COME ONE, COME ALL

BARE HAND COLLECTIVE CREATES NEW SPACE FOR COMMMUNITY BY HANA FRENETTE A mile north of downtown on Palafox Street is a large, white, unassuming warehouse. No sign hangs out front, yet cars are in and out of the lot regularly, with people coming and going through the large warehouse doors. The space is known as Bare Hand Collective and serves as the newest artist collective and studio space in Pensacola. The space has been open less than a year and is already home to some of Pensacola’s favorite creators. The cofounders of the space, Caitlyn Cooney and Jeff Bere, have big plans for utilizing the space to foster a community of creativity, entrepreneurial thinking, relationships, collaborations, and educational opportunities. Caitlyn Cooney spoke with Pensacola Magazine about this growing venture and the new path Bare Hand hopes to forge for the community. Tell me about when and how Bare Hand Collective began? Who founded it, where it’s located, when it’s first event or opening was etc. CC: On a conceptual level, Bare Hand started around June of 2017. Jeff Bere and I had been talking about both needing a space to work out of, and it initially grew from that need on both our ends to incorporating a fully functional coworking space and creative destination for Pensacola. Jeff owns it and I manage it, so I guess you could say he’s really the founder but I’ve been there collaboratively every step of the way. It’s located at 2370 North Palafox in the Longhollow neighborhood. Our grand opening was August 25th, and from that day forward it’s been nonstop. What was the motivation/inspiration for starting new venture? CC: Jeff and I commiserated over the shared need for a professional studio and workshop space for our businesses. After he and I had agreed to go in on a space together, I asked if he was interested in education, if we could hold classes together, etc. Once word got out in our friend group that this was happening, several other creatives (our core artists) asked if there was room for them, so the concept grew to include a fine art component, a co-working office area, and continues to expand every day. Our members can all relate on the notion that working alone isn’t nearly as fun or inspiring or productive has having artists around you that you respect, so that was a need we all shared. Tell me a little bit about you and Jeff—what your backgrounds are, your passions, your vision for the space etc. CC: My background in printmaking started in high school where I studied under an amazing print teacher – I went to a performing arts school in Jacksonville. In college, I continued my education in printmaking and added an art history degree, which is where I really got into the nitty gritty of the history of letterpress. Once I graduated I went on to work with Hatch Show Print in Nashville, the oldest letterpress in the country, and they inspired me to start my own thing in Pensacola. I’m most passionate about the educational facet of Bare Hand because I feel that without a mentor like the one I had, letterpress would have faded into history by now. I want

to keep the idea and practice of fine craftsmanship in the forefront of our community, and an opportunity to educate and inspire people is what I look forward to the most. Jeff has been in creative fields since he was 16 – music, art, wood, anything you can think of, along with the rest of his friends. He looked at Bare Hand as an opportunity to foster that creativity he saw among his own community and wanted to give everything he had to see it thrive. As he and I sat down and considered the collective as an idea and started putting down the key roots of how this would work, we agreed that our main goal above all else was to facilitate our artists visions, creativity, and make their voices heard. Jeff ’s passion is really to see everyone we know be the best they can be and see Bare Hand be the place they grow and become better. He wants everyone to be successful whether they’re affiliated with us or not, because if others are successful then we are as well. We want to see the artists and makers of our community really grow and become a unity that supports and inspires one another, and that’s why we do what we do. How big is the warehouse and how many spaces are available for artists? Will more spaces be made available at a later time? CC: At this moment, we are occupying the front most portion of the property, which is around 10,000 square feet total. Jeff ’s woodshop occupies around 7,000 sqft., while the artist studios occupy the remainder. There are 6 private studios at around 100 sqft. each, a 200 sqft. “flex art” space for artists to work on large pieces or to allow transitional artists to have a home base for days or weeks at a time. It also includes the Charlotte Mason Letterpress studio, the Workweek Silkscreen Studio, and a practice space for Faux/ Fox, a local band. Our mission is to eventually acquire the entire property, which is around 50,000 sqft. total, which would allow us to expand our programming, businesses, memberships, etc. What is your mission/vision for the space? What would you like to see it grow into? CC: Ultimately, we want this to be a destination where people can patronize local small businesses and become more involved with the Makers community of Pensacola. We are currently taking the first steps to become a non-profit organization, which would allow us to expand our educational programming and community development. I want this to be a place that people come because they love the collection of businesses we house, surely, but also because they know by supporting us, they’re supporting the growth of Pensacola. Tell me about how the artist memberships works. CC: Thus far we have our core artist members who all rent space from us. They’re here daily and work on projects together in a less formal or directed way. In 2018 we are expanding that to include other satellite businesses who may not need or want to rent space within the Bare Hand warehouse. They would enjoy the same benefits of an artist network to collaborate with, discounted event entry or featured spots at Bare Hand

