By Hana Frenette The subconscious of a city is a complex and ever-evolving thing. Millions of thoughts, ideas, workplaces, streetscapes and community gatherings come together daily to form an intricate and expansive psyche of a city. In 2014, Stephanie Berger and Nicholas Adamski made an attempt to capture a glimpse of that psyche. The two launched The Typewriter Project: The Subconscious of a City on Governor’s Island during the New York City Poetry Festival. In January, that project will come to Pensacola. The project consists of a wooden booth, housing a typewriter, a seat for the participant, an open window and 100-foot long spool of paper. The booth creates a collaborative opportunity for passers-by within the city to stop and share their thoughts, poetry or feelings. The writings can be anonymous or signed, and on any topic the writer chooses. Berger and Adamski, also co-founders of the New York Poetry Society, cited several reasons for creating this project, with the first simply being one of curiosity. “I think first and foremost, we were really curious about what New Yorkers were thinking in different parts of the city at different times. We wanted to hear what their
internal dialogue sounded like at particular times in a particular places. That’s why we subtitled the project ‘The Subconscious of the City,’” Berger said. The two also really wanted to give people the opportunity to sit and reflect on their day or their thoughts. Berger noted our modern lives can often be quite hectic, especially for those living in a bigger city, and creating time and space for a little mindfulness and tangible creativity was something they thought people could benefit from. “Writing on a typewriter helps in causing one to slow down and deeply consider what one is about to type because it feels more permanent. And the clickety-clacking of the keys provides an oddly calming effect,” she said. “Lastly, we wanted to give people the opportunity to write poetry! Bringing poetry to people in innovative ways is a big part of The Poetry Society of New York’s mission. Poetry has such a dull reputation amongst the general public. The Typewriter Project makes writing poetry fun, collaborative, and inclusive.” Since it’s launch in 2014 the project has been installed 13 times in Brooklyn, NY; Manhattan, NY; Hamilton, NJ; and Raleigh, NC. Berger said the public response to the project has been overwhelmingly positive since the first installation on Governor’s Island. “There was a line to use it that was five to 10 people
long throughout the New York City Poetry Festival that year. I’m glad we launched it in a place where there were already tons of poets roaming around,” Berger said. “The first person to write on it was actually Paul Muldoon, poetry editor of The New Yorker magazine. It was really nice to launch the installation with a bang!” Because the project is completely dependent on the individual people who encounter and contribute to it, Berger noted that every installation so far has been really different and totally distinct. Some of Berger’s favorite moments include the day same-sex marriage was legalized throughout the country and the project was set up in New York. “The Typewriter Project was installed in Tompkins Square Park, a historic site of political activism and resistance, and there were just so many celebratory remarks that day and beautiful stories and poems of peoples’ love,” she said. “It made me really happy that that moment in time had been documented in that particular way.” The newest installation will be set up in Pensacola at three different public locations during January: The Museum of Commerce; The West Florida Public Library Downtown Branch, and The University of West Florida’s John C. Pace Library. Dr. Robin Blyn, a faculty member from the English Department at UWF had
read about the Typewriter Project and invited Berger to be an artist-in-residence for a few days in addition to giving a public lecture on the project. “We figured it would only make sense for the students and faculty at UWF to get to
experience the installation,” Berger said. Once the public installation ends, the scrolls will be taken off the typewriter and then shown at the Pensacola Museum of Art in April. Once the exhibit at the PMA ends, the scrolls will then be housed in airtight containers in Berger’s storage unit in Queens. “We’ve had several exhibits that featured them, and we are always open to finding new and interesting ways to display and use them,” Berger said. If you’re out and about in January and see a modest wooden booth with a spool of paper rolling through the

UWF Receives Top Award for Luna Settlement Project from Society for Historical Archaeology
