PERSPECTIVE 2018: A NEW YEAR A year of learning, participation, and growth

2 We need your involvement to ensure to continue the great work the association is doing for our industry.

017 was a wonderful year with many achievements for our industry and for the Austin Apartment Association. I am proud to announce that the Doc and Gayle Young Food Drive was an amazing success. We were able to beat our goal of $60,000 by raising just over $70,000 which fed more than 1,350 families during the Thanksgiving Holiday! I am so grateful to our many volunteers and contributors’ that helped make this such a great holiday for so many people. Doc really would have been proud.

The Austin Apartment Association offered over 40 classes during the year. Many of theses classes are covered as part of the ACE program.

The ACE program has opened the doors for many more individuals to continue their education and enable them to meet their career goals. If you are an owner member, consider the ACE program. It’s a small price to pay for employee education that could improve your bottom line and protect your investment.

We need your involvement to ensure to continue the great work the association is doing for our industry. If you have not already done so, consider the following committee meetings in 2018: Communication Advisory Committee: Be a part of the committee that brings our members the Window on Rental Housing magazine. Members of this committee plans editorial content and

develops communication strategies for the association. Members also decide and procure content and promote advertising for the Window magazine.

Doc & Gayle Young Food Drive: Come and be a part of bringing smiles to many faces during Thanksgiving. This is a volunteer-driven fundraiser to purchase Thanksgiving foodstuffs for Central Texans.

Community Outreach Volunteer Opps: Community outreach programs are held throughout the year. All members of AAA are welcome to join this fun and energetic group. Keep an eye out on the association website or on the Friday Facts for more information.

Legislative Committee: Be part of the in-crowd and get to know how legislation affects how our industry operates. This committee is ideal for those who want to stay informed about how the government affects business. This committee is only for AAA property managers, owners, supervisors, onsite maintenance personnel and other appointed members.

Austin Supervisors Council: Open to property supervisors and upper-level management, the meetings are used as a forum to discuss emerging issues and hot topics to the rental housing industry.

POLITICAL CLIMATE OF 2017 IMPACTS APARTMENT INDUSTRY ON ALL LEVELS OF GOVERNMENT

Political turmoil and changes at the national, state and local level affected the apartment industry in 2017, and there are many impacts expected for 2018. Fortunately, the apartment association is a federation of organizations that provide the industry’s collective voice when legislative or regulatory changes are on the agenda no matter at what level of government.

National The political dynamics in Texas also presented challenges for the industry during 2017.

Political changes at the national level were hard to ignore in 2017. While the new administration took the helm in Washington D.C. the National Apartment Association (NAA) began the year by advocating for to the Americans with Disabilities Act (ADA)reforms, Flood insurance and Tax Reform. By the end of the year advocacy efforts included a push for disaster relief and put forth several federal policy recommendations to help apartment communities recover quicker in the wake of a disaster and get residents back in their homes faster The advocacy efforts in Washington D.C. are bolstered each spring when apartment industry professionals from all over the country three for the National Apartment Association’s Advocate Conference. This is the industry’s largest advocacy event.

At the conference held March 2017,

members visited with legislators to push for end to “drive by” lawsuits whereby apartment communities are notified that the property my not be fully compliant with ADA requirement and that a complaint will be filed unless settlement payments are made. The fix to these situations is to provide the property owner 120 days to cure the ADA defects before lawsuits or filed or any settlement monies are paid.

On the topic of the National Flood Insurance Program (NFIP) and disaster relief, NAA staff and members discussed reforms to the flood maps as well as program changes that would provide replacement cost value paid to apartment communities following a flood event as opposed to the existing system of paying actual cost value to damaged apartment properties.

