Less than two weeks after he was put on the federal Bureau of Investigation’s (fBI) 10 most Wanted list, fil-Am Philip Patrick Policarpio, 39, was arrested by agents of the Us Customs Border Protection on sunday night, may 29.

According to the fBI spokeswoman Laura eimiller, Policarpio was apprehended at the border, while he was crossing into the Us from tijuana, mexico, as reported by fox News. A convicted felon, Policarpio — whose aliases include “Damon hiromi tanaka,” “Paul Policarpio,” “Bugsy,” “sinister,” and “sins” — was taken into custody at the san Ysidro Port of entry.

“Leni must understand that she belongs to the opposite side,” Duterte said.

When asked what would be robredo’s role in his administration, he replied: “We’re still studying the script of the movie.”

The session was slightly interrupted when Northern Samar Representative Harlin Abayon made a manifestation asking who the real representative of the province was and why his name was not mentioned during the roll call in the canvassing. The Supreme Court has ruled that Abayon was the duly elected representative of Northern Samar’s first legislative district, reversing previous resolutions of the HOR Electoral Tribunal nullifying his victory in the May 2013 polls, which was questioned by former deputy speaker Raul Daza.

Gonzales said Abayon’s concern could not be resolved in the joint session.

Abakada party-list Representative Jonathan Dela Cruz, who served as Marcos’ campaign adviser, also delivered a speech that exceeded the allotted two minutes. He cast doubt on the integrity of the electoral process and called technology provider Smartmatic “Smartmagic.”

At 4:10 p.m., an hour after the session started, Senate President Franklin Drilon and Speaker Feliciano Belmonte Jr., proclaimed Duterte and Robredo as duly elected President and Vice President. This was after both chambers had approved the joint committee report and an accompanying resolution. Senator Alan Peter Cayetano moved for the proclamation of the two.

The session was temporarily suspended to allow Robredo to join the plenary.

The widow of the late Interior Secretary Jesse Robredo, who had come from a Mass at St. Peter Parish in Quezon City, attended her proclamation.

The proclamation was done only three weeks after the May 9 national polls, one of the fastest in Philippine post-Edsa history.

Outgoing President Benigno Aquino III and Vice President Jejomar Binay were proclaimed winners on June 9, 2010 almost a month after the elections.

After the press conference, City of Artesia Mayor Victor Manalo said he agrees with Clinton’s priorities. He would like to see the potential Democratic nominee continue her focus on poverty issues, especially as they apply to women and children.

“We have a significant number of children that are going hungry, and suffering from abuse and neglect,” Manalo told the Asian Journal. “We can do better as a country to take care of those who are most vulnerable.”

would apply only if one live bullet is found in the luggage of a departing passenger, especially elderly people and overseas Filipino workers (OFWs).

He clarified that if they find a fully loaded bullet magazine or several bullets inside the luggage, the passenger would be apprehended.

He said once the X-ray machine at the departure area detects only one live bullet in the luggage, the OTS inspector will ask the passenger to view the Xray monitor to look at the bullet without anybody touching the subject luggage.

Denros said the inspector would then ask the passenger to get the bullet from the bag and surrender it to the OTS and the passenger would be allowed to board his plane without any interrogation or even charges of violating the law.

“We ask them (passenger) if you still want to leave. If they say yes, then we will ask them to open their luggage and get the bullet and surrender it to us, then we will let them go,” Denros explained.

Denros recalled that last Saturday afternoon at NAIA Terminal 1, the X-ray scan detected a live bullet and two empty shells inside the check-in luggage of a departing OFW. “I called the attention of the OFW and asked him to view his luggage that contained a bullet through the X-ray monitor and asked him politely if he still wanted to proceed to the Middle East, and he replied, yes please,” Denros said.

He told the OFW to open his luggage, get the bullet and surrender it to the OTS.After doing this, he was allowed to board his flight without being charged with any violation.

The OFW, whose identity was

withheld, thanked the OTS team several times and continued waving his hand while walking toward the airline counters.

Denros said the new rule is part of the review of regulations of the OTS security check.

He said that many people still believe in bullets as amulets or good luck charms, and some passengers are caught in the airport with amulets in their luggage. n

FBI reports said that he and his 32-year-old girlfriend were visiting a friend in the Rampart area of Los Angeles last April 12 when the crime was committed.

Policarpio allegedly became angry with Olguin and started to beat her face, and then shot her in the forehead with a handgun.

Prior to his 2001 conviction, Policarpio fled to the Philippines in 2000 due to a case involving a dispute in Burbank, California, in which he was suspected to have fired nine shots into another car.

He was deported back to the US the following year, convicted and sentenced to 15 years in prison.

He was released on parole in May 2015.

The 39-year-old convicted felon has numerous ties to Las Vegas, Florida and the Philippines.

According to investigators, Policarpio’s family members include multiple wives and children.

“His pattern is one of violence, and he is always armed,” FBI Special Agent Scott Garriola said in a statement earlier this month, NBC News reported. “He is the definition of a continuing threat to the community.”