events to sell or showcase their works, discounted services between one another such as marketing and handmade goods, be included in educational programming as attendees or instructors if desired, be eligible for non-profit funds for projects, etc. What are your upcoming plans for the space in 2018? Events? Educational opportunities? Maker’s Market? CC: All of the above! We have several events and gallery showings we’re planning right now for early 2018. We’re also expanding our memberships to include families or individuals that want to be a part of our programming and support our makers. We’ve also been speaking with members of the community that want to start a distillery, a brewery, a motorcycle/bicycle shop, expanding to include a music component, and more. Maker fairs are definitely on the agenda, as well as structured classes within the letterpress and art studios. We’ve been working on a lot behind the scenes and 2018 is going to be a blast. The space hasn’t been open long and already seems to have a lot of support from the local art community—what is it about this space that you think appeals to so many artists and community members? Why did Pensacola need this space? CC: We have the perfect mix of artists right now who are inclusive and talented, and even their increase in production and exposure seems to have enticed quite a few people. I think we market this more as a family you can become a part of, we all want the other members to succeed, to be part of that success, and support them professionally and personally in every way we can. Also to become involved with something early takes guts, which I respect our initial members for taking the leap with us, but it also takes time and effort and ideas, so for them, it’s not just about having a cool studio with cool people, it’s also about being a part of something bigger for Pensacola. We aim to be a community hub for creatives, and there’s a ton of talent in Pensacola that hasn’t discovered one another. That’s where I see us being the catalyst for those introductions, interactions, and inspiring connections.

Panhandle Fruit and Vegetable Conference Planned for Feb. 19 and 20

First Pensacola Meeting Partnering with Solar United Neighbors of Florida

The UF/IFAS Small Farms and Alternative Enterprises Extension team is proud to present the Panhandle Fruit and Vegetable Conference on Monday, Feb. 19 and Tuesday, Feb. 20 at the University of West Florida, located at 11000 University Parkway. This will be the second installment of the conference, which was created by a team of UF/IFAS Small Farms and Alternative Enterprises Extension Agents and occurs every 18 months. This event will provide a great networking space and share practical farming knowledge that can help farmers across the region. “Our event will feature leading experts in fruit and vegetable production, hands-on learning and an educational farm tour,” said Matt Lollar, horticulture agent for the UF/IFAS Jackson County Extension, and one of the event organizers. The conference sessions will focus on six main tracks: marketing/business, food safety, fruits and nuts, North Florida citrus, protected agriculture, and vegetable production. The conference keynote speaker will be Joy Rumble, Ph.D., from the University of Florida’s Department of Agricultural Education and Communication. Rumble’s talk entitled “What’s Your Story? Closing the Farm to Table Gap Through Storytelling,” focuses on strengthening your farm’s marketing plan. Her research focus is effective

Pensacola League of Women Voters has joined a statewide initiative to make the Sunshine State a Solar State, working with League of Women Voters of Florida and Solar United Neighbors of Florida, which partnered over a year ago to foster solar co-ops, so far numbering 11 across the state. SUN of Florida’s partnership plan “expands access to solar by educating Floridians about the benefits of distributed solar energy, helping them organize group solar installations and strengthening Florida’s solar policies

She is a key contributor to the initiatives of the UF/IFAS Center for Public Issues Education in Agriculture and Natural Resources. Registration includes refreshments, lunch, farm tour supper, educational materials and transportation to farm tour sites. Full conference registration also includes a pre-conference tour. On Monday, Feb. 19, from 1 p.m. to 8 p.m., registered attendees can take an additional tour to explore the many aspects of Southeast fruit and vegetable production. The pre-conference tour will travel from UWF to family-owned Sirmon Farms in Daphne, Ala.; then to Allegri Farm Market, also in Daphne; and the tour will conclude at the Gulf Coast Research and Extension Center in Fairhope, Ala. with supper at the center. Great Minds Distinguished Lecture Series Explores Solar Fuels in Inaugural Event

