GENERAL NOTES

Persons unknown to the Auctioneers and who pay by cheque will have their goods impounded until cheques have cleared. The Auctioneers reserve the right to refuse a bid off any potential unknown customer.

All bidders should note that in many cases video security will be on site. Viewing and Inspection – Strictly on sale day only from 8.30am onwards.

Conditions of Sale – Bagshaws usual farm sale conditions of sale shall apply at this sale, copies of which are available from the Town offices or the on-site sale office.

Cash – Under the money laundering regulations the auctioneers are unable to accept cash in sums greater than €10,000 (or its Sterling equivalent). Please contact the auctioneers to discuss methods of cash payment prior to the sale.

Commission Bids – The Auctioneers will be pleased to execute written commission bids on behalf of persons unable to attend the sale. For further details please contact Mark Elliott on 07973 673092.

Export Purchasers – All goods must be paid for in pounds sterling (£).

VAT on Export Goods – Under regulations imposed by HM Customs & Excise, the auctioneers must account in a proper manner for VAT on export goods. All customers must pay all VAT on the purchase price of goods on sale day. On receipt of all relevant export documentation and bills of laden (which must be received in the prescribed time limits), the auctioneers will then refund relevant VAT sums.

Post Sale Insurance-The Auctioneers are unable to provide insurance on any lot in the sale. The Purchaser is responsible for insuring any item with effect from the fall of the hammer.

Buyers Premium – For Purchasers On Site there is no Buyers Premium payable at the sale.

Pre-Registration for Live Online Bidding, and SurchargesOn-line bidding is available through the Bagshaws platform on www.auctionmarts.com. Please visit www.bagshaws.com and follow the registration button on the on-line sales page. All prospective purchasers must register by Wednesday 3rd May at 3:00pm. General Notes

Bagshaws LLP cannot accept any responsibility for loss of internet connection. All lots are sold strictly “as seen” without warranty. Lots will only be invoiced to the name and address of the registered purchaser and cannot be transferred to another name and address. Bagshaws can only accept payment from the registered Bidder.

Online Sale Time – Please note the online sale commences at Lot 401 (As detailed in this catalogue) which will not commence prior to 12:30pm on sale day. There will be no online bidding for the small lots within this sale.

Machine Hours – Machine hours have been taken as at Wednesday 22nd February 2023. These are given for information purposes only and are not guaranteed by the Auctioneers.

Inspection of Powered Equipment-

No individuals are allowed to start or move any powered plant, vehicle or self-propelled machine, (tractors etc) without the prior consent of the vendor or a Bagshaws representative. Full health and safety procedures must be adhered to at all times.

Telehandler Loading Facilities – Telehandler loading facilities will be available on site up until approximately 5.30pm on sale day.

General Notes

Loading

It is the responsibility of the purchaser to arrange for the safe loading & transport of all and any purchases.

Bagshaws are under no obligation to provide assistance in loading but on occasion they will do their best to help provided that it is not putting themselves, the purchaser or other people at risk of injury.

For large, heavy and unwieldy items, specialist loading and transportation will be required for example bulk bins and tanks. The decision made by Bagshaws will be final.

Foreword

This genuine dispersal arises as a result of the Kay family re-arranging all their farming activities and many locals will know that all the cattle have already been sold from the farm with contractors used for arable operations.

The Kay family have been at Moor Farm since 1971 with the majority of the kit owned from new.

All the tractors together with the JCB Telehandler have been owned from new and carefully driven with the Marshall Trailers together with the Bailey 12 Ton Grain Trailer all owned from new and barn stored.

There is a comprehensive range of sundry kit together with an Opico Gas Fired Dryer which sits under a permanent cover and is in very good order.

Purchasers should attend and bid with confidence at this May sale where online bidding is available for the larger items and tractors.

It is expressly brought to the bidders attention that at the time of sale, items of plant, machinery and equipment may not necessarily comply with the requirements of the Health & Safety at Work Act 1974, and its’ associated regulations, governing the use of plant, machinery, and equipment at work.

Whilst Bagshaws take all reasonable steps to ensure the integrity of sale items, or make bidders aware of any known defects, anyone purchasing an item must ensure it is safe, and complies with all relevant regulatory requirements, before it is used in a work environment.