Olguin’s mother, Jerilyn Olguin was relieved when she found out that her daughter’s suspected killer has been caught.

“Although my daughter’s gone, my biggest fear was, ‘God, I hope he doesn’t do this to someone else,’” Olguin said, in an interview with NBC Los Angeles.

SAN FRANCISCO — A jury found that the life of one of the five women killed three years ago in a limousine fire was worth $6.5 million, but her widower won’t be able to collect that money.

Aldrin Geronga, widower of Felomina “Fyla” Geronga, 43, had sued Ford Motor Co. for up to $37 million. The jury, however, found that Ford was not responsible for the fatal fire that destroyed the limousine carrying a wedding party on the San Mateo Bridge in Foster City, California on Saturday, May 4, 2013.

Jurors did decide that Limo Stop, the San Jose owner of the limousine, was to blame for the fire. Investigators blamed the fire on a “catastrophic failure” of the car’s suspension system: The vehicle’s drive shaft rubbed on its undercarriage, causing sparks and friction that started the fire.

Ford’s lawyer said Limo Stop’s neglect and abuse of the vehicle for causing a suspension system failure that led to the fire.

Geronga has already settled with Limo Stop for an undisclosed amount, said his attorney, William Smith. The survivors, as well as the families of the other victims who died also have settled with the other defendants except Ford. Geronga will appeal

In an open letter to Democratic and Independent voters, Governor Jerry Brown said he sympathized with Sanders’s campaign message of empowering of the average American against the influence of the “top one percent.”

However, Brown said that Clinton’s nomination would be “the only path forward to win the presidency,” and added that her lead over Sanders by “millions of votes” signifies that Democrats want her to be the nominee.

The AAPI community is the fastest-growing ethnic group in the country, and its voting power has doubled from 2 million to 4 million voters in the past decade.

In addition to Chu and Matsui, who represented CAPAC, other AAPI elected officials were also present at the event, including Monterey Council Member Stephen Lam, San Gabriel Mayor Chin Ho Liao, and Garvey Elementary School Boardmember Henry Lo. They made note of the presidential hopeful’s history of dialogue with not just AAPIs, but all communities of color. Lo recalled the first time he saw Clinton speak when she visited his high school in 1992, just after the LA riots. Lo said that Clinton held an hours-long session with young community members discussing social inequality and racism.

“One of the first things [Clinton] did after kicking off her campaign was to meet with members of CAPAC,” said Chu. “She listened to every point we raised.”

Earlier this month Clinton was the only presidential candidate to speak at the Annual Asian Pacific American Institute of Congressional Studies’ gala in Washington DC. She is also the only presidential candidate to host an outreach event directed specifically toward the AAPI community.

Clinton will continue her campaign in California with a series of appearances at Get Out The Vote events from June 2 through June 6. Sanders is scheduled to appear at events in Palo Alto, Santa Cruz and Monterey. Donald Trump has scheduled an appearance at a rally in Sacramento at the International Jet Center on Wednesday, June 1.

On Monday, three witnesses surfaced to claim that the vote rigging took place in a four-story building in Lucena City. They claim that they accepted the votes from clustered precincts in the

municipalities and reconfigured the results with secured digital (SD) cards with preloaded data for the favored candidates. The said SD cards will then be used by Smartmatic operators to transmit votes to the Comelec servers.

In a Radyo Inquirer interview, Council for Philippine Affairs Secretary General Pastor “Boy” Saycon Jr. quoted one of the witnesses who said that President-elect Rodrigo Duterte lost 200,000 votes in Quezon.

Comelec chairman Andres Bautista echoed Guia’s sentiments, adding that the timing of the whistleblowers is suspect.

The witnesses surfaced hours before Congress is set to proclaim Duterte and Robredo.

“Bakit ngayon lang? Kung meron talagang ebidensya at may pruweba ng dayaan, bakit ngayon lang lalantad?” Bautista said in a radio dzMM interview.

Chinese President seeks better ties with PH

CHINESE President Xi Jinping is hoping that the Philippines and China will have better ties under a Duterte administration amid a bitter territorial row in the West Philippine Sea (South China Sea).

Xi’s statement was issued by China’s Ministry of Foreign Affairs late Monday afetr the proclamation of President Rodrigo Duterte, who has been vocal about resuming bilateral negotiations with the Asian giant. “[I] hope both sides can work hard to push Sino-Philippine relations back onto a healthy development track,” Xi said.

Beijing and Manila has had strained relations since the standoff in 2012 between a Philippine warship and Chinese surveillance vessels in Panatag (Scarborough) Shoal.

The tension escalated when the Philippines filed a memorial against China at the United Nations-backed Permanent Court of Arbitration.

In seeking better ties, the Chinese leader noted that Manila and Beijing had a rich history of friendly exchanges and deep traditional friendship.

healthy development of SinoPhilippine relations accords with the basic interests of both countries and both peoples,” Xi said, adding that both countries have the responsibility to deepen cooperation.

Meanwhile, the Singapore Embassy in Manila also disclosed that President Tony Tan Keng Yam and Prime Minister Lee Hsien Loong have written a congratulatory letter to Duterte.

