While we were researching this story we were greatly surprised to learn just how many veterinarians in California are subject to disciplinary actions . . . and, of those listed, how many had problems with alcohol and controlled drugs. We had no idea there was such a substantial number.

We were also impressed with how thorough the California Veterinary Medical Board was in reviewing and investigating complaints and, when called for, filing charges agains the The Paper - 760.747.7119

I was shocked when I learned that Dr. Dorota Pearson and her practice, Pearson Animal Hospital, had been placed on probation for five years as part of a stipulated settlement.

Evelyn Madison and I knew her; she was a regular advertiser with The Paper for several years, having a weekly column with pet advice.

Well written and interesting. A former fashion and photographer's model in Poland, she was a beautiful woman, though always somewhat

aloof.

I took her for lunch once and she opened up . . . in the office and during business hours, however, she was all business.

I obtained and read the record filed with the court by the California Veterinary Medical Board.

Shocking!

Unbelievable. Such an attractive, apparently skilled, person, graduate of Iowa State’s Veterinary School,

who seemed to be so lacking in compassion and care for animals entrusted to her!

But Dr. Pearson was only the first of two major shocks to us regarding veterinarians we had used in the past.

We also had used Dr. Brian Hosking and his San Marcos Animal Medical Center on Rancho Santa Fe Road in San Marcos on numerous occasions.

shut down and had his veterinary license suspended. Reason? The Veterinary Medical Board found that Dr. Hosking presented “present an immediate danger to his patients and the public because of drug use and a mental health condition.”

We knew that Dr. Hosking worked long hours, often till 8, 9, 10 pm, and that he was superb with our animals and had a waiting list of adults with pets that needed veterinary care.

None of use knew of his problems with alcohol, drugs, and mental health issues.

We decided to look into both cases.

Here’s what we found:

In the case of Dr. Dorota Pearson, the record shows repeated violations of the laws concerning care of animals. It also reported instances of apparent cruelty by Dr. Pearson toward animals left in her care.

Hospital regulations require a wheel chair for patients being discharged.

However, while working as a student nurse, I found one elderly gentleman already dressed and sitting on the bed with a suitcase at his feet, who insisted he didn't need my help to leave the hospital.

After a chat about rules being rules, he reluctantly let me wheel him to the elevator. On the way down I asked him if his wife was meeting him.

'I don't know,' he said. 'She's still upstairs in the bathroom changing out of her hospital gown.'

her request, and gave her a chance to respond to a number of items in the Accusation. Her comments are noted in italics following some of the the allegation/accusation(s):

On May 8, 2017, the Board's Hospital Inspectors, SS and Doctor TP, Division of Investigation team members (DOI), TC, KH, SR, MP, JP, and LG, and Drug Enforcement Agency (DEA) agents LB and BC conducted a complaint related inspection at Respondent Hospital.

During the inspection, the teams interviewed employees MG, BV, TP, DF, CR, TS, YW, LH, AD, NH, MR, JW, and GM. The inspection included the scanning of 146 medical/surgical records. The DEA investigated the drug logs. The inspection revealed 24 items for correction.

Dr. Pearson The DEA agents entered the Veterinary Clinic with guns drawn. Totally unnecessary.

The Board assigned Investigator TC to review the complaint. As part of the investigation, TC interviewed employees, reviewed the documentation and photographs provided by MG and coordinated a complaint related inspection on May 8, 2017.

We wrapped up our up-close tour of British history by driving by the birthplace of modern democracy and probing every corner of the multi-roomed house that was home to the man probably most responsible for saving it during World War II.

Chartwell, the estate Sir Winston Churchill bought in 1922, is nestled in the Kent countryside about an hour south of London. As our hosts, Grahame and Frauke Leon-Smith from Surrey, guided us through the proprieties of afternoon tea in a nearby restaurant, Grahame wrapped up our visit with, "Nothing pretentious. You could move into the house right now and be comfortable."

We had worked our way up through history rather quickly, starting with a "flight" aboard the London Eye, the 44-story Ferris wheel overlook-

ing Big Ben, the British Parliament buildings, and Westminster Abbey from the south bank of the Thames River.

Before visiting Churchill's home, we drove to Windsor Castle, with its 1,000-year-old tower. From there, we strolled across the Thames to Eton and stopped for a bit at the Cock Pit Restaurant, a pub that's been on the same site since 1420.

Then we whisked past Ascot, playground of British royalty for centuries.

We slowed down a bit as we cruised by Runnymede, the meadow where King John signed the Magna Carta, the birth certificate of democracy. "For the first time in history, people were ruled by law, not the whim of the king," Grahame

Dr Pearson: This did not happen.

I conducted hundreds of C-Section surgeries every year and never had an animal die as a result of the surgery.

This was a story made up by a disgruntled employee (MG). She did not like me and spent her time behind the scenes taking notes and false photographs, trying to build a case against me.

