As our world evolves technologically, the skills we need to succeed evolve too. It is no longer enough to have a general education – you need skills in communication, computers, programs and the latest cutting-edge technology. However, colleges are often behind on their curricula, and those in need often don’t have the resources to compete in these fast moving fields. The Invictus Knowledge Institute hopes that it can alleviate some of these worries in the Gulf Coast as it readies its first classes in September. Vickie Patterson is the founder and CEO of the Institute, and she found inspiration for the start-up fairly close to home.
“I was born in Pensacola but currently live in Austin, though a lot of my family still lives here. I grew up in pretty poor conditions and got out of them, but when I came back to visit I saw most of my family hadn’t,” said Patterson. “Many of them don’t have the skills to compete in today’s economy.” This led Patterson to want to start mentoring both her family and others in the skills sets that many employers are looking for – things like the latest computing methods and simple communication skills. “We want to help give people the light at the end of the tunnel and help them on every step of the way.” Patterson said that what separates Invictus from other technical workshops or schools is that they
intend to lead students through every step of the process – from learning soft communication skills and basic computer technology, to advanced concepts like cloud computing, all the way through job help, internship placement and other aid. Their target for job placement by their third year is for 85 percent of students to have employment related to their training. “Not many other organizations or schools follow through with their students,” said David Costales, the Institute’s Director of Technology Education. “Traditional degrees and training force you into a tunnel where you can only go towards certain careers. We want to provide options.”» The actual teaching portion that the Institute offers will be based
around building blocks, which are discrete pieces for each training type that are customized by skill level, experience and computer knowledge. Students will have a career and aptitude test that will place them in the level appropriate to them. Communication and basic computer skills will always be on offer, but the first classes in September will focus on cloud computing – a typical training track is set to last no longer than a year. “We have three targets: the underprivileged who want to learn, those who want to brush up on their skills, and businesses who want to train their employees,” said Patterson. Invictus is partnering itself with local businesses for internship placement in order to guarantee a rapid turnaround, and
also secure sources of expertise and other resources. They’ve also officially partnered themselves with Pathways for Change, a local non-profit dedicated to helping the underprivileged through addiction treatment, family support and other programs. While Patterson promotes college education, she says traditional university settings don’t provide everything: curriculum boards take long periods of time to alter their courses, and by that time the technology or methods are outdated or being phased out. Invictus will have a rotating and ever evolving curricula that changes with the industry. Another issue is the reliance on pre-recorded classes, which are often ineffective and hard to pay attention to. Patterson said any online classes would either be live or active workshops – absolutely no pre-recording for later viewing. “There is a huge technical skill gap between America and the rest of the world, because the skill set keeps evolving,” said Patterson. One focus she wants to bring to Pensacola is high-performance computer training for supercomputers such as the IBM Roadrunner or the Oak Ridge National Laboratory Jaguar. Patterson’s 16-year history with IBM will help bring that expertise to the area. Invictus will also be serving as more than an educational center. Costales said they will also be forming a research arm of the Institute for differing tech projects. Their first proposed project is integrating Pepper, a prototype
companion robot from SoftBanks Robotics, with IBM’s Watson to serve as a teaching assistant to be tested in local classrooms. “We have full support from IBM, as well as help from UWF and the Institute for Human & Machine Cognition,” said Patterson. Samantha Weaver, the Director of Communications at Invictus, said the Institute is non-profit, focusing only on the project and helping others. “We are still a start-up, though,” said Weaver. “We are actively looking for sponsors for the Institute. We need hardware for classrooms and people or companies that could sponsor events or scholarships. We also need people who would offer internships, or just any person who is willing to lend their expertise and knowledge on the subjects we cover.” Patterson said that despite offers to spread Invictus to other locations, the Institute will stay local to the Pensacola area. “It means we don’t have to relocate, and it’s great timing for the tech industry in Pensacola.” Invictus is currently located in the Pathways for Change building, but they plan to open at the cowork@nnex at 13 North Palafox Place. The first classes will be held in September. A high school diploma or GED is required to enroll. UWF assistant professor receives fellowship to prestigious institute
