The annual Dragon Boat Festival Will benefit the Gulf coast kid’s house by heidi TRavis

Derived from the Duanwu Festival in China, which occurs on the fifth day of the fifth month of the traditional Chinese calendar, Pensacola’s Annual Dragon Boat Festival puts a local spin on the whole spectacle. The all-day festival, which takes place September 9 at Bayou Texar, includes music, food, and children’s games, but most of the excitement will come from the main event—the dragon boat race!

The dragon boats, 40-foot long canoes fashioned with elaborate dragon mastheads, are the stars of the show.The race pits over 40 teams of 20 oarsmen and women against each other in a heated contest set to the beat of their own drums—literally. Each crew includes a drummer, pounding out a rhythm to which the team will stroke their way to the finish line. Training for this event is intense and takes place over several months. Synchronization is the key to success—that, and more than a little elbow grease. The team that can work together to keep pace to the rhythm of the drum and cut the 300 meters across Bayou Texar first is the winner. But it isn’t all just fun and games. The Dragon Boat Festival is organized by Northwest Pensacola SERTOMA, a non-profit international organization of businesses and professionals working towards community improvement. They raise money through events like

these for community service projects. Once again, the profits of the event this year will go towards the Gulf Coast Kid’s House, a nonprofit organization that provides support to victims of child abuse. As an advocacy center, Gulf Coast Kid’s House provides a safe-haven for children of abuse while also providing the professional resources needed for investigating and prosecuting cases of child abuse. The organization also provides access to mental health counseling for the families they serve. Last year, SERTOMA raised over $30,000 for the Gulf Coast Kid’s House through this event. Stacey Kostevicki, Executive director of Gulf Coast Kid’s House is very enthusiastic about the upcoming event. She sees not only as a way to help her organization, but also as an event that enriches the local community through team work and a little friendly competition. “The Dragon Boat Festival is a really fun way to pull the com-

munity together for a competitive day on the water. The SERTOMA group just has a way of getting things done. With their brains and the sweat equity from our volunteers, staff and board, it is a match made in heaven,” Kostevicki says. It’s due to the hard work of their volunteers and sponsors that this event has successfully grown over time. As the enthusiasm for this event continues to gain momentum, the hope is that more people will be drawn out in support of this cause. Currently, the goal is to expand from 40 to 70 participating teams and to draw crowds of up to 10,000 spectators. Meanwhile, those already committed to the cause are always ready to try new ways to raise funds to help support organizations like Gulf Coast Kid’s House. “It has come so far in the last few years – in large part due to the community support seen from Wind Creek and other corporate sponsors,” Kostevicki says. “This year, the Northeast Pensacola SER-

TOMA is trying a team fundraising approach—we’ve seen it be successful in other races across the country.” The Dragon Boat Race holds a special place in Kostevicki’s heart for other reasons as well. “It is really meaningful to me in the sense that GCKH comes together as a team—‘Forty Arms

of Fury’—and gets to bond with the Cordova Rotary Dragonflies— who I’m a member of and who meet at GCKH, ” Kostevicki says. This year’s proceeds will go towards increased safety and security at Gulf Coast Kid’s House, so come out and give them some support! Just pick up an oar or cheer from the shore!

UWF and ECSD 2017 UWF engineering students apply Environmental Science Partnership classroom knowledge in the real Future environmental Students, each of so they had recorded world through summer internships health advocates presented their Capstone projects before a panel of local judges to wrapup an 8-week summer program held at the University of West Florida (UWF). The UWF Environmental Health Scholars is a grant-funded partnership with the Health Science programs in high schools in the Escambia County School District (ECSD). “This was our fourth year in this partnership and each year we have the pleasure of working with some amazing local high school students. They make me feel good about our environmental futures,” said Aisha Adkison, Health Science Specialist, in the ECSD Workforce Education Department. “These students dedicated 3 days a week for 8 weeks of their summer vacation to learning more about our world and a vast variety of environmental challenges. They each select a research topic and prepare a Capstone project.” The program is funded on a subcontract for over $100,000/yr for 5 years through the Gulf Region Health Outreach Program (GRHOP) administered by the Center for Gulf Coast Environmental Health Research, Leadership & Strategic Initiatives, School of Public Health & Tropical Medicine, Tulane University. The grant covers training for secondary education teachers from the region, specialized equipment and supplies for those teachers’ classrooms and the summer program for students. Selected students spend three days a week at UWF with public health faculty, Dr. Enid Sisskin and Dr. George Stewart. “Our high school students get to work with college professors who are experts in the field of environmental health, they get to be on a university campus for the summer, they learn, and they make friends. This experience helps prepare them to successfully continue their postsecondary education and training,” said Adkison.