Tan noted that the Philippines and Singapore are “old friends

with strong ties.”

“Our countries cooperate closely in Asean and internationally, including at the United Nations, to promote peace, stability and prosperity. During my State Visit in April 2014, my wife and I were impressed by the economic progress of the Philippines and the resilience of the residents of Tacloban [City] as they worked to rehabilitate their hometowns from the devastation of Typhoon Yolanda,” part of the letter read.

While Duterte has been criticized by the local business community for his lack of economic agenda, the Singaporean President still expressed confidence that the new administration “will lead the Philippine economy to greater heights.”

“I wish you success as you embark on your new role, and look forward to meeting you soon. I would also like to take this opportunity to invite you to visit Singapore at the earliest opportunity,” he said.

Lee expressed hopes that the Philippines and Singapore will be able to strengthen diplomatic ties.

Cayetano eyes Senate presidency

SENATE Majority Leader Alan Peter Cayetano on Monday claimed that 15 senators committed to support his bid for the Senate presidency but Sen. Vicente Sotto 3rd downplayed Cayetano’s claim, saying commitment is different from actual votes.

Cayetano admitted that he is not sure if he will be elected.

“I don’t want it to be a game of numbers at this point in time.

There are those who also already signed. Others have given their commitment. Until the final day that you get elected, nothing is 100 percent,” he said.

Senator Emmanuel “Manny” Pacquiao was the first to sign a manifesto declaring support to Cayetano’s bid.

But Sotto said 18 senators gave their commitment to support another candidate for the Senate presidency.

“Everybody has commitments, it’s easy to commit. The important thing is when you

vote,” he added.

Sotto said Pacquiao was among the 18 senators who committed to support another candidate.

Sen. Aquilino Pimentel 3rd, the president of Partido Demokratiko Pilipino-Lakas ng Bayan (PDPLaban), which is chaired by President Rodrigo Duterte, also gave his commitment to their bloc.

“It’s not that easy. They have to realize first if you have the same objectives, if you have the same advocacies then you come up with the majority for the Senate.

An independent, a Senate with integrity,” he added.

Meanwhile, Cayetano said major factor in the Senate presidency race are the committee chairmanships because the heads of the different blocs in the chamber want to protect their members.

He added that it will be difficult to grant all the committee chairmanship requests of senators.

Cayetano said they have settled the chairmanship of at least 13 committees including the Public services, finance and public order.

The Public Services committee handles matters affecting public services and utilities; communications; land, air, river and sea transportation including railroads, inter-island navigation, and lighthouses; and the grant or amendment of legislative franchises.

The panel on public order and illegal drugs is in charge of matters relating to peace and order; the Philippine National Police; the Bureau of Jail Management and Penology; the Bureau of Fire Protection; private security agencies and the use, sale, acquisition, possession, cultivation, manufacture and distribution of prohibited and regulated drugs and other similar substances.

The finance committee handles all matters relating to funds for the expenditures of the National Government and for the payment of public indebtedness; auditing of accounts and expenditures of the National Government; claims against the government; intergovernmental revenue sharing; and, in general, all matters relating to public expenditures. n

MALACAÑANG on Tuesday, May 31 highlighted improvements in the country’s business efficiency following the release of the World Competitiveness Yearbook (WCY) ranking.

According to the International Institute for Management Development’s (IMD) WCY report, the country went down a notch to 42nd in the world rankings, from 41st last year.

It also went back to 12th place in the Asia-Pacific region from 11th last year.

The ranking covers 61 countries and involves 342 criteria under four broad categories: economic performance, government efficiency, business efficiency and infrastructure.

“We note the WCY report stated the Philippines registered marked improvements in business efficiency and infrastructure and remained stable in government efficiency, while the

MANILA — The Philippine government and the Moro Islamic Liberation Front (MILF) have agreed to continue the peace process in Mindanao.

by Miriam Coronel-Ferrer and MILF peace panel chairman Mohagher Iqbal signed the “Declaration of Continuity of the Partnership” after a two-day special meeting in Kuala Lumpur, Malaysia on Monday.

Both panels sought to ensure the full implementation of the Comprehensive Agreement on the Bangsamoro (CAB) in the next administration.

Ferrer and Iqbal also signed the Terms of Reference for the establishment of the Bangsamoro Normalization Trust Fund (BNTF), a multi-donor trust fund under the Framework Agreement on the Bangsamoro (FAB) and the Annex on Normalization.

The two panels also signed the Terms of Reference for the Project Board of the Mindanao Trust Fund for the economic development of six MILF camps.

CHANGE is indeed coming. The transition of power to Presidentelect Rodrigo Duterte’s administration has become more apparent even in the incoming 17th Congress.

In the House of Representatives, a Congress shake-up is currently ongoing after several members of the ruling Liberal Party have decided to curtail its “Tuwid na Daan” (Straight Path) engagement for Duterte’s PDP-Laban Coalition. Several elected congressmen and congresswomen have also decided to jump ship from their respective parties to support the incoming president.

