In the last year, markets have sprung up across the entire city of Pensacola—from Uptown Pensacola Market, to 200 South Outdoor Market, Palafox Market, Pensacola Positivity Market and a myriad of other pop-up markets at breweries and restaurants. In the wake of the pandemic, these outdoor markets allow people to shop in the open air, support local artisans and businesses and add a little social routine back into their weekends. One newbie in the bustling market community is the Pensacola Arts Market, organized by local artist and vintage clothing connoisseur, Marri Salt. As the owner of Funky Yet Groovy, a traveling and budget-friendly vintage boutique, Salt wanted to create a market focused on uplifting and supporting local artists. She hosted her f irst market in November 2020 and has since outgrown her original location at New Market Antique Mall. Although the market will rotate through various venues in Pensacola, The Pensacola Arts Market is currently located at Cordova Square, 1101 N. 12th Avenue, and is open from 10 am to 3 pm every second and fourth Saturday of the month. “I really love showcasing local artisans and connecting with people,” Salt said. “I’m passionate about art because it provides so much for the community—dancing, music, joy, happiness. Artists provide most of our entertainment, and I think the pandemic showcased that. It makes me really happy to see busy markets all over Pensacola. I just wanted to create a nice, safe and affordable space to show everyone that we have some really cool people and
things happening in Pensacola.” As a single mom with two kids, Salt explained that the pandemic allowed her to slow down and focus on her own artwork and business. She has hosted art markets in the past and planned to launch the Pensacola Arts Market before the state-wide lockdowns postponed her plans. Since opening, the market regularly hosts around 15 artisans with a sprawling variety of goods: potted plants, microgreens, crocheted art, handmade bags, beauty products, baked goods, candles and diverse artistic mediums including digital art, painted canvases, drawings and sculptures. Most of the vendors are recruited by Salt herself through the network of artists she has built in Pensacola. Each month, the vendors rotate with new artists who are constantly brought in to keep the market offerings diverse and avoid multiple artists selling the same thing. Salt also spends a great deal of time marketing and showcasing each individual vendor online. “As an artist, I know how the world works, so I don’t want to charge a lot for setting up at the market,” Salt explained. “I spend a lot of time advertising and building this network for artists to connect with each other. I start out each month on Instagram with a flyer for the event, then each post after that is welcoming the artists you can expect to see at the upcoming market. I post a photo of them with some of the goods they sell and tag their

It’s a better experience to interact in person with someone interested in my artwork. Plus, we attract a variety of crowds with our different art styles. I keep the nerds in the tent with my art and she attracts a lot of women embracing body empowerment.” Hampton explained that her nude figure art can initially shock some people browsing at the markets, but it has allowed her to test the waters with creating more geometric-style art. “The markets can be inspiring and give me room to experiment with my art. Some people tell us, ‘I could never work with my partner!’ But I think it’s exciting, and I get to be hype for him when he makes a sale and vice versa. The markets are like a family and a community to us,” Hampton said. The Pensacola Arts Market is currently located at Cordova Square, 1101 N. 12th Avenue, and is held from 10 am to 3 pm on alternating Saturdays. CHARLIE PEPPLER SELECTED AS NEW CITY ATTORNEY The City of Pensacola has selected Charlie Peppler as the new City Attorney, responsible for overseeing the city’s Legal Department and acting as the legal advisor for the City of Pensacola and all of its elected and appointed officers. Peppler currently serves as the Deputy County Attorney for Escambia County, where he has worked since January 2002. He graduated from the University of Miami with a Bachelor of Arts degree in 1974 before attending the Cumberland School of Law of Samford University in Birmingham, Alabama, earning his juris doctorate degree in 1977. “I am looking forward to having Charlie join the City of Pensacola, bringing with him decades of experience and legal expertise,” Mayor Grover Robinson said. “His experience working