Sitton Sets Sights Downtown

As downtown Pensacola has morphed from sleepy office park to bustling entertainment district, one property with immense development potential has remained stuck in the past. Until now.

T

he downtown Post Office, beloved by customers for its convenience, is nonetheless housed in a building with far greater potential than its current use. With an expansive corner lot, wide courtyard and historic charm, the building at 101 Palafox Place is a prime piece of downtown property thus far untouched by the resurgence of downtown as the city’s premier entertainment district. That will all soon change as native son and Super-Bowlchampion-turned-developer Josh Sitton and his wife Kristen have purchased the property with plans to transform it by adding retail or restaurant space on the ground floor and residential units upstairs. Sitton said the couple had been looking for an investment opportunity downtown for some time before they became aware the 101 Palafox property was an option. “My wife and I are always looking for opportunities to invest in the downtown area,” he said. “A friend of ours introduced the property idea to us. It was off market so we had no idea it was even an option. We fell in love with

the building right away. We have always wanted to invest on Palafox and we personally don’t think there’s a better corner downtown.” Patrons of the downtown Post Office need not fear, the Post Office will remain in the building, just in a smaller footprint. As for what will fill the rest of the building once the Sitton’s are done with it, they’re not quite sure yet. They’re still in the very early planning stages. “Nothing is set in stone this early for the project,” said Sitton. “Our initial idea is to reduce the footprint of the post office downstairs and add retail and or a restaurant. Upstairs is a beautiful untouched canvas. The ceilings are 15 feet high and it is a beautiful old space oozing with charm. We plan on turning this space into condos or apartments. None of this is for sure yet. The property is so large and has so many possibilities that we won’t know until it happens.” Partnering with the Sittons on the project is Josh’s lifelong friend and president of Bear General Contractors Chris Jaubert. successful NFL career. Sitton retired from the NFL in April following an 11-season career that saw him take the field with Green Bay packers and Chicago Bears. Sitton won Super Bowl XLV with the Packers in 2011. The 101 Palafox property has a long history downtown and was once home to a Sears, Roebuck & Co., a Walgreens, a dry cleaners and the Downtown Improvement Board. The building was designated in honor of former Pensacola mayor Vince Whibbs, Sr. following his death in 2006. The water fountain in the courtyard was once located at the intersection of Palafox and Garden streets and used for watering horses. Sitton said watching downtown’s transformation since his youth has been inspirational and that, if they do end up putting condos on the second floor of the building, there’s a good chance the couple will keep one for themselves. “Where downtown is compared to when I was growing up here isn’t even close,” he said. “It’s amazing to see the transformation, and we’re so very happy to be a part of it!”

“Legal Graffiti” Foo Foo Style - Live Painting Event at Zarzaur Law Building to Take Place Nov. 8-10 in Downtown Pensacola Zarzaur Law, P.A., a personal injury law firm based in Pensacola, Florida, presents a special event that will be a Foo Foo Fest edition of its well-known “Legal Graffiti” event. This three-day live painting event will attract locals and visitors that are in the Downtown Pensacola area for the Foo Foo Fest activities happening during the first two weeks in November. Visitors can watch three artists work on large canvases using a variety of paint, including spray paint, just like the traditional “Legal Graffiti” fundraiser events hosted by Zarzaur Law, P.A. during the monthly Gallery Nights.

The artists will paint on a 6ft x 6ft vinyl canvas at the corner of Palafox and Romana Streets right outside of the Zarzaur Law building in Downtown Pensacola. Each of the three artist, Jaime Shevant, Gabe Pellerin and Patrick Quintanilla, who were chosen through a submission process, will create one original piece using a variety of paint mediums and techniques. “Being a part of this event brings me excitement to see where the Art scene and Pensacola community as whole will go. Being able to expose the community to Artist performing their passion could may encourage others to

take similar steps.” Said artist Gabe Pellerin. Zarzaur Law’s “Legal Graffiti” Foo Foo Fest Style will take place Friday Nov. 8 and conclude on Sunday, Nov. 10 in Downtown Pensacola on the closing weekend of Foo Foo Fest. A judge has ruled in favor of protecting a heritage live oak tree on North Spring Street that the City of Pensacola has been working to prevent from being cut down. On Wednesday, Oct. 30, Judge Jeffrey L. Burns of the First Judicial Circuit Court denied the property owners’ motion to dissolve a temporary injunction preventing the removal of the tree, allowing the injunction to remain in place. “The injunction will serve the public interest, as the tree ordinances in place were enacted by local government officials elected by the voters of the City, and are the reflection of the public interest of the residents of Pensacola,” Judge Burns wrote in his ruling. The Spring Street heritage live oak was at risk of being removed at the request of the property owners, despite

