Law and Vengeance Mike Papantonio Writes the Book on Corporate Corruption and the Justice System By Kelly Oden Most Pensacolians know Mike Papantonio as a senior partner at Levin Papantonio, one of the nation’s largest plaintiff law firms. Elected in 2012 as president of the National Trial Lawyers Association, Papantonio has received numerous awards for his legal work and was one of the youngest attorneys inducted into the Trial Lawyer Hall of Fame. Papantonio is the host of the nationally syndicated radio show Ring of Fire with Robert F. Kennedy Jr. and Sam Seder. He also hosts America’s Lawyer on the RT America network and has appeared as a political commentator on MSNBC, Free Speech TV, RT America Network and Fox News. He is the author of numerous books, including the legal thriller Law and Disorder, and a co-author of the New York Times political bestseller Air America: The Playbook. In his second novel, Law and Vengeance, Papantonio takes on the arms industry. After a whistleblower comes forward to defend a soldier wrongfully charged with murder, the attorneys at Bergman-Deketomis realize they have a class action suit on their hands. But what seems like a regular torts case snowballs as witnesses start disappearing during the discovery process.
Your professional career is well documented. What can you tell me about your upbringing? Well, I was raised by a lot of different families, so it’s an interesting thing. I was raised primarily in Florida. I was born in New York, and I think I came to Florida when I was six weeks old or something crazy like that and I’ve been in Florida all my life. I was raised around Arcadia, Bradenton, Sarasota, Ft. Myers, Tampa, and St. Petersburg by different families and it was a great way to be raised because you learn so much. From every family you take something different. One family, somebody in the family was an artist and they taught me how to oil paint. In another family, music was very important and they helped me become a musician. Another family got me interested in writing. With another family, I lived with a WWII flight instructor and he taught me how to fly at a very early age. I understand you were a journalism major as an undergraduate? Yes, I was a news editing major at University of Florida and I intended to work in the area of journalism. My goal was to be a foreign correspondent and I was setting up for that, actually. I guess the last thing I had to get was command of a language. Back then everything was happening in South America. You had issues with conflict in about five areas in South America so foreign correspondents were going there. I figured that’s where I’d end up, but it didn’t work out. I ended up going another route. Why did you choose to go to law school? I had some friends in Arcadia that said ‘Maybe you ought to think about law,’ so they introduced me to a man named Perry Nichols who is known as the “father of torts.” He was a very significant trial lawyer. They have awards in his name, as a matter of fact, in Florida and
other places throughout the country. He kind of engineered the whole notion of demonstrative evidence—how to try a case, here are the parts, here’s how these parts come together. He really made huge leaps when it comes to lawyers trying to better represent their clients. So they asked, ‘Why don’t you go meet him’ and I went and I met him and it had a huge influence on me. I said, ‘Well, I guess if I want to write, I can have a law degree and write as well.’ You’re married and you have a daughter. Tell me about your family. My daughter is in law school at Stetson down in central Florida in St. Petersburg, which has become the premier trial school. My wife and I have been married going on 30 years. She was an air traffic controller and I was a pilot and we met that way. I was taking off from the airport and she was in the tower calling traffic and I said ‘Well I don’t see the traffic’ and she called the traffic three times. One o’clock, half-mile and it said no traffic and she gave me a vector back to the airport and as she did the other plane came screaming across my wing. She got me out of there just in time; I’ll put it like that. Not long after we were both at a bar and I was telling the story and she came up and asked me if I was the idiot who ran into the airplane. Both of us concluded that we were supposed to be married. What got you interested in writing legal thrillers? Great question. Well, you know, for a long time I’ve worked in media. I was probably the only liberal on Fox News for a while, then I did MSNBC and all along, whether it was CNN or whatever, I realized that these stories can’t be told. Written media typically doesn’t have the national advertiser problem. But when you have, say MSNBC, and they’ve got eight pharmaceutical advertisements an hour and you want to do a story on Bayer because their product, Yaz, has killed women between the ages of 18-35. You would think the producers would say, “This is an important story,” but unfortunately the power of money, especially in television and cooperate media is overwhelming. You can’t tell the stories. So what’s happened is, in order for people to hear these stories, sometimes this is the only kind of vehicle they can have. They can read a good thriller and hopefully it’s going to be an entertaining thriller for them, but then they can walk away and say “Well, what did I learn?” In these books they learn an awful lot about the dysfunction of the Department of Justice. They learn how predatory the pharmaceutical industry is, they learn that everything is stacked against the whistle blower. So I think it opens some peoples’ eyes along the way. The vehicle of the book gives me many things to talk about. I think it’s kind of incumbent on a lawyer that’s writing about issues that they’re aware of to understand that maybe nobody else is aware of them and to try to get those stories out. To what extent are the legal issues and happenings in your books factual? Entirely. When you’re reading what happened in the case, it’s going to be accurate. Obviously it’s dressed up. There are some murders involved which didn’t

