This one might put me in hot water with all the bankers around town and I was a banker before I became a mortgage adviser/broker.
Wow, I can’t have been that bastard then.
you up, what do you do then, you don’t have any say on the sale price and you’ll only get the change, if there is any.
But back to the saying, to try and not have the bank or banker become the bastard, you always need to know what your conditions are when borrowing. It is a well-known fact that contracts or agreements are only referred too when something goes wrong or one party isn’t happy with the other party. It’s the ‘what ifs’ we all must know about. What if I lose my job and can’t meet the loan payments? What if my partner dies and I only have one income? What if there’s an earthquake and my business closes? These ‘what if’s’ are really important and it’s good to have a good banker and a good relationship with him/her, without this, you’re lost if you need them to work with you in a crisis. Your crisis could be different from others and this is where a good banker will know you and your business.
I do remember having to sell someone when I was running the Loan and Building Society, so I know what it is like to be the “bastard”. This only came down to a last resort, we tried to work with the person right up to the sale date, but they weren’t interested. The auction was actually one of the most spirited I’ve been to and the property went for a great price with everything considered.
Imagine a banker that banks a business and has never been on the premises or imagine being lent the money to buy your first home and the banker has never even driven past it. In today’s world you can Google the house and go to Google maps and have a look, but it’s always best to at least drive past it. I used to go past every property we lent on at Loan and Building Society; it became a habit.
With the price we got for the property I still felt for the owner, but believe it or not I became comfortable with the price, as the owner “the person we sold” actually came back to me and invested the surplus money with Loan and Building Society. His words were that I got a good price for him.
If you’re in business or setting up a new business, you’d expect your banker to come out and see you and have a look at what you’re doing. Maybe this is old-fashioned banking, but it may be the secret to stop banks/ers coming back to that headline that they’re all bastards as

One lady, Stephanie Retchless (I presume this is not an alias) has written a book on it – How to Beat the Banks at Their Own Game. Now why someone would do this? Or why would someone say this about one of our most respected professions? The reasoning is that the lender is probably all nice, when you’re wanting to borrow money from them and, yes, you can do this and you can do what they say. But, and there is a but, this is where you do find the difference between a good banker and bankers the heading gets referred too. If someone does fall into trouble with their loans, whether it is in business and the market moves and the client hasn’t got the ability to pay their loan for a while, or needs to refinance to get some breathing space, if the bank/er isn’t supportive of the borrower this will created significant stress on the borrower and any family involved. Some wrong decisions may be made that shouldn’t have been and it could make things worse. It must be terrible living in an environment where you don’t know from one day to the next if you’re going to lose your home and stability. If the banker sells

they’d understand your business and what makes you tick. The other way to make sure you’re getting treated right by your bank is to use a mortgage broker. They are the people in between you and the bank, getting you the best deal available and fitting you to the right bank. Things you MUST do before buying Buying a home is a big deal. It’s likely to be the most expensive thing you buy, and it can be a complicated legal process. It’s even tougher in a hot market, where there is a lot of competition for a limited number of properties. It might be tempting to take a few shortcuts, but failing to do things properly could cause more problems later. Here are our top four tasks for home buyers.
1. Research the property The real estate agent selling the property acts on behalf of the seller, however they are also required to tell you everything they know about the property. They must respond professionally to all your enquiries and not withhold any
details. Remember that you still need to do your own due diligence. That means getting a title search so you can find out all the facts about the property’s ownership, boundary and access, as held by Land Information New Zealand (LINZ). It’s a good idea to get a Land Information Memorandum (LIM), which shows information held by the local council about the property and land. For valuable feedback on the property’s condition, get