in local government combined with his dedication to community service make him a perfect fit to lead our city’s legal team.” The City Attorney is appointed directly by the Mayor with the consent of City Council. Peppler’s appointment is expected to go before City Council for affirmation at the July 15 City Council meeting. His tentative start date with the City of Pensacola is Monday, Sept. 20. Peppler was selected to replace current City Attorney Susan Woolf, who has been appointed as the general counsel for the University of West Florida. Peppler is board certified in civil trial law by the Florida Bar Board of Legal Specialization and Education from 1997 to present. He was also board certified in criminal trial law by the Florida Bar Board of Legal Specialization and Education from 1991 to 2001. Peppler was admitted to The Florida Bar in 1977 and is admitted to the U.S. District Court, Northern District of Florida, the U.S. Eleventh Circuit Court of Appeals and the U.S. Supreme Court. In representing Escambia County, Peppler is engaged in litigation involv-
ing personal injury, employmentrelated disputes, civil rights, insurance law, land use and construction defects and many other government-related legal issues. While in private practice, he handled cases involving workers’ compensation, insurance coverage, environmental law, government law, employment-related practices, criminal law and appeals, both civil and criminal, among many other legal matters. Since being in practice, Peppler has earned several awards, including the Writing Award by Florida Association of County Attorneys (2008), Community Service Award by the Escambia-Santa Rosa Bar Association for community and civic participation (2006), President’s Award of the Escambia-Santa Rosa Bar Association for instituting “Law School for the Layman” (1990), and the Distinguished Service Award by the Dade County Bar Association for participation in the Haitian refugee pro bono project (1983, 1984). Peppler is also active in the Pensacola community, including previously serving on the Board of Trustees for the West Florida Public Library Foundation, Board of Directors of the Pensacola YMCA, President of the Board of Trustees of the Northwest Florida Legal Services, Inc. Peppler also served as President, PresidentElect, Vice President, Treasurer and Sergeant at Arms for the Rotary Club of Pensacola Suburban West and as President of Pensacola SubWest Rotary Foundation Board, the fundraising arm of the club. In 2010, he received a Paul Harris Fellow because of his service to Rotary. “Being selected as the City Attorney is truly an honor, and I’d like to thank Mayor Robinson for the opportunity,” Peppler said. “I’m excited to use the experience I’ve gained throughout my career to serve the City of Pensacola and work with the talented legal team here to best represent the city.”

CITY OF PENSACOLA, ST ENGINEERING BREAK GROUND ON NEW AIRCRAFT MAINTENANCE HANGAR AT PENSACOLA INTERNATIONAL AIRPORT The City of Pensacola and ST Engineering North America celebrated the groundbreaking for a new aircraft maintenance hangar at the Pensacola International Airport today, Thursday, July 1. Secretary of the Florida Department of Transportation Kevin Thibault, Florida Secretary of Commerce Jamal Sowell, and Pensacola Mayor Grover C. Robinson, IV off iciated at the groundbreaking ceremony organized by the City of Pensacola. The construction of the new hangar is the first phase in the development of a 655,000 square foot airframe Maintenance, Repair & Overhaul, or MRO, complex that was originally announced in October 2018. The project expands on an existing twobay widebody hangar operated by ST Engineering. When fully completed, the expansion will add three large state-of-the-art hangars and associated support shops, and around 1.5 million labor hours to ST Engineering’s annual capacity in Pensacola. “We are excited to see construction begin on Project Titan, and we look forward to the opportunities it will bring to the City of Pensacola and our entire region,” Mayor Robinson said. “This project will allow Pensacola to become a regional center for excellence for the MRO industry, bringing 1,700 high-paying jobs and expanding educational programming, which will continue to build a brighter future for Pensacola. This project will also indirectly create significant economic spinoffs in the Pensacola and the region’s economy in terms of demand for goods and services that will be generated as a result of this development.” “Project Titan is a generational gamechanger for our community,” Pensacola International Airport Director Matt Coughlin said. “We would not be here today without the support of our federal, state and local governments in addition to our various partnerships to include ST Aerospace. We have faced a lot of challenges as a community since the inception of this project, but we will persevere, as evidenced by today’s groundbreaking.” The total development cost for the airframe MRO complex is budgeted at $210 million, funding for which comes from ST Engineering, Triumph Gulf Coast, Inc., the City of Pensacola,