According to Inquirer.net, other parties have gravitated towards PDP-Laban, namely the Nationalist People’s Coalition (NPC), Nacionalista Party, Lakas-Christian Muslim Democrats, National Unity Party and the 45-member party-list coalition.

They are expected to enforce Duterte’s platforms with laws to rein corruption and criminality in the country.

Quezon City Rep. Feliciano Belmonte Jr., who led the House speakership in the 15th and 16th Congress under the Liberal Party, has conceded and joined the minority.

“I will join the minority, I have no idea how many are joining it,” he said after at least 80 of the the 116 elected Liberal Party members have decided to transfer to PDP-Laban.

The Philippines has three branches of government: the executive (President), the legislative (Congress consisting of the Senate and the House of Representatives) and the judiciary (Supreme Court and all other courts). Each department has a distinct and essential role in the function of the government, and was established under the Constitution.

Filipinos expect these three great departments to work together to solve the country’s much bigger problems. Enhancing such cooperation among the branches may be achieved by meeting regularly to discuss issues and be involved in addressing key problems facing the nation. No long goodbyes and fond farewells for the president of the 1% THE President of our nation always Opinion leaves behind a mostremembered optic, upon which we base our lasting impression of his or her leadership. It can be an act of supreme MaRlen Ronquillo greatness—or hubris.

That optic stays vivid and fresh in the national memory—there is no need for a caption, or accompanying worlds.

Think of Erap and his tugboat ride out of Malacañang to escape the lynching mob outside. In contrast, think of Mr. Ramos and the joyful cigar puffing and his “skyfalls,” reminders of a government marked by relative prosperity and peace. A government of very little tumult.

On Mr. Aquino, the one lasting, unforgettable optic of his six years in power—his permanent imprint on the national memory—took place on the sad day the bodies of the fallen SAF 44 were planed in by military aircraft to Manila, from the Mamasapano killing fields. Not a shadow of Mr. Aquino was at the welcoming group, an occasion that marked an outpouring of national grief and commiseration.

Where was he? What epic event made the President decide to skip a sad homecoming where his presence was not only badly needed, but a leadership must, and a calming one?

Believe it or not, he was at the recycling-cum-inauguration of a decades-old car manufacturing facility in Sta. Rosa, Laguna, which changed ownership, to save the facility from moving on into the next obvious destination—the junkyard. There, Mr. Aquino talked of the

theme that animates him, investments, and the supposed nirvana that the nation derives from such lofty event—which on that day was the recycling of a mass of steel to save it from its junkyard-bound fate.

A mass of aging steel versus 44 returning cadavers that his government itself had sent into the slaughter? Mr. Aquino, our all-business President, opted to glorify the aging steel instead of sharing the grief with his stunned, mourning nation. Nowhere in that Sta. Rosa speech did the President waver from his unrelenting theme of growth and investments. It was totally out-ofsync with the preoccupation of his nation at that moment, commiseration with 44 SAF troopers waylaid due to operational and leadership bungles in the underwhelming cornfields of Mamasapano.

A look back at the six years of Mr. Aquino in power, and the photos that revealed what for him were the highlights of his presidency, validated the impression that Mr. Aquino’s obsession were inanimate pursuits: nice GDP charts, credit upgrades from the (discredited) rating agencies, inaugurations of roads, bridges and office towers and assembly plants. If you wanted the attendance of the President, or the attendance of an enthusiastic President, the invitations should be about gleaming office towers of glass and steel, new power plants, new airports and seaports, structures with intimations of a country on the go and on the move.

Never human lives, especially the

lives of the downtrodden .

Of course Mr. Aquino interacted with humans. But they were taipans, young achievers, would-be-investors, movers and shakers. On the occasions with the movers and shakers, the photo collection of the Aquino presidency would show him a pleased man, grinning from ear to ear, devouring the usual blah blah on how these chosen ones’ investments would move the GDP growth.

Mr. Aquino’s sense of triumphalism peaked on the occasions he was with the Davos crowd or the Makati Business Club.

About two years into his presidency, I wrote a piece titled “Mr. Aquino should change his photo-ops” after many concerned citizens took note of the fact that his photos as President were exclusively about success and successful ventures and people—never about people on the margin, the class of people so strongly specified in The Sermon on the Mount.

Where were the weak, the meek, the humble and the persecuted in Mr. Aquino’s presidential photos, that piece asked. Why were they rendered invisible by his presidency?

Was not the President the father to all the citizens regardless of status in life, religion and beliefs?

Typhoon Yolanda and the heart-rending misery and devastation it dealt on Eastern Visayas unraveled the almost brutal indifference of the Aquino government toward those who need the government most. Mr. Aquino and his co-president, Mr. Roxas, if you reread the Yolanda files, seemed to loathe the whole exercise of coming to the succor of the dead and the barely living. Mr. Aquino was a clueless Dead Leader Walking while presiding over the Yolan-

da relief and rehabilitation efforts.

The adrenalin that surged within the body system of the President during the inauguration of gleaming office towers was replaced by impatience and surliness in the Yolanda devastated areas.