When advocating the industry’s positions on tax reform, the NAA launched its “Protect the Lease” campaign (www.protectthelease.com) and established primary objectives and priorities to ensure that any reforms made will promote economic growth and investment in rental housing without unfairly burdening apartment owners and renters relative to other asset classes. Key priorities established by the NAA included protecting “flow-through entities” (e.g., LLCs, partnerships, S Corporations, etc.), which are the dominant business struc-

Texas Senate leaders clashed with Texas House leaders over priorities and budgetary matters, and these conflicts eventually led to a Special Called Session held mid-summer. The Texas Apartment Association (TAA) was able to overcome the challenges to secure passage of a water bill that will limit individual and class action lawsuits over water billing procedures.

SB 873 requires residents who have water billing complaints to go through the Public Utility Commission (PUC). The legislation was needed because unlike complaints against PUC-regulated utility companies, the law had previously allowed residents to either file complaints with the PUC or go to court.

Under the new law, if residents are unable to resolve their complaint directly with the property owner, they may file a complaint with the PUC. If

ture in our industry and “like-kind exchanges” where property owners can defer tax on the gain on sale of an asset if, instead of selling their property, they exchange it for another comparable property. Other provisions involving investment incentives, the low-income tax credit program and changes to cost recovery rules and depreciation were also addressed in the NAA’s advocacy efforts.

NAA also implemented its Vision 2030 campaign in 2017 aimed advocating for solutions to help supply meet demand and reduce the cost of developing apartments. The campaign included a report explaining how rising apartment demand is challenging families to find quality rental housing they can afford, and outlined how lawmakers can lower barriers to development to better address the current and future housing shortage of all types of apartments and at all price points.

Housing Veterans With VASH The HUD-Veterans Affairs Supportive Housing (HUD-VASH) program combines Housing Choice Voucher (HCV) rental assistance for Veterans in housing distress with case management and clinical services provided by the Department of Veterans Affairs (VA). Case management includes help securing VA and other benefits such as educational aid and financial planning, and the program is effective at connecting Veterans with the community and transitioning

them into the workforce.

Under Texas law, landlords cannot deny a Veteran’s use of federal housing assistance as a form of rent payment.

This past summer the Austin Apartment Association received the NAA’s Excellence Award for Community Achievement for helping Austin end veteran homelessness. The AAA’s effort involved finding apartment units for veterans receiving federal housing assistance, and this is an ongoing effort. AAA members

the PUC launches a formal investigation and finds wrongdoing, an owner can be ordered to provide restitution for any overcharge and can also be fined up to $5,000 per violation a day.

(In assessing the amount of any fine, the PUC considers criteria such as the severity of the violation.)

The legislation also makes several other important changes by clarifying the definition of owner so that management companies are not held liable unless the company explicitly purports in the lease to be the owner, and also clarifies that owners may pass along charges that are unrelated to the water bill.

TAA also effectively addressed: • Towing with new rules to allow a property owner to tow a vehicle to a different location on a property rather than an offsite vehicle storage facility. This clear authority will be useful, for example, when a property needs to restripe a parking lot or do repairs.

• Property tax arbitration by raising to the ceiling on the value of a property eligible for binding arbitration as an alternative to appealing to district court to $5 million from the current $3 million, and setting a $1,550 arbitration deposit for non-homestead properties valued between $3 million and $5 million.

• Disability accessibility drive-by claims by supporting a bill to reduce state court disability accessibility claims by providing pre-suit notice and an opportunity to cure.

The TAA will soon be establishing its legislative agenda for the Texas Legislative Session that begins in twelve months. If you have any issues or concerns related to state law you are encouraged to contact AAA staff or leadership to discuss the TAA legislative agenda process.

Local New faces on the Austin City Council and other city councils in the region also presented challenges for the region’s apartment industry. Most often these new leaders come into office without any knowledge about the apartment industry, and it is incumbent upon the AAA to provided information and resources to help them better understand our issues.

In Austin last April, after receiving input and comments from the industry, new Change of Ownership (CHOW) swimming pool inspection procedures were put in place. These new procedures are intended to ensure pool safety and building code compliance and will allow existing pools with minor issues to continue operating

In 2017 the Austin city council also finalized rules for when properties are closed and tenants relocated due to new development, enacted regulations for multifamily buildings to be built “solar ready” and began deliberations on notifications requirements for tenants affected by load music emanating from downtown bars and music venues. In Cedar Park discussions have begun on recycling and composting requirements for apartment communities.