Escambia County, the State of Florida and other state and federal organizations. The complex is expected to bring about 1,300 jobs to Pensacola. When combined with the first hangar, the total number of jobs at the facility will reach about 1,700. To meet the future demand for talent expected at the facility, ST Engineering is exploring the creation of an Aviation Training Academy that would add an additional 150 graduates a year to the local aviation maintenance programs. “We are thrilled at the opportunity to strengthen our existing partnership with the City of Pensacola and play a major role in its post-pandemic recovery and growth,” shared Tom Vecchiolla, ST Engineering North America President and CEO. “We are driven by our commitment to help customers be better prepared, better protected and better connected for a more sustainable future. Through Project Titan, we pledge to do just that.” Jeffrey Lam, President of Commercial Aerospace, ST Engineering, said, “The plan to go ahead with the expansion is a reflection of our confidence in the sector’s long-term prospects and growth as the aviation industry in the U.S. and the rest of the world gradually recover from the pandemic. FEDERAL JUDGE BLOCKS SOCIAL MEDIA LAW DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE—Calling it “riddled with imprecision and ambiguity,” a federal judge Wednesday blocked a new state law targeting social-media behemoths such as Facebook and Twitter that can strip politicians and other users from their platforms. U.S. District Judge Robert Hinkle issued a preliminary injunction as he sided with online-industry groups NetChoice and the Computer & Communications Industry Association, which filed the lawsuit challenging the measure pushed by Gov. Ron DeSantis and approved by Republican lawmakers this spring. “The legislation now at issue was an effort to rein in social-media providers deemed too large and too liberal. Balancing the exchange of ideas among private speakers is not a legitimate government interest,” Hinkle wrote in Wednesday’s 31-page order. The controversial law seeks to prevent large social-media platforms from banning political candidates from their sites and to require companies to publish —and apply consistently—standards about issues such as banning users or blocking their content. The industry groups sought an injunction to block the law from going into effect on Thursday, arguing that the measure violates the First Amendment rights of private companies and would harm their ability to moderate content on their platforms. Trying to flip the First Amendment argument, lawyers for the state maintained that the social-media platforms are engaging in censorship and violating users’ speech rights. But Hinkle scolded the state for its position. “First, the state has asserted it is on the side of the First Amendment; the plaintiffs are not. It is perhaps a nice sound bite. But the assertion is wholly at odds with accepted constitutional principles,” the judge wrote. The “concentration of market power among large social-media providers does not change the governing First Amendment principles,” Hinkle wrote. “Whatever might be said of the largest providers’ monopolistic conduct, the internet provides a greater opportunity for individuals to publish their views—and for candidates to communicate directly with voters—than existed before the internet arrived,” he added. The plaintiffs “are likely to prevail on the merits of their claim that these statutes violate the First Amendment,” Hinkle wrote. “Like prior First Amendment restrictions, this is an instance of burning the house to roast a pig,” the judge said. Hinkle found that the state law also is flawed because it targets only large companies, applying to platforms that have annual gross revenues of more than $100 million or have at least 100 million monthly individual “participants” globally, such as Twitter, Facebook and YouTube. Under the law, companies that remove political candidates from platforms could face fines of $250,000 a day for statewide candidates and $25,000 a day for other candidates.