whom receives a laptop and a variety of other incentives, spend one day working online, one day on field trips and one day working in class together with a variety of activities and learning the scientific process and hands-on procedures through competitions, games and expert speakers. They each also select a topic they want to know more about to research in depth. They earn credit for a high school level health science directed study class. Sisskin told all of this year’s class, “when it is time to work on recommendations to go with your applications to colleges I will be willing to help.” She explained later that while they have been impressed with the students every summer, this year’s group of students were standouts. Stewart commented, “I have been impressed with the intellectual caliber of the students who have enrolled in this program. They have a solid grasp of the major environmental perils the world faces and a firm commitment to investing their futures in addressing these issues.” Project topics included, the 21st Century War on Science, GMOs, pandemics, climate change, the dangerous cumulative effect of littering, storms’ effect on the ozone layer, anthrax and a look at the U.S./ Mexico border challenge from the perspective of its effect on animals. Another student took a hard look at anxiety and tied it to the other topics because, as she pointed out, how can any of us go out and fix any of these other environmental problems if anxiety keeps us trapped inside. The team of judges reviewed their presentation boards and watched the students present, most with Power Point slide shows, and asked questions about conclusions and if the topics had inspired plans for the students’ futures. Two students had to leave town,

themselves presenting. All of the judges were very impressed with the depth of the projects and the confident and professional students. Selecting the top three for special recognition was a difficult decision and the judges even asked if they could have a tie because they were so impressed. Finally, a decision was made. The results were: 1st Place: Madison Kemp, who is homeschooled and attends classes through the Florida Virtual School. Her topic was: The Effects of Man-made Climate Change on Global Health. She won a plaque and a $100 gift card to Amazon. 2nd Place: Tyra Williams, a rising senior in the Health Academy at Pensacola High School. Her topic was: How Facts Became Opinions: The 21st Century War on Science. She won a plaque and a $75 gift card. She and her younger sister, who will enter high school this year, plan to apply for next summer’s program. 3rd Place: Tyler Motts, an Environmental Science student from Pine Forest High School, who was one of the students who recorded his presentation ahead of time because he had to be out of town. His topic was: The Environmental Impact of the US - Mexico Border. He had researched how the border wall along the Texas/Mexico border has affected animals, their migration patterns and hunting grounds. He received a plaque and a $50 gift card. Statements made during the presentations started with facts, data, graphs and images. But project requirements also directed the students to reach their own conclusions, reflect on what they learned and state their opinions. One student did a great job of summarizing a conclusion shared no matter what the topic, “We need to care. Humans must take a stand, because we are our own worst enemy.”

Twenty-five electrical, computer and mechanical engineering students at the University of West Florida Hal Marcus College of Science and Engineering are participating in internships and Research Experiences for Undergraduates programs with companies and universities throughout the nation this summer. Although not required for graduation, junior and senior level students who participate can earn course credit, a competitive salary or stipend and consideration for full-time employment or graduate-level studies, according to Dr. Mohamed Khabou, chair of the Department of Electrical and Computer Engineering. “Internships provide a great opportunity for students to gain handson experience and observe how theory and topics they’ve learned in the classroom apply in the real world,” Khabou said. “The students also learn how to interact with customers and supervisors. For some of them who may be unsure of which field they want to pursue, it helps them to determine an area of specialization.” Senior Everette Petsinger is interning with Caterpillar in its Seguin, Texas engine plant. As a controls engineering intern, he said he has helped eliminate downtime in production by diagnosing a problem and then re-coding a robotic arm and computer vision system. “This internship has shown me how engineering techniques are implemented in real life, which can be quite different at times than classroom engineering,” said Petsinger. “The biggest takeaway is the need to be a self-starter and self-motivated in a new position.” Petsinger, who will graduate in December, said he has been offered a full-time position with Caterpillar contingent upon a final review of his internship performance.