take place and there are some fictional characters that you create. Why did you choose to make your protagonist a woman? Gina Romano was created because I’m really kind of outraged about the way women are handled in the practice of law. It’s ridiculous. You’d think it’s the last, best haven for progressive thinking and there should be no distinction in how we treat women in the courtroom. It’s a very real problem, so Gina Romano, to me, is based on a composite of the best trial lawyers I’ve worked with and she is faced with the same problems that female trial lawyers are faced with. And, you know, having a daughter that intends to practice law, I tend to take it very seriously. Tell me about your writing process. The characters are so important. There are two things that I think really are important, especially about a legal thriller. One is the concept of show me, don’t tell me. In order to get there you’ve got to create the character because how does the character show you anything unless you know who the character is. It’s even hard to visualize a dialog and so I think the time spent on the character is important. I have a big advantage because I have so many unusual characters around me day to day, so I just borrow a little bit here and a little bit there. Add it all up and I come up with a character that I like. I genuinely like Gina Romano and I like Nick Deketomis and Martin Bergman, you know, they’re people I’d want to hang out with. I’m always looking for back stories. And sometimes it’s just a nuance. Maybe something that everybody thinks is an affectation, but actually it’s a fairly well-engrained characteristic of the character. And so I’m always looking for that. I keep notes on my telephone and so the notes section on my iPhone is always jammed up with little thoughts. Who are your favorite writers? Steinbeck. Unquestionably, it’s Steinbeck. You know, I mean they’re odd writers. Kafka, you know The Trial. Who’s read Kafka? It’s those types of books that at a very early age taught me a sense of social responsibility. I was entertained. Tortilla Flats, you know, you read that and you love Doc. You love the characters surrounding Doc. They’re all miserable failures by American standards, but you take a look at them and they all offer these interesting things and you think, ‘Wow I would just love to spend an afternoon with that person.’
How would you not want to say, ‘Doc, let’s sit here and talk a while?’ So those are the kinds of writers generally that move me. I read peculiar things growing up. I genuinely liked the classics. Even today, I’ll pick one off the shelf and reread it and I’ll say, “Wow that was great.” Sometimes I’ll interview a young lawyer and I’ll say, “What do you like to read?” and I’m lucky if I get a “John Grisham.” And I’ll say, “Well did you ever read any Hemmingway?” Not to say that I’m a great Hemmingway fan, but what is it that you grew up with? F. Scott Fitzgerald? Did you read any of that? There’s a lot of important stuff there. You know this guy Perry Nichols that I told you about? His message to me was that the way that you become a great lawyer is to read and borrow from different cultures and different ideas. Borrow from concepts that might be totally foreign for you. And then you’re able to take all that material and you can write a great closing statement, and you can do a great cross examination. Because the jury wants more depth. The jury is there sometimes for two months. They like depth. They don’t want to see a shallow show. They want to see meaningful cross examination where they can say, “Oh, I see where he is going with this cultural idea.” It’s not just about the case for them sometimes. So, in order to do that you have to arm yourself with great literature. You plan on writing two more books in this series, right? I’m working on the third one now, it’s Law and Addiction. It’s actually developing as the case is developing. I know what it’s about in my head. I’ve got some really interesting characters in this book. You’re kind of torn both ways because it involves drug addiction and so many people are so judgmental about drug addiction they’re not willing to dig and find a way to understand. So what it does is, it takes some of those people and it’s like taking layers off an onion. It may be a pretty ugly character but let me show you where it started. It started in a dentist chair where they were given 70 OxyContin. They were a brilliant student, they were wonderful in their community, they had all these positives and all of a sudden they emerge and evolve into something else and they live in Zombie Land. There are actually parts of the country that are called Zombie Land. If you get into this opioid crisis, read Dreamland. It is a spectacular book.