multiple expert opinions finding it to be healthy. The City of Pensacola filed a declaratory judgment action in an effort to save the tree and also raised some questions to the court to get clarification about how to interpret a new state statute that replaces local government processes for evaluating whether trees should be removed from residential properties to protect public safety. In his ruling, Judge Burns determined that the city proved each required element to keep the injunction in place, including presenting evidence that it will suffer irreparable harm and establishing that the injunction will serve the public interest. “There is an immediate danger of significant loss or damage if the injunction is not maintained, as an irreplaceable 200 plus-year-old tree will likely be removed without the injunc-

tion remaining in place,” Judge Burns wrote. The City’s Code provides for removal of dangerous trees and protection for certain trees that are healthy. The new state law delegates to professional arborists and landscape architects the duty to determine if a tree is unsafe, but it does not specify the documentation needed to make that determination. How that decision is made and whether it is objective were among the questions posed in the city’s declaratory judgment action. Judge Burns provided some guidance on interpreting the new state statute, concluding that any documentation rendered on whether a tree is dangerous must conform to industry standards applicable to certified arborists and licensed landscape architects.

His ruling also stated: “Accordingly, the only reasonable interpretation of section 163.045 (1), Florida Statutes is one where: (1) an arborist or landscape architect must determine that a tree is a danger; and (2) for the determination and documentation to be rendered utilizing only the methodologies and official documents applicable to the two respective industries.” The City of Pensacola strives to have practices that respect individual property rights that are also not burdensome on property owners, but the city also places value in protecting healthy trees from being destroyed. The hope is that guidance with this new state statute will not only help Pensacola and its residents, but also other municipalities that are looking for assistance with interpreting this law.

In the Subway 5K race, Nikki Boltja, 27, of Mooresville, North Carolina, won in 21:42. Second in the Subway 5K was Ashley Leisher, 21 of Harrisburg, Pennsylvania and third was Autumn Rouke, 35, of Ft. Myers, Florida.

The primary charity partner for the Women’s Half Marathon was Rally Foundation for Childhood Cancer Research, a 501(c)(3) nonprofit, that empowers volunteers across the country to raise awareness and funds for childhood cancer research to find better treatments with fewer long-term side effects and, ultimately, cures. Pensacola Sports and the City of Pensacola Create City Running Championships

Pensacola Sports, in conjunction with the City of Pensacola, is excited to announce the Bayou Hills Run will now be known as the Bayou Hills Run City of Pensacola 5K/10K Championships. Runners will now have the opportunity to earn bragging rights and the title of City Champion. The date of the Bayou Hills Run City of Pensacola 5K/10K Championships is Saturday, March 28, 2020. Ray Palmer, President and CEO of Pensacola Sports, said, “We have always had a great partnership with the City of Pensacola. With the City sponsoring the Bayou Hills Run and joining us in creating the City Championships, we are excited for the opportunity to strengthen that relationship and elevate this already successful

lenging race that includes several steep inclines and declines, fitting for a city championship. The course begins and ends at Bayview Park and goes down the bayou, through the 12th Avenue tree tunnel, and all throughout one of the most beautiful neighborhoods in Pensacola, Historic East Hill. Join Bike Pensacola on November 16 for the most popular bike ride in town--the Slow Ride! Each month we explore the quiet, scenic streets of Pensacola’s many historic neighborhoods for a fun and leisurely ride among friends. For November our host is Gulf Coast Kid’s House, and our sponsor is an anonymous slow rider who stepped-up to make sure we get to ride this month. Pensacola State’s Vet Tech Program Open House to be held Nov. 13

The Pensacola State College Veterinary Technology Program Open House is set for 3-7 p.m. Wednesday, Nov. 13, on the Warrington campus. Visitors will have the opportunity to meet the Vet Tech Program instructors and tour the college’s state-of-the-art facility in Building 3200 at 5555 W. Highway 98, Pensacola. The event also includes financial aid information, student organization exhibit and animal ambassadors. The two-year program covers a wide range of subjects including animal behavior and husbandry, clinical procedures, anesthesia, lab diagnostics, medical and surgical nursing, radiology, dentistry and office management, said Vet Tech Program Director Sarah Meyer-Paterson. The Vet Tech program prepares students to take the Veterinary Technician National Exam (VTNE). Once a student passes the VTNE, they are eligible to

practice as a Credentialed Vet Tech in the state to which they apply to practice. In the past seven years, 76 students have graduated from the Pensacola State program. The program also is nationally accredited by the American Veterinary Medical Association’s Committee on Veterinary Technical Education and Activities, and attracts students from not only Florida – but Alabama, Mississippi, Louisiana and even Maine. “In the past, we’ve had students from as far away as California,” Meyer-Paterson said. “We also have had several nontraditional students who have entered the field as a second or third career.” Program graduates have an 88 percent VTNE pass rate and Meyer-Paterson describes veterinary technicians as “credentialed multi-disciplined nurses of the veterinary world.” “We are the ancillary staff for veterinarians. The responsibilities of a veterinary technician include