“Internships provide a nice financial incentive for engineering students, with interns being paid $13 to $23 an hour,” said Khabou. “And in most cases they do lead to full-time job offers, often with hiring bonuses. Successful interns are already partially trained employees familiar with the work environment, so employers have a desire to keep them.” Engineering students who plan to pursue a graduate degree benefit from Research Experiences for Undergraduates, Khabou explained. REU is a competitive summer research program sponsored by the National Science Foundation. Students receive a stipend to spend their summer doing research with faculty in STEM fields at a host university. Five UWF students are participating in REU programs at schools nationwide this summer. “An REU is the best thing you can have on your resume to prove you are good at research,” Khabou said. Students apply for REU opportunities through a nationwide database of REU research sites or directly through the investigators who receive NSF funding for the program. Internship opportunities are advertised at UWF through JasonQuest, an online career services portal. Khabou said local companies have been pleased with the quality of students in the UWF program. “We are grateful to work with companies such as Gulf Power, Avalex and Current to offer students these opportunities,” he said. “We receive evaluations from student’s internship supervisors, and they have been appreciative of our students’ preparation.” For more information about the Hal Marcus College of Science and Engineering, visit uwf.edu.

Lakeview Center Names New Program Manager

Licensed Clinical Social Worker Dustin Perry has been appointed as the Director of a new program at Lakeview Center named STOP (State Targeted Opioid Program). The program will help people who are struggling with opioid addiction. “The program is a response to the statewide opioid crisis that Governor Rick Scott declared this spring,” said Karen McAllister, Director, Lakeview Center Behavioral Health Substance Abuse Services. ”This grant-funded program targets low income opioid users, through medication-assisted treatment using Suboxone, methadone, Vivitrol and counseling services to promote recovery. Dustin definitely has the expertise to work with our community to improve lives.” Perry is responsible for screening, coordination, and continued development of STOP which is

currently a two-year program. The role requires coordination among the state, local medical and behavioral health providers, and law enforcement to provide access to those who are challenged by addiction. The program also will expand telemedicine to surrounding counties for efficient delivery of substance use services in rural communities. Most recently and for the past five years, Perry served as the admissions coordinator for the Lakeview program Road to Recovery, a residential treatment program. He holds a Master of Social Work from the University of West Florida and Bachelor of Arts in Psychology from University of Central Florida. Perry has 11 years experience working with adolescents and adults to help them throughout their life journeys.

Moultrie Announces Resignation from ECSD School Board Superintendent of Schools Malcolm Thomas regretfully shares that Escambia School Board Member and Chair Linda Moultrie has made the decision to resign her position on the Board. “Linda Moultrie has been an outstanding leader in our community, representing the students and their families in District 3, as well as the interests of the entire county, with professionalism, respect and compassion,” Superintendent Thomas said. “She has made this decision because it is what is best for her family and we will respect her wishes and support her as she makes this transition. She will be greatly missed by myself, the leaders of the District and the rest of the Board.” Mrs. Moultrie was elected to the Escambia County School Board as the District 3 Representative in August 2008 and was re-elected in August 2010 Primary Election. She attended school in District 3. Mrs. Moultrie is the seventh child from a family of

eleven children. Having a passion for education, she was the first in her family to graduate from high school and college. She is a proud mother of Escambia County graduates as well as the grandmother of ECSD graduates. Moultrie has also been involved in many community service organizations. As the District 3 representative on the School Board, she represented Brentwood Elementary School, Brown Barge Middle School, Ensley Elementary School, Global Learning Academy, Lincoln Park Elementary School, Montclair Elementary School, Oakcrest Elementary School, Weis Elementary Community School, McMillan Center, Woodham Middle School and Pensacola High School The District 3 seat on the School Board was scheduled to be up for election in 2018. It is up to the Governor to select a temporary representative from District 3 to hold the open seat until then. That selection has not been made as yet.