The University of West Florida Division of Anthropology and Archaeology recently received the 2018 Daniel G. Roberts Award for Excellence in Public Historical Archaeology for the Tristan de Luna y Arellano project. The award was presented at the Society for Historical Archaeology’s annual meeting, held Jan. 3-6 in New Orleans. “Our Luna Project team has been working for several decades, first on the shipwrecks and recently on the settlement, to explore archaeological traces of Luna’s ships and colonists after a hurricane destroyed the colony’s food supplies, and left the survivors stranded on the shores of Pensacola Bay from 1559 to 1561,” said Dr. Elizabeth Benchley, director of the Division of Anthropology and Archaeology and the Archaeology Institute. “From the beginning, we have reached out to Pensacolians to share our findings through lectures, websites, tours, and hands on opportunities, as we piece together this important story. We are indebted to the support and interest from the community, and especially the Luna neighbors who have allowed us to excavate in their yards. We are very honored to receive this prestigious award for Excellence in Public Historical Archaeology from the Society for Historical Archaeology.” The award recognizes the efforts of a large team of faculty, staff, and students from the UWF Division of Anthropology and Archaeology, which includes the Department of Anthropology, the Archaeology Institute, the Florida Public Archaeology Network and Marine Services Center at UWF. The team has been studying the shipwrecks and land settlement linked to the 16th-century Spanish expedition led by Don Tristán de Luna y Arellano from Veracruz, Mexico to modern-day Pensacola, marking the earliest multi-year European settlement in the U.S. The first ship, named Emanuel Point I by archaeologists, was discovered in Pensacola Bay by the Florida Bureau
of Archaeological Research in 1992. In 2006, UWF archaeologists identified a second shipwreck, Emanuel Point II. In December 2015, the UWF archaeology program identified the location of the Luna land settlement, serving as evidence of Pensacola being home to the first multi-year European settlement in the U.S. The team then discovered a third shipwreck, Emanuel Point III, in June 2016. The Roberts Award, one of the SHA’s top four annual honors, was created and endowed by the staff of John Milner Associates Inc., now part of Commonwealth Heritage Group Inc., to recognize and honor their colleague Daniel G. Roberts, one of the pioneers in public historical archaeology, particularly within a heritage management framework. Public archaeology entails a commitment to broad dissemination of the lessons learned from archaeology and the importance of preserving the archaeological record. The award recognizes outstanding, sustained accomplishments in public historical archaeology by individuals, educational institutions, for-profit or non-profit firms or organizations, museums, government agencies and private sponsors. Formed in 1967, the Society for Historical Archaeology is the largest scholarly group concerned with the archaeology of the modern world (A.D. 1400-present). The main focus of the society is the era since the beginning of European exploration. SHA promotes scholarly research and the dissemination of knowledge concerning historical archaeology. The society is specifically concerned with the identification, excavation, interpretation and conservation of sites and materials on land and underwater. Geographically the society emphasizes the New World, but also includes European exploration and settlement in Africa, Asia and Oceania. To learn more about SHA, visit sha. org. JazzFest Selects Artist for 35th Anniversary Poster
Jazz Pensacola is pleased to announce that the poster for the 35th annual Pensacola JazzFest will feature a painting by DeFuniak Springs artist Carol Ferony. UWF Announces Historic Gift in Excess of $8 million from Pensacola Attorney Fred Levin
Today, the University of West Florida announced that Fred Levin, attorney and community advocate, is gifting his multi-million dollar waterfront home and estate, known as Timeless Tanglewood, to the institution. The donation also includes much of the renovated home’s contents, including works of art and collector’s items. The total value of the donation is more than $8 million, the largest gift by a living donor in the University’s history. “Every gift we receive helps us provide students with access to high-quality, relevant educational opportunities,” said UWF President Martha Saunders. “But every once in a while, a gift like this one from Fred Levin comes along that has the ability to transform what we do. We are most grateful for his trust in us.” The property will provide the opportunity for enhanced learning experiences for students in the global hospitality and tourism management program. In addition, the property is envisioned to offer a venue for meetings and events that support the University’s mission, as well as a place