(Later, MG would file suit against Dr. Pearson and collected a $200,000 settlement, paid for by Dr. Pearson’s insurance company. MG sued for Unlawful Termination. Dr. Pearson said she was not fired, she came to work one day and left after having been on site for only one hour. This, says Dr. Pearson, is because the rest of the staff was upset with MG and would not talk to her because, Dr. Pearson alleges, MG was the one who had called KFMB-TV8 on May 8, 2017, and was in the parking lot gleefullly taking pictures of the ensuing raid and TV8’s television coverage of the raid.)

were nine patients with their animals inside the clinic when DEA agents, with guns drawn, and the other investigators entered the premises.

Not once, Dr. Pearson says, did MG confront her personally and discuss anything she was unhappy about or did not approve of.

In one case, says Dr. Pearson says, MG took a photo of a cage with feces on the floor as a result of an animal’s diarrhea. Rather than clean it up, which was her job as a veterinary tech, she took a photo that inferred the clinic kept unclean facilities. Again, this was not true, says Dr. Pearson. Dr. Pearson also claims the DEA found no violations.

Poor Patient Care Witnesses reported patients were maintained in the laundry room and near the freezer containing deceased patients.

MG reported that Respondent Pearson commonly used the same towel for the patient for surgery, shaving, recovery, and when placed in the kennel. MG believed there was little to no sterility between preop, surgery, and post op.

BV confirmed that kennels were consistently not cleaned after patients were removed, and new patients were repeatedly placed in contaminated kennels.

They also stated Dr. Pearson provided the same dosage of medication to all patients, regardless of the

As part of the complaint related inspection Doctor TP conducted a visual inspection of the hospital and discovered debris and fur in unoccupied animal compartments, corners of all surgery rooms, inside the refrigerator, and some exam room drawers. Shelves contained dust, debris, fur, and staining underneath the medication and injectables. The containers housing the endotracheal tubes contained excess debris and fur mixed in with the endotracheal tubes. The surgical room counter tops, floor and clipper blades were dirty with fur and debris. Human beverages were housed in a treatment room.

Then it was on to the home of the man who was called "the greatest Englishman of our time" when he died in 1965 at the age of 91.

Churchill paid 5,000 pounds for the original 80 acres in 1922 and kept supporting it with proceeds from his books, the first of which was about his grandfather, the 7th Duke of Marlborough who was elected to Parliament before becoming a member of the House of Lords. He added to the property over the years, even raising cattle on the low rolling hills.

"Churchill was never poor," said our tour guide. "He earned his money from royalties as a writer.

He used to say, 'If your outgo outdoes your income, increase your income.'"

The dozens of bookshelves that make up much of the walls in the estate were bowed with books, many of them written by him.

Drafts of several of his books were peppered through his various offices, dens and libraries.

The Paper • Page 4 • June 2, 2022 Man Dies in Solo Motorcycle Accident - Escondido

On May 23, 2022, at 1:20 a.m. the Escondido Police Department received a report of domestic violence in the 300 block of West Vermont Avenue.

The caller had advised the possible suspect in the domestic violence was on a Harley Davidson motorcycle. As officers were responding, they saw a 2015 Harley Davidson motorcycle northbound on Escondido Boulevard, turning east onto Felicita Avenue.

Officers made a U-turn to stop the motorcycle, but the rider had accelerated rapidly and was already out of sight.

The motorcyclist had continued east on Felicita Avenue, which becomes 17th Avenue east of Juniper Street. Upon reaching a significant curve in the road near Encino Drive, the motorcyclist lost control of the motorcycle and collided with a fence and streetlight. The motorcyclist, a 44-year-old man, was pronounced deceased by Escondido Fire Paramedics at the scene.

This collision is being investigated by Traffic Investigator Tyler Herrmann.

MISSION MIDDLE SCHOOL STABBING UNFOUNDED

On May 12, 2022, officers of the Escondido Police Department were called to Mission Middle School for a reported stabbing victim.

The 13-year-old was reported to have been stabbed in the 700 block of East Mission Ave, about a block and a half away from the school. The victim suffered minor cuts. Initially, the attacker was described as a possibly high school aged male wearing all black clothing. Detectives were able to determine that the crime was falsely reported. The 13- year-old and a friend were “horsing around” when he was unintentionally cut by a knife the friend was carrying. The 13-year-old then went to the school and told staff the false story, so as not to get himself or his friend in trouble.

Detectives are evaluating if any juveniles will be charged with filing a false police report or any other crimes. The Escondido Police Department would like to thank everyone who attempted to assist in the investigation of this stabbing and who showed concern for the child involved.

County Supervisors Approve Purchase of Helicopters for Fire Suppression

The County Board of Supervisors voted to strengthen aerial fire protection in the region by approving the purchase of a new twin-engine firefighting helicopter and adding two additional firefighting helicopters to a firefighting response agreement with San Diego Gas & Electric.

Man About Town

A memory from 10 years ago . . .

This afternoon we did something we should do more often.

We went for a car ride.

Back in the day before television (yes, there was such a time) we would often go for car rides. Mom, dad, myself and my late brother, Gene . . . and the family pup.

Car rides were an enjoyable experience. So was today.

We had a few errands to run, I needed to fuel up the car . . . the girls (Trixie and Cindy) are always ready for a car ride . . . so me, evelyn, and the girls, all jumped into the car and took off.

The car ride took me back to many other pleasant car rides.