The work of coming to the succor of a wasteland seemed to be too tasteless, too cumbersome for the President.

Of course this was the same President who vetoed a meager increase in the SSS pension, claimed that the token Magna Carta for the Poor was a “budget-buster” and vigorously opposed a tax break for tax-burdened wage earners; and used the Napoles scam to cut off the token subsidies to the peasantry.

Of course, this was the same Presi-

dent who designed the P1.4 trillion PPP projects as bid-ready for the members of the 1 percent and the blue-chip corporations.

Mr. Aquino will be a private citizen a month from now and the new Palace occupant is the same man he vigorously campaigned against, the candidate he deemed unfit to be President. PLDT, Globe buy SMC telco for P69-B

THE country’s top two telecommunication firms have agreed to buy assets in the sector of conglomerate San Miguel Corp. (SMC) for nearly P69.1 billion in a joint deal that, they say, will significantly upgrade slow Internet services that have been a drag on one of Asia’s fastest-growing economies.

Philippine Long Distance Telephone Co. (PLDT) and Globe Telecom confirmed on Monday, May 30 the mega deal in what could signal their continued duopoly in the telco sector.

Both telcos vowed that services — especially in terms of quality of Internet services — would improve with added frequencies from SMC-controlled companies, the main target of the acquisition.

In separate statements, PLDT and Globe said they would acquire subsidiaries of food-topower group SMC, including a prized 700-megahertz frequency.

The transaction is valued at P69.1 billion ($1.48 billion), they said.

Each of them will acquire 50 percent of the SMC’s telco business just a few months after SMC’s attempts to seal a joint venture with Australia’s Telstra Corp. Ltd. collapsed.

The mega deal is subject to

shareholder and regulatory approvals.

Slowest in world Internet connectivity in the Philippines is among the slowest in the world, according to data analytics firm Ookla, despite the country’s rapid economic growth. President-elect Rodrigo Duterte last week warned telco players to shape up or face the prospect of foreign competition.

In a media briefing, PLDT chair and CEO Manuel V. Pangilinan said subscribers would be able to feel the improved quality of services as early as “within the next six months.”

“We entered into this transaction as a solution to harmonize the spectrum assets in the country and immediately unlock the benefits of the underutilized frequencies,” Ernest L. Cu, Globe president and CEO, said in a statement.

“Ultimately, our goal is to provide our customers with a better experience on our mobile data and home broadband services progressively over the next 12 months,” he added.

Improved Internet?

In a separate statement, Pangilinan described the transaction as “a breakthrough opportunity, not only for the companies involved, but also for the industry and the country.”

MANILA – Economic concerns of the business community surrounding a Rodrigo Duterte administration are easing, but businessmen are turning cautious in terms of their growth forecast for the Philippines this year on the effects of a one-two punch provided by a dry spell and a possible onslaught of La Niña.

Heads of several local and foreign business groups interviewed by The Star said apprehensions earlier raised against the incoming president have subsided following

the unveiling of his eight-point economic agenda as well as recent appointments of Cabinet secretaries.

“Everybody is welcoming him and the business community is expecting much from our new president especially because he is in favor of lifting the economic provisions, the restrictions in our Constitution so that’s very welcome. And he also said he would fight criminality and leave business to business. That’s fantastic,” Management Association of the Philippines president Perry Pe said.

“We’ve seen his economic eight points.

We agree that it looks fairly progressive

and very reasonable. He said he’s going to continue the current macroeconomic policies and he’s going to ease restrictions on foreign investments so we are happy with that. But we will be very happy to see the details of this. The 50-50 venture mainly involved acquiring SMC’s Vega Telecom Inc. for P52.08 billion and the assumption of about P17.02 billion in liabilities.

PLDT and Globe said the equity part of the deal for Vega, as well as companies New Century and eTelco, would be paid over a period of three years, with the first tranche done upon signing today.

Both telcos were mainly targeting the 700-MHz frequency of SMC, which held most of the spectrum.

PLDT said the additional spread would result in “wider coverage and more efficient network utilization.” This is expected to mainly benefit subscribers of PLDT’s Smart Communications, TNT and Sun as well as those of Globe Telecom.

As part of the deal, PLDT and Globe will also give up some of the acquired frequencies.

These will be partly in the 700MHz, 850 MHz, 2500 MHz and 3500 MHz, they said.

“These radio frequencies to be returned by subsidiaries of Vega

Telecom to the NTC [National Telecommunications Commission] will be sufficient together with the radio frequencies already held by the NTC to allow for a third-party operator to enter the market,” PLDT said.

While the deals will reinforce the leading pair’s grip on the market, PLDT and Globe both said they would return certain radio frequencies to the government, allowing for a third competitor to enter the market.

Speaking at a news conference after the deal was announced, Ray Espinosa, PLDT’s head of regulatory affairs, said the agreement would not need the approval of Congress.

On Monday morning, PLDT shares were up 6.8 percent while Globe rose 4.2 percent. San Miguel shares were flat after having risen as much as 3.4 percent earlier.

While additional bandwidth will be good for the incumbent telecom players, sector watchers said, new entrants are seen facing steeper hurdles.