CodeNEXT, the total re-write of the city land development code and biggest local issue of 2017, will not be resolved until later this year. In 2017 the AAA closely monitored the release of the first two draft documents and provided comments on the documents in a collaborative effort with other organizations to ensure that the new code removes barriers to development and helps facilitate a wide variety of multifamily and attached-wall housing options.

The third and final draft of the document will be released in February and the city council is expected to take action in April. The AAA will continue collaborating with likeminded organizations to reduce regulations and improve the apartment development process to help usher a new wave of opportunities for apartment owners, manager and residents.

association dues AAA Shifts Dues Renewal to Annual Cycle Beginning in 2018, AAA changes the annual membership renewal cycle to every January. In order to achieve this renewal cycle change, all members have been paying a prorated amount in 2017. Shifting renewal cycles means all members will renew their membership every January rather than the month the company joined the association (i.e. anniversary date).

Better Government Fund (BGF) The BGF is a suggested voluntary contribution amount included

on your annual dues statement. Members are free to contribute more, less or nothing at all. AAA’s BGF uses member donations to support our research and legislative goals.

Deducting Dues For tax purposes, AAA dues are not deductible as a charitable contribution, but may be deductible as a business expense.

Because the Austin, Texas, and National apartment associations engage in lobbying efforts, the non-deductible portion of the dues for 2017 is 8.15%, and 7.86% in 2018.

2017 MARKED THE 31ST YEAR OF THE DOC & GAYLE YOUNG FOOD DRIVE. FOR THE PAST 31 YEARS, THE AUSTIN APARTMENT ASSOCIATION’S DOC & GAYLE YOUNG FOOD DRIVE HAS RAISED OVER $760,000 AND FED OVER 71,650 CENTRAL TEXANS. CERTAINLY, OUR NAMESAKE, DOC YOUNG, WOULD HAVE BEEN MOST PROUD OF EVERYONE WHO CAME TOGETHER TO MAKE THIS A BANNER YEAR IN HIS MEMORY.

n 2017, the Doc & Gayle Young Food Drive again surpassed the committee’s $60,000 goal and raised just over $70,000 to purchase 1,350 food packs for hungry local families. Each food pack contains enough food to feed a family of five their Thanksgiving meal and for a few days after that.

The Food Drive crew partnered with HEB to purchase over 34 tons of food again this year. HEB employees assembled 1,350 food packs and loaded them onto volunteer delivery trucks from CORT, Charter Furniture, HD Supply, Century A/C Supply, Sherwin-Williams and Two Men and a Truck. The benefiting agencies this year were: Foundation Communities, The Housing Authority of the City of Austin, SAFE, and Partnerships for Children. Families receiving the food packs were chosen by these four agencies.

With such a hefty fundraising goal in place, the great minds of

the Food Drive Crew organized two happy hours and silent auctions (one South and one North), the Treaty Oak Distillery Tour and Taste came back for another year, and sold lots of “Official” Food Drive t-shirts. Our food drive was honored for the second year to be a beneficiary of CORT’s annual Operation Chili Cookoff. New and very successful this year were two Facebook Live telethons held by our very able and entertaining Food Drive Crew. As always, our amazing crew of volunteers made numerous phone calls, and sent emails and letters asking AAA members to donate to this year’s drive.