“As the Supreme Court has recognized, discrimination between speakers is often a tell for content discrimination,” Hinkle wrote. “That is the case here. The state has suggested no other basis for imposing these restrictions only on the largest providers.” The new law includes a provision that shields theme-park operators from the restrictions. Hinkle said that the law “discriminates on its face among otherwise-identical speakers: between social-media providers that do or do not meet the legislation’s size requirements and are not under common ownership with a theme park.” DeSantis, a close ally of former President Donald Trump, pushed the social-media crackdown after Twitter and Facebook blocked Trump from their platforms after his supporters rampaged at the U.S. Capitol on Jan. 6. “Day in and day out, our freedom of speech as conservatives is under attack by the ‘big tech’ oligarchs in Silicon Valley,” the governor said at a bill-signing ceremony last month. DeSantis’ office did not immediately respond to a request for comment late Wednesday. But the governor, a Harvard Law School graduate, has said he believes the state will prevail in the lawsuit. Hinkle’s order rejected the state’s arguments that the law was not subject to “strict scrutiny” by the court. Viewpoint- and content-based restrictions on speech are subject to strict scrutiny, the judge wrote. “Laws that are facially content-neutral, but that cannot be justified without reference to the content of the regulated speech, or that were adopted because of disagreement with the speaker’s message, also must satisfy strict scrutiny,” he said. “These principles plainly require strict scrutiny here. The Florida statutes at issue are about as content-based as it gets.” To survive strict scrutiny, “an infringement on speech must further a compelling state interest and must be narrowly tailored to achieve that interest,” Hinkle noted. “These statutes come nowhere close. Indeed, the state has advanced no argument suggesting the statutes can survive strict scrutiny. They plainly cannot,” he said. NetChoice Vice President and General Counsel Carl Szabo hailed Hinkle’s decision. “When the state’s own lawyers can’t explain how the law works or even identify to whom it applies, there’s just no way that Florida’s enforcement of that law would keep users, creators, and advertisers safe from the tidal wave of offensive content and hate speech that would surely ensue,” he said in a prepared statement. “America’s judiciary system is designed to protect our constitutional rights, and today’s ruling is no different, ensuring that Florida’s politically motivated law does not force Floridians to endure racial epithets, aggressive homophobia, pornographic material, beheadings, or other gruesome content just to use the internet.” During a hearing Monday, Hinkle peppered lawyers with questions and swiped at the law. “I won’t put you on the spot and ask you if you’ve ever dealt with a statute that was more poorly drafted,” the judge asked lawyers representing DeSantis’ administration.

U.S. SUPREME COURT TO HEAR FLORIDA MEDICAID DISPUTE JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE—After getting off a Lee County school bus in November 2008, Gianinna Gallardo was struck by a truck and suffered catastrophic injuries. Now, more than a decade later, her case could lead to a U.S. Supreme Court decision that will affect Medicaid programs across the country. The Supreme Court on Friday said it will take up a legal battle about how much money Florida’s Medicaid program should be able to recoup from a legal settlement that Gallardo’s parents reached after the accident left her in a vegetative state. Attorneys for Gallardo’s parents and the state Agency for Health Care Administration asked the Supreme Court to resolve the issue because of conflicting court decisions about a reimbursement issue involving Florida’s Medicaid program —and programs in other states. “The uncertainty on the issue affects millions of Americans who rely on Medicaid for health care coverage,” attorney’s for the parents, Walter Gallardo and Pilar Vassallo, wrote in a March petition. “A beneficiary’s federal Medicaid rights should not depend on whether she lives in Idaho, West Virginia or Massachusetts. But until this (Supreme) Court resolves the question presented, identically situated Medicaid beneficiaries will receive different treatment under federal law.” Medicaid, which is jointly funded by the federal and state governments, is operated through a maze of laws. But states are required to seek reimbursements of Medicaid payments for medical care if, in situations such as the Gallardo case, lawsuits result in settlements. Documents filed by both sides show that the Agency for Health Care Administration, which runs Florida’s Medicaid program, paid $862,688 for Gallardo’s care after she was injured. Gallardo’s parents filed a lawsuit against the truck’s owner and driver and the Lee County School Board and ultimately reached an $800,000 settlement. The petition filed in March at the Supreme Court said the settlement applied to claims for past medical expenses, future medical expenses, lost earnings and other damages. Under a formula used by the state Medicaid program, the Agency for Health Care Administration said it was entitled to $300,000 of the settlement —ncluding a portion of the settlement that was for Gallardo’s future medical expenses. The legal battle centers on whether the agency is only entitled to recover