“It’s not that easy to come in,” Wilson Sy, director of Philequity Management Inc., told Reuters.

His company handles more than P20 billion ($427 million) in assets.

“Capital expenditure is so

huge … . Additional players will find it difficult versus those who are entrenched,” Sy said.

Capitulation?

Reacting to the PLDT-Globe venture, a militant party-list lawmaker said it was a capitulation of a third player in an oligopolistic market.

“It’s telling that a massive conglomerate like SMC was forced to raise the white flag in its attempt to enter the telco sector.

The sale of broadband frequency to PLDT and Globe will further entrench their stranglehold on the market,” said ACT Teachers Rep. Antonio Tinio.

Without a strong government regulator, Tinio saw little incentive for PLDT and Globe to improve Internet speed and lower costs.

Former Akbayan Rep. Walden Bello said broadband space had nothing to do with the problems faced by consumers on slow download speed and high costs.

“It’s not a technological problem. It’s a market control problem. SMC was not a serious player. But with its broadband frequency now with PLDT and Globe, it will strengthen oligopoly and make it more difficult for smaller local players to emerge,” Bello said. (With reports from Gil C. THAT scene in one of the Harry Potter books where eerie sounds and strange occurrences caused by a ghost in residence were coming from — of all places— the toilet stalls, in Hogwarts is not all that original. Because it happened years ago, not as fiction but as part of reality — my reality, that is.

Just for kicks during my halcyon days as a full-time working /full-time grad student at the University of the Philippines long ago, I had agreed to act as medium for a séance or a hypnotic session to conjure or call the spirit or spirits that were causing a disturbance. I took over from another medium in a previous session weeks earlier conducted by a Jesuit priest from the Ateneo, Fr. Bulatao. There were repeated paranormal disturbances at the old building where I worked, a stone’s throw from the Institute of Mass Communication (now called by another name) where I was a grad student at night while working during the day as a full time research associate of what was then the Institute of Environmental Planning, now called the School of Urban & Regional Planning. That haunted building has been razed and there stands a newer multi-story building.

side, there were eerie noises that would make the hair on the back of one’s neck stand on end. The occurrences were so frequent and so disruptive, ignoring them and pretending life was normal was no longer an option. Someone finally did something about it and called on Fr. Bulatao to help shed light on the mysterious goings-on at the institute. I simply avoided the rest rooms and steered away from isolated areas of the building and never stayed in the building past sundown.

Professor Cynthia Turingan was the first medium. Under hypnosis, she revealed that an American soldier, an enlisted man, by the name of Stephen Davies (his name was spelled with an e in the surname) was murdered at the location right smack dab where the building stood. Details of a murder story flowed out of her like a gusher.

But then it came to an abrupt halt when the door to the room where the session was being held, for no apparent reason, suddenly burst open. The medium snapped out of the hypnotic trance feeling extremely limp and exhausted as though she had traveled many miles across a desert. I stood up and with a nonchalant shrug of my shoulders calmly closed the door.

Dissatisfied with the aborted session, the group decided to hold another. Professor Turingan was unavailable for the next session and I was drafted to act as medium, a role which I accepted on a lark and a dare.

There was a thunderstorm raging outside but I don’t remember much of what I said when I went on a trance. I do remember feeling very light, as though weightless, while someone gently whispered things to my ear. Later, I learned that under hypnotic suggestion, I was instructed to go back to 1945, the year that the medium revealed when the alleged murder of the American soldier occurred.

How do you characterize real property purchased prior to marriage but with the mortgage principal paid down using community income or funds during the marriage?

The community in this situation acquires a pro tanto interest in the ratio that the payments on the purchase price made with community funds bear to the total payments on the purchase price and any appreciation should be apportioned accordingly. Marriage of Moore (1980) 28 C3d 366, 371, 373, 168 CR 662, 664, 665. Other expenses associated with the property are not considered in the calculation such as mortgage interest, taxes, and insurance. In essence, the real

Is real estate property purchased prior to marriage considered community property in a divorce? property would accumulate both a separate property and a community property component by the date of separation. The appropriate remedy in this situation where separate property is subsequently paid with community funds is “apportionment.”

The process of apportioning between the separate and community property component is laid out in the Marriage of Madsen. In that case, the court determined the ratio or percentage in which the mortgage loan principal was reduced during the marriage and applied that percentage to the appreciation of the real property during the marriage.

The community property component would then consist of the reduction in the mortgage loan principal during the marriage plus the portion of appreciation during the marriage applying the ratio discussed above.

In the Marriage of Madsen, the real property was purchased by the husband for $38,300 prior to the marriage. The original mortgage was $30,000.

By the time the husband got married, the house was now worth $65,000 while the mortgage has gone down by $7,000. Both the

appreciation of $26,700 and the mortgage reduction of $7,000 would be separate property since it occurred prior to marriage.

During the marriage until the time of trial, the property has appreciated another $117,500 (property now valued at $182,500) while the mortgage has further declined by $9,200 up to the date of separation.