UWF Department of Music presents Dr. Leonid Yanovskiy, Violin in Concert

The University of West Florida Hal Marcus College of Science and Engineering will launch its 2018 Great Minds Distinguished Lecture Series on Jan. 18 with Dr. Nathan Lewis of California Institute of Technology presenting a public lecture, “Where in the World Will Our Energy Come From?” with a reception at 5:30 p.m. and the lecture from 6 to 7 p.m. at the Museum of Commerce in Historic Pensacola. On Jan. 19 at noon, Lewis will present, “Artificial Photosynthesis: Direct Production of Fuels from Sunlight,” a scientific lecture at UWF in Building 58A, Room 105. Both events are free and open to the public. Lewis has been active in the solar fuels/solar chemical field for over 40 years. He has published over 500 papers, presented hundreds of public and technical plenary and invited lectures and is responsible for training a preeminent cohort of globally leading researchers in the solar fuels field. Lewis’s work has been the subject of media coverage by ABC News, National Public Radio and Scientific American. He continues to contribute to the discussion of how to meet current and future energy needs and has been cited by thought-leaders, including Bill

The University of West Florida Department of Music will present Dr. Leonid Yanovskiy, professor and director of strings and orchestra in concert on Monday, Jan. 29 at 7:30 p.m. The performance will be held in the Music Hall of the Center for Fine and Performing Arts, Building 82. Yanovskiy, violin, will perform works by Beethoven, Schubert and Brahms. Bolton Ellenberg will accompany on the piano. Yanovskiy is an acclaimed violinist, violist and conductor who has captivated audiences around the world with his luminous and energetic performances. He is the concertmaster of the Pensacola and Northwest Florida Symphony Orchestras, principal violinist with the Washington Square Festival, NYC, and co-director of the “Gulf Coast Virtuosi” Chamber Music Ensemble. Throughout his career, he has performed on the stages of Lincoln Center, Carnegie Hall, Chicago Orchestra,

Gates and Thomas Friedman. Lewis is a distinguished advisor to industry, government, academia, and national and international media the role of research and development in clean energy innovation. Lewis earned bachelor and master’s degrees in chemistry from the California Institute of Technology. In 1981, he obtained a doctorate in inorganic chemistry from the Massachusetts Institute of Technology after working under the supervision of professor Mark S. Wrighton in 1981. Lewis then began as an assistant professor at Stanford University and was promoted to associate professor in 1986. In 1988, Lewis returned to Caltech where he is currently the George L. Argyros Professor of Chemistry. The 2018 HMCSE Great Minds Distinguished Lecture Series will continue with additional presentations from Dr. Jyotika Virmani of the Shell Ocean Discovery X-Prize, Feb. 15-16, and speakers, James Rea and Lydia FrancoHodges, from the Alan Alda Center for Communicating Science, March 8. The Art Gallery at UWF presents “Points of Departure, a Foundation-level Student Art Exhibition” The Art Gallery at the University of West Florida presents “Points of Departure, a Foundation-level Student Art Exhibition” from Jan. 8-25. A reception will take place on Thursday, Jan. 25 from noon to 3 p.m. TAG is located in the Center for Fine and Performing Arts, Building 82. The objective of the exhibition is to showcase the challenges and successes introductory level art students encounter in drawing, ceramics, painting, photography, digital art and graphic design. These foundation courses are a crucial component of the program and form the cornerstone to a successful art-making practice. The works created in these

classes are presented in a raw, studiolike format to engage students, faculty and the greater Northwest Florida community through a variety of media and expression. Before coming to UWF in 2000, Dr. Yanovskiy taught at the Moscow Gnessin Academy of Music. He was principal violinist with the Moscow Chamber Orchestra Northern Crown, Goliard Chamber Ensemble and Philadelphia Virtuosi Chamber Orchestra. He was also a violinist with the Orchestra of St. Luke’s and the American Symphony. Dr. Yanovskiy received degrees from the Moscow Gnessin Academy of Music in Russia, studied at the American Conservatoire at Fontenbleau in France and earned a doctorate in musical arts from Rutgers University. PSC Performer Named November Theatre Student of the Month