MONEY FLOWS IN SPECIAL ELECTION TO REPLACE EISNAUGLE By JIM TURNER THE NEWS SERVICE OF FLORIDA

Nearly $250,000 has been spent since the end of May by three of four Republicans running in a special election in a state House district that includes major Orlando-area tourist attractions. And while the District 44 contest won’t be decided until a special general election on Oct.10, the winner of Tuesday’s Republican primary will be the favorite to finish the term of former Rep. Eric Eisnaugle, R-Orlando. GOP candidate John Newstreet, president of the Kissimmee/Osceola Chamber of Commerce, is tops in raising money and spending, according to newly filed finance reports, followed by Robert Olszewski, Bruno Portigliatti and Usha Jain. The district, which leans heavily Republican, goes from Winter Garden south to Lake Buena Vista and is home to Walt Disney World, Universal Florida and SeaWorld Orlando. Newstreet, 40, of Orlando, raised $59,175 between July 7 and Thursday, according to reports posted on the state Division of Elections website. In all, Newstreet has raised $124,554 for the special election, of which more than $111,000 had been spent as of Thursday.

More than half of Newstreet’s spending has gone to the Orlando-based consulting firms The Red Envelope and Millennium Consulting. Olszewski, 39, a business consultant and former Winter Garden commissioner, reported $23,050 in contributions from July 7 through Thursday. In all, Olszewski had raised $75,980 and loaned $1,750 the campaign, with all of that money spent. Most of the spending --- $65,771--- went to Tampabased Strategic Image Management for campaign consulting and direct mail. Portigliatti, 29, the CEO of Excellence Senior Living and executive vice president of Florida Christian University, reported raising $14,760 during the most-recent period, bringing his overall total to $65,581. More than one-third of the money, $26,500, had come from the candidate. He had spent $54,761, with much of the money going to Spencerville, Md.-based SRH Media for advertising and to Tallahassee-based EM Campaigns for consulting, direct and online marketing. Jain did not report raising any cash but has spent $3,400 on campaign signs and other advertising. Jain, 66, is a doctor and medical director at Emergi Care Medical Center in Windermere. Awaiting the winner is Democrat Paul Chandler,

whose eligibility for the race is the subject of a lawsuit filed last week in Leon County. He had raised $3,508, including $2,168 during the most recent filing period. Chandler has also put up $21,792 of his own money and the Florida Democratic Party has chipped in $250. The complaint by Charles Hart of Windermere claims Chandler is an active registered voter in Missouri and has voted in that state as recently as Nov. 8, 2016. Florida law requires candidates to be a resident of Florida for the two years prior to the election. Republicans make up 36.1 percent of the registered voters in House District 44, while Democrats make up 32.4 percent. But the district has gone heavily in the past to Eisnaugle, who left the House this spring after being appointed by Gov. Rick Scott as a judge on the 5th District Court of Appeal. Eisnaugle, who went unopposed in the 2016 general election, received 64.6 percent of the vote in 2014 November general election when challenged by independent Matthew Falconer. Eisnaugle got 74.2 percent of the vote in a March 11, 2014 special election over Democrat Shaun Raja.