Port of Pensacola remains wildlife friendly
Dr. Peter Memiah, assistant professor of epidemiology and public health in the University of West Florida Usha Kundu, MD College of Health, has received a yearlong fellowship to the PRIDE institute. PRIDE stands for Programs to Increase Diversity Among Individuals Engaged in Health-Related Research. The National Heart, Lung and Blood Institute sponsors PRIDE. Memiah will attend the Behavioral Medicine and Sleep Disorders PRIDE Summer Institute in August at New York University’s Langone Medical Center. “I am grateful for the opportunities this fellowship will provide me, my colleagues and UWF as an institution,” Memiah said. “The PRIDE fellowship will give me an opportunity to sharpen my grantwriting and research skills while working within a network of experts and mentors. This program will help me learn the nuts and bolts of navigating a research career as a junior faculty member and as a scientist, and I can’t wait to get started.” The institute provides intensive didactic and mentored research training to underrepresented minorities and those with disabilities engaged in behavioral medicine or sleep disorder research. training and mentoring program is to inspire participants to conduct research by employing techniques at the forefront of their fields. Memiah stated in his PRIDE f e l l o w s h i p application that his future research plans emanate from questions raised from his current work. “I hope to advance my research linking HIV and other chronic diseases and answer the question: What is the etiology of sleep disturbances and fatigue associated with HIV infection?” he said. “Understanding this will help in developing approaches to improve the sleep and quality of life of HIVinfected patients and improve fundamental understanding of the relationship between sleep and chronic infections, in particular, and chronic diseases in general.” In addition to being an assistant professor at UWF, Memiah is an epidemiologist who conducts fieldwork that combines clinical data with behavioral and community observations to ensure evidence-based decision-making. He has extensive experience in conducting research, program evaluation and community outreach and support. He has consulted with the Joint United Nations Program on HIV/AIDS, UNICEF,
Norwegian Mission and United Nations Trust Fund, among other organizations. Memiah is currently conducting an evaluation of the elimination of mother-to-child transmission 2016-2021, a national document that is a public health priority for Kenya and the World Health Organization. The document highlights strategies aimed at reducing infant mortality and is critical in primary prevention of HIV and curbing the spread of the epidemic. Memiah has lived in nine African and two Caribbean countries and collaborated with institutions and countries to design and implement quality improvement programs that ensure optimal client outcomes. The Port of Pensacola Warehouse #1 continues to be recognized as a BirdFriendly Rooftop by Audubon Florida, in partnership with the National Fish and Wildlife Foundation and the Florida Fish and Wildlife Conservation Commission. Now, more than 70 active Least Tern nests are documented on Port of Pensacola’s Warehouse #1 roof during a recent site visit by Audubon of Florida’s Rooftop Nesting Bird Program. A team of wildlife observers visited the Port of Pensacola and inspected the rooftop for evidence of bird nests, eggs and hatchlings. Warehouse #1’s gravel overlay provides an artificial nesting habitat that is similar to the natural sand beach nesting habitat preferred by Least Terns and Black Skimmers. The warehouse rooftop was first officially recognized in 2015. Least Terns are listed as a threatened species by both the U.S. Fish and

Parks and Recreation Receives Grant to Expand Access to Outdoor Program
The City of Pensacola Parks and Recreation Department has received a State of Florida, Department of Juvenile Justice grant for the Outdoor Outreach Program to build relationships with youth throughout Pensacola. The Pensacola Parks and Recreation Outdoor Outreach Program (PROOP) provides positive, life-changing outdoor experiences and opportunities for urban children to grow through outdoor adventures and to learn about their regional ecosystem. According to the American Institutes for Research, children who participate in outdoor learning show higher gains in conflict resolution, increased confidence, self- esteem, positive relationships among students, and reduced discipline and behavior problems.