to host visiting dignitaries and academic scholars from around the world for the enhancement of UWF academic programs. Levin has established a longstanding history of generosity toward the University. More than 20 years ago, he gifted an endowed professorship at UWF in honor of his father, Abe Levin, which is now worth more than $400,000. In 2017, he gave $100,000 to support UWF football, as well as $550,000 to establish the Reubin O’D. Askew Institute for Multidisciplinary Studies. The Institute will further the University’s leadership in STEAM initiatives: combined applications of science, technology, engineering, art and math. The Institute will also create a hub for students and faculty to work on innovative community projects, better preparing graduates for today’s everchanging workforce. “Fred is passionate about the critical role UWF plays in our region and investing in the lives of others,” said Howard Reddy, interim vice president of university advancement. “We thank him for his exceptional vision and generosity.” The property is being dedicated to the University in honor of Levin’s personal friend, law partner and the 37th governor of Florida, Reubin O’D. Askew. The University also announced that it renamed the Department of Government the Reubin O’D. Askew Department of Government in recognition of Levin’s continued support. Starting in Fall 2018, the Reubin O’D. Askew Department of Government will provide opportunities for students to receive scholarships as Askew Scholars. “Reubin O’D. Askew was one of the finest governors to serve Florida,” said Levin. “He was also one of the founding partners of the Levin law firm and a wonderful friend. It is a privilege for me to honor him in this way and to provide an opportunity for his name and legacy to be remembered in the Pensacola community he loved and supported so much.” Reubin O’D. Askew was an Ameri-
can politician who served as the governor of the state of Florida from 1971 to 1979. In 1974, he became the first governor in Florida history to be elected to a second consecutive four-year term. During his two terms as governor, Askew was primarily involved in tax reform, especially in the increase of homestead exemption and passage of the “Sunshine Amendment,” which called for full financial disclosure by public officials and candidates. In 1955, Askew and David Levin founded the law firm of Levin & Askew. In 1961, David Levin’s younger brother Fred joined the firm. The 7,500-square-foot home, located on Bayou Texar, was designed with a European influence marked by a contemporary flair. The lower level boasts a bar area themed after the RMS Titanic, which includes a 1912 Renault automobile that was the original sister car of one that was aboard the Titanic and is now at the bottom of the Atlantic Ocean. Distinctive commissioned artworks, including pieces by local artist Jeff Bass and bronze sculptures by Michael Boles, will remain with the property, as well as wood paneling and a 21-foot dining room table by master craftsman Vic Cormier, custom-made European Chinaware emblazoned with the Tanglewood logo, and antique Victorian Tiffany silver. The three-bedroom home also features a room dedicated and themed after Irving Berlin, which includes some of his personal crystal stemware and other original, historical artifacts on display. The surrounding grounds are also impressive and were redone from waterfront to roadside, showcasing seven different design styles and a collection of award winning camellias, including a special hybrid named in memory of Mr. Levin’s late wife, Marilyn, who passed away in 2011. Levin is widely considered one of the most successful trial attorneys in the country and has been a partner at the Levin Papantonio law firm for more than 50 years. He has received more than 25 jury verdicts in excess of $1 million, six of which were in excess of $10 million. He is best known for rewriting Florida’s Medicaid Third Party Recovery Act to allow the state of Florida to recover billions of dollars from the tobacco industry for smokingrelated illnesses. He is a member of the Inner Circle of Advocates, an organization limited to 100 members throughout the country, and he has been listed in every edition of the publication, “Best Lawyers in America.” Among his accomplishments, Levin was named the Trial Lawyer of the Year by the National Trial Lawyers for 2015. He was also inducted into the Trial Lawyers Hall of Fame in 2009, which is located at Temple Law School in Philadelphia. Other honors include receiving the Perry Nichols Award in 1994, which is the highest honor bestowed by the Florida Justice Association and is given in recognition for a person’s lifetime achievements in the pursuit of justice. At UWF’s Fall 2017 Commencement, Levin was named an Honorary Doctor of Laws, the highest form of recognition a university can bestow.

