Carolina Halloween Best Dressed Competition
Conditions of entry (Conditions)
1. Entry into the competition constitutes acceptance of these terms and conditions.
2. Competition starts Thursday 30th October at 9.00am and closes at 5pm AEST on Sunday 2nd November 2025 (Promotion Period).
Eligibility
3. Entry is open to all residents of Carolina by AVID who live in the Carolina community and any individual subscribed to the Carolina database (Entrant).
4. Directors, management and employees of the Promoter, its associated companies or agencies as well as the immediate families of each of these people are not eligible to enter
How to enter
5. To enter the competition, participants are required to attend the Carolina Sales & Information Centre during the promotional period, participate in a photo dressed up Halloween themed which will be taken at the Sales & Information Centre. All entrants must fill out a entry form available at the Sales & Information Centre.
6. Entries must be received by the Promoter during the Promotion Period.
7. No entries will be accepted after 5pm on Tuesday 2 November 2025
8. The Promoter may accept or reject an entry in its absolute discretion. No correspondence will be entered into with any Entrant whose entry has been rejected. The Entrant has no right of appeal or contest.
9. Each Entrant is responsible for the entry they submit and for paying any costs associated with entering the Competition, including the preparation of the costume
10. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
Entrant’s responsibilities
11. Each Entrant must create their own entry and only submit an entry in their own name. By submitting an entry, all entries become the property of the Promoter.
12. Each Entrant warrants and agrees that:
a) the Entrant has created the entry by themself;
b) the Entrant is entitled to reproduce and exploit all of the underlying works in the entry;
c) the Entrant has not been previously published it in any other medium or forum worldwide;

d) they will not submit material that is unlawful; obscene; defamatory; derogatory; threatening; pornographic; sexually inappropriate; violent; abusive; harassing; hateful; racially, religiously or ethnically offensive; or encourages, evidences or indicates conduct that would be considered a criminal offence, gives rise to civil liability or violates any law;
e) the entry will not contain viruses or cause injury or harm to any person or entity; and f) the Entrant has not granted rights to their entry to any other person which are inconsistent with the rights granted to the Promoter.
13. The Promoter accepts no responsibility for any damage, injury, loss, defect, interruption, destruction, personal or property damage or third party damage which may occur as a result of entry into this Competition.
14. Each Entrant consents to the Promoter (and each of its assignees and licensees) doing or omitting to do anything which may infringe any and all moral rights of the Entrant including to edit, alter and reproduce the entry, and that such consents have been obtained to the full extent permitted under the Copyright Act 1968 (Cth).
15. By entering the Competition, the Entrant unconditionally gives the Promoter and any of its contractors and agents, the right to use any photos provided by the Entrant as part of the entry to the Competition in any in any printed, digital or other form of media (including but not limited to: television, internet (including social media) and electronic mediums, publications, displays, and any other form of media utilised by the Promoter), without charge.
16. As a condition of accepting the prize, each winner agrees to if required by the Promoter, sign a statutory declaration regarding the originality of their entry.
17. As a condition of entry, each Entrant irrevocably and unconditionally assigns to the Promoter all of the Entrant’s right, title and interest (including, without limitation, all intellectual property rights such as present and future copyright) in and to the winning entry and to sign a document (in a form to be determined by the Promoter) to acknowledge this assignment to the Promoter.
18. Each Entrant acknowledges and agrees that the Promoter (and each of its assignees and licensees) have the right, in their absolute discretion, to edit, amend, copy, use, publish, broadcast and communicate to the public, the entry in any media including the internet, without any further consultation, reference, payment or any other compensation to the Entrant.
19. Failure to comply with the Conditions may lead to immediate disqualification of an entry and withdrawal of prizes.