I remember the four and a-half hour drive from Omaha to Grandma's farm in southern Minnesota.

Always great to arrive at our destination and get the hugs and kisses from grandma . . . but the journey was almost as great as arriving at the destination.

I remember going through really small, colorful towns . . . in both Nebraska and Iowa (for we'd cross over into Iowa when we reached Sioux City, Iowa . . and finish up the journey from there . . . our halfway point.)

I wish now we'd taken the time to stop and visit in some of those small towns. Perhaps get to know some of the people . . . the legends of the town, the culture of the towns ... often, there's a lot of interesting history there. But, no, we drove right on through . . . all too anxious to see Grandma again.

The Bell 412 EPX helicopter will be the first twin-engine in the Sheriff’s fleet. A twin-engine helicopter is safer, can fly at night, hoist more weight, carry more water and reach more locations to pick up water.

“The reality is we need a twin-engine firefighting helicopter in our county firefighting arsenal. This has been a long-desired goal of making sure as a region, we’re better prepared to fight wildfires,” said Board Chairman Nathan Fletcher at the meeting. “We know over time we will need more than one but moving forward now with one is the right step as we confront the realities of much more devastating risk of wildfires than we’ve seen in the past and we upgrade our fleet air support arsenal.”

The San Diego County Sheriff’s Department firefighting and search and rescue helicopter fleet now consists of three Bell 205 helicopters built in the 1960s and 1970s. During wildfires, CAL FIRE/San Diego County Fire Protection District staff the helicopters, except for the pilot, for water drops. Eventually, all the Sheriff helicopters will be replaced with twinengine models.

“It’s the next generation for ASTREA (Aerial Support to Regional Enforcement Agencies),” said Sheriff’s ASTREA Sgt. Gavin Lanning.

I come from small town people.

Windom, Minnesota, where I was born . . . was small. Maybe 5,000 population. Maybe less. There was a standing joke that one reason Windom never really grew is that every time a baby was born, someone left town.

Small towns tend to have rich histories. But sometimes we're too busy . . . or in too much of a hurry to stop and explore them.

Today, I'd love to have the late Charles Kuralt's old job. Driving America and stopping to visit the small towns, villages, and cities . . . and getting to know the stories that lay within them. His "On the Road" series was a fascinating look at America.

All these thoughts passed through my mind . . . in just this one afternoon.

Just because we decided to get out of the office and go for . . . a car ride.

That SOB has caught me three times this week alone!

•••• Youngest son Kenny stopped by today to fix our television. (He's an audo-visual genius). Afterwards, we were relaxing, enjoying a bottle of Guinness together.

He told me of a time, three years ago, when he had visited his cousins who live in Belfast, Northern Ireland. Came evening time and they decided to adjourn to a pub for pint . . . a good auld Irish tradition.

"We drove about 15 miles outside Belfast, along these ancient, winding roads . . . roads that have been there for centuries. Pitch dark.

Finally, we came to the pub. A beautiful, traditional, Irish pub.

Dark, smoky, lovely. I ordered a Guinness. All four of the other lads ordered . . . a Bud Light!"

"Bud Light?!" I asked.

"Yep. We went all the way to Ireland . . . the home of fine beers, lagers, ales . . . and, of all things, they ordered Bud Light. I don't drink that crap here at home . . . sure wasn't gonna drink it there. I had another Guinness. They had another Bud Light. They apparently love the stuff."

At least our Irish cousins could take great comfort in bragging that they were drinking . . imported beer.

ously spayed. Respondent Pearson anesthetized "Velvet" and asked the contract veterinarian assisting to open "Velvet" for surgery.

BV observed Respondent Pearson drag patients by the leash and described her treatment of patients as cruel.

BV stated that Respondent Pearson repeatedly did not conduct examinations of patients prior to giving a vaccination, and did not learn the patient's vaccination history for possible reaction to the vaccine.

On May 4, 2017, TC interviewed DF, an independent contractor for Respondent Pearson Animal Hospital. DF stated that he terminated his employment after an incident where he was called to perform surgery on a patient that Respondent Pearson had not examined prior to placing the patient under anesthesia.

TTP described the surgeries conducted at Respondent Hospital as an assembly line. Respondent Pearson will have the patient anesthetized on the surgical table, conduct the surgery, then have the next patient brought in so that she can just change gloves. This practice results in patients being anesthetized longer than necessary.

TP reported that Respondent Pearson will call while driving to the office and order patients to be anesthetized prior to her arrival.

Respondent Pearson would also see patients in exam rooms while other patients were under anesthesia.

Dr. Pearson: In all my years of practice I cannot reacll ever losing a dog due to anesthesia.

During the hospital inspection, staff members informed TC that some animal compartments remained in the room during radiographic exposure of other animals resulting in an exposure to unnecessary radiation.

Inadequate Shaving for Surgery

During their interviews, MG, TS, and NH informed TC that Respondent Pearson ordered employees not to shave show dogs for surgical preparation.

Dr. Pearson: We had many breeders with show dogs, expensive dogs.

Sometimes $10,000-$20,000 dogs.

If they are in a show with shaved legs they are disqualified. Yes, we did try to help patients., who were breeders and would not shave their legs . . but that was the exception rather than the rule.