Escambia County’s Pensacola Beach Lifeguards recently completed the requirements for the United States Lifesaving Association Open Water Lifeguard Agency Certification Program, following guidelines for the highest quality open water lifeguard training standards. To qualify for this certification, Pensacola Beach Lifeguards had to ensure compliance with USLA’s required elements, which include minimum standards for lifeguard training, policies, medical and rescue equipment, record keeping and reporting. The USLA Open Water Lifeguard Agency Certification Program accounts for the unique challenges faced by lifeguards who safeguard natural bodies of water, such as waves, water currents, dangerous animals and weather. Pensacola Beach Lifeguards join some of the most respected lifeguard agencies in the country that use the USLA system. The certification will remain active until November 2020, provided that lifeguard training is conducted in a manner consistent with USLA standards. WFPL Summer Reading Winners get Firetruck Rides to School
Six lucky readers from the Summer Reading Club at West Florida Public Libraries received rides to school from Escambia County Fire Rescue after being drawn from a pool of 72 children who read 50 hours or more over the summer. The children participated in Summer Reading Club at libraries across Escambia County. Escambia County firefighters picked each child up at their home and took them to school. After the ride, each child went up in the bucket with firefighters and then enjoyed a fire safety presentation with their classmates.
The winners were: • Ten-year-old Gabriella Minchell, who rode to Ferry Pass Elementary School on Sept. 29. She said her favorite book from her summer reading was the Goosebumps book “Planet of the Lawn Gnomes”. • Eleven-year-old Peniel Otabil, who rode to Ransom Middle School on Oct. 4. He said he wanted everyone to know that there don’t have to be contests or prizes involved to enjoy reading. • Eight-year-old Abigail Corliss, who rode to Tryon Branch Library on Oct. 6. Corliss, who is homeschooled, enjoyed a special story time and fire safety presentation.
UWF College of Business Executive Mentor Program Hosts Ethics Educator Aaron Beam
The University of West Florida College of Business Executive Mentor Program will host guest speaker Aaron Beam from 1 to 2:30 p.m. on Nov. 17 in the College of Business, Building 76A, Room 101. Beam will discuss the dangers of unethical business practices and the ethical challenges students and others could one day face in his presentation, “Fraud, Lies, and Hermes Ties.” The pressure put on Beam as an ac-
counting executive to raise the bar put him behind bars after he took part in one of the largest corporate fraud schemes in the U.S. From 1984 to 1996, Beam, the cofounder and first chief financial officer of HealthSouth, helped land his company on the Fortune500 list. In 1996, earnings declined and the former CFO took part in an $2.5 billion accounting fraud scandal. In 2003, he pleaded guilty to the crime and spent a short time in federal prison for approving fraudulent quarterly numbers in the scandal. In his recently published book, “Ethics Playbook: Winning Ethically in Business,” Beam helps others understand the importance recognizing ethical boundaries in business and the value of doing the right thing. The presentation is free and open to the public. A drawing will be held to win a copy of Beam’s “Ethics Playbook.” The winner must be present. Pensacola Museum of Art Announces Fall Exhibition: Crossing Boundaries: Art and the Future of Energy National Juried Exhibition
The University of West Florida Pensacola Museum of Art, 350 Pensacola and UWF Department of Art announces the exhibition, “Crossing Boundaries: Art and the Future of Energy National Juried Exhibition” as part of the Clean Energy Festival and Pensacola Foo Foo Festival. The exhibition will be on view through Jan. 14, 2018 in the Charles W. Lamar, Sr. Assembly Room located on the second floor of the museum. SENATORS BACK COLLEGE SYSTEM REVAMP AMID CONCERNS By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA
A plan to create a statewide board to oversee Florida’s state and community colleges advanced Monday, while college presidents raised objections to a proposed cap on four-year degrees and a stricter performance measure for graduation that are part of the legislation. The bill (SB 540), sponsored by Sen. Dorothy Hukill, R-Port Orange, cleared the Senate Education Committee in an 8-2 vote. “That’s what this program is all about,” said Hukill, chairwoman of the education panel. “Not only getting students into the community college, but moving them through the community college, getting them into the next level and actually graduating them.” Although the colleges have earned national accolades, Hukill said “we can do a heck of a lot better.” Hukill cited data that showed that only 17.7 percent of the students who enrolled in two-year associate degree programs in the college system in 2009 ended up with baccalaureate degrees within six years. Some 26 percent of the students were still enrolled in the associate degree programs, with 13 percent having left with either an associate degree or certificate. But 43 percent left the system without any degree or certificate. “I think we need to do better than that,” Hukill said. The bill revives major provisions of legislation passed in the 2017 session but vetoed by Gov. Rick