The grant funds are used to cover the costs for at-risk youth to participate in the program’s Adventure Camps and Fishing Camps. “It’s great to see these kids who may not have had the opportunity to do these camps get the chance to learn new skills. Seeing their smiles when they catch that first fish or shoot a bow and hit a target for the first time and realize they’re accomplishing something they hadn’t done before is exciting,” said Tim Land, Outdoor Pursuits Coordinator. The Fishing Camp is a week-long camp that introduces kids to the sport of fishing and includes teaching basic fishing skills such as knot-tying and baiting a hook, as well as taking kids to fish in some of Pensacola’s best fishing spots. The Adventure Camp is a week-long
camp that includes an introduction to fishing, kayaking, archery, and stand-up paddle boarding. Land says that many of the kids have asked if they can come back and try more camps. The Outdoor Outreach Program has three weeks of camp remaining including Advanced Fishing July 17-21 and two more Adventure Camps July 24-28 and July 31-August 4. Although camp registration is closed for these programs, Parks and Recreation will continue working with the department’s day camp locations to include more children in who qualify for these programs. 2000 Participants Gathered at the Annual Relay For Life of Pensacola Event Sixty-five teams and 2000 people participated in the American Cancer Society Relay For Life of Pensacola event on May 5, 2017 at Community Maritime Park. The 2017 event was presented by Audi of Pensacola and more than $103,000 was raised to support the American Cancer Society’s mission to save lives from cancer. These funds will help the American Cancer Society provide free information and support for people facing the disease today, and fund cancer research that will help protect future generations. PSC joins Achieving the Dream to pursue transformative change, improve student success
Pensacola State College has joined Achieving the Dream (ATD), a network of more than 220 colleges in 39 states dedicated to improving student success. As a network institution, Pensacola State will innovate to implement, align, and scale cutting-edge reforms, work with ATD coaches to build institutional capacity, and connect with peers to foster learning and share information. “We at Pensacola State are excited to be a part of the Achieving the Dream Network, and we expect to accelerate our present momentum in student retention and completion,” said PSC President Edward Meadows. “The Northwest Florida region is heavily dependent upon our ability to successfully train our students to fill the workforce needs of business and industry, and our participation in Achieving the Dream will certainly help to increase our capacity to do so.” Karen A. With the capacity framework as a guide, ATD’s approach integrates and aligns existing college success efforts and offers valuable support in preparing for accreditation, fostering conversation about goals, and making bold, holistic institution-wide changes because initiatives that don’t reach most of a college’s student body have not shown strong results. A team from Pensacola State and teams from the other colleges now
joining ATD met in April and June to prepare to launch their ATD work. ATD Network colleges report data using metrics that answer critical questions about who attends college, who succeeds in and after college, and how college is financed. To advance goals of social mobility and equity, the metrics provide information on how low income and other underserved students fare. These metrics are categorized into performance metrics, efficiency metrics and equity metrics at points during the student experience from access through post-college outcomes. As colleges in the new cohort progress, they may apply to participate in initiatives supported by philanthropic funding and managed by ATD. These initiatives help incubate new ideas that help colleges refine practices based on evidence of what works and allow ATD to disseminate knowledge to the broader network and the field. New initiatives address the challenge of engaging adjunct faculty more deeply as key members of colleges’ workforces and implementing degree programs using only open educational resources. STATE FACES LEGAL TAB IN `DOCS VS. GLOCKS’ FIGHT By JIM SAUNDERS THE NEWS SERVICE OF FLORIDA
