WHY do artists or public art commissioners need specific installation insurance?

4

Let’s take a look: Are you sure?

ASSUMPTION: “I’m an artist, and I already have studio coverage. So I’m covered.”

What if… a passer-by trips and injures themselves during installation? Studio policies may not cover installations to an adequate level. In most cases, studio coverage is specific to the studio location only. What if… while working on an installation, the scaffold that was set up falls down and causes damage to the floor? A non-specific installation policy may not cover the property damage.

5

But the reality might be different: Property Damage

ASSUMPTION: “I commission public art and our outdoor/indoor public spaces are all insured. So I’m covered for installations.”

What if… the artist accidentally drops a heavy piece of equipment and damages the flooring? Without specific installation insurance, you may not be covered.

Bodily Injury What if… the artist’s ladder falls on a person who is walking past the installation site and leads to a broken leg and missed work, you may not be covered.

Illness What if… the paint that you selected for the interior mural is causing employees or residents to experience dizziness and headaches, which are preventing them from going to work, you may not be covered. 6

WHAT kind of insurance then do artists or public art commissioners need?

8

General Liability Insurance is the safety net for not only the purchaser of the commissioned piece but for the artist as well. Overview of the Art Installation Program The Commission Artist General Liability Insurance Program is a first of its kind and covers commission artists for certain liability claims which arise out of the installation of commissioned artwork on-site. Liability insurance protects commission artists from the risks of potential lawsuits that could arise from accidents, injuries, illnesses, or damages. This protection provides coverage for accidents like slips and falls, destruction of third-party property, and accidents that cause injury to others. This program works on a per project basis and is specifically designed to provide coverage for artists, and by association, protection for commissioners on the installation site.

BEYOND ARTISTS’ STUDIO COVERAGE So what’s the difference between my current coverage and art installation insurance? What might not be covered by my studio coverage? Studio coverage will mainly apply to one specified location and will not follow you to the installation site. Therefore, if an incident takes place on site during the installation, the studio coverage may not cover the damages incurred. Art Installation insurance is purposely designed to provide adequate coverage while on the installation site to protect in case of an incident. When something goes wrong? Insurance coverage is simple; accidents happen. In some cases, the insurance is required by the client or the venue. In cases where it may not be required, artists should still make sure they are properly covered. You never know when a passerby might trip over a barrier or section of scaffolding at the site, or what kind of damage would be done if you happened to drop a metal beam from twenty feet overhead. Example: We had a client create an interactive multimedia installation where people could directly interact with the piece. If something were to happen and someone tripped over a cord, or slipped and was injured while being inside the installation, the artist could have been sued. Our policy would have protected the artist against such an incident.

FAQs How long will it take for me to get this insurance in place? Depending on the complexity of the installation it could take anywhere from an hour to a couple days. Will this cover me for the whole year? At this point our program is based on a per project or event basis, so the insurance procured will only cover one installation. Will this coverage extend to the sub-contractors? No, the sub-contractors must have their own insurance to be covered during your installation. We will need you to provide proof that they have adequate coverage prior to purchasing our policy. The subcontractors must carry limits that are at least as high as the ones we provide. As a public art professional, can our city, state, municipality, or non-profit organization obtain insurance on behalf of the artists I am commissioning? Yes. The insurance policy can be purchased on behalf of the artist. As a public art professional, will a liability waiver be sufficient to protect our city, state or municipality from lawsuits? No. During the installation process someone needs to be accountable for the liability and therefore a simple liability waiver would not be sufficient. Does this insurance cover both temporary and public installations? Yes. We have the flexibility to adjust the rating for both temporary and permanent installations. At what stage in the art commission process should I look into insurance? Anytime. We can provide price indications well in advance of the installation in order for the artist or commissioner to get an idea of 14

the cost related to that installation. This can be a useful tool when submitting proposals or when establishing contracts. Will this cover my assistant? As long as a written agreement exists between the assistant and the artist stipulating they are hired for the installation, then the assistant would be covered by this policy. Otherwise, the assistant and the artist would be separate entities requiring their own policies. Does this cover the physical art being installed?

No, the pieces being installed are not covered for damages. Will this cover me if I get hurt? No, this policy is a general liability policy to protect against suits arising against you. What is not covered? • Injuries or illness to you and your employees • Damage to your own property • Economic damages (financial losses) to third-party data breaches or identity theft