Scott, who objected to a cap on four-year degrees awarded by the colleges and “unnecessarily increasing red tape” in the system. The new bill would create a 13-member State Board of Community Colleges to oversee the college system with its 800,000 students and $2.24 billion budget. The system is now under the state Board of Education, which has the primary responsibility for overseeing Florida’s pre-kindergarten through 12th-grade system. The bill would emphasize the college system’s primary role in producing associate-degree graduates, with a secondary role of granting baccalaureate degrees. The bill would cap individual school enrollment of students seeking four-year degrees at 20 percent, with a systemwide cap of 10 percent. Another provision in the bill would measure the performance of colleges based on how many students earn degrees by completing programs within “100 percent” of the expected time. Students in associate-degree programs would be measured against a two-year completion standard, as opposed to the current performance metric, which is
very easily prevent us from responding to a potential critical future need,” Stephenson said. Stephenson said “market demand” should be the impetus for creating four-year programs rather than imposing a cap. “There is a need and a demand,” he said. Based on data from the 2016-2017 academic year, Hukill said individual colleges and the system are well below the enrollment caps. Santa Fe College had the highest four-year enrollment at 13.9 percent, while the system had roughly a 5 percent total enrollment, Hukill said. “There is a tremendous amount of leeway in terms of the expansion of programs,” Hukill said. Ava Parker, president of Palm Beach State College, said colleges would prefer to stay with performance measures that allow completion of degrees and certificates within 150 percent or 200 percent of the expected time. NEGRON REJECTS REMOVING RULES CHAIR FROM LATVALA PROBE

A lawyer for Sen. Jack Latvala, a veteran lawmaker accused of sexual harassment by a Senate staffer, wants the head of the Rules Committee to be removed from an investigation into the alleged wrongdoing, but the Senate president is refusing to comply with the request. Latvala lawyer Steve Andrews asked Senate President Joe Negron on Monday to disqualify Senate Rules Chairwoman Lizbeth Benacquisto from participating in the Latvala inquiry because, Andrews said, she broke the rules when speaking to a reporter about the probe this month. Negron ordered an independent investigation into alleged sexual harassment after Politico Florida reported that several women accused Latvala of groping them and making unwelcome remarks about their bodies. Latvala, R-Clearwater, has steadfastly denied sexually harassing lobbyists or staff members, releasing results of a lie-detector test on Friday. In a lengthy interview with The News Service of Florida, he acknowledged making comments that could be construed as inappropriate but insisted he never physically touched the women in the way described in the Politico article. After Negron announced an investigation, Benacquisto, R-Fort Myers, acknowledged to a reporter that her committee had received a
sworn complaint, although she did not specifically name Latvala as the subject. Andrews called Benacquisto’s public comment a “material breach” of the Senate rules and “mandates her disqualification from any further involvement” regarding the inquiry into Latvala. Under the Senate rules, the identity of the subject of a complaint is supposed to be kept secret until the complaint is dismissed, a determination of probable cause has been found, a determination of no probable cause has been found or the senator authorizes the release of the information. “Her breach implicates the integrity of the process and her intent is irrelevant,” Andrews wrote. Benacquisto’s disqualification would “ensure that any other potential conflict of interest will be avoided which might flow from her relationship with any alleged complainant” or witnesses, Andrews added. But Negron, R-Stuart, flatly turned down the request. “Chair Benacquisto was asked specifically whether a complaint had been filed with the Committee on Rules. She confirmed that a complaint had been filed. Chair Benacquisto did not confirm that the complaint is regarding any specific senator, officer or lobbyist. The president does not believe Chair Benacquisto violated the Senate rules and will not ask her to recuse herself,” Negron spokeswoman Katie Betta said in an email. Meanwhile, a lawyer representing