Florida will pay $1.1 million in legal fees to attorneys who challenged a controversial state law that sought to prevent doctors from asking patients about guns, a group representing opponents said Monday. The Brady Center to Prevent Gun Violence announced the legal-fees agreement more than five months after a federal appeals court sided with doctors and medical groups in striking down key parts of the 2011 law --- which became known as the “docs vs. glocks” law. The state did not appeal the Feb. 16 decision by the full 11th U.S. Circuit Court of Appeals. A copy of the legal-fees agreement had not been posted in an online court file Monday morning. But documents indicate the state and the law’s opponents had been in mediation on the fees. The law, which was backed by groups such as the National Rifle Association, included a series of restrictions on doctors and health providers. For example, it sought to prevent physicians from entering information about gun ownership into medical records if the physicians knew the information was not “relevant” to patients’ medical care or safety or to the safety of other people. Also, the law said doctors should refrain from asking about gun ownership by patients or family members unless the doctors believed in “good faith”
that the information was relevant to medical care or safety. Also, the law sought to prevent doctors from discriminating against patients or “harassing” them because of owning firearms. Opponents argued, in part, that the law violated free-speech rights. The full appeals court found that the record-keeping, inquiry and anti-harassment parts of the law were unconstitutional, but upheld the portion of the law that bars doctors from discriminating against patients who have guns. “Legislators across the country should learn from Florida’s example that if you side with the corporate gun lobby instead of your constituents, you endanger the safety of children and families, impinge upon First Amendment rights of doctors, and force taxpayers to pay millions to unsuccessfully defend unconstitutional laws,” Jonathan Lowy, director of the Brady Center’s Legal Action Project and an attorney in the case, said in a prepared statement Monday. “Thankfully, in this case justice prevailed and the court recognized that doctors have a First Amendment right to tell the truth about guns, and the risks they can pose to children and families.” When asked for comment Monday about the legal fees, John Tupps, a spokesman for Gov. Rick Scott, said in an email that Scott signed the 2011 law after it “was approved by a large, bipartisan majority in the Florida Legislature.” “Governor Scott is a strong supporter of the Second Amendment,” Tupps said. “Much of this
law was either never challenged or upheld in court. This (legal fees) settlement is in accordance with Florida law and a recommendation from the Department of Financial Services.” The challenge to the law was filed in June 2011 and played out over nearly six years. A U.S. District Court judge blocked the law from taking effect, but a three-judge panel of the appeals court upheld the law in three rulings before the full appeals court agreed to take up the case. Supporters of the law said it was necessary to prevent doctors, such as pediatricians, from harassing and discriminating against patients and parents about gun ownership. The also described the law, formally known as the Firearm Owners’ Privacy Act, as a Second Amendment issue. But Douglas Hallward-Driemeier, an attorney with the firm Ropes & Gray, who argued the case for the plaintiffs, said in a prepared statement Monday that the case allows doctors to “go back to giving their best advice to patients when it comes to gun safety.” “From day one in bringing this case, our commitment has been to protect doctors’ First Amendment rights to ensure the safety of individuals, families and communities in Florida,” HallwardDriemeier said. “The successful resolution of the litigation and subsequent fees and costs award are both critical to furthering that goal.”
MAGLAB HOME TO MAJOR RESEARCH --- AND HEFTY POWER BILLS By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA
Cutting-edge science is not cheap. Last month, the National High Magnetic Field Laboratory facility at Florida State University paid a $236,735 electric bill for powering up its magnets. And that didn’t include another $106,000 to keep the lights on and run the air-conditioning at the sprawling facility on the Southwest side of Tallahassee. Over a one-year period ending in June, the MagLab paid about $3.4 million to the city of Tallahassee for power, split between $2.3 million in electricity for the magnets and $1.1 million for the facility’s other power needs. It’s a hefty price, but physicists and other researchers believe it’s worth the cost to have the largest and highestpowered magnet laboratory in the world. The MagLab also includes facilities at the University of Florida in Gainesville and the Los Alamos National Laboratory in New Mexico. “High magnetic fields play a critical role in developing materials that affect nearly every modern technology,” according to a 2013 operational agreement between the MagLab and the National Science Foundation, which provides funding for the research, including covering all the electricity costs related to the magnets.