Since Carley Lambert was a young child, the Pensacola State College theatre major has been right at home dancing, singing and now acting in front of an audience. That natural ability and love of the stage recently paid off when Lambert was selected the Florida College System Activities Association Theatre Division Student of the Month for November. Lambert was nominated by PSC Professor Rodney Whatley. “Carley recently finished performing a major dance role in our fall production of ‘The Addams Family’ musical. She played the Stewardess Ancestory, which we designed as being the leading member of the group of ancestors in the play,” he said. “In addition to her outstanding performance, she served as the dance captain. She often led physical warm-ups, she ran numbers in alternative spaces while the choreographer and director utilized the stage, and she made sure that any cast member who had missed rehearsal and needed to be taught steps got caught up quickly and efficiently.” Lambert did not even know she had been nominated but was still grateful to Whatley. “I found out on Dec. 4 when I was notified that I had been selected. Dr. Whatley messaged me and told me,” she remembered. “I was so excited ─ it is nice to

be recognized for the work that I’ve been doing. And it will be a great addition to my performance resume.” Lambert, 20, attributes much of her success to PSC Professor LaVonne French and the college’s Summer Dance Workshop. “I attended dance workshops for seven years and Professor French was one of the reasons I enrolled in PSC. I was looking forward to taking classes from her,” she said. A 2015 graduate of Pace Victory Performing Arts Center, Lambert added the accolade was especially rewarding because she’s not a “huge school person.” “College has been an uphill battle for me ─ a challenge but I’ve found so much support here at Pensacola State,” said Lambert who also credits her parents, Lance and Lidia Lambert; brother, Connor; and fiancé, Cruze Angeles, with being very supportive. The sophomore eventually wants to become a stage performer at Walt Disney World. Right now, she teaches at Time to Shine dance studio. “I’m a dancer first, and have been dancing for 17 years. I’ve just recently starting acting and singing but I really love being involved with anything on the stage. It is so fulfilling to witness the joy a performance brings to the audience,” she added.

State agencies spent $680.2 million after Hurricane Irma, with county government costs exceeding $1 billion, according to a draft of a report by the House Select Committee on Hurricane Response and Preparedness. And while the state expects the Federal Emergency Management Agency to cover most of the costs, the numbers --- separate from $2.49 billion spent by federal agencies in Florida --- will continue to grow, as the figures reported by the committee are more than a month old. “Even now Hurricane Irma’s full damage to our state’s economy and industries is still being assessed, but initial estimates are concerning,” the draft report released Friday said. “In addition to emergency response costs, initial recovery costs were incurred for debris removal, temporary housing, food assistance, and other expenses. Although many of these costs are covered at least in part by federal assistance, state and local governments must bear some of the burden.” The report was released before the committee was slated to meet Tuesday to consider 77 recommendations about the state’s response to Irma and the influx of people from Puerto Rico because of Hurricane Maria and how to prepare for future storms. Recommendations range from extending the Suncoast Parkway along the Gulf Coast as another northern evacuation route and setting up petroleum distribution centers throughout the state to imposing timelines to stop tree trimming and trash collection before storms so waste- management employees can prepare trucks and landfills.

Proposals advanced from the select committee will be go to other panels as lawmakers craft bills and the state budget during the legislative session that started last week. The report said Florida is working to receive a storm designation from FEMA that would include a 90 percent federal cost share. The state is expected to be responsible for at least $115 million of the local-government costs and 25 percent of what are known as “other needs assistance” payments, which include such things as medical expenses and funeral costs. Those payments are projected to be about $274 million, with the state’s share at least $68 million. Federal “reimbursements for preparation and response efforts will be processed faster than reimbursements for recovery efforts such as longerterm infrastructure projects,” the report noted. The report said long-term damage from the storm includes the loss of affordable housing in the Florida Keys, damage to wastewater and potable water infrastructure and severe erosion of large stretches of Florida’s coastline. The report said the insurance industry faced $6.55 billion in property damages claims. The Office of Insurance Regulation on Jan. 5 upped that figure to $7.2 billion. The agriculture industry, which has been seeking a federal disaster-relief package, faces $2.5 billion in losses. Hurricane Irma made landfall Sept. 10 in Monroe and Collier counties and pounded the state as it moved north. The storm created 18 tornadoes across the peninsula, caused at least 32 rivers and creeks to