a Senate staff member who made the complaint confirmed Monday that the staffer has filed a workplace harassment complaint with Negron’s office. It is unclear whether there will be two investigations into the sexual harassment allegations against Latvala, who is running for governor and who was stripped of his post as the powerful Senate budget chief after the accusations were revealed. Negron hired national employment law firm Lewis Jackson to conduct the inquiry, which will be headed by Tampa lawyer Gail Holtzman. Under the Senate rules, a “special master” is supposed to be appointed to conduct the investigation. The special master then makes recommendations to the Rules committee. If the special master finds the facts don’t support the allegations, the Rules chair --- Benacquisto --- has to dismiss the complaint. If the complaint isn’t dismissed, the Rules Committee “shall consider special master’s report and recommendation, shall grant the senator an opportunity to be heard, and shall develop its own recommendation.” If the committee doesn’t vote to dismiss the complaint, the recommendation of the special master and the recommendation of the committee will be given to Negron, according to the rule. Negron must then present the recommendations to the Senate “for final action.” Potential penalties include censure, reprimand, or
expulsion from the Senate, and require a two-thirds vote of the chamber, which now has 39 members following the resignation of Lake Worth Democrat Sen. Jeff Clemens, who stepped down last month after admitting he had an extramarital affair with a lobbyist. Neither Andrews nor Tiffany Cruz, a Tallahassee lawyer representing the Senate staff member, could say whether Holtzman would act as the special master or conduct a separate probe, and Betta wouldn’t comment about how the process would be handled. Cruz wouldn’t comment on Andrews’ letter, but spoke of what she called an intimidation campaign by Latvala and his supporters. “I think there is generally intimidation occurring, and I think that my client is a normal citizen. She’s not independently wealthy. She doesn’t have a $4 million campaign account at her disposal. The fact that Jack Latvala had control over an $83 billion budget and there’s the potential that he could control that again soon, I think that intimidates people,” Cruz said in a telephone interview. Cruz accused Andrews and Latvala of releasing the lie detector test results to keep others from coming forward. “There’s a lot of people that have things at stake --- politicians, lobbyists, etc. But what we want people to know is witnesses and victims should not be afraid to come forward. There are people who are willing to help them,” she said.

Florida continues to spend about $2.4 million a week to clean up debris strewn across state waters during Hurricane Irma two months ago. The state money could soon run dry, even as the weekly costs grow with the cleanup moving deeper into counties more heavily damaged by the storm. Department of Environmental Protection Deputy Secretary David Clark told members of the House Select Committee on Hurricane Response and Preparedness on Monday that by early next year the state may use up the $36 million allocated to the agency for storm-debris cleanup. “At the current pace, we’re spending about $2.4 million a week to do the waterway cleanup,” Clark said. “At that pace, we’re going to run out of money by the time we get into session at the beginning of January or sooner.” Committee members, while praising the state agency for waterway cleanup efforts, didn’t offer direction on future or emergency funding. Chairwoman Jeanette Nunez, R-Miami, has said she expects legislation to come out of the committee in mid-December.
The state expects to receive at least 75 percent reimbursement for its expenses from the Federal Emergency Management Agency. But based on past storms, Clark said the federal money, which isn’t guaranteed, might be at least two years away. Clark said the state has already spent about $12 million to clean up about 76,000 cubic yards of household goods, building materials and vegetation that ended up in state waters following the powerful and deadly storm. By comparison, the state spent close to $15 million to clean up 79,000 cubic yards of debris after Hurricane Matthew caused damage along the East Coast in October 2016. Clark said Irma’s numbers will increase as the state has ramped up efforts in Collier County, which sustained the second of two landfalls by Hurricane Irma on Sept. 10. Also, the state is still working on an agreement with Monroe County to assist in waterway cleanup at the southern end of the state, which received the first landfall and saw some of the most severe impacts from the storm. The “hope” is to have boats in the waters of Monroe County in a few weeks, he said.