PUTNAM KEEPS FUNDRAISING EDGE IN GOVERNOR’S RACE By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA With the field of candidates expanding, Agriculture Commissioner Adam Putnam leads the fundraising contest in the 2018 race for governor, with more than $12.3 million in unspent cash to back his campaign. In July, Putnam’s political committee, “Florida Grown,” raised nearly $1.05 million, bringing its total since early 2015 to $14.73 million. It had spent $3.88 million spent through the end of July, newly filed finance reports show. More than $750,000 in contributions hit the committee’s account on the last day of July, including $250,000 from political committees tied to the Florida Chamber of Commerce, $200,000 from an Associated Industries of Florida committee, $100,000 from U.S. Sugar Corp. and $100,000 from Heritage Property & Casualty insurance company. Putnam’s regular campaign account added $250,000 in July, bringing its overall total to $2.24 million, with $720,000 in expenditures. Senate Appropriations Chairman Jack Latvala of Clearwater on Friday filed paperwork to join Putnam as the second major candidate in the Republican field. Latvala raised $362,154 for his “Florida Leadership Committee” in July and had about $3.84 million available as he prepared to launch his campaign, according to the state Division of Elections. Among the large contributions to the committee in July were $50,000

from Destin real-estate firm Sterling Diversified, LLC; $25,000 from a Florida Transportation Builders Association PAC; $25,000 from The Vestcor Companies, Inc., a Jacksonville real-estate firm; $25,000 from a Florida Chamber of Commerce PAC; and $25,000 from Duke Energy, the report shows. House Speaker Richard Corcoran, a Land O’ Lakes Republican who is another potential candidate, raised $818,500 for his “Watchdog PAC” in July. That brought the committee’s total to $2.86 million, with only $84,000 in expenditures. The July contributions included $100,000 each from two firms of plaintiffs’ attorneys --- the firm Searcy Denney Scarola Barnhart & Shipley and the firm Lytal, Reiter, Smith, Ivey & Fronrath. Among the other large contributions were $50,000 from Heritage Property & Casualty insurance company and $50,000 from Wal-Mart Stores, Inc., according to election records. A political committee tied to U.S. Rep. Ron DeSantis raised $320,000 in July, bringing the committee’s total to $1.26 million, as the Palm Coast Republican contemplates entering the governor’s race. The biggest contribution to the “Fund for Florida’s Future” was a July 31 donation of $300,000 from the “Fighting for Florida Fund,” a super PAC that supported DeSantis’ 2016 U.S. Senate campaign, which ended when incumbent Marco Rubio announced his decision to seek reelection. Through the end of July, the Fund

for Florida’s Future had only spent $40,222 of the $1.26 million raised, according to the state Division of Elections. In addition to the committee collecting money, DeSantis continues to raise his profile outside of his congressional district, which includes Flagler, Volusia and parts of Lake and St. Johns counties. He has a scheduled appearance on Thursday at the “Lobsterfest” dinner hosted by Palm Beach County Republicans. In the Democratic field for governor, former U.S. Rep. Gwen Graham of Tallahassee raised $138,000 for her “Our Florida” political committee in July, bringing its total to nearly $2.12 million, election records show. The committee had spent $443,000. The largest July contributions included $25,000 from Graham’s congressional committee and $25,000 from James Lynch, a Lynn Haven construction company owner. Graham also raised $225,000 for her regular campaign account in July, bringing its total to $887,000, with almost $310,000 spent, records show. A political committee affiliated with Democratic candidate Chris King, a Winter Park businessman, raised $140,000 in July. The “Rise and Lead” committee had collected a total of $830,000 as of the end of the month, with $246,000 in expenditures, records show. The largest July contribution was $50,000 from Verde Investment, an Arizona real-estate company. King also raised $14,288 for his regular campaign account, bringing its total to $1.56 million, with $420,000