flood, and left 84 dead. The most shocking loss of life occurred at a Broward County nursing home, The Rehabilitation Center at Hollywood Hills, which was evacuated Sept. 13, three days after Irma knocked out its air-conditioning system. Eventually, the medical examiner ruled 12 deaths to be homicides due to heat exposure. Power was knocked out to more than 64 percent of the state. The Federal Communications Commission reported that on Sept. 12, 82 percent of the cell towers in Monroe County, 73 percent in Collier County and 78 percent in Hendry County weren’t working. About 50 percent of cell towers were not functioning in another six counties, including Lee and Miami-Dade counties. Evacuation orders were issued in 54 of the state’s 67 counties, as the storm’s projected track changed. A record 6.5 million people evacuated, which forced the Department of Transportation to open the left shoulder for northbound traffic on Interstate 75 from the intersection of Florida’s Turnpike in Wildwood to the Georgia state line starting Sept. 8 and on Interstate 4 from Tampa to State Road 429 near Celebration for a few hours on Sept. 9. The report acknowledged that even with the new technique, established before the start of the 2017 hurricane season, traffic congestion was found across northbound Interstate 95, the Turnpike and Interstate 75. After the storm, the State Emergency Response Team distributed more than 6.7 million meals and 10.7 million liters of water, as well as over 71,000 tarps and 13,000 cots. Nearly 700 shelters opened, housing 191,764 people at the peak of the storm.

had no appetite for reducing how much hospitals and ambulatory surgical centers could bill for caring for injured patients. It’s not clear that any progress has been made since last year. Negron this week stressed that any proposal his chamber considers would have to treat everyone in the system --- including injured workers, attorneys and insurance companies --- fairly. “There are a number of different parties involved in the workers’ compensation system, obviously,” Negron, R-Stuart, said. “We want to make sure workers who are injured are treated fairly. We also want the rates to be reasonable and we want the insurance company side to be run fairly.” National Federation of Independent Business Florida Executive Director Bill Herrle, who has been pushing the Legislature to address workers’ compensation for more than a year, said the lack of a Senate bill isn’t worrisome. “If some senators want to do workers’ comp, then not having a bill filed yet isn’t much of an obstacle,” he said. Workers’ compensation is a no-fault system meant to protect workers and employers. It is supposed to provide workers who are injured on the job access to medical benefits they need to be made whole. Those who are injured for at least eight days also are entitled to indemnity benefits, or lost wages. In exchange for providing those benefits, employers generally cannot be sued in court for causing injuries. While the system is supposed to be self-executing, injured workers hire attorneys when there are disputes over the amounts of benefits they should receive. Florida businesses faced some of the highest workers’ compensation costs in the country in the early 2000s. Business interests blamed attorney involvement --- legal fees in the aggregate totaled $427 million in fiscal year 2002-2003 --- for the high costs. The Legislature responded by passing a sweeping rewrite of the workers’ compensation system in

2003 that, among other things, tied the recovery of plaintiff attorneys’ fees to percentages of the amount of recovered benefits. The law was tweaked in 2009 to make clear that workers’ compensation judges were precluded from awarding additional hourly fees for plaintiffs’ attorneys. But in a 2016 decision in a case known as Castellanos v. Next Door Company, the Florida Supreme Court ruled that the restrictive fee caps violated injured workers’ due process rights. The court authorized judges to award fees outside the fee schedule if adhering to it yielded unreasonable results. Since the ruling, Florida business interests such as NFIB Florida have pushed state lawmakers to pass legislation limiting the amount plaintiffs’ attorneys can charge, warning that rates would skyrocket if nothing was done. The Legislature didn’t pass a bill last year and Florida Insurance Commissioner David Altmaier in November approved a final order lowering premiums by nearly 10 percent. Florida Workers Advocate, a group that represents workers’ compensation plaintiffs attorneys, issued a statement following Friday’s House vote saying the bill will ultimately hurt business “by delaying and denying the care their injured workers receive.” Negron says it’s important to keep attorney fees down and notes that insurance companies spend more money to defend claims than injured workers spend on lawyers. A recent report from the Judge of Compensation Claims shows that legal fees in the workers compensation system totaled nearly $440 million during the 2016-2017 fiscal year. The majority --nearly $254 million --- was spent challenging workers’ compensation claims. “When I talk to employers they don’t care if it’s plaintiffs’ fees or defense fees,” Negron said. “They only want to pay attorneys fees that are necessary in the system. We want them to be as low as possible across the board.”