Justin Gatlin to be Featured Speaker / Pro-Athlete of the Year at Pensacola Sports Cox Annual Awards Banquet
Pensacola sprinter and world record setter Justin Gatlin will be the featured speaker at the Pensacola Sports Cox Annual Awards Banquet on Feb. 20 at New World Landing. Each year the awards banquet recognizes outstanding achievements of teams and individual athletes from the area, both professional and amateur. The highlight of the awards banquet includes induction into the Pensacola Sports Hall of Fame and the announcement of the Sportsman of the Year, an award that is not announced until that evening. “This last year has seen so many outstanding performances by area athletes and teams,” Ray Palmer, executive director of Pensacola Sports said. “We are so excited to recognize some really great athletic achievements – baseball, tennis, golf and football championships, world records being set, inspira-
tional performances by athletes from all walks of life – it’s been an unbelievable year for sports and we hope everyone will come to the banquet to help us recognize these great efforts.” This year’s special achievement winners will include the UWF Men’s Tennis national championship team, the Blue Wahoos, Ben Lively, Navarre High School’s weightlifting team and others. DOCTORS WARY OF PAINKILLER PRESCRIPTION LIMITS

Surgeons complain it’s too restrictive for patients who undergo major heart surgery or hip replacement. Emergency room doctors gripe they don’t have the time or resources to comply. And pharmacists say it needs to be tweaked. But the litany of suggestions offered by health care professionals over the past few weeks has done nothing to persuade key lawmakers to change a sweeping measure aimed at curbing opioid addiction and overdoses, now the leading accidental cause of death in the U.S. The proposal (HB 21) continued moving forward Monday when it was unanimously approved by the House Appropriations Committee. According to research, 80 percent of heroin users first abused prescription drugs, whether their own or someone else’s. Other studies show that a patient’s chances of addiction increase as the number of days a first prescription for opioids lengthens. The data has spurred state lawmakers to focus not only on treating drug users but on trying to keep patients from getting hooked in the first place. That involves restricting doctors to writing prescriptions for a three-day supply of opioids, such as OxyContin or Vicodin, for patients with acute pain, or a seven-day supply if physicians deem it “medically necessary.” The Legislature also wants to force doctors to consult a statewide database,
known as a prescription drug monitoring program, or PDMP, before writing prescriptions for controlled substances, something doctors have strenuously opposed in the past. Pharmacists already are required to enter information about most controlled substances into the database, but only about 27 percent of Florida health care providers authorized to prescribe controlled substances are currently registered to use the PDMP, according to a November presentation by PDMP Director Rebecca Poston. Lawmakers want doctors to use the database to ensure that patients aren’t “doctor shopping,” or seeking prescriptions for addictive drugs from multiple physicians. Patients who do so may be addicted, or could be selling the drugs on the street, in some instances to subsidize their habit. Under the bill approved Monday by the House Appropriations Committee, doctors would have to consult the database before writing any prescriptions for controlled substances, including drugs that have a low potential for abuse. Rep. Jim Boyd, the bill sponsor, told The News Service of Florida that the measure may undergo some minor changes before it hits the desk of Gov. Rick Scott, who has made stemming the opioid epidemic --- which he declared a public health emergency last summer --- one of his top legislative priorities. “Will we end up with something at the end of the day that is a little bit of a compromise? Perhaps. But right now, we’re kind of sticking with the
policy that we started with,” Boyd, a Bradenton Republican whose district is experiencing some of the state’s worst impacts of the opioid scourge. Doctors don’t want to have to look up every patient’s drug history in the database and don’t want to have to consult it before writing prescriptions for every kind of controlled substance. They also want the database to be linked to patients’ electronic health records, something also contained in the House plan. And doctors have repeatedly complained that the database is clunky and is frequently unavailable. The House proposal includes about $873,000 to upgrade the drug database, something not included in a Senate companion measure, which, unlike the House version, also steers more than $53 million to substance abuse-related issues. “We’re hopeful that the final bill will be a mixture of checking the PDMP for the appropriate medications in the appropriate instances, with a PDMP that is integrated into the EHR (electronic health records), so that it’s easy to do so and it’s not an undue burden on the physician,” Jeff Scott, Florida Medical Association general counsel, told the News Service on Monday. While doctors and lawmakers might reach a deal on the use of the PDMP, prescription restrictions will likely remain a sticking point. Hank Hutchinson, a Tallahassee orthopedic surgeon, told lawmakers that “putting a strict day limit on prescriptions for pain medication” is “really bad for my patients,” who he
said travel from as far away as Dothan, Ala. He also bridled at the wording of the exception to the three-day restriction that would allow doctors to order seven days’ worth of narcotics if they decide it’s “medically necessary.” “I don’t think any of us as competent physicians would write a prescription that wasn’t medically necessary,” Hutchinson said. “Whatever day you choose to pick, I think it’s arbitrary. Patients are different. Their pain is different. And we treat them all differently.” The bill would allow doctors to write additional prescriptions, with the same seven-day limit, if patients need more pain medication. But Hutchinson said that would impose a burden on patients who would have to travel sometimes for hours to get another prescription, and it would cost them another co-payment for the drugs. “I think you’re really hurting the patients,” the surgeon said. “Whatever number you put on it, there’s going to be unintended consequences for the patient that I don’t think are good.” While Boyd indicated a compromise about checking the drug database might be in the works, he seemed unlikely to budge on the prescription limit, something pushed by Scott and also included the Senate plan (SB 8). “We’re sticking pretty hard and fast to the three- and seven-day prescription periods. They do have the ability to reup that. … So I think there’s a little bit of room already that they don’t realize,” he said.