“As the rising waters and the king tide events are subsiding we’re starting to find more debris that is either coming up to the surface or as the waters drop we’re finding more debris,” Clark said. The DEP cleanup work doesn’t include vessel removal. The Florida Fish and Wildlife Conservation Commission estimates about $25 million will be needed to complete removal of the remaining 514 damaged vessels still in the water or thrown ashore. Maj. Robert Rowe, the commission’s boating and waterway section leader, said the state is expected to pay 25 percent of the vessel-recovery costs. More than 1,800 boats have already been moved from state waters, many into storage areas by the owners or the state, working with the U.S. Department of Environmental Protection and the U.S. Coast Guard. The state estimates that each vessel costs $25,000 to $40,000 to remove, Rowe said. Unlike water-debris removal, the pace and cost of storm debris hauled from land has been among several points of contention in the government’s response to Hurricane Irma. The House committee didn’t address land-debris removal on Monday.

NURSING HOMES LOOK FOR STATE MONEY FOR GENERATORS By CHRISTINE SEXTON THE NEWS SERVICE OF FLORIDA
Florida’s largest nursing-home association has one question as the 2018 legislative session approaches: Will the state help foot the costs of generators at nursing homes? But getting an answer is proving elusive. Florida Health Care Association chief lobbyist Bob Asztalos on Monday asked a top Medicaid official whether nursing homes would be authorized to include generators on the cost reports facilities are required to submit to the state. The answer from Tom Wallace, who is the interim assistant deputy secretary for Medicaid finance and analytics at the Agency for Health Care Administration, did not give a clear picture. “The agency’s response right now would be, we are looking at that. We are looking into that and what is the best approach to doing this,” Wallace said. Asztalos asked the question at the third and final meeting of the Nursing Home Prospective Payment Working Group, which met Monday at the agency’s Tallahassee headquarters. The question was posed as the group started discussing Hurricane Irma and the state’s response to the storm. The Legislature during the 2017 session directed AHCA to assemble the group and have it examine the myriad issues involved in switching the state’s Medicaid reimbursement for nursing homes away from a cost-based system and toward a “prospective payment” system. Under a cost-based system, nursing homes annually submit unaudited cost reports that are used as the basis for payment. After the reports are audited, providers can go back and demand higher reimbursements.
Under the prospective payment system, nursing homes will be reimbursed predetermined, fixed amounts. Nursing homes became a high-profile issue after residents of a sweltering Broward County nursing home died following Hurricane Irma. Eight residents of The Rehabilitation Center at Hollywood Hills died Sept. 13, three days after the storm knocked out the facility’s airconditioning system. Six others died after evacuation. The deaths prompted Gov. Rick Scott’s administration to issue emergency rules requiring nursing homes and assisted-living facilities to have generators and enough fuel to cool buildings for 96 hours. The rules were challenged by three long-term care associations that argued the Scott administration violated state law because there was no emergency and that the rules overstepped legislative authority. Though an administrative law judge sided with the groups, the Scott administration took the issue to the 1st District Court of Appeal. The administration maintains the rules stay in effect during the appeal. The Florida Health Care Association estimates that it would cost about $230 million for more than 650 nursing homes to get generators. The association would like Medicaid --- which pays for about 60 percent of nursing-homes days on average --- to help offset a corresponding amount of the costs. If that were the case, it would cost Florida taxpayers about $53.8 million. Another $84.1 million would be absorbed by federal matching dollars. Asztalos, whose association did not challenge the rules, said nursing homes are precluded from transferring residents to special needs shelters. Generally, nursing homes ink agreements with other nursing homes that allow them to transfer patients in case of hurricanes or storms.