The ratio at which community funds paid down the mortgage ($9,200) during the marriage to the original purchase price ($38,300) amounts to 24.02%.

This percentage of the property appreciation during the marriage of $117,500 ($28,223.50) plus the reduction in mortgage balance during the marriage ($9,200) would constitute the community component of the real property. The rest was the husband’s separate property.

The husband in that case was awarded his separate property component of the real property plus one half of the community property component.

The Madsen apportionment method is also applicable to situations where a community

real property is later transmuted into one spouse’s separate property through execution of a quit claim by the other spouse but is subsequently paid using community funds. Marriage of Broderick (1989) 209 CA3d 489, 257 CR 397.

Since California case law allows the creation of a community interest in real property acquired prior to marriage, one has to consider vehicles to protect themselves if you own property and you are contemplating of getting married. There are several ways of avoiding the creation of a community interest on your separate real property. One, you can sign

a prenuptial agreement. Two, the parties can execute a postnuptial agreement if the parties are already married. Three, the parties can execute a transmutation agreement with a waiver of any family code section 2640 reimbursement claim. Notable female entrepreneurs share keys to succeeding in today’s marketplace by

AT the tail end of Asian Pacific American (APA) Heritage Month, the Asian Business Association (ABA) of Los Angeles hosted its third annual Women Business Pioneers Symposium, featuring a panel of four women who have achieved success in the fashion and lifestyle industries.

Held at the California Club in downtown Los Angeles on Thursday, May 26, the sold-out event drew in over 200 guests who listened to the four speakers: Tina Aldatz, co-founder and CEO of Savvy Travelers; Hannah An, founder and CEO of The District by Hannah An; Ferial Moloo, founder and CEO of 365HANGERS; and Kalika Yap, founder and CEO of Citrus Studios, LuxeLink and the Waxing Company.

Supporting Asian female entrepreneurship is more important than ever, Jayme Hu of US Bank noted in her welcoming remarks, and the panel sought to promote that conversation.

Kicking off the panel, Farzana Nayani, programs and membership director of the ABA, asked each speaker to detail her “origin” story and family values, given that they all came from immigrant backgrounds.

Kalika Yap, who was born in Quezon City, Philippines, shared

that her family moved to the United States after Martial Law was declared.

“It was very difficult for my family to transition from being in the Philippines to Hawaii,” she said. “I just realized how lucky and fortunate I was to make it to the United States.”

She moved to California with a boyfriend in the early 90s and was told to look for a job once the relationship ended weeks later. She would take a bus to an internet cafe in Venice, where she started building and coding websites. It soon turned into a venture of selling website hosting plans door to door — picking up sales strategies from her father who sold encyclopedias and vacuum cleaners when she was growing up.

From there, Yap went on to establish Citrus Studios, an award-winning digital agency for corporations, institutions, museums and universities.

A serial entrepreneur, Yap is also the inventor and patent design owner of Luxe Link, a fashion accessory hook for purses.

The idea came when she was traveling in Italy and ate at a small Michelin-starred restaurant, where she was given a big hook to keep her purse off the floor.

“The reason why I [initially] put my bag on the table was because my grandmother always said, ‘pursue on the floor means money out the door,’” she said. “I saw this weird looking meat hook and I didn’t think I would carry this gigantic hook in my Victor Parker, district director of the Small Business Association bag, although it’s (SBA)’s Los Angeles Office, and Farzana Nayani, programs and membership director of the ABA. very functional. tempted to create this hook that would fold.”

For Tina Aldatz, a tumultuous childhood and turn of events led her to pursue a career in the fashion industry and find voids in the market, which eventually turned into two business ideas.

“I decided to take another path [when] my environment was changed because of the circumstances,” Aldatz said.

She didn’t finish high school and has been working full-time in the fashion industry ever since at companies like Victoria Secret and BCBG Max Azria before launching her own business.

Despite her lack of formal education, her experiences working have earned her an “MBA from the school of hard knocks,” Aldatz said.

Along with her best friend and business partner Margarita Floris, Aldatz started Foot Petals, a line of designer insole cushions for women’s high heels. The concept went on to become a multi-million dollar company that garnered recognition from Inc. 500 as one of the “500 fastest growing companies in America.” “...I invented [it] walking through New York City because coming from California, we don’t walk. I tried to walk in high heels and I designed designer foot cushions [as a result],” Aldatz said. “That company was sold for $14 million to a publicly-traded company

and now we’ve just launched our second company here in California.”

After that venture, Aldatz and Floris found that there were not a lot of options for beauty wipes, especially for women who travel frequently; thus Savvy Travelers was born.

“We created a niche after finding a void in the market.

Disposable individually-wrapped wipes, specifically for women, is what we’ve curated in a collection for Savvy Travelers,” Aldatz said.

Ferial Moloo also narrated her immigration story from Pakistan to the United States.

From her parents, she learned the importance of education and hard work.

“It’s been an amazing journey and you know, going to school and growing up here and learning from my parents, it’s all about working hard. I saw my mom working two…three jobs and never taking life easy.

It wasn’t given to us on a plate,” she said.