Tim Jansen, a lawyer representing Roberts, told Walker that his client could be personally sued if he turned over some of the documents, which contain trade secrets. And, Jansen said, the request for income tax returns is a violation of his property rights. Walker acknowledged that the subpoenas --- signed by Corcoran from the rostrum during a floor session and immediately dispatched by a process server, who was waiting in the speaker’s office --- equate to “a certain 1,000-pound gorilla.” “I wouldn’t use the word ‘bullying,’ but some might use the word,” Walker said, saying the House may have been “posturing” by issuing the subpoenas. While no case law exists for the unprecedented move by the House, the judge said there are rulings that found rare instances when subpoenas issued by Congress can be overturned by the courts. The only time that can happen is when the subpoenas are unrelated to issues within the scope of a committee’s purpose. But, in the request for the Visit Florida documents, lawmakers are “rooting out information dealing with the public purse,” Walker said. “The Legislature does get to say, if we want to continue to spend money on Visit
Florida, let’s figure out how it’s being spent,” he said. “Are we buying a pig in a poke or are we engaging in contracts that make sense for the public purse?” Adam Tanenbaum, general counsel for the House, assured Walker that Roberts’ arrest wasn’t imminent. Only the full House – which won’t meet until Wednesday – could decide that Roberts is in contempt and decide to impose the sanctions. But Tanenbaum said that wasn’t likely to happen. Roberts’ lawyers turned over some documents on Tuesday and are negotiating with Tanenbaum about the release of other records and how to keep them from being kept secret from the public. “We’re optimistic that, at this point, we’ll be able to get those documents from MAT Media and Mr. Roberts,” Tanenbaum said. Even if the House did approve the contempt charge, Roberts would have an opportunity to defend himself, Tanenbaum promised. “Nothing has happened yet, and there’s not even the suggestion that something is going to happen,” Tanenbaum argued, saying it was too soon for the court to issue the preliminary injunction sought by Roberts and his company. Although Walker sided with Corcoran and the House, he had some harsh words for the lawmakers. The judge questioned why the House would issue the new subpoenas while two court cases were pending on the matter, accusing them of doing “an end run to subvert the state courts.” “Can the Florida Legislature really subpoena me for whatever they want
and whenever they want, and, if I refuse to respond, they can throw me in jail?” Walker asked. “Sounds a little Orwellian to me.” But Tanenbaum said the House issued the subpoenas because it was “the only thing it has the power to do to get the documents it has been seeking” since April, when the House began probing the contracts. After delivering his decision from the bench, Walker expounded on his rationale. “If Mr. Roberts was being hauled off and taken into custody … I suspect I may have a very different view of separation of powers,” he said. “But that’s not what we have here.” Even if such harm was imminent, Walker said his power to do something was limited, and “the only thing I could say” to the Legislature was “follow the law.” But Walker found that there was “nothing to show that the Florida Legislature is going to willy-nilly” impose penalties on Roberts. The judge concluded with a minilecture for the Legislature. “I in no way minimize the significance of having an august body like the House say you’re going to turn over documents or we’re going to throw you in jail,” Walker said, adding that there’s “probably a reason why it’s never been done before.” “I am going to respectfully suggest to the Florida Legislature, just as I am cautious about exercising my authority, my colleagues in the other two branches should likewise comport themselves,” he concluded.