“Lasers, computers, motors, plastics and MRI all came about after researchers learned more about materials through magnet-related research,” the agreement noted. Since powering up its first major magnet at the Tallahassee facility in 1994, the research efforts as well as the magnets have expanded in scope. In 2015, more than 1,600 researchers from universities and corporations conducted research at the three MagLab sites. The efforts generate about 400 research papers each year. The MagLab had a $49.2 million budget in 2015, with the National Science Foundation paying just under 70 percent, the state of Florida paying some 26 percent and the rest coming from grants obtained by researchers. One of the basic goals is to create bigger, more-efficient magnets that will lead to more research insights in a wide array of fields, including materials research, superconductors, biofuels and pharmaceutical products. “Most people don’t realize that in your cell phone there are 20 materials that didn’t exist 20 years ago,” Eric Palm, the deputy MagLab director said in a recent tour of the Tallahassee facility. “We are advancing new materials all of the time, and we are a key part of understanding those materials and being able to engineer future, better materials.” One research effort has focused on finding materials to make safer, more
efficient lithium batteries, Palm said. In another research area, the MagLab late last year powered up a 33-ton “series connected hybrid” magnet. Its full-field magnetic strength was 36 tesla, a measurement that can be compared to .01 tesla in a refrigerator magnet or 1.5 to 3 tesla in a typical MRI machine. It is the world’s most powerful magnet that is focused on nuclear magnetic resonance spectroscopy, which is used by chemists and biologists to study molecular structures. The new magnet will allow scientists to expand their research to more elements than in the past, including oxygen, which is involved in most biological processes. The MagLab also has a hybrid magnet, which uses both resistive and superconducting technologies, that has held the world record since 1999 as the most powerful “continuous field” magnet, reaching 45 tesla. Palm said the resistive magnets use the most electricity, while the superconducting magnets use the least. The record-setting hybrid magnet, for example, requires about 30 megawatts of power when it is running at full field. In February, the MagLab had its highest electricity usage for the year, reaching a 52-megawatt peak demand for the magnets. The city of Tallahassee has about a 600-megawatt peak demand capacity, meaning the MagLab’s electric needs

Florida wildlife officials will have less money this year to help communities equip residents and businesses with bear-proof trash containers. The Florida Fish and Wildlife Conservation Commission announced Thursday the start of a nearly three-month application period for local governments and others seeking “BearWise” funding for the fiscal year that began July 1. The agency has $515,000 to match with local government funding to help people and businesses buy bear-resistant trash cans and hardware to secure regular trash cans and to have modified dumpsters. The amount is down from $825,000 last year. Money generated by a controversial 2015 bear hunt was available last year. The commission voted against holding similar hunts in 2016 and 2017. A majority of the “BearWise” money will go to communities that have enacted ordinances requiring residents and businesses to keep garbage secure from bears looking for food. Roughly 4,000 black bears are estimated to live in
Florida, from the forests of Southwest Florida through the Panhandle. The current population is considered a success story, as the numbers had fallen to as low as 300 to 500 in the 1970s when bears were put on the state’s list of threatened species. Bears were removed from the list in 2012. But as the bear population has rebounded and more homes and businesses have been built in the animals’ native habitats, incidents of human-bear interactions have grown. Lawmakers approved $415,000 for the “BearWise” project for this fiscal year, with an additional $100,000 coming from the Fish & Wildlife Foundation of Florida through the sale of “Conserve Wildlife” license plates. An agency spokeswoman pointed to those numbers when asked if this year’s reduction in available money for the “BearWise” program was due to the absence of funds generated by a bear hunt. “Each year the Legislature has a process where they determine how much money they fund to specific programs,” spokeswoman Carli Segelson said in an email. “This year it was $415,000 and last year it was $500,000 for the BearWise funding. Similarly the Fish & Wildlife Foundation of Florida has a process to

The MagLab is also awaiting approval for another five-year funding grant from the National Science Foundation, which will make a decision later this year. “It’s extremely critical for us,” Palm said about the National Science Foundation funding. “We’re on the verge of creating an entirely new class of magnets so we get to even higher magnetic fields. We’re excited about the opportunities.”