The South happy hour at Moontower Saloon and the North happy hour at The Local Post raised just shy of $15,000 through donations at the door and two silent auctions. Lunches with AAA Leadership sold in the silent auctions once again proved to be very lucrative. Football and basketball tickets, jewelry, getaway weekend packages…and of course “booze baskets”…were all a hit in the bidding wars. The AAA

NextGen committee organized the third annual volleyball tournament, bolstering our fund by $3,150 in a fun and exciting way only our young professionals can. Thanks, NextGen! Congratulations to the entire 2017 Doc & Gayle Young Food Drive committee, who spent countless hours volunteering their time. Special

thanks to the three chairs: Stephanie Naylor, Flooring Warehouse, Terri Needham, PS Landscapes, and Paige Russell, Gables Residential.

ith each new year, we assess whether our past conduct should continue or whether some changes may be in order. Now that 2018 is upon us, that assessment is likely underway once again.

Step one is to try to determine what the likely outcome will be after we act in a particular manner. There is quite a bit of crystal ball or perhaps even Magic 8 Ball logic in play during this analysis. What we seek to discover through this exercise, in legal terminology, may be foreseeability. Is the likely outcome, if we engage in certain conduct during the new year, foreseeable?

Our analysis won’t stop after step one, however, if we are serious about our new year analysis. We recognize that our ability to foresee the future may be flawed. So we add another element to the equation. We add reasonableness. Is what we have to do, or sacrifice in order to reach

the foreseeable outcome, reasonable or unreasonable?

The two elements of our analysis are certainly related. Yet they also are distinct and independent. Even if we know what we should do to achieve our foreseeable goal, we must weigh the cost to us and determine whether that cost is unreasonable. If it is, chances are we will pursue a less costly goal. If we do, we will hope that the foreseeable outcome of our new pursuit is as favorable to us as the one we dismissed as unreasonably costly.

Throughout the 2018 new year, we can call upon Texas Supreme Court precedent to assist us. In its opinion delivered nearly a year ago, on January 27, 2017, the Texas Supreme Court reversed a Houston 14th Court of Appeals decision, and thoughtfully told Texans how our courts will apply Texas law to analyze the potential liability of apartment owners for the criminal acts of third parties.

The case is entitled UDR Texas Prop-

erties LP d/b/a The Gallery Apartments vs. Alan Petrie, 517 S.W.3d 98 (Tex. 2017) (Petrie v. Gallery).

As Justice Don R. Willett stated in his concurring opinion in Petrie v.

Gallery, “I read the Court’s opinion as holding that a duty is imposed on property owners to use ordinary care to protect invitees from an unreasonable and foreseeable risk of harm from third-party crimes.”

The 2017 opinion from Petrie v.

Gallery was not the first time the Supreme Court of Texas determined that it made sense to look at foreseeability and reasonableness together.

In 1997, the Texas Supreme Court held in Lefmark Management Co. v.

Old, 946 S.W. 2d 52, that a person is “...to use ordinary care to protect invitees from criminal acts of third parties if he knows or has reason to know of an unreasonable and foreseeable risk of harm to the invitee.”

In fact, the 1997 Texas Supreme Court stated that unreasonableness turns on the risk and likelihood of injury to [a person] as well as the magnitude and consequences of placing a duty on [another person].

Here the first person is the one who gets injured, while the second person is the one who owns the property on which the injury occurred.

Should our personal new year’s development of the plan of action we will adopt in 2018 follow a similar analysis? Should we distinctly consider foreseeability and reasonableness? How likely is it that if we do or refrain from doing certain things (e.g. eat too much and exercise too little), the foreseeable outcome will be overall poorer health?

When we examine the second factor, reasonableness, in our analysis we begin to see the magnitude and consequences of reasonable conduct.

What burdens will we necessarily incur to prevent or reduce the risk of weight gain and poorer overall health? As a matter of public policy, should one prefer the burdens that accompany being less fit and weighing more, burdens created by eating too much comfort food and being a couch potato? Or should we find those burdens too costly to our overall health? Does the burden of the unpopular changes (e.g. eating better and exercising more) we would be compelled to make in order to prevent a foreseeable decline in our overall health outweigh the risk of poorer health? If the answer is NO, we should make the changes or else accept responsibility for any negative health consequences.