A federal judge Friday refused to block subpoenas issued by the Florida House of Representatives demanding documents from broadcasting executive Pat Roberts and his production company, MAT Media, related to contracts with the tourism-marketing agency Visit Florida. A House committee in October issued subpoenas to Roberts, who is the longtime president of the Florida Association of Broadcasters, and the production company. The contracts at issue include $11.6 million for a cooking show featuring celebrity chef Emeril Lagasse. Roberts refused to comply with the subpoenas, and two court cases focused on the contracts and the subpoenas are pending in Leon County circuit court. House Speaker Richard Corcoran and the Florida House last week again issued subpoenas demanding records about the contracts with the state tourism agency. The subpoenas gave Roberts until 5 p.m. Tuesday to turn over the records or risk $1,000-per day fines and 90 days in jail for each day he did not produce the documents. Lawyers for Roberts asked U.S. District Judge Mark Walker to block the subpoenas, saying they violated his constitutional right to due process. But on Friday, Walker said the issue wasn’t ripe because there wasn’t a “concrete controversy” before the court. “We’re not even there because there’s not an imminent threat of injury,” Walker said. PANEL WEIGHS BAN ON SUPPORT FOR RELIGIOUS GROUPS By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA
Former Florida Supreme Court Justice Raoul Cantero on Friday urged a Constitution Revision Commission panel to repeal a constitutional ban on state support for religious groups. Cantero told the commission’s Education Committee that the socalled “no-aid” provision in the Florida Constitution is unnecessary and would likely be held unconstitutional by the U.S. Supreme Court based on recent rulings. The no-aid provision, also known as the “Blaine Amendment,” dates to Florida’s 1885 Constitution and prohibits public funding “directly or indirectly” for any church, religious group or sectarian institution. Citing a U.S. Supreme Court case that overturned a Missouri decision to deny playground funding to a churchaffiliated daycare center, Cantero said Florida’s no-aid provision would also likely be rejected by the federal courts. Florida is one of 37 states with a no-aid provision. “Beyond I think the obvious unconstitutionality of the no-aid provision given the Supreme Court’s recent case, we no longer need that
provision in our Florida Constitution,” Cantero said. A possible repeal of the provision is one of dozens of issues being debated by the Constitution Revision Commission, which meets every 20 years and can put proposed constitutional amendments directly on the November ballot. The 37-member commission is expected to decide this spring which issues will go before voters. Commissioner Patricia Levesque of Tallahassee asked Cantero if the commission should press ahead with a repeal of the no-aid provision, knowing the issue could be controversial and could jeopardize other ballot proposals. A ballot initiative to repeal the noaid provision was soundly rejected by Florida voters in 2012. Cantero said he would recommend the repeal, knowing there are many public agencies that could use the provision to deny funding to religiously affiliated groups carrying out non-religious activities like health care or social work. “There’s always the danger of agencies that say, ‘Well, they (the federal courts) haven’t spoken about the Florida provision,’ ” Cantero said. “Then the state and local agencies are going to spend a lot of money to defend the indefensible.”