TS stated there were multiple records of clients that had a no shaving policy written in their charts.

These clients included Castle Creek N Cavaliers, Sharing Puppy Love, and Van Lewen's Cocker Spaniels.

TS stated Respondent Pearson instructed staff daily not to shave surgical sites prepared for surgery or placement of intravenous catheters.

were instructed not to shave for IV catheter placement at the breeder's request. MG recalled that medical records reflect "don't shave" because the clients are breeders or the patients are show dogs.

Administration of Diluted Vaccines Against Manufacturer's Recommendations

BV stated Respondent would mix Dexamethasone (Dex) with the rabies vaccine as a dilutent and charge each client for the full vaccine even if the patient did not receive the full dose.

TP stated she vaccinated over onehundred animals and used Dex in every vaccination. TP stated Respondent Pearson would direct her to give half the dose and still charge for a full vaccination.

CR received direction from Respondent Pearson to not provide the full vaccination and to dilute vaccines with Dex. Even if the patient did not receive the full dose, the rabies certificate was still completed and the client charged full price.

AD stated she was aware that Respondent Pearson diluted vaccines and that Respondent Pearson directed her to not vaccinate to the full dose of vaccines including vaccines for Felv/FIV and rabies.

Respondent Pearson directed NH and GM to not administer the full dose of a vaccine for distemper and rabies.

Authorization for Blood Donation or Transfusion Involving Patients

TC interviewed MG regarding Respondent Hospital's blood donation policies. MG stated that Respondent Pearson is known for repeatedly obtaining blood from patients to be euthanized without obtaining the owner's consent, including patient "Bart Chandler," who was euthanized and blood harvested without approval.

blood is donated by Labs and More where the dog's origin and health status is unknown.

NH and MR stated that Labs and More has a "standing consent" for blood donation.

Blood donation occured at the time of euthanasia. NH and MR confirmed the blood source was untested and in some instances came from donors that were euthanized as a result of complications from dog bites.

Alteration of Health Certificates/Maintaining Written Records During her interview, MG stated Respondent Pearson will falsify certificates on sick patients such as patients from EM's pugs and LG's feline sphinx.

MG indicated that Respondent Pearson changed medical records to reflect that canines from Mexico were listed as canines from the United States and checked clear of all vaccinations and blood tests, although the canines were from Mexico and were not properly tested or vaccinated. MG believed Labs and More patient "Menda's" record dated September 21, 2016 would reflect this alteration.

BV recalled "Coco" as a patient who received a vaccine, had a reaction, and died. BV stated following the death, Respondent Pearson instructed that "Coco's" medical record be changed to reflect that an exam regarding possible reaction to the vaccine was conducted, when it wasn't.

Dr. Pearson: I deny that allegation.

BV stated Respondent Pearson did not test or document donor blood to include when it was spiked or tested.

During the complaint related inspection, Doctor TP found many medical records lacked patient history or pertinent information, physical examination information, actual dosages of medications administered to patients based on patient's weight, and lacked notation of daily progress or response to treatment.

Other records contained client signatures on blank forms for 16 anesthesia release including clients AR, AL, and AC.

Dr. Pearson: At the time blood was selling for $500 per unit and transfusions would run up to $1600 which many clients could not afford - so we had a difficult decision. Do we let the dog die? Or do we transfuse donated blood and save the animal’s life? So, yes, we used blood which often was donated by rescue organizations we serviced, from animals that were scheduled for euthanasia.

Healthy dogs, for example, but dogs that could not be trained to not be aggressive and dangerous.

MG stated Respondent Pearson would send bulk medication home with breeders and rescue organizations. Respondent Pearson would also dispense medication without seeing or establishing a patient relationship. Doctor TP learned that Respondent Pearson, TS, and JW consistently failed to wear gowns for small spays and neuters. When questioned about wearing the required surgical attire, Respondent Pearson admitted to not wearing a gown during these procedures.

BV also confirmed that Respondent Pearson obtained blood from euthanized or dying patients without client consent or approval.

During the complaint related inspection, CR confirmed that Respondent Pearson did not test the blood acquired by donation. CR stated much of Respondent Hospital's

Employee TP reported that Respondent Pearson did not require surgical gown for aseptic surgeries, specifically C-sections, exploratory surgeries, bowel surgeries, and gall bladder surgeries.

As a result of the raid and inspection of premises and staff, the Veterinary Board made the following findings: FIRST CAUSE FOR DISCIPLINE (Negligence)

Respondent Pearson is subject to disciplinary action under section 4883(i) of the Code in that she committed negligence, or incompetence in the care and treatment she provided to patients. Respondent Pearson instructed staff not to shave certain patients prior to the placement of intravenous catheters and for surgical preparations. The medical records obtained during the complaint related inspection on May 8, 2017 contain documentation that specific animal patients were not to be shaved for intravenous catheter placement or surgery.

b . Respondent Pearson administered inadequate quantity rabies vaccines and compounded with an injectable steroid of Dexamethasone to the vaccine to reduce vaccine reactions in the animal patients. Respondent Pearson instructed staff to administer reduced rabies antigens mixed with Dexamethasone to the vaccine to reduce vaccine reactions in the animal patients.