We could continue along this non-legal road and end up with a self-help book entitled “Healthy Living the Supreme Court Way.” Then again, we would need a majority to decide upon the content of our book, and that may be challenging. For a more informative and enlightening alternative to enhance our legal knowledge, let us take the foregoing concepts of foreseeability and reasonableness and explore the outcome of the Petrie v. Gallery case.

Alan Petrie was assaulted and robbed in the visitors parking lot of Gallery Apartments. The Court’s opinion describes the incident like this: Mr. Petrie arrived at Gallery Apartments one morning around

2:00 a.m. to attend a party hosted by a co-worker. Upon his arrival he parked in the visitor lot. Although the complex was gated, the visitor parking lot, which spanned most of the property’s street frontage, was outside the gate and accessible to the public.

While Petrie made a phone call from inside his car, a vehicle pulled up behind his, blocking him in. Two men exited the vehicle and approached Petrie’s car. One man pointed a shotgun at Petrie and

ordered him to exit the car. Petrie complied and when requested, he surrendered his wallet and keys.

But when ordered to lie down, he hesitated. So one of the men shot him in the knee and Petrie fell to the ground. The shooter then placed the shotgun barrel to Petrie’s head and pulled the trigger, but the weapon did not fire. Petrie quickly crawled under the vehicle next to him while the assailants fled.

Petrie sued the Gallery Apartments alleging it knew or should have known about the high crime rate on its premises and in the surrounding area, yet failed to use ordinary care to make the complex safe. After a jury trial, Petrie lost and recovered nothing after the trial

court concluded Gallery owed no duty to Petrie.

There was an appeal and the Houston Court of Appeals saw it differently. They concluded “There is evidence of the foreseeability of an unreasonable risk of harm that a person on the premises would be the victim of violent criminal conduct.”

The Houston Court of Appeals erroneously held that “[t]he potential unreasonableness and foreseeability of harm is considered as a whole, not as separate elements requiring independent proof.” To support its position, the court of appeals incorrectly stated that “[w]hether the risk of criminal conduct is both unreasonable and foreseeable is determined by assessing the five Timberwalk Factors.”

What are those, and what is Timberwalk?

Timberwalk is another Texas Supreme Court opinion from 1998 often discussed in seminars - that address apartment liability for crimnal acts on its property. The case is entitled Timberwalk Apartments Partners, Inc. v. Cain, 972 S.W. 2d 749 (Tex. 1998).

The Timberwalk Factors are designed to determine whether the occurrence of certain criminal conduct on a landowner’s property should have been foreseen. The Texas Supreme Court presented the five Timberwalk Factors, and in so doing, instructed lower courts to consider: (1) whether any criminal conduct previously occurred on or near the property; (2) how recently it occurred; (3) how often it occurred; (4) how similar the conduct was to the conduct on the property; and (5) what publicity was given to the occurrences to indicate that the landowner knew or should have known about them.

These factors are still valid when considering whether and to what extent an apartment owner may be liable for third party criminal acts on their property. But the Petrie v. Gallery case points out that the Timber-

Establishing only the foreseeability of a particular type of conduct or outcome is insufficient.

walk Factors address only foreseeability. A second analysis to determine reasonableness must also be done, and it must be done separately.

The Texas Supreme Court stated in the Petrie v. Gallery opinion that it designed the Timberwalk Factors to measure foreseeability; [and] their application cannot, without more, determine the reasonableness of the risk of harm.” The majority opinion in the Petrie v. Gallery case went on to conclude that “unreasonableness turns on the risk and likelihood of injury to the plaintiff [i.e. injured party] as well as the magnitude and consequences of placing a duty on the defendant [i.e. apartment owner].”

“A risk is unreasonable,” states the Texas Supreme Court, “when the risk of a foreseeable crime outweighs the burden placed on property owners – and society at large – to prevent the risk.” The court noted that none of the Timberwalk Factors compels any consideration of what burdens a property owner would necessarily incur to prevent or reduce the risk of a crime. Likewise, the [Timberwalk] factors do not address whether, as a matter of public policy, it is preferable to impose such burdens or, instead, accept the risk that a crime will occur.