After consulting for nonprofit organizations for years, Moloo shifted gears to the fashion industry and launched fashion technology platform 365HANGERS in 2010.

“The concept was, the way consumers act and react with brands and products, I thought was going to change very significantly when social media -- being a key driver -- and with that in mind, I wanted to test

the market. I was looking at where the gaps are and where is social media being used and how it can be used better. That’s when I picked fashion,” she said, noticing that fashion brands would not show clothing on models of different shapes and sizes.

365HANGERS was supplemented with a fashion app, Style Scavenger, which was acquired in 2015.

Apart from the fashion-related ventures shared by the other speakers, Hannah An spoke about how she and her family became well-known figures in the restaurant industry.

When her family moved from Vietnam to San Francisco, her grandmother Diana bought a small 20-seat diner and opened Thanh Long.

“It’s her spirit, courage and entrepreneurship that I think that led my family to [where we are] today,” An said.

She added, “From that point on, my family [went] into the restaurant business and it grew from 20 seats to 40 seats to 60 seats to 80 seats to 160 seats in that one one location. In 1991, that’s when we started our new restaurant concept, it’s called Crustacean. I really believe in business that you have to work very hard, but it’s also about the right timing and about how lucky you are.”

such as Crustacean in San Francisco and Beverly Hills, Anqi in Orange County and Tiato in Santa Monica.

In addition to the familyowned restaurants, An opened up her own restaurant, The District by Hannah An, which seeks to fuse Vietnamese cuisine with global influences. From this concept, An said, the lesson of finding the right timing resonated with her.

The four women also shared their best advice for fellow female entrepreneurs.

“Sometimes you have a good idea but you can’t wait because there are billions of people out there and you have to act on it right away,” An said.

Yap emphasized the importance of supporting a passion with a business plan because without one, it’s just “an expensive hobby.” Further, finding the right people and establishing core values within the company sets the tone for the kind of operations and clients you attract, Yap noted.

For Aldatz, she said “know what you’re good and not good at.” Similarly, Moloo, said “Be prepared to let go of what’s not working; keep what’s making it profitable.”

In disclosing their paths of success, these women are champions of encouraging more women to start businesses of their own and inspire changes in their respective communities and industries.

I STIll need more time and a lot of help.” That was how actress-TV host Denise laurel explained her decision to postpone her planned wedding this year to basketball player Sol Mercado.

“I got overwhelmed with putting our families’ schedule together. I had no idea it would be this difficult,” Denise told reporters during the press conference for her latest magazine show, “Modern Girls.” “If you invite one person, you’re going to want to invite everyone. It’s tough to get everybody here, especially family members from the United States.”

There’s also the problem of how to fit the event into Sol’s hectic schedule. “He gets his schedule from the PBA (Philippine Basketball Association) only a couple of months before. In the Philippines, it takes over a year to book a church.”

Denise and Sol got engaged in 2013. She has a son named Alejandro from a previous relationship.

Las Vegas is a city of a thousand flashing lights racing on and off, bizarre and beautiful, meant to confuse people that there is no time here, no night and day, no past or future. It is just like having arrived at a palace at the end of the world, its oversized antiquitiess, employees wearing costumes, seducing you inside with a game of roulette or craps with the sound of money.

Behind the glitter and neon posts is an incredible array of colorful characters who enhance its mystique larger than life. The tales are taller of their winnings and losses in life as well as on the tables, their extreme experiences, even greater.

The characters both real and imagined, famous and obscure—whether a writer is looking for the classic kitchy Las Vegas of yesteryears, when it was known as the temple of the First american Dream (founded

by Bugsy siegal). There is

a hidden world beyond its popular image ranging from the hilarious to the tragic. We are drawn to the city for the inspiration provided by its spirit and character, for what it says about us and our society whether as a cesspool for the crass or a pleasant palace of the ordinary mortal.

Throw in the world’s best and worst gamblers, ladies room attendants, showgirls, conventioneers (doctors are the lowest tippers), to a haven of sin and vice, to its present incarnation as lower rollers gambling playground of today.

You start pondering about that cocktail waitress with the coiffed dyed hair like she was the chorus line beauty, wise cracking with hard, tired eyes and smile that happen on reflex. You know each person has a story. even as we talked, I could hear the handle of slot machines. They pulled and pulled and pulled, making you wonder where the money comes from, even imagined the possibility of the machine incubating their own coins and giving birth to the money—money while lights flashed and bells rang!

For some reason though, I knew the money could never be mine or yours, even if we had a truck load of coins

to spend and pull the same machines all night long, until kingdom come. It will be devoured again and again, the nickels, and the dimes, and the quarters it provides for the hungry slot machines, rather than extra cash for the moonlighter. It seems to me that in some great sky, someone had chosen the lucky and the unlucky, the winner and loser.

Luck wasn’t given because someone needed or deserved it, or I’ll be the luckiest one alive!

Vegas is the temptress that seduced and beguiled leading to wide doors, but these doors weren’t doors, they were great sucking machines of which money fell out of slot machines, into stacks of chips that grew taller or shorter on green felt tables for winners and losers.