C. Respondent Pearson collected, stored, and administered blood products from blood donors that were not blood typed and were not screened for blood borne diseases prior to use in surgical patients.

d. Respondent Pearson and Respondent Hospital maintained unsanitary conditions in surgical and treatment area resulting in an unsterilized environment. Respondent Pearson did not properly quarantine patients from infectious disease exposure. e. Respondent improperly housed large dogs in small cages. f . Respondent did not properly monitor patients during recovery and unnecessarily anesthetized patients for surgeries previously completed or for long periods of time.

SECOND CAUSE FOR DISCIPLINE (Fraud) She engaged in fraudulent activity, when she administered an inadequate/partial volume of rabies vaccine to animal patients and charged the clients for an administration of a full vaccine.

Beating the Deadline

May 27th was the “House of Origin Deadline,” the final day for bills to pass out from the legislative house in which they were first introduced.

Since this is the end of a two-year session, any bills that failed to pass by the deadline have died.

I’m very happy two more of my bills made it through the process.

During recent wildfires, we all became more aware of the tremendous contributions made by tribal fire departments in our rural district and in many areas throughout the state. Unfortunately, under current regulations, dependents of tribal fire fighters who are killed or injured during the performance of their duties are not eligible for scholarships or other death/injury benefits generally available to firefighters and peace officers. My bill, AB 2661, will make tribal fire department employees eligible for those benefits. The bill is supported by the California Forestry Association and tribal governments. AB 2661 passed the Assembly without opposition and is now pending in the Senate, where prospects seen bright.

There are lots of contentious issues in Sacramento, but that doesn’t keep legislators from both sides of the aisle from coming together to pass bipartisan legislation that benefits everyone.

Last week, we passed two important Board items that will help the lives of San Diegans.

The first item dealt with seniors.

Seniors are the fastest-growing population in North County and we must do all we can to help them by bringing resources directly to senior centers.

I have partnered with Supervisor Anderson to bring County staff to senior centers that will provide information on special programs and services that can help seniors. If passed, the initiative will implement a one-year pilot program to the Escondido Park Avenue Community Center and College Avenue Center at Temple Emanu-El, both of which serve seniors.

This will help bring vital information to seniors regarding living cost reduction, maintaining healthy habits, and how to avoid eviction from their own homes.

The second item is about fire safety.

Camp Fox, is located within the Cleveland National Forrest at the base of Palomar Mountain. For over 75 years, the San Diego County Board of Education (SDCOE) has used the camp as an outdoor education experience for 6th graders

across the County.

The deed granting ownership required SDCOE to return the property back to the County if they no longer wanted to occupy the land.

Seeing a unique opportunity, I've put forth a Board letter for CAL FIRE to use Camp Fox as a fire center for year-round training.

CAL FIRE will make improvements to the property, investing significant resources to clear overgrown vegetation and update the aging buildings. Once renovations have been completed, four CAL FIRE Firefighter 1 hand crews will inhabit the property, providing 24hour wildland fire protection coverage.

This will help greatly as we head into fire season.

Q: I recently bought a professional camcorder online. I received a small cloth purse instead. I disputed the purchase through PayPal and sent a photo of the purse.

PayPal claims that it spoke to the merchant, who provided proof of delivery of the item. But their "proof" doesn't prove I received a camcorder.

Can you help me get a refund? -- Ken Engelman, McKenzie Bridge, Ore.

A: You should have received the camcorder you ordered, of course.

But before I get to that part, a disclosure. You publish a newspaper that runs my Problem Solved column, and decided to avail yourself of my nonprofit organization's advocacy services. We try to help everyone, so my advocacy team and I are happy to assist you. I'm also very grateful that you've decided to run this column, which allows us to help your readers.

PayPal states that if an eligible item that you’ve bought online doesn’t arrive, or doesn’t match the seller’s description, PayPal's Buyer Protection "may" reimburse you for the full amount of the item plus postage. A careful review of PayPal's Buyer Protection suggests that your camcorder is covered.

But I'm worried about the "may" in PayPal's agreement -- it sounds kind of noncommittal. Your records suggest PayPal reached out to the merchant, which assured the company that it had sent you the camcorder.

But then PayPal simply closed the case without really getting your side of the story. That's not what I would call due diligence.

You might have reached out to one of the PapyPal executives for help, although lately, even emails to PayPal executives meet with form email and bot replies.

The key to solving your case was in the "proof" the merchant sent. The camcorder weighs 3 pounds, but the package you received was lighter.

Therefore, they couldn't have sent you a camcorder.

I reached out to the merchant, but the listing site was permanently closed.

That made me wonder if PayPal had indeed contacted the merchant, or if it just said it did. I contacted PayPal. It reviewed your case and refunded your purchase.

Q: I booked a Vrbo rental in Philadelphia for a birthday party with my friends. The code for getting into the rental was incorrect. I contacted the property manager multiple times on three different platforms and did not get a reply. I ended up staying somewhere else.