money in the settlement representing past medical expenses --- or whether it can also tap into money in the settlement for future medical expenses. U.S. District Judge Mark Walker in 2017 ruled in favor of the parents’ position that the agency should only be able to recover settlement money representing past medical expenses. But a panel of the 11th U.S. Circuit Court of Appeals overturned Walker’s decision and sided with the Agency for Health Care Administration. Meanwhile, in a separate case, the Florida Supreme Court ruled that the Agency for Health Care Administration was only entitled to recover money in a settlement for past medical expenses —creating a conflict between the state Supreme Court and the federal appeals court. Describing the legal conundrum, attorneys for the Agency for Health Care Administration wrote in a June 1 document that under the appeals court decision, the state “has a duty to recover payments for future care. But if it fulfills that duty, it defies the Florida Supreme Court’s ruling.” In arguing that the Supreme Court should come to the same conclusion as the appeals court, the agency’s attorneys pointed to potential major financial ramifications. “First, states, the federal government, and Medicaid recipients have a substantial interest in state Medicaid agencies obtaining full reimbursement from liable third parties,” the June 1 document said. “Ensuring that Medicaid is a payer of last resort is critical not only to state and federal budgets but also to Medicaid’s longevity.” But in his 2017 ruling, Walker wrote that Gallardo was 13 years old at the time of the accident and that her parents were living a “nightmare” as they continued battling with the agency. Attorneys for Gallardo’s parents wrote in the March petition that the Supreme Court should overturn the appeals court decision. But the attorneys also pointed to a need for a final resolution of the issues in the case. “Every state has passed some type of third-party recovery statute to comply with the mandates of the (federal) Medicaid Act,” the petition said. “Unless and until this (Supreme) Court resolves the conflict, the states and their legislatures cannot know what federal law requires of them. There is an urgent need for this court’s guidance on the question presented.”
COURT UPHOLDS ZOOM TESTIMONY DURING PANDEMIC NEWS SERVICE OF FLORIDA STAFF A state appeals court has rejected arguments that a juvenile’s constitutional rights were violated when witnesses were allowed to testify remotely by Zoom because of the COVID-19 pandemic in an attempted-robbery trial. A panel of the 4th District Court of Appeal, in a 2-1 decision, pointed to administrative orders issued last year by the Florida Supreme Court and the chief judge of the 15th Judicial Circuit that were designed to prevent the spread of the virus. The appeals court rejected arguments by attorneys for the juvenile, identified by the initials E.A.C., that his right to confront witnesses had been violated. The majority opinion Wednesday said a Palm Beach County circuit judge “provided the necessary protection of E.A.C.’s due process and confrontation rights” and referred to challenges caused by the pandemic. “The court system cannot be a legal ostrich and stick its head in the sand to avoid the obvious—the COVID pandemic,” Judge Melanie May wrote in the 11-page majority opinion, with Judge Spencer Levine writing a concurring opinion. But Judge Cory
Ciklin dissented, saying the juvenile’s rights had been violated. He wrote that the circuit judge had not made proper “individualized findings” before allowing witnesses to testify by Zoom. “Undoubtedly, preventing the spread of the COVID-19 pandemic qualifies as an important public policy, and preventing people from gathering in a courtroom would generally appear to further that policy,” Ciklin wrote. “But generalities and assumptions are not a substitute for the required case-specific determination of necessity. For example, the trial court did not seek to determine the potential level of risk involved with each witness’ possible exposure to COVID-19 through an in-person appearance. Nor did the trial court evaluate the necessity of each witness’ proffered testimony with respect to the overall effectiveness of prosecution of the case. Lastly, the trial court did not explore alternatives to Zoom testimony, which would go to the question of ‘necessity.’” The juvenile was tried in August and found guilty of attempted robbery in an incident involving an attack on a student in a high-school bathroom, according to the majority opinion.