in expenditures. Tallahassee Mayor Andrew Gillum lagged his Democratic gubernatorial rivals with a slow fundraising month in July. The “Forward Florida” political committee affiliated with Gillum’s campaign raised $10,000 in July, bringing its total to $697,000, with $488,000 in expenditures. Gillum raised $48,534 for his regular campaign account in July. That brought its total to $645,000, with $202,000 in expenditures. Gillum’s fundraising has been hamstrung by investigations involving the city of Tallahassee, although a grand jury this week cleared the mayor in a probe into whether software purchased by the city had been improperly used for political purposes. But Gillum and other city officials have faced broader questions in recent weeks about an FBI investigation that involves city government. Gillum has said he is not a target of the investigation. A political committee tied to Miami Beach Mayor Philip Levine, another Democrat who is looking at the governor’s race, raised slightly more than $500,000 in July, election records show. The “All About Florida” committee had raised a total of $4.53 million, with only $79,000 in expenditures. Levine gave $275,000 to the committee, with other major contributions including $50,000 from the Schlesinger law firm in Fort Lauderdale and $30,000 from Infinity Real Estate of New York.

LATVALA LAUNCHES CAMPAIGN FOR GOVERNOR

Friday’s announcement was not a surprise. He will formally kick off his campaign on Wednesday, with stops in Hialeah, Clearwater and Panama City.

Palm Beach County to talk about the opioid crisis and an appearance in Blountstown last week to talk about the need for more economic development in rural regions. On Friday, Latvala was in Steinhatchee, where he has a home, for another economic roundtable. On Sunday, he will be on a political talk show hosted by an Orlando television station. “As a small business owner and public servant, I have a track record of getting things done and solving problems,” Latvala said in a statement announcing his Wednesday itinerary. “One thing you can always expect from me too is when I give you my word, I will keep it.” Latvala’s entry into the governor’s

MOODY, GRIMSLEY, CALDWELL TOP JULY CABINET FUNDRAISING

Ashley Moody, a former Hillsborough County circuit judge, put more fund-raising distance last month between herself and two opponents in the race to become Florida’s next attorney general. Meanwhile, state Sen. Denise Grimsley and state Rep. Matt Caldwell each raised six figures in July as they compete in a four-way Republican primary to replace Agriculture Commissioner Adam Putnam. Still, they do not have as much campaign cash as Republican opponent Baxter Troutman, a former House member from Winter Haven who put up $2.5 million of his own money in June. The 2018 contest for the third state Cabinet office, chief financial officer, currently has only one candidate, former Democratic Sen. Jeremy Ring. Ring, from Broward County, pulled in a combined $45,396 in July through his campaign account and an affiliated political committee known as “Florida Action Fund PC.” He started August with nearly $100,000 in the fund and less than $32,000 in his campaign account. In the attorney general contest, Moody picked up $117,360 during July, bringing her campaign account’s total to $607,736 since she started raising money in June, according to numbers posted on the state Division of Elections website. As of July 31, just under $16,000 had been spent by Moody, who has the backing of term-limited Attorney General Pam Bondi.

Moody’s July haul, raised mostly from the Tampa region, included money from the backyard of her primary opponent, state Rep. Jay Fant, R-Jacksonville. Moody’s contributions included nearly $10,000 from people --- many of them attorneys --- in Jacksonville and surrounding communities on July 25. Fant meanwhile collected $15,850 in July, with most of it coming from his hometown. Over three months, he has brought in $163,665 for his campaign account. He had spent a total of $5,447 as of July 31. Meanwhile, political committees for Moody and Fant were mostly inactive last month. Despite not bringing in any new money, the committee Friends of Ashley Moody had more than $108,000 on hand as of July 31. Combined with her personal campaign account, Moody had $700,526 available for the 2018 contest. The Fant committee known as “Pledge This Day,” meanwhile, had $72,633 in the bank. Democratic candidate Ryan Torrens, an attorney from Hillsborough County, picked up $7,432 in July, nearly $1,500 less than what he spent during the month. Since entering the contest on May 22, Torrens had raised a total of $28,985, of which $12,441 had been spent as of the end of July. In the agriculture commissioner’s race, Grimsley, R-Sebring, raised $49,000 in July for her political committee known as “Saving Florida’s Heartland,”