Last year, three Central Florida counties --- Seminole, Lake and Orange --- each received $200,000 through the “BearWise” program, while the rest of the money was spread among eight other counties, three cities and two homeowner associations. Overall the money was used to purchase 4,000 bearresistant trash cans, 2,500 sets of hardware to secure regular trash cans and 40 dumpsters that were modified to keep bears out.

Rick Scott seeks to prevent Florida from doing business with entities supporting the Maduro regime. Scott hasn’t outlined details of the proposal he intends to put before the state Cabinet on Aug. 16. But just saying he wants to make a change that could affect the state’s investments has drawn attention from the Wall Street firm. A revision to Scott’s daily schedule on Wednesday included a meeting in Jacksonville with two officials from Goldman Sachs Asset Management. The meeting was requested by Goldman Sachs “to discuss his upcoming policy to prohibit Florida from doing business with anyone who supports the brutal Maduro regime,” Scott spokesman John Tupps said Thursday. A spokesman for Goldman Sachs
directly named Goldman Sachs in his statements regarding Venezuela. “We appreciate the opportunity to visit with Gov. Scott, who has been a leader for all concerned about the situation in Venezuela,” Goldman Sachs spokesman Michael Duvally said in a statement. “We share that concern and let him know that we do not support the Maduro regime and will not do business with it.” As part of the company’s statement, Goldman Sachs listed a series of bullet-point “facts.” One noted it had purchased the bonds in May on behalf of clients through a broker in the secondary market. The bonds were initially issued in 2014 by Petroleos de Venezuela. Goldman Sachs also said many asset managers make similar investments for clients that own mutual funds, index funds and exchange-traded funds. “We learned a great deal from the reaction to the investment and enhanced our investment process to consider a broader array of risk and meet our fiduciary responsibilities,”
the company said in the facts. As of early this month, Goldman Sachs, an investment manager of part of what is known as Florida’s “long duration portfolio,” had an allocation from the state of $478 million, according to the state chief financial officer. The overall portfolio included $8.2 billion. In another possible sign of Goldman Sachs’ attention to the issue, the company has recently hired lobbyists Hayden Dempsey and Fred Karlinsky of the Greenberg Traurig law firm. Dempsey is well known to Scott, having served as his special counsel, overseeing legislative affairs and assisting in policy development, during the governor’s first year in office. Karlinsky, a major Scott political fundraiser who served as co-chairman of Scott’s second inaugural, serves as one of Scott’s picks on the state Constitution Revision Commission. Scott and a number of other Florida politicians from both parties have been ratcheting up their criticism of the Maduro regime since a high-profile attack on Venezuela’s opposition-
controlled National Assembly on July 6, the nation’s independence day. State Sen. Victor Torres, D-Orlando, lent support Thursday to the idea of economic sanctions against Venezuela. Torres said Venezuelan voters this week opposed efforts by Maduro to rewrite the country’s Constitution. “The voices of the Venezuelan people spoke with unanimity in their desire to preserve their national freedom and an open society,” Torres said in a prepared statement. “We should all stand with the citizens and demand the current leadership abide by the will of the people.” At the Aug. 16 Florida Cabinet meeting, Scott intends to ask trustees of the State Board of Administration --- comprised of himself, Attorney General Pam Bondi and Chief Financial Officer Jimmy Patronis --- to prohibit the state from doing business with any organization supporting the Maduro regime. Scott hasn’t said if his plans will result in divesting from existing contracts and agreements or simply from making future deals.

