjack, for 15 more years. In a motion for summary judgment filed Friday, the Seminoles also asked U.S. District Judge Robert Hinkle to order the state back to the negotiating table in a last-ditch effort to try to resolve differences over the games. Gov. Rick Scott and the Florida Department of Business and Professional Regulation, meanwhile, filed a motion Friday asking Hinkle to rule against the tribe on an allegation that the state failed to negotiate in good faith. The dueling motions for summary judgment come in a dispute over the Seminoles’ “exclusive” right to operate banked card games, including blackjack, at five of the tribe’s seven casinos. That exclusivity was part of a broader 20-year deal, called a “compact,” signed in 2010. In exchange for the banked card games, the tribe promised to pay the state a minimum of $1 billion over five years, an amount which it has exceeded. But the five-year agreement regarding the cards expired on July 31. The terms of the compact gave the Seminoles a 90-day “grace period” after the agreement expired to continue operating the banked card games. But after mediation failed, the tribe filed a lawsuit against the state, alleging that Florida officials had failed to negotiate in “good faith” on a new deal. The Seminoles’ lawsuit is centered on two types of games—controversial “designated-player” card

games and blackjack played with electronic cards—authorized by state gambling regulators at pari-mutuel facilities. The tribe contends those games violate the exclusivity provision of the compact regarding banked card games. “Despite the promises it made in the compact, within a year of its approval, the state began permitting others to conduct various types of banked card games without explanation or justification,” the tribe’s attorneys, Barry Richard and Joseph Webster, wrote in Friday’s 31-page motion. Regulators in 2011 first approved the designatedplayer—also called “playerbanked”—games, in which the “bank” is another player, instead of the “house.” The designated players almost always are employees of third-party companies. Under Florida law, a “banking game” is defined as one “in which the house is a participant in the game, taking on players, paying winners, and collecting from losers or in which the cardroom establishes a bank against which participants play.” Pari-mutuel cardrooms are allowed to conduct games in which players compete only against each other. “DBPR has acknowledged that the designated player serves as ‘essentially the bank for the game,’ “ the lawyers wrote, quoting the deposition of Department of Business and Professional Regulation Secretary Ken Lawson. The games have since swept the state, and are involved in an unrelated, pending administrative complaint. Also in 2011, gambling regulators authorized electronic blackjack games, the Seminoles lawyers’ argued. The tribe put the state on notice in 2011 and again the following year that the games violate the Seminoles’ exclusivity regarding

banked games, the lawyers wrote. “The use of electronic cards does not change the nature of the game,” the Seminoles’ lawyers wrote. “The only material difference between the DigiDeal electronic blackjack game and traditional blackjack found in Las Vegas and other casinos is that the cards used are electronic.” The tribe also accused the state of failing to negotiate about the banked card games in “good faith,” as required by the federal Indian Gaming Regulatory Act, which governs tribal gambling, Richards and Webster wrote. “The state refused to participate in any negotiations regarding such games unless they were part of a renegotiation of the entire compact. It also demanded a substantial increase in the state’s revenue share as a condition of such an amended compact without specifying any new benefits for the tribe that would justify the increase sought,” they wrote. Amid the legal wrangling, Scott and tribal leader James Billie in December signed a proposed 20-year compact in which the tribe pledged to pay the state $3 billion over seven years in exchange for being able to add craps and roulette to its casino operations. Lawmakers failed to authorize the proposed deal, however, during the legislative session that ended in March. The burden of negotiating in “good faith” rests not just with the governor, but with the Legislature as well, the tribe’s lawyers argued. If the compact was not satisfactory to the Legislature, it “could have enacted an amended version and submitted it to the tribe” or reached out to the tribe to propose amendments to the plan signed by Scott, the tribe’s lawyers wrote.

“It did neither,” they wrote. The Seminoles are asking Hinkle to declare that the tribe is permitted to operate the banked card games for the remainder of the 20-year compact, which expires in 2030, and to force the state to negotiate. Under federal law, if no agreement is reached within 60 days, each side would submit a proposed compact to a mediator, who would choose one of the plans. In a dueling motion for partial summary judgment Friday, lawyers for Scott and the Department of Business and Professional Regulation focused on the continued existence of the broader compact as they sought to scuttle the tribe’s arguments about a lack of good-faith negotiations. The federal Indian Gaming Regulatory Act bars the tribe from claiming the state failed to negotiate new

terms when a compact remains in place, the state’s lawyers wrote. The state’s lawyers alleged in the motion that the “tribe’s current suit is an improper attempt to make an end-run around the bargained-for expiration of the tribe’s authorization to conduct banking or banked card games.” “When the 2010 compact was being negotiated, the CEO of the tribe’s gaming operations proposed the five-year limitation on the tribe’s authorization to conduct banked card games because the state Legislature was unwilling to approve a 20-year authorization,” the motion said. “The tribe persuaded the state to authorize banked card games by proposing to include in the 20-year compact a fiveyear limitation on the tribe’s authorization to conduct banked card games.” The state rejected the

Seminoles’ argument that the five-year card deal was intended to be renewed for the remainder of the compact if the games were successful. “While at the tribe’s suggestion the 2010 compact provided the state with the opportunity to extend the authorization to conduct banking or banked card games through an affirmative act of the Florida Legislature, it is undisputed that the Florida Legislature has not provided such authorization,” lawyers for the state wrote. “Neither the 2010 compact nor the IGRA (Indian Gaming Regulatory Act) provides the tribe with a right to sue the state under these circumstances to secure a different deal than the one it negotiated in 2010. Therefore, the state is entitled judgment as a matter of law on the tribe’s claim for violation of IGRA’s good-faith negotiation requirement.”
