Avoid hefty penalties The WHS Act 2011 places an obligation on ‘officers’ of a company to be able to demonstrate their active participation in the practical implementation of WHS preventative measures. Breaches include fines and penalties of up to $3 million for a corporation and $600,000 for an individual per breach, and up to five years imprisonment.