RATES ARE DOWN BUT LEADERS ARE UP ON WORKERS’ COMP CHANGES

Workers’ compensation rates have been reduced by nearly 10 percent this year but state legislative leaders said this week they want to make some changes to the system designed to help injured workers return to their jobs. Florida House Speaker Richard Corcoran fasttracked the House’s workers’ compensation bill (HB 7009), passed by the chamber by a 74-30 vote on Friday. And Senate President Joe Negron said this week that some of his members are anxious to pass something this session even though there is no Senate companion for the House plan. Other workers’ compensation bills have been filed in the Senate, however. For instance, one measure (SB 376) would extend workers’ compensation benefits to first responders who suffer from post-traumatic stress disorder as a result of trauma they experience on the job. Corcoran told The News Service of Florida in an interview Wednesday that the high costs of healthcare in Florida’s workers’ compensation system need to be addressed. “I think that the problem is largely the hospitals who want a reimbursement rate that’s the highest in the southeast region,” Corcoran, R-Land O’ Lakes, said. “That our problem.” Among other things, the House measure caps the fees hospital outpatient centers can charge for unscheduled care at 200 percent of what Medicare would pay for the procedure. For surgeries that can be scheduled in advance, either at a hospital or at an ambulatory surgical center, the bill limits charges to 160 percent of what Medicare would pay for the procedure. Currently, providers are allowed to bill the workers’ compensation carrier a percentage of their billed charges. The proposal passed Friday mirrors the position the Florida House took last year, but the Florida Senate

CITRUS INDUSTRY REMAINS ‘IN CRISIS’ DESPITE STABLE FORECAST

Forecast numbers for Florida’s struggling citrus industry held steady from December to January, the first month since Hurricane Irma that the figures didn’t drop. The U.S. Department of Agriculture estimated Friday that Florida will grow enough oranges to fill 46 million 90-pound boxes, the same as in December. Meanwhile, grapefruit production held at 4.65 million boxes for the third consecutive month. While the month-to-month numbers showed some stability, Florida Department of Citrus Executive Director Shannon Shepp said the industry --- which, according to private estimates, was looking forward to producing enough oranges to fill 75 million boxes --- is still facing the impacts from the September storm. “Florida continues to face its lowest citrus forecast in more than 75 years,” Shepp said. “While the temporary comfort of a stable forecast gives us a moment to breathe it doesn’t hide the fact that this industry remains in crisis due to the impact of Hurricane Irma.” The seasonal forecast for oranges had fallen 15 percent since October’s initial estimate, following the September hurricane that uprooted trees and left many groves in standing water for up to three weeks.

The storm came as the industry continued a decadelong battle against citrus greening disease, which is deadly to the fruit. The January forecast stands 33 percent below production from the prior growing season, with Florida’s growers on pace for the lowest harvest since 1945. Growers are projected to produce enough Valencia oranges to fill about 27 million boxes, while the nonValencia variety is expected to fill about 19 million boxes, according to Friday’s estimate. Navel orange production accounted for 500,000 of the non-Valencia boxes. Florida growers had annually filled more than 100 million boxes of citrus since 1950, with production topping 200 million boxes most years between 1971 and 2005. In contrast, growers produced 68,750 boxes of oranges during the 2016-2017 season. Florida Agriculture Commissioner Adam Putnam’s department estimated in October that the citrus industry took a $761 million hit from Hurricane Irma. Since then, a number of lawmakers and Putnam said the damage estimate has grown to possibly more than $1 billion, as fruit continued to fall in flooded groves. Among the 77 recommendations that will go before the Florida House Committee on Hurricane Response