20. The Promoter reserves the right to change the Conditions at any time.
21. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, tampers with the entry process not in accordance with these Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
22. The Promoter reserves the right to request winners provide proof of identity, proof of residency or proof that they reside in the Carolina community or subscribed to the Carolina database.
23. The Promoter reserves the right to refuse an entry if it does not meet the entry criteria or is deemed offensive or inappropriate.
24. Prizes are not exchangeable and cannot be redeemed for cash. If, for any reason, a winner does not take an element of the prize at the time stipulated by the Promoter, that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
25. If, for any reason, any aspect of this Competition is not capable of running as planned or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter may in its absolute discretion cancel, terminate, modify or suspend the Competition or invalidate any affected entries.
26. The Promoter accepts no liability for any injury, loss or damage that may arise in connection with or as a result of the cancellation, termination, modification or suspension of the Competition.
Judging
27. Judging of all eligible entries will be completed by judges appointed by the Promoter. Each judge has the sole discretion to determine the winner. The judges’ decision will be final and the Entrants have no right to appeal or contest the decision of the judge.
28. The Promoter reserves the right to reclassify, disqualify or withdraw an entry at any time if these Conditions are not complied with.
29. The Promoter’s judging panel will review all valid entries received during the Promotion Period. On the day after the end of the Promotional Period, the judging panel will judge all entries based on creativity and originality. This is a game of skill and chance plays no part in determining the winners. The Promoter’s and judges’ decisions in relation to all aspects of the Competition is final and no correspondence will be entered into.
30. The judging parameters for all Categories are based on: First impressions; Creativity; and Showmanship – creativity and uniqueness.
31. The winners will be notified by the Promoter by 3pm (AEST) on Monday 3rd November 2025 by phone and email. In the event of a prize not being accepted or claimed within this time, the winner will be taken to have forfeited their prize and no redraws will be conducted.
32. The Promoter may require a winner to verify their entry and may require a winner or their nominee to provide proof of identity, age, purchase or residency at the nominated prize delivery address. Proof considered suitable for verification is at the Promoter’s discretion. Failure to provide any of this

verification to the Promoter upon request may, at the Promoter’s discretion, invalidate any or all of the Entrant’s entries.
33. If a winning entry is deemed not to comply with these Conditions, the entry will be discarded.
Prize for winning Entrant
34. The prize for the winning entrant of the Best Carolina Halloween Costume is a $100.00 Prezzee gift card.
35. The photos of the winning entrants will be distributed or published:
a) on the AVID Development and Corporate websites;
b) through AVID corporate and social media accounts;
c) email distribution and electronic direct message to individuals and corporations registered on the AVID database;
d) general social media promotion, including but not limited to organic and paid posts, cover images, event pages across AVID’s corporate social media platforms as well as all project channels in Queensland, New South Wales, Victoria, South Australia and New Zealand (including Facebook, Instagram, LinkedIn, Twitter); and
e) any other means agreed between the parties in writing (acting reasonably).
36. Each Entrant acknowledges and agrees that if their entry wins, the Promoter (and each of its assignees and licensees) have the right, in their absolute discretion, to edit, amend, copy, use, publish, broadcast and communicate to the public the entry in any media including the internet, without any further consultation, reference, payment or any other compensation to the Entrant.
37. The Promoter accepts no liability to the prize winner(s) or anyone else for any injury, loss, damage or expense incurred as a result of, or in connection with, the Competition or in the event that the winning Entrant is dissatisfied with the end result of the Halloween Best Dressed Competition.
Privacy
38. The Promoter will collect and use each Participant’s personal information, competition entries (including photos) for the purposes of:
a. future marketing, public statements, testimonials, and advertisements about Carolina, including (but not limited to):the AVID Development and AVID Corporate websites; through AVID corporate and social media; ;email distribution and electronic direct messages to individuals and corporations registered on the AVID database; and general social media promotions; and b. research.
39. By participating in this competition, Participants consent to the use of their personal information as described in these terms and conditions.
40. As a condition of accepting the prize, each winner agrees to:
a) if required by the Promoter, sign a statutory declaration regarding the originality of their entry; and
b) irrevocably and unconditionally assign to the Promoter all of the entrant’s right, title and interest (including, without limitation, all intellectual property rights such as present and future copyright) in and to the winning entry and to sign a document (in a form to be determined by the Promoter) to acknowledge this assignment to the Promoter.

41. 42. Any personal data relating to the Participant will be used solely in accordance with current Australian data protection and privacy legislation, and in accordance with the AVID Privacy Policy https://www.avid.com.au/privacy_policy/
43. Participants may access, change, opt out and/or update their personal information in accordance with the Seller’s privacy policy https://www.avid.com.au/privacy_policy/