Cantero said the no-aid provision can be eliminated, while emphasizing the state and federal constitutions have an “establishment” clause prohibiting any laws “respecting the establishment of a religion.” “It’s much more efficient just to remove that (no-aid clause) from the Constitution, knowing that we will still have the establishment clause, and that still protects the state and its citizens from an undue intrusion of religion,” Cantero said. The no-aid repeal (Proposal 4) is sponsored by Commissioner Roberto Martinez of Miami, who has argued the provision is being used to prohibit churches and other groups from performing nonreligious activities based solely on their statuses as religious organizations. The provision has been invoked in recent years in legal fights over using publicly funded vouchers to send students to private schools. A state appellate court in 2004 cited the provision in striking down a voucher program, though the Florida Supreme Court later found the program unconstitutional on other grounds. Scott McCoy, a lawyer with the Southern Poverty Law Center, urged members of the Constitution Revision Commission to reject the proposal,
saying he disagreed with Cantero’s analysis that the Missouri ruling negates Florida’s no-aid provision. He said Florida’s no-aid provision has been upheld by state courts and is similar to provisions used by the majority of states “ensuring that state law similarly limits direct government and taxpayer funding of religion.” “Florida should retain its long-standing commitment to using public money to fund public schools and other public services and not religious institutions or programs,” McCoy said. The Education Committee did not vote on the proposal. Commissioner Marva Johnson, who chairs the panel, said she wanted to give committee members more time to analyze the proposal, along with more than a half-dozen other education measures that were debated on Friday. She said the proposals would be voted on at the next committee meeting. In a 4-3 vote, however, the Education Committee rejected a measure (Proposal 32) from Commissioner Erika Donalds of Naples that would have eliminated salaries and benefits for county school board members. Her proposal would have allowed school board members to receive a “stipend,” set by the Legislature, for their services.
OFFICIAL’S COMMENTS STIR UP OIL-DRILLING DEBATE

Despite U.S. Interior Secretary Ryan Zinke’s declaration last week that Florida wouldn’t be considered as part of a White House offshore oildrilling proposal, waters near the state’s Gulf and Atlantic coasts may continue to be under review. But that all depends on how to interpret comments from Walter Cruickshank, the acting director of the Interior Department’s Bureau of Ocean Energy Management. He told members of the U.S. House Natural Resources Committee on Friday that there has been “no formal decision yet on what’s in, or out, of the five-year program.” “We are following the process conducting a full analysis of all areas included in the draft proposed program,” Cruickshank added. Democrats quickly pounced on his statement that “no formal action” has been taken on Zinke’s announcement. Yet Cruickshank also said Zinke’s statement “stands for itself,” the secretary’s decision would be “reflected in the proposed program” and that Congress has treated Florida waters differently, noting a decades-long moratorium against oil drilling in an area of the eastern Gulf of Mexico used by the military
for air and sea training. Cruickshank had been asked why Florida was carved out of the plan, as governors and leaders of other coastal states have sought similar exemptions to the one Zinke announced after flying into Tallahassee International Airport on Jan. 9. Zinke, appearing alongside Gov. Rick Scott at the airport, said Florida coastal waters would be removed from plans to open previously protected parts of the Atlantic Ocean and eastern Gulf of Mexico to oil and gas drilling. In making the decision, Zinke praised Scott, an ally of President Donald Trump, for working with the administration. Scott hailed Zinke’s announcement, while some others questioned the quick decision and manner of announcement as an attempt by the Trump administration to further Scott’s political career. In a release Friday, the office of U.S. Sen. Bill Nelson --- a Democrat expected to be challenged for his seat later this year by Scott --- said Cruickshank’s comment confirms that Zinke’s airport announcement was a “political stunt” and not an official policy. The drilling proposal was introduced less than a week before Zinke’s trip to Tallahassee. Scott and Florida politicians from both parties voiced opposition to opening waters beyond the nation’s outer continental
shelf --- a jurisdictional term describing submerged lands 10.36 statutory miles off Florida’s west coast and 3 nautical miles off the east coast. Sierra Club Florida Director Frank Jackalone called Cruickshank’s testimony an administration “flip-flop” that should be an embarrassment for Zinke and Scott. “It also makes a mockery of the entire offshore planning process and this administration’s ability to do its job and responsibly manage America’s public lands and waters,” Jackalone said. “Zinke’s promise to take Florida ‘off the table’ was never anything more than a PR stunt to greenwash Governor Scott’s record, but Floridians won’t be fooled.” Nelson has filed legislation to permanently ban drilling off Florida’s coasts and on Wednesday placed a “hold” on the confirmation of three Interior Department nominees, which he said would remain in place until Zinke rescinds the current draft five-year drilling plan and replaces it with a new draft that fully protects Florida’s coasts. Asked about Nelson’s legislation on Thursday, Scott said he had not seen what was being proposed, but maintained his opposition to offshore drilling. “I’ve been clear, I oppose offshore drilling,” Scott said.