During Hurricane Irma, Asztalos said, many East Coast nursing homes transferred patients to facilities on the state’s West Coast. But when Hurricane Irma changed course and started barreling toward the West Coast, that put some nursing homes who agreed to take residents from East Coast facilities in the awkward position of evacuating not only their residents but the residents they agreed to take from sister facilities. “We agree with the governor we’ve got to get these generators,” he said. Asztalos said that hardening nursing homes would not only allow the facilities to keep residents in place but enable the facilities to serve as special-needs shelters and take in people who need shelter from storms. “I think this does have a public policy point for the state,” he said, adding that generators could also help abate what could be a growing problem in that nursing homes are beginning to “pull back on evacuation agreements (with other facilities).” Working group member, Scott Hopes said Manatee County opened 25 shelters that had capacity to serve about 25,000 people. But only one of the shelters, he said, was a dedicated special needs shelter. It was able to accommodate about 500 people. “We had special needs residents in every one of the (shelters),” Hopes said adding that people with oxygen and oxygen generators, “just were everywhere.” Jennifer Langer Jacobs, an administrator with Sunshine Health, told the panel that care coordinators who work at the HMO were worried about their clients and where they could be evacuated. “Ultimately, everybody got where they needed to get to, but I think the stress level in the system was much higher than what it needed to be,” she said.
FACILITY SEEKS TO BOOST TRANSPORTATION TECHNOLOGY By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA
State officials held a ceremonial groundbreaking Monday at a transportation facility in Polk County that could make Florida a leader in developing technologies related to tolling and automated driving. The 400-acre SunTrax facility, which is being developed by the Florida Turnpike Enterprise in conjunction with Florida Polytechnic University, will include a 2.25-mile oval track that will allow for highspeed, multi-lane testing of new toll technologies, including smart-phone based payments. The track, which is scheduled for completion in 2019, is one part of the overall facility. The 200-acre infield, where construction is set to begin next fall, will be developed as a testing ground for connected and autonomous vehicles, featuring environments that can simulate driving conditions in urban, rural and suburban communities. Diane Gutierrez-Scaccetti, executive director of the Florida Turnpike, said the facility is intended to
be a “high-tech hub” for research and development of cutting-edge transportation technologies. “SunTrax enhances Florida’s place at the forefront of new transportation and tolling technologies, while providing Florida Poly a unique opportunity for its students to participate in the testing and development of transportation technologies and innovations,” Gutierrez-Scaccetti said in a statement. Randy Avent, president of Florida Polytechnic, said the joint facility “will increase opportunities for faculty research and partnerships with industry. “As a university founded in the practice of applied research, we look forward to these increased opportunities that SunTrax will bring to our faculty, students and the state of Florida as a whole,” Avent said. Agriculture Commissioner Adam Putnam, a Polk County resident who is running for governor, also attended the ceremony. “Innovation in transportation is essential to Florida and SunTrax is at the forefront,” Putnam tweeted. When completed, SunTrax will be the only
dedicated high-speed tolling and automated-vehicle testing facility in the southeastern United States, according to state officials. Gutierrez-Scaccetti said one of the goals for the facility is to attract related technology companies to the region. “Hundreds of acres are available immediately adjacent to the facility for the future development that will support the growth of this emerging industry,” she said. SunTrax is part of the Central Florida Automated Vehicle Partnership. Central Florida in January was designated by the U.S. Department of Transportation as one of 10 regions in the country for automatedvehicle testing. Other members of the Central Florida partnership include the city of Orlando, the University of Central Florida, the Florida A&M University-Florida State University College of Engineering, NASA, the Florida Department of Transportation and the Florida Turnpike.