and another $103,830 for her campaign account. Among the bigger contributions to her political committee were $25,000 from a PAC linked to Associated Industries of Florida and $10,000 from a Florida Chamber of Commerce PAC. Grimsley’s campaign and the political committee began August with a combined total of $813,911 in cash on hand. Caldwell, R-North Fort Myers, picked up $43,275 in July for his campaign account, while the political committee Friends of Matt Caldwell brought in another $65,000, the reports show. Similar to Grimsley, the Caldwell committee received $25,000 from a PAC linked to Associated Industries of Florida and $10,000 from a Florida Chamber PAC. Overall, Caldwell had raised $1.13 million through his campaign account and his political committee, of which $260,000 had been spent as of July 31. After Troutman put $2.5 million of his money into the agriculture-commissioner race in June, he raised $6,500 for his campaign account in July, the reports show. A Troutman political committee, known as “iGrow PC” raised $17,000 in July, bringing its overall total to $27,000. The fourth Republican candidate to replace Putnam, Orlando businessman Paul Paulson, reported raising $3,744 in July. Democratic candidate Michael Christine of Miami did not report raising any money for the second consecutive month.

JUSTICES REJECT RESENTENCING IN 1976 MURDER By JIM SAUNDERS THE NEWS SERVICE OF FLORIDA

In a case stemming from the 1976 strangulation of a 13-year-old girl, the Florida Supreme Court on Thursday rejected arguments that a Death Row inmate should receive a new sentencing hearing. The arguments by attorneys for inmate James Ernest Hitchcock were rooted in a major 2016 U.S. Supreme Court ruling and subsequent Florida decisions that have led to requiring unanimous jury recommendations before defendants can be sentenced to death. With Hitchcock sent to Death Row after a 10-2 jury recommendation, his attorneys argued that the new unanimity standard should retroactively apply to his case and lead to a new sentencing hearing. But justices, as they have done recently in other cases, rejected the idea that the unanimity requirement should be applied to such old cases. The opinion was fully shared by Chief Justice Jorge Labarga and justices Peggy Quince, Ricky Polston and Alan Lawson, while justices R. Fred Lewis and Charles Canady concurred without signing on to the majority opinion.

Justice Barbara Pariente dissented and pointed, in part, to the U.S. Constitution’s Eighth Amendment, which bars cruel and unusual punishment. “Reliability is the linchpin of Eighth Amendment jurisprudence, and a death sentence imposed without a unanimous jury verdict for death is inherently unreliable,” Pariente wrote. Hitchcock, now 61, was convicted in the murder of his brother’s 13-year-old stepdaughter in Orange County, according to court documents. He was accused of going into the girl’s bedroom in the middle of the night, having sexual intercourse with her and then killing her when she said she was going to tell her mother. Hitchcock had to be resentenced three times because of a series of U.S. Supreme Court and Florida Supreme Court rulings in his case. In his final sentencing proceeding, the jury voted 10-2 to recommend the death penalty, and the Florida Supreme Court upheld that sentence in 2000. Thursday’s ruling stemmed, in part, from a January 2016 ruling by the U.S. Supreme Court that found Florida’s death-penalty sentencing system unconstitutional because it gave too much authority

to judges, instead of juries. That ruling, in a case known as Hurst v. Florida, has spawned extensive litigation about death-penalty cases and legislation to change the sentencing system. As part of that litigation, the Florida Supreme Court ruled that juries are required to make unanimous recommendations before judges can sentence defendants to death. Florida long allowed majorities of juries to recommend death sentences. Also, the Florida Supreme Court has ruled that the unanimity standard should apply to cases dating back to 2002. That is when the U.S. Supreme Court ruled in a case known as Ring v. Arizona, which was a key underpinning of the Hurst v. Florida decision. Hitchcock and other longtime Death Row inmates have argued that the unanimity standard also should apply to cases decided before 2002. But the decision Thursday appeared to make clear that the Supreme Court will not go along with such arguments. “Hitchcock is among those defendants whose death sentences were final before Ring, and his arguments do not compel departing from our precedent,” the majority opinion said.