and Preparedness on Tuesday are proposals to create sales tax exemptions for the agricultural industry and for the state to continue lobbying for post-disaster funding from Congress. The U.S. Senate is considering $2.6 billion in federal relief for Florida’s agriculture industry. The budget item is part of an $81 billion disaster-relief package the House approved Dec. 21. Putnam has said that Florida’s agriculture industry cannot fully recover “without the emergency assistance.” In addition to the citrus losses, Putnam’s office estimated that Irma inflicted $624 million in damage to the nursery industry, $237.5 million in damage to the cattle industry, $11.8 million in damage to dairy farmers, $383 million in damage to the sugar industry, and $180 million in damage to vegetable and noncitrus fruit growers. Florida U.S. Sens. Marco Rubio and Bill Nelson have asked Senate Majority Leader Mitch McConnell and Senate Minority Leader Charles Schumer to bring the disaster relief package for Florida, Puerto Rico and Texas to the floor for a vote. “Congress has delayed providing this aid for too long while our communities face the consequences of our inaction,” the Florida lawmakers wrote.

PANEL KILLS CONTROVERSIAL ENVIRONMENTAL PROPOSAL

After drawing widespread opposition from business and agriculture groups, a proposal to redefine legal standing for Floridians on environmental issues won’t go before voters in November. The Judicial Committee of the Florida Constitution Revision Commission on Friday unanimously rejected the proposal (P 23), filed by commission member Jacqui Thurlow-Lippisch, with opponents saying it was too broad. Thurlow-Lippisch, a former mayor of Sewall’s Point, acknowledge after the meeting that while the proposal may be “a little extreme,” she will continue to work on improving it as a citizens’ initiative. Under the proposal, “any person” would have a right to clean air and water, which includes the ability to “enforce this right against any party, public or private, subject to reasonable limitations, as provided by law.” The “any person” language is what raised hackles of critics. Commissioner Tom Lee, a Republican state senator from Thonotosassa, described the proposal as “a radical departure from a balance of rights that exists currently in our Constitution.” “If I saw a way, in the four corners of this proposal, to adjust it in such (a way) that the commissioner could get to conceptually where she was trying to move the needle without creating an explosion of litigation in our state, in upturning rights that currently exist as vested in the jurisprudence in our procedural law, I would try to find a way to help you out here,” Lee said. “I just can’t get there.” Currently, people must show they are “substantially” affected to challenge state permits.

Former state Sen. Arthenia Joyner, an attorney and commission member from Tampa, encouraged Thurlow-Lippisch to keep working on the proposal, which was inspired by students from the Treasure Coast. “If there was a way that we could carve language out that would actually have some standards that could be measurable, and it would not be open to anyone’s definitions and standards, that’s the challenge,” Joyner, a former Senate Democratic leader, said. “I strongly believe that the citizens of the state of Florida need a more effective tool to safeguard our state’s beauty and our natural resources, but I don’t want to give anybody an open to ticket to sue,” Joyner continued. “There is enough litigation in the state that is unnecessary.” Thurlow-Lippisch said she hopes the students who first proposed the idea won’t give up on the idea. “Sometimes you have to make extreme changes to have considerable benefits,” she said. Thurlow-Lippisch was appointed to the 37-member commission by Senate President Joe Negron, R-Stuart. The Constitution Revision Commission meets every 20 years and can place proposed constitutional amendments directly on the 2018 ballot. Committees have been looking at dozens of proposals. Senate Agriculture Chairwoman Denise Grimsley, a Sebring Republican running this year for agriculture commissioner, and former Department of Environmental Protection Secretary Herschel Vinyard became the latest voices to oppose the proposal this week. Grimsley, in a letter Thursday to Judicial Committee Chairman Bill Schifino, argued that the proposal “strikes at the heart of Florida farming and ranching