SUPREME COURT TO HEAR FLORIDA FIRST AMENDMENT CASE

The U.S. Supreme Court on Monday agreed to take up a First Amendment case stemming from the arrest of a frequent government critic as he spoke during a South Florida city council meeting. Justices will hear an appeal by Fane Lozman, who filed a lawsuit against the city of Riviera Beach after his arrest in 2006. Lozman alleged that the city had violated his First Amendment rights by retaliating against him for his outspoken criticism and for another lawsuit alleging Sunshine Law violations. Lower courts sided with the city, which argued that a police officer had “probable cause” to arrest Lozman, who had refused to comply with directions from a council member. The case focuses on whether probable cause
“defeats” the First Amendment retaliation claim, according to documents filed by both sides. Attorneys for Lozman argued in a June petition to the Supreme Court that the city’s position could have broader implications on free speech. “The prospect of being arrested will deter many individuals from exercising their First Amendment rights at all, particularly when it comes to criticizing government,” said the petition, posted on the website SCOTUSblog. “A Riviera Beach resident of `ordinary firmness’ who attended the council meeting or saw the video of petitioner (Lozman) being arrested, handcuffed and manhandled out of the city council chambers would surely think twice before speaking his or her mind about the city’s policies.” But attorneys for the city said police commonly consider what suspects say in deciding whether to make arrests, and Lozman’s position could open
the door to civil lawsuits. As an example, the attorneys wrote in a brief last month that police might consider whether a drunk is making aggressive statements in deciding whether to make a public-intoxication arrest. “It is thus easy to imagine myriad circumstances in which officers perform arrests that they would not have performed but for the arrestee’s speech,” the brief said. “Under Lozman’s proposed rule, every one of them would be unconstitutional.” Court documents make clear that Lozman was an outspoken critic of the Riviera Beach city government, including over plans by the city to use eminent domain as part of redevelopment efforts. That criticism included filing a lawsuit alleging Sunshine Law violations about the approval of an agreement with developers. The arrest happened in November 2006, as Lozman addressed the city council during a public-comment pe-
riod. During his comments, Lozman spoke about the arrest of a former Palm Beach County commissioner on corruption charges, according to details included in an 11th U.S. Circuit Court of Appeals ruling early this year. A city council member interjected, but Lozman refused to stop speaking, subsequently leading to his arrest on charges of disorderly conduct and resisting arrest without violence. The city’s brief at the Supreme Court contends the council member did not try to stop Lozman from speaking but sought to “redirect him” from talking about the Palm Beach County Commission issue. The State Attorney’s Office said probable cause existed for Lozman’s arrest but decided against prosecuting the case, according to the appealscourt ruling. In 2008, Lozman filed the civil lawsuit alleging retaliation in the arrest.

Florida stepped up its emergency-operations activities Thursday as the federal government plans to offer short-term relocation to Florida or New York for Puerto Ricans still homeless after Hurricane Maria. Noting that more than 140,000 Puerto Ricans have arrived in Florida since the powerful storm devastated the U.S. territory in September, Gov. Rick Scott directed the Division of Emergency Management to place the State Emergency Operations Center in a “Level 2” status. “This will ensure that local, state and federal agencies are all working together and enhance the delivery of resources at the state’s disaster relief centers at Miami and Orlando international airports as they prepare to assist more families with services like crisis counseling, educational resources, job placement
services, medical services and help getting housing and drivers licenses,” Scott said in a prepared statement. The state designation follows a Federal Emergency Management Agency announcement that it will offer the option to relocate to the U.S. mainland to about 3,000 Puerto Rican residents still in shelters after Maria. FEMA reports that 59 percent of the island is still without power, potable water is inaccessible to 17 percent of the island and 8 percent of the island is without cell service. Scott, who declared a state-of-emergency on Oct. 2 as Florida prepared for the arrival of people from Puerto Rico, traveled to the Caribbean island last week with utility officials to discuss power restoration efforts. Puerto Rico Gov. Ricardo Rossello asked for Scott’s assistance as the head of Puerto Rico’s gov-
ernment power company, Puerto Rico Electric Power Authority, announced plans to sever a $300 million deal with Whitefish Energy Holdings over questions about a contract with the small Montana company. FEMA’s Transitional Shelter Assistance program, according to its website, “provides short-term lodging assistance for evacuees who are not able to return home for an extended or indeterminate period of time following a disaster.” The federal agency usually covers hotel costs for storm victims until they can find long-term housing. However, in Puerto Rico, hotels remain at capacity. FEMA is working on agreements with New York and Florida to handle storm evacuees on a temporary basis. The governor’s office said Florida expects to be repaid by the federal government for expenses related to FEMA’s assistance program.