I would like a full refund and for this property manager to be off of Vrbo and Airbnb. They had poor communication and blocked me when I asked for a refund. Can you help me get my $588 back? -- Charysma Adams, Philadelphia

A: This is a strange case that took me a while to untangle. But the bottom line is, you should have had been given access to your rental when you showed up.

Let's start with your rental, which advertises itself as the perfect place for groups and small events such as game nights, birthday gatherings, and sleepovers. So it's not as if you showed up with your friends and the owner decided not to rent to you.

Instead, it appears you tried to contact the owner numerous times on the evening of your check-in for a one-night stay. The owner didn't respond until the following morning.

Further complicating your problem, for some reason, the owner processed your payment outside the Vrbo system. Even though Vrbo returned its fees quickly, the owner did not -- and then blocked you.

Vrbo protects you against fraud or if the owner wrongfully withholds your damage deposit. If you couldn't get into your property, Vrbo should have helped you book a new reservation for your birthday party.

I reviewed the correspondence among you, the owner and Vrbo. It looks like you followed all the correct procedures and tried to resolve this with both parties as soon as you discovered the problem. I'm troubled that the owner tried to block you when you asked for a refund. But the real issue was that the owner processed your payment outside of the Vrbo system. As I read Vrbo's terms, that means you aren't protected by its book with confidence guarantee.

You might have tried reaching out to one of Vrbo's executives. I list their names, numbers and email addresses on my consumer advocacy site, Elliott.org.

I contacted Vrbo on your behalf. A representative agreed with me that yours was a "complex" case. The company offered a full refund as a goodwill gesture.

The 10th of a Second Nightmare

A tenth of a second during one of history’s most dramatic moments kept him awake at night and often seemed like a lifetime to Ralph H. Metcalfe.

Metcalfe was four-times elected Chicago alderman (city council); an eight-year serving U.S. Congressman; a Legion of Merit medal-holder as a U.S. Army 1st lieutenant during World War II, and a successful college coach.

But it was a 10.4-second space of time in his life that haunted Metcalfe more than anything. He ran one-tenth of a second behind Jesse Owens in the world-famous 100-meter dash at the 1936 Berlin Olympics as Adolf Hitler looked on in an irate shock.

Metcalfe graduated from Marquette University in 1936, and after the Olympics that year, he went on for a master’s degree at the University of Southern California. He taught political science and coached track at Xavier University in New Orleans before joining the Army during World War II. In 1955, Metcalfe won the first of four elections as an alderman representing the South Side of Chicago. As an alderman, he broke ranks with Mayor Richard Daly after a series of police brutality incidents.

In 1970, he was easily elected as a Democrat to the U.S. Congress and was a co-founder of the Congressional Black Caucus in 1971.

But, no doubt, it was that eye-blink of a second that kept him awake at night.

Jesse Owens won a gold medal and equaled a world record that summer in Berlin running the 100-meter dash at 10.3 seconds. Metcalfe had equaled that time four years earlier. But, on that summer day in 1936, before thousands of screaming Germans, Metcalfe was right behind Owens for the silver medal at a time 10.4 seconds.

Ironically, Metcalfe broke or equaled the100-meter world record as well as 16 times at various college track events, however only five of them were ever officially ratified by the world governing body, the International American Athletic Foundation (IAAF).

Metcalfe won four Olympic medals

during the 1932 Olympics in Los Angeles. He was regarded as the world’s fastest human in 1934 and 1935, after running at the world record time of 10.3 seconds. Metcalfe was convinced to the end of his life that the 100-meter event in 1932 should have been awarded as a dead-heat tie between him and Eddie Tolan. In all, Metcalfe won 16 national titles in track during his athletic career.

"I have never been convinced I was defeated (during the 1932 Olympics),” Metcalfe often said. “It should have been a tie."

Film evidence and that of observers of the sprint event seem to support Metcalfe's verdict. The AAU (American Athletic Union) later changed their rules to have the winner being the first athlete to cross the line not merely to breast the tape. It was the latter that fellow sprinter Tolan was judged to have done first. The AAU went further and awarded the 1932 race as a tie but the International Olympic Committee has never agreed to this change. Additionally, even though credited with the same time as Tolan, 10.3 seconds, a sprint time that equaled the then-world record, Metcalfe's time was never ratified as a world record.

The next year at the Berlin Olympics, Owens ran the 100 in 10.3 and Metcalfe a tenth of a second behind him. At Berlin, He also matched the 200-meter world record of 20.6 seconds. He completed the 1932 intercollegiate season by winning the first of three NCAA championships, in both the 100- and 200-yard events. Later that summer Metcalfe competed in the 1932 Olympics in Los Angeles, racing to a virtual tie with Eddie Tolan in the 100 meters. After an exhaustive review, officials awarded the gold medal to Tolan and silver medal to Metcalfe. The Marquette sprinter also earned a bronze medal in the 200 meters at Los Angeles. he ran with Owens, Foy Draper, and Frank Wykoff in the 440-meter relay winning a gold medal. Owens and Metcalfe became life-long friends.

Despite coming in second in Berlin, Metcalfe had much to be proud. He became the first man to win the NCAA 200-meter title three times consecutively.