Florida gambling regulators this week gave a Miami dog track permission to ditch greyhound races but keep more lucrative slot machines and card games, in a first-of-its-kind ruling. The Department of Business and Professional Regulation on Wednesday granted a request from West Flagler Associates, which operates Magic City Casino in Miami, to replace dog races with jai alai matches, as part of a drawn-out legal dispute over a controversial “summer jai alai” permit. It’s the first time a pari-mutuel facility has been allowed to drop dog or horse races and continue operating slots. The Magic City decision is rooted in a 1980 Florida law that allows Miami-Dade and Broward pari-mutuels that have the lowest betting handle for two consecutive years to convert to summer jai alai permits. But if those pari-mutuels do not seek conversion, other facilities can seek the permits. The Miami dog track’s lawyer, John Lockwood, first sought the summer jai alai permit for Magic City in 2011. After much legal wrangling, the department’s Division of Pari-mutuel Wagering denied the track’s request to do away with dog races, launch jai alai games and keep lucrative slots the track began operating after voters signed off on the machines in 2004. But the 3rd District Court of Appeal ordered gambling regulators to reconsider the issue. In a declaratory statement issued Wednesday, state regulators said Florida law gives the track the green light to do away with dog races, as long as the jai alai matches take place at the same facility where the current greyhound permit is operated. “The jai alai fronton is going to take up significantly less space than the greyhound track, so this frees up West Flagler to develop its property to the highest and best use,” Lockwood told The News Service of

Wednesday’s decision came in response to a question posed by Magic City, asking regulators if the pari-mutuel would still be able to operate slots if the dog races were discontinued and replaced by jai alai games. The answer rests on whether “a licensed parimutuel facility as present in Florida law means `the actual racetrack or jai alai fronton,’ ” Division of Pari-mutuel Wagering Director Anthony Glover wrote in Wednesday’s declaratory statement. If so, the summer jai alai permit wouldn’t meet the requirements “because a new fronton would have to be built,” Glover wrote. Alternatively, if a “licensed pari-mutuel facility” means “the areas of the facility where pari-mutuel activity takes place, petitioner’s summer jai alai permit operating at the same location as where the greyhound permit was located would remain an eligible facility,” Glover wrote, siding with the dog track. “… It is apparent that the Legislature intended for the term `licensed pari-mutuel facility’ … to refer to the physical location or piece of property utilized for pari-mutuel wagering, rather than just the racetrack or jai alai fronton itself,” he wrote. The agency’s decision won’t have broad implications but comes as lawmakers consider a push by gambling operators who want to do away with live dog and horse racing while holding onto slots or card rooms. “It’s pretty clear that the department intends for this to not have any far-reaching effects, but once again, John Lockwood has masterfully used a unique set of circumstances to create a positive outcome for his client,” Scott Ross, a former deputy secretary at the Department of Business and Professional Regulation who is now a lobbyist representing other gambling operators, said in a telephone interview Thursday. Hartman and Tyner, Inc., and H&T Gaming, Inc.,
which operate rival Mardi Gras Casino and Racetrack in Broward County, had sought to intervene in the case. Lawyers for the Hallandale Beach dog track argued that Magic City was asking regulators to establish “a new and completely unfounded policy that improperly expands the types of permits eligible for slot machine gaming beyond what the plain terms” of the Constitution and state law allow. But in Wednesday’s declaratory statement, gambling officials rejected the petition to intervene, saying Mardi Gras had not shown “with particularity what real and immediate injury or impact the outcome of the declaratory statement would have had on the intervenors.” Multiple attempts to reach representatives of Mardi Gras were unsuccessful. Isadore Havenick, vice president of the familyowned West Flagler Associates, which also operates a greyhound track in Southwest Florida and owns a 25 percent share of a jai alai fronton in Dania Beach, said Magic City sought to put an end to the dog races in Miami because “nobody wants to watch them.” The Havenicks are among the track owners who have pushed lawmakers to allow pari-mutuels to “decouple,” which would allow operators to do away with live horse or dog races while keeping more lucrative gambling activities such as slots or card rooms. “Since decoupling hasn’t happened, and since jai alai has to run fewer performances than dogs do, we said if we have two permits at the same location, why can’t we switch sports that we do here,” Havenick told the News Service on Thursday. “Nobody’s watching. Our dog men complain that they have to come over to Miami and deal with Miami when they get no customers in the stands. So this is a way for us to try a new sport and see if we can make it go of that.”
