What Is Outstanding Finance - and Why Does It Matter?
Outstanding finance means that the equipment’s previous owner still owes money on it, typically through a loan or hire purchase agreement. Until that debt is fully repaid, the lender may retain legal ownership and could reclaim the item at any time.
It’s similar to buying a used car with an unpaid finance agreement. Unless the finance has been cleared, the legal owner isn’t the seller - it’s the lender, and that puts the buyer at risk.
Carry Out Thorough Checks Before You Bid
The best way to avoid issues is by doing your due diligence before placing a single bid.
• Ask for Documentation: Request proof of ownership, service history and confirmation that finance has been settled.
• Run a Finance Check: Use serial numbers or asset details to check for debt. For registered items, tools like HPI Check or Experian Asset Check can help.
• Ask the Auctioneer: Reputable auction houses often conduct finance checks and may confirm in writing that the item is being sold with clear title.
Read the Fine Print
Carefully review the auction house’s terms and conditions, including:
• Whether the machinery is sold “as seen”
• If a clear title is guaranteed
• Any clauses allowing sales to be cancelled due to disputes or debt
Get a Detailed Bill of Sale
Once the sale is complete, ensure you receive a Bill of Sale that includes:
• Full asset details (make, model, serial number)
• A statement confirming there are no finance or legal claims
• Buyer and seller information
• Signatures from both parties
This document helps establish legal ownership and serves as vital protection in the event of a dispute.
Protect Yourself When Spending Big
For high-value purchases, consider additional protection:
• Speak to a solicitor who specialises in commercial sales
• Take out title insurance to safeguard against future claims

Midlands-based chartered surveyors and auctioneers Kumar and Company are overseeing the sale of approximately £300,000 worth of wall and floor tiles following the liquidation of Stourbridge-based tiling retailer, Essentially Tiles.
The auction comes after insolvency specialist Philip Ballard, of Ballard Business Recovery, was appointed as liquidator in June. He has since instructed Kumar and Company to handle the disposal of the company’s stock and business assets through an online auction.
The sale features over 260 carefully assembled lots drawn from more than 5,000 product lines, including ceramic, porcelain and natural stone tiles previously stocked by Essentially Tiles. Also included in the auction are two forklift trucks, a long wheelbase van and a variety of related materials such as grout and adhesives.
The auction is now live and runs until Thursday 24 July via Kumar and Company’s online platform.
Rajiv Kumar, Managing Director of Kumar and Company, commented: “Essentially Tiles had been trading for many years and, at its height, operated multiple outlets across the UK before scaling back to focus on its main warehouse in Stourbridge. The business served both trade professionals and retail customers, but unfortunately faced operational and financial pressures that led to its closure.”
“This is a significant stockholding, and with more than 5,000 product lines available, there’s strong potential value here for resellers, builders, developers and individuals working on home renovation projects. We’ve already seen early interest from tiling wholesalers and other trade buyers.”