communities” and would “unleash a no-holds-barred wave of interventionism and frivolous lawsuits that I know my own farming operation would be unable to fend off.” Vinyard equated the proposal to “feel good” constitutional amendments in the past that have addressed issues such as pigs and high-speed trains and contended environmental-restoration efforts could be jeopardized by the proposed amendment. “This proposed amendment gives a disgruntled homeowner not wanting to give up his or her septic tank another litigation avenue to block a new wastewater treatment system,” Vinyard wrote. Thurlow-Lippisch has said she filed the proposal because the Constitution might appear friendly to the environment but often offers contradictory language that nullifies preservation efforts. She noted on her blog that the proposal has raised environmental awareness and made the business and government community “look desperate to hold on to Florida’s ‘standard environmental operating procedure’ that puts corporations and development before people. After the meeting, Brewster Bevis, senior vice president of state and federal affairs for Associated Industries of Florida, commended the committee for stopping an “unnecessary proposal” that would have exposed “not only Florida businesses, but private citizens as well, to endless litigation and harmful uncertainty.” “With the Judicial Committee’s vote today, Florida’s comprehensive, thoughtfully crafted environmental policy will remain intact, continuing to protect the rights of Floridians and provide much-needed regulatory certainty and stability for businesses moving forward,” Bevis said.

HOUSE PASSES PLAN TO BAR ‘SANCTUARY CITIES’

With reported comments by President Donald Trump inflaming an already-raw immigration debate, the deeply divided Florida House on Friday passed a proposal to ban “sanctuary cities’ in the state. The 71-35 vote by the Republican-dominated House came after two days of debate, with GOP supporters pointing to a need to uphold the “rule of law” and Democratic critics contending the bill (HB 9) is unconstitutional and could lead to racial profiling. The debate took on another element Friday, after widespread reports that Trump questioned why the United States should accept immigrants from “s--hole countries” like Haiti, El Salvador and countries in Africa. House Democrats linked the sanctuary-city bill to Trump and his reported comments. “HB 9 is President Trump’s immigration policy wrapped up into one bill, without a wall and without a Muslim ban,” said Rep. Carlos Guillermo Smith, D-Orlando. Republicans, however, repeatedly returned to the idea that Florida should uphold the rule of law and drew a distinction between legal immigration and illegal immigration. Rep. Byron Donalds, R-Naples, said Trump’s statements were “out of bounds,” but he said the bill is about following federal immigration law.

“The one thing that must remain consistent is the rule of law,” Donalds said. Trump’s reported comment caused such an uproar that House Republican and Democratic leaders issued a rare joint statement condemning it. “If the remarks attributed to President Trump are accurate, they have no place in our public discourse,” the statement said. “America’s greatness is selfevident, we do not need to tear down other nations. The leadership of the Florida House celebrates our diversity.” In an early morning tweet Friday, Trump denied making the remarks but did not specify what he said at the meeting centered on Deferred Action for Childhood Arrivals, or DACA, the Obama-era policy that focused on children who are brought into the U.S. illegally by their parents or guardians. “The language used by me at the DACA meeting was tough, but this was not the language used. What was really tough was the outlandish proposal made - a big setback for DACA!” Trump tweeted. The House bill passed Friday would require local governments and universities to comply with federal immigration laws and would impose stiff penalties on those that declare themselves sanctuaries from immigration enforcement. Under the measure --- dubbed the “Rule of Law Adherence Act” --- state or local governmental entities or law enforcement agencies would be fined

up to $5,000 for each day they are deemed out of compliance. The bill would require complying with U.S. Immigration and Customs Enforcement detention requests and repealing current sanctuary policies. House Speaker Richard Corcoran, R-Land O’ Lakes, has made the issue one of his priorities of the 2018 legislative session, which started Tuesday. But even with passage by the House, it remains questionable whether the bill will get through the Senate, which has refused to go along with similar proposals in recent years. “No one is above the law, and now if a politician or government official tries to ignore America’s immigration laws, they will be punished,” Corcoran said in a statement after Friday’s vote. The bill, however, drew impassioned debate Thursday and Friday on the House floor. Democrats, in part, contended that Republican were using the bill as a political ploy to fire up the GOP base in an election year. “The world is watching,” Rep. Al Jacquet, D-Lantana, said. “They are watching us. Do we embrace diversity, or do we just embrace some and not others?” But Rep. Jay Fant, a Jacksonville Republican who is running for attorney general, said lawmakers swore an oath to uphold the state and federal constitutions. “Do your duty. Uphold the rule of law, and eliminate sanctuary cities in Florida,” Fant said.