While he focused on the dead-heat 100 meter he ran with that tenth of a second loss to Owens never seemed to bother him – that is maybe in the middle of the night as he dreamed those days of would-be glory.

Metcalfe also was an accomplished student and a campus leader. In 1933 he was inducted into Alpha Sigma Nu, the elite Jesuit academic honor society. Metcalfe also was elected president of the Marquette University senior class. He graduated cum laude in 1936.

In 1991, when the downtown Chicago Federal building was completed it was named in his honor.

During his career in track Metcalfe equaled or bettered 13 world records.

That enough life-time accomplishments to keep anyone awake at night.

Try these ride-hailing tips for your next vacation

Most of my ride-hailing experiences have been uneventful — except for one recent trip to the airport. On a rainy afternoon, I failed to connect with my driver, which precipitated a soggy 20-minute delay. That got me thinking: Maybe I could benefit from some advice.

I asked academics, travelers and ride-hailing experts. And much like the ride-hailing industry itself, the answers I received were all over the map.

“The best strategy today is to have access to many services and to use each one when it best fits your trip needs,” says Stan Caldwell, executive director of Carnegie Mellon University’s Traffic21 Institute, which focuses on transportation issues.

For example, he says savvy travelers should consider using Uber or Lyft to get from home to a transit hub. Or they should use the ridehailing services late at night when mass transit isn’t running. On other trips, a Zipcar rental or even a bike share or scooter might be more appropriate.

And me? Maybe I should have taken the train to the airport. A carpool or the subway would have been cheaper, experts say. At the very least, I could have done a little homework before summoning a car — like how to use the location pin on the app.

How did I fail to connect with my driver and end up soaking wet and a little irritated? User error. I didn’t understand how to edit my pickup location on the app. (It turns out that you have to drag your pin to the right location.) When I tracked down my driver several blocks away, he said he hadn’t received a notification from the ride-hailing company.

The solution? I canceled the ride, made a new request and — bing! — my driver received his hail. I was on my way to the airport, lesson learned.

Here’s what else I learned:

The practice of surge pricing, or charging more if demand is higher, can make some rides less affordable, says J.B. Shepard, a Baltimore-based photographer who has driven for both major ride-hailing services. “For whatever reason, this seems to happen more to visitors from out of town and those picked up at or traveling to hotels,” he says. Shepard recalls a $72 fare for an out-of-town passenger on a ride-hailing platform. Normally, the same ride would have cost just $22. “I called the company, thinking that they billed the passenger in error,” he remembers. “But they assured me it wasn’t a bug and that,

since the rate was what the passenger agreed to pay, that was the bill.”

Pay a little more to get a lot more.

Uber launched a service called Uber Comfort in 2019. It guarantees that you get a roomier car for a small upcharge. And you also get a top-rated driver. The upper tier options such as Uber Black and Uber Select generally aren’t worth it to travelers who don’t really care about the make and model of the car that takes them there. “But it’s always nice to have more space,” says Harry Campbell, author of the popular Rideshare Guy blog for drivers. “I like to think of it as flying economy plus.”

Yep, there’s an app for that. It’s called Up Hail, and it compares the prices of Uber, Lyft, a taxi and an airport shuttle. It’s the brainchild of Avi Wilensky, a ride-hailing expert who has taken nearly 3,000 Uber rides since 2015. Wilensky’s insider tip for people who want to save money on ride hailing: Check out Waze Carpool. “Drivers are only able to charge to cover the cost of gas and tolls and are not permitted to make a profit,” he says. UberX Share and Lyft Shared also offer carpooling options, but they are a little pricier.

Never hail a ride from the airport.

An airport pickup can cost up to twice as much as it would from the airport hotel across the street, according to experts. “Instead, take a free airport shuttle to a nearby hotel,” says Michael Alexis, who runs a team-building company that coordinates flights and airport pickups each month. “Your ride will be significantly cheaper, sometimes as much as 25 to 50 percent less, and you will also save the driver from having to navigate the busy airport pickup.” That’s a useful tip even if the price is the same. On my last pickup in Lisbon, I spent about 15 minutes looking for my ride. At an airport hotel, I would have found him right away.

Sign up for a loyalty program. Uber Rewards gives frequent users upgraded rides, highly rated drivers and priority pickup at airports. Lyft has Lyft Pink, a $9.99-per-month program that offers rewards and other benefits. “The higher up you are in the program, the better the cars and the drivers you get,” says Logan Freedman, a frequent Uber and Lyft rider. The loyalty programs are generous and flexible — something you don’t typically find with airline loyalty programs.

Freedman, a researcher who works for a lawn-service company in Austin, has a favorite pro tip: If you use Uber for your job, set up an Uber for Business account and toggle to it when your rides are workrelated. “What this essentially does is give you double the number of points toward the next reward tier,” he says. You’ll spend less to get a higher loyalty status on Uber, he says.

Even Robert Farrington, who sold his car three years ago and ridehails everywhere, doesn’t always take a Lyft or Uber. Farrington, who edits an investment news site in San Diego, has every reason to use the two services. His Chase card gives him five times the points for each Lyft, and he regularly gets bonuses and incentives from the companies for his loyalty.