radiology, surgical assistance, administering anesthesia and so much more. It’s not an easy program; it is a challenging but very rewarding career field,” she said, adding students complete supervised clinical rotations at approved area veterinary hospitals. “This gives students firsthand technical experience working with patients and clients, as well as seeing each hospitals’ daily operation and staff interaction.” Also, veterinary technicians can find employment in general or specialty veterinary hospitals, biomedical facilities, wildlife facilities, academia, industry and more. Employment of veterinary technicians is forecasted to grow 19 percent nationally, faster than the average for all occupations, through 2024, according to the U.S. Bureau of Labor Statistics. Legislative efforts to allow Florida college athletes to get paid for endorsements will go forward, even though the NCAA’s governing board voted unanimously Tuesday to move toward letting student athletes make money on their names, images and likenesses. Sen. Debbie Mayfield, R-Rockledge, said in an email she plans to continue moving her “common-sense legislation forward” with Rep. Chip LaMarca, RLighthouse Point. The Republicans have filed two bills (SB 646 and HB 287) on the issue for the 2020 legislative session, which starts in January. “In reviewing the NCAA’s decision, the board has asked each division to create new rules beginning immediately, but no later than January 2021,” Mayfield said. “Our legislation, if passed, would keep them accountable because it would go into effect July 1, 2020.”

Florida Secretary of State Laurel Lee has sent a memo to county elections supervisors with direction about complying with a federal judge’s ruling on felons’ voting rights --- but questions remain about how the state will move forward. “In the interim, we are currently evaluating the order and considering our options,” Lee said in the memo, which her office provided Wednesday to The News Service of Florida. “We will offer subsequent guidance as may be needed. In the meantime, if you have any specific questions regarding compliance, please don’t hesitate to contact us.” The memo came after an Oct. 18 ruling by U.S. District Judge Robert Hinkle in a case stemming from a 2018 constitutional amendment that restored the voting rights of felons “who have completed all terms of their sentence, including parole or probation,” excluding people “convicted of

Juan Peñalosa, executive director of the state Democratic party, told reporters that the party has registered more than 17,000 voters since June. Party workers have registered more Democrats than Republicans --- a major part of the Florida Democrats’ 2020 strategy --- for four consecutive months, he said. “We learned our lesson in 2018 … and we have been taking Donald Trump seriously since he was elected in 2016,” Peñalosa said during a conference call Friday morning. To continue to boost the number of Democratic voters, the party has put $3 million into registration efforts, he added. The party ultimately hopes to register 200,000 new Democratic voters by July 2020. Democrats have good reason to focus on voter registration. HEALTH INSURER TO OFFER LYFT RIDES News Service of Florida Staff Florida Blue announced that Affordable Care Act customers will have access to Lyft rides as part of the benefits package in individual health-insurance policies, beginning Feb. 1. The goal is to ensure policyholders can access needed health-care services, such as doctor’s visits, or trips to the pharmacy. The policyholders will have $100 in transportation benefits from Lyft, a ride-sharing service. Jacksonville-based Florida Blue, which offers Affordable Care Act policies in 67 counties, has sold individual policies to more than 1 million people in 2019 under the Affordable Care

Act, commonly known as Obamacare. That is out of more than 1.6 million people in Florida who have purchased individual policies on the Obamacare exchange this year. In a news release announcing the ride-sharing benefit, Florida Blue noted that people without reliable transportation can miss appointments. That can lead to “disruptions in care, and in turn, increased costly hospital and emergency room visits.” Open enrollment under Obamacare for 2020 health-insurance coverage began Friday and runs through Dec. 15

The latest data showed an increase of eight cases in the last week, according to a News Service of Florida analysis. The number of deaths associated with the lung illnesses remained at one. The nation had 1,888 lung-injury cases associated with the use of e-cigarettes or vaping, as of Oct. 29, the federal Centers for Disease Control and Prevention reported Thursday. Every state but Alaska has had at least one reported case of the vaping-related illness, which has caused 37 deaths in 24 states, according to the CDC website. The federal government announced Monday that THC products are playing an important role in the multistate outbreak of vapingrelated illnesses and recommended that people not use vaping devices that contain

News Service of Florida Staff Gadsden County School District administrators erroneously distributed nearly $39,000 in teacher bonuses to individuals who were not eligible for the awards under the state’s “Best and Brightest” scholarship program, according to a report issued by the Florida Auditor General this week. The audit, released Tuesday, found that the district offered awards totaling $13,238 during the 2018-19 school year to school counselors, pre-kindergarten teachers and assistant principals, who were ineligible to receive awards under the program’s guidelines. Auditors also found the district offered awards of $800 to 146 teachers, who only should have received $709, resulting in overpayments of more than $13,000. The audit also found that 13 classroom teachers received awards that totaled $12,000 during the 2018-19 school year, even though they had separated from the district during the school year. Under the bonus program, school districts are required to determine whether instructors who have been granted the awards are still teaching in Florida, and thus remain eligible for the awards. But the Gadsden administrators did not keep such records, auditors found. The audit noted that district personnel said the errors occurred because the employee who administered the bonus program retired in the middle of the school year. The district also said the state Department of Educa-