The Petrie v. Gallery opinion, therefore, has clarified that there must be two separate, although related, inquiries when someone seeks monetary relief against an apartment owner for damages caused by a third party criminal act on the property.

The Petrie v. Gallery opinion has instructed us that the five Timberwalk Factors do not cover both the foreseeability and unreasonableness analyses.

If there is a trial, the victim must offer compelling evidence establishing the things the owner could have done to prevent crime were not so oppressive and expensive as to be unreasonable.

In the Petrie v. Gallery case, the lawyers for Mr. Petrie were asked during oral argument before the Supreme Court of Texas what evidence had been admitted at trial to show the burden Gallery Apartments should bear to prevent crimes like those that injured Petrie. The

lawyers identified four; but they acknowledged that there was only one of the four for which there was evidence in the record of the trial.

The four mentioned to the justices were: (1) having improved lighting in the visitor parking lot; (2) having courtesy officers who would patrol from 10:00 p.m. to 2:00 a.m. on Friday and Saturday nights; (3) having off duty police monitor the parking lot; and (4) trimming a row of hedges

that run between the visitor parking lot and the sidewalk. Only the better lighting proposal, however, was supported by any actual evidence.

The Texas Supreme Court justices also asked Petrie’s appellate lawyers what it would cost Gallery Apartments to implement a police presence in its parking lot. Petrie’s lawyers again had to admit there was no such evidence in the trial record.

The Texas Supreme Court has now made it clear that even if a plaintiff, namely a third-party crime victim, establishes that the criminal act was foreseeaable, that is only part of the total burden they must satisfy to prevail. In addition, the plaintiff must introduce compelling evidence on what the actual burden on the defendant, (that is an apartment complex owner), would be to prevent or reduce violent crime on their premises.

Establishing only the foreseeability of a particular type of conduct or outcome is insufficient. The evidence must also call for the conclusion that allowing the risk to exist unchecked is unreasonable. The risk, foreseeability and likelihood of injury must be weighed against the social utility of the actor’s conduct, the magnitude of the burden of guarding against the injury, and the consequences of placing the burden on the property owner. There must be a balancing of the risk to the victim and the burden on the property owner to prevent the commission of crime at its apartment community.

In 2008, in the case of Trammell Crow Central Texas, Ltd. v. Gutierrez, a concurring opinion by Supreme Court of Texas Justice Wallace Jefferson commented how the unrea-

sonableness inquiry includes whether crime prevention measures required conspicuous security at every point of potential contact between a patron and a criminal, or requires extraordinary measures to prevent a similar occurrence in the future.

Justice Jefferson went on to comment, in the same opinion, as follows: “[t]he question is the extent to which we should require premises owners – even those who have experienced crime in the past – to provide the same level of security that airports enlist to prevent terrorism. Life in a free society carries a degree of risk. That risk can be virtually eliminated by a pervasive military presence, but the burdens – both in terms of the economic cost to premises owners and in the oppressive climate a police state spawns – would be prohibitive.”

A key takeaway from the Petrie v. Gallery case is that there is a lot to prove at a trial involving a claim based upon third party crime. The Timberwalk Factors remain. But to them, we can now add the Petrie Factors. What are they?

If a risk posed by foreseeable criminal activity is established, that risk must be weighed against the consequences of placing a too high a burden on the owner of the apartments, and on society, to reduce or eliminate that risk. If the risk is still unreasonable in light of the requisite burden, liability on the apartment owner may result.

When you are weighing both the existence of risk and the burden of preventing that risk, separate evidence of both is needed. The inquiries are uniquely distinct. While they are related issues, they are also separate elements requiring independent proof. The scales tipped in favor of Gallery Apartments, to at least a large extent, because Petrie offered no evidence of and did not argue that he faced an unreasonable risk of harm.

