ACCESSING WORKERS IMMIGRATION AND RIGHT TO WORK
The post EU exit immigration system continued to evolve in 2022, with new immigration routes, the end of Coronavirus Adjusted Checks, the introduction of digital identity document validation technology (IDVT) checks and the continuing journey towards digitisation of UK borders. Right to work issues are the most common type of query the ALP Expert Helpline receives. Throughout 2022, ALP remained engaged with the UK Home Office and Defra’s Access to Labour team, asking questions, challenging guidance, calling out misinterpretation and ensuring that our guidance is clear, comprehensive and up to date, enabling labour providers to remain confidently compliant. Our new Right to Work Checklists take members through a compliant right to work check for manual, online and IDVT checks, making sure that labour providers can keep a detailed record of each check they undertake, establishing a statutory excuse, and demonstrating compliance to auditors and clients.

ALP worked closely with the Home Office to create the online guide ‘Workforce Recruitment and Labour Supply.
Created as a one-stop guide to recruitment in the UK after Brexit and now on its 4th edition, the guide supports labour providers and employers to consider what actions to take to help secure continuity of labour supply, and understand the immigration system including:
n Routes to employment in the UK
n How to become a sponsor
n What action to take to remain compliant with right to work legislation, both in respect of existing workers and new applicants