And yet, when he’s in a less urban area that isn’t ride-share-friendly, Farrington calls a pro. “I spend slightly more and book a car service,” he says.

The City of San Marcos recently welcomed Kenneth Jones as Captain of the San Marcos Sheriff’s Station.

Jones became Captain following Amy Brown-Lisk's promotion to Commander of Human Resources for the San Diego County Sheriff’s Department.

As a lifelong San Diego resident, Jones’ new position with San Marcos continues his 28-year career with the San Diego County Sheriff’s Department that started in 1994. The City of San Marcos contracts with the San Diego County Sheriff’s Department to provide law enforcement services.

From patrol units and detective investigations to most recently serving as captain of the San Diego County Sheriff’s Major Crimes Division, Jones is committed to public safety and looks forward to serving San Marcos. I would like to share a few thoughts on Memorial Day. When you read this, it will have just passed. I know it is the “unofficial” beginning of summer and for those who don’t live in our nice SOCAL weather, it marks the time when the cold is finally gone.

Now we all know that it is really the day that we honor those who have fallen in service to our country. And don’t worry, I’m not asking you to change what the holiday has become. But as a veteran, it means a lot to me. And so, I am going to ask you to think about the values of our country that these men and women gave their lives for. And then ask yourself, in our society today are we honoring those values? If your answer is no, then I would ask that as a tribute to our fallen heroes, we change ourselves. And finally, I would ask you to remember them and share with me the sense of gratitude we owe them. Despite our challenges, we do live in a great country and I pray God continues to bless it.

We became the “biggest” computer shop quite naturally. In the mid 1990s Nome and I helped a member of our extended family sell a computer manufacturing company he owned called Vision Technologies. It took about a year to sell the company. The Asian buyer was interested in Vision’s distribution channels and name but not the inventory or manufacturing plant. In 1995 we moved the inventory into the five thousand square foot space on San Marcos Blvd recently made available by the San Marcos Public library’s move to Civic Center. Nome and I, along with some employees from the old company, took on the task of finishing the assembly of the computers.

We sold the inventory, paid off the owner and took over the business, gradually reducing our space needs to today’s level of three thousand square feet. As far as we know, no other PC shop has close to that much space.

We came to be the “oldest” active couple running a computer business by attrition. Most folks know it’s time to retire when their company throws them a party and hands them a gold watch.

No one threw us a party or gave us a watch so we just kept going in to work every day. The years slipped by and we kept doing what we were doing because we could not think of anything better to do.

REQUEST FOR PROPOSALS SOUTH FAÇADE EXTERIOR REPAIRS – ONE CIVIC CENTER DRIVE

PUBLIC NOTICE IS HEREBY GIVEN that IDS Real Estate Group and the City of San Marcos (City) request proposals from qualified contractors for the above stated project.

DESCRIPTION OF WORK The Work includes removal and replacement of the façade on the south elevation of the Civic Center Building. The work will occur at One Civic Center Drive, San Marcos, CA. Contractors must meet or exceed the specifications and requirements stated in the Request for Proposal (RFP).

CONTRACT TERM The Contractor shall diligently and continuously prosecute the work to completion, which shall be no later than June 30, 2023.

DEADLINE FOR SUBMISSION OF PROPOSAL: All proposals must be received by the project construction manager via email no later than 5:00 p.m. on Wednesday, June 29, 2022. Late proposals will not be accepted. Proposing contractors are required to request a read receipt or a reply from the project construction manager for confirmation of delivery. Facsimile submittals are not acceptable.

The purpose of the pre-submittal meeting is to discuss the Scope of Work included in the RFP and answer questions proposers have relating to the RFP and/or the Contract. A mandatory site walk of the project will immediately follow the pre-submittal meeting. All proposers must attend the pre-submittal meeting and site walk. Failure to attend either of these events shall be cause for rejecting proposals.

It is the responsibility of the proposer to download and carefully review the contents of all documents provided in this RFP, including the addenda and any exhibits attached thereto. Incomplete proposals, proposals containing errors or inconsistencies, failure to comply with the submission requirements contained in the RFP, or other process or content errors or deficiencies may constitute cause for rejection.

Submission of a proposal indicates acceptance by the proposer of the conditions contained in the RFP and the attachments thereto, unless clearly and specifically noted in the proposal and confirmed in the Contract executed between the Owner and the selected service provider. The Owner reserves the right to retain all proposals submitted and to use any idea(s) in a proposal regardless of whether that proposal is selected.

PREVAILING WAGE NOTICE IS HEREBY GIVEN that, pursuant to the San Marcos City Charter and the San Marcos Municipal Code, payment of prevailing wages and compliance with the California Labor Code Sections 1770 et seq is required for this project. The Contractor will be required to comply with all of the terms and conditions (including State General Prevailing Wage requirements) prescribed for Contractor performing public works construction projects.

The California Department of Industrial Relations determines the general prevailing wage rates for the State and are available at the DIR website, http://www.dir.ca.gov, or from the City of San Marcos’ City Clerk Office.

DIR REGISTRATION Under (SB 854), “contractors” are required to register with the Department of Industrial Relations (DIR) on an annual basis (July 1-June 30).