Stated another way, Petrie’s case failed because the opinion suggests he relied exclusively on a foreseabilty evaluation. He correctly argued the Timberwalk Factors were determinative of the foreseeability the crime would occur. But he incorrectly argued that those same five factors were determinative of both the burden on Gallery Apartments to make the property safe from foreseeable crime, and whether that burden was reasonable.

Gallery case was neither obtained nor reviewed to write this article.

As such, many questions – the rest of the story one might say – remain unanswered. There are certainly a lot of answers to who, what, where, when, why and how questions that the judge and jury took into account.

No matter what those answers may have been, they may not have helped Petrie to prevail.

When the trial court judgment stated that Gallery Apartments owed no duty to protect Petrie from the criminal acts of third persons, did it make that determination based on foreseeability or unreasonableness or both? All we know is that the trial court judge concluded

that by failing to address unreasonableness, Petrie failed to challenge a potential independent basis for the trial court’s ruling.

We also know that the Houston 14th Court of Appeals disagreed with the trial court. It concluded that there was evidence Gallery Apartments knew or should have known of a foreseeable risk of harm that a person on the premises would be the victim of violent criminal conduct.

The court of appeals went on to erroneously hold that “[t]he potential unreasonableness and foreseeability of harm is considered as a whole, not as separate elements requiring independent proof.” In fact, the court of appeals expressly and again erroneously determined that “[w]hether the risk of criminal conduct is both unreasonable and foreseeable is determined by assessing the five Timberwalk Factors.”

The Texas Supreme Court ultimately agreed with the trial court. The Petrie v.

Gallery opinion concluded as follows: “We reverse the court of appeals because it failed to properly consider whether the risk of harm was unreasonable.

We render judgment in Gallery’s favor because Petrie failed to offer evidence of the burden that would be imposed on Gallery to prevent or reduce the risk of a crime like this one.”

Whether your personal assessment of your new year’s conduct will take the form of a resolution or a commitment, realize that its success depends upon a two-part (at least) analysis. First, can you foresee the consequences of your questionable conduct (e.g. over-eating and under-exercising)? Yes. Second, will you independently and candidly weigh the costs to you to eliminate the questionable conduct? After reading this, you most likely will.

Will you achieve your resolution of better health in 2018? The Magic 8 Ball says “Signs Point to Yes.”

As the number of new unit deliveries continues to rise, and in-migration from the east and west coasts steadily slows, the local apartment market reflects a pattern of diminishing returns that has lasted for the past two years. Despite the decline, many new developments move forward and investors continue to pour in.

The third quarter, usually the strongest quarter of the year, held occupancy steady at 92.4% during one of the largest new unit delivery waves seen in many years.

However, while occupancy struggled to maintain the status quo, annual rents, which are usually heightened by new luxury additions and upgrades, crashed during the quarter – falling from an annual growth rate of over 4.5% this time last year, to a nominal .23%, to rest at $1.41psf.

Although effective rental rates didn’t keep the pace, there may have been some reprieve for occupancy due to the latest hurricane disaster. However, there have been few reports of market impact therein. On the other hand, many properties reported a loss of tenant retention because of job transfers out of the area, but the dominant cause of reported moves were tenants feeling priced out of the rental market and choosing home ownership instead. On that note and for future reference, the local home buyer’s market has just recently experienced a shift as well. Previously, home sales and prices hit record highs in both 2015 and 2016, however, the latest data from the Austin Board of Realtors reflects a downward shift in year over year pricing with inventory levels on the rise. It is yet to be seen if there will be a continuation of this trend but it is expected – unless there is a dramatic change in the flow of in-migration.

With all of that said, the Austin area is not expected to experience the heights in growth seen in the past, but interest among developers and investors alike remain.

There are over 26,000 units in the permitting process or in the planning stages, and the number of sales transactions remains on par with annual totals, only with a greater supply of “for sale” assets entering the market.

The fourth quarter is likely to be challenged due to the extensive number of new unit deliveries from delays that will enter the market during the seasonally slow period. Sales, however, are expected to increase.