Also, U.S. Rep. Brian Mast, a Republican whose Treasure Coast district has provided the strongest opposition to the rail service, tweeted the trains should be stopped while “massive safety flaws” are addressed. Brightline is ultimately planned to run from Orlando to Miami and has been fought by residents and local governments on the Treasure Coast. Brightline said in a news release that the system is “designed to prevent and protect people from incidents like those that occurred in recent days.” “Those systems functioned as intended,” the release stated. “Our focus is on expanding our efforts to educate the community about rail safety alongside our partners at Operation Lifesaver, Tri-Rail, local law enforcement, city and county officials.” Treasure Coast lawmakers have filed proposals for this legislative session that would lead to the state Department of Transportation having oversight of passenger-rail issues not preempted by federal law. The measures also would require private passengerrail operations to cover the costs of installing and maintaining safety technology at crossings unless contracts are reached with local governments. Brightline has questioned the constitutionality of legislation that targets a private company and private property rights and contends the measures are designed to stop the service. During the 2017 session, a similar House proposal
failed to get through committees, and this year’s version, sponsored by Rep. Erin Grall, R-Vero Beach, and Rep. MaryLynn Magar, R-Tequesta, has not been scheduled to appear before a committee. Asked if transit like Brightline will make the state more competitive, Corcoran first said autonomous vehicles would be more economical. “But that’s a private enterprise,” he continued, pivoting to the passenger rail service. “If private enterprise thinks they can make money having a train that runs from Miami to Orlando, then have at it,” Corcoran said. “That’s their decision. And whether they succeed or fail is up to the marketplace.” The Senate version (SB 572), filed by Rockledge Republican Debbie Mayfield, has drawn support from one committee and is scheduled to appear Tuesday as a workshop item at the Community Affairs Committee. Mayfield has urged passage of her bill following the death Wednesday of a man in Boynton Beach who was hit by one of the new trains while bicycling across the tracks. Less than a week earlier, a woman was hit while crossing the tracks ahead of a train as the service was showing its service to reporters and others. “Two deaths in six days is two too many,” Mayfield tweeted. “These senseless deaths only confirm the need for the legislature to pass #SB572 in order to put protections and safety measures in place to protect Floridians.”
CORCORAN SAYS LAWMAKERS WILL LOOK AT RAIL ISSUES By JIM TURNER THE NEWS SERVICE OF FLORIDA
House Speaker Richard Corcoran said a push by some lawmakers for state oversight of high-speed passenger rail will get consideration during this year’s legislative session. But he offered little detail, as opponents want to put the brakes on a controversial new rail service in South Florida following a second recent death on the tracks. Corcoran, R-Land O’ Lakes, said Thursday in an interview with The News Service of Florida that a rail proposal (HB 525) will “have movement” this year. But he also spoke about the rights of the private All Aboard Florida and its Brightline rail service, which has started running between West Palm Beach and Fort Lauderdale. “It’s important, and we’ll keep following it and looking at it,” Corcoran said. Corcoran’s comments came as U.S. Sen. Bill Nelson asked U.S. Transportation Secretary Elaine Chao on Thursday to investigate two fatalities in the past week --- both in Boynton Beach --- involving Brightline trains. “While these investigations are ongoing, I urge you to examine these incidents and to review the safety of rail crossings, particularly for higher speed trains,” Nelson wrote in a letter.

A federal appeals court Monday rejected a bid by former Congresswoman Corrine Brown to stay out of prison while she appeals a conviction on charges related to a charity scam. The 11th U.S. Circuit Court of Appeals issued a one-sentence order denying Brown’s motion to remain free during the appeal.
The motion came after U.S. District Judge Timothy Corrigan in December ordered Brown to report to prison Jan. 29 to start serving a five-year sentence. Brown, a former 12-term Democratic congresswoman who represented a district that sprawled from Jacksonville to Orlando, was convicted in May on 18 felony counts related to her role in using contributions to the One Door for Education charity for personal expenses and events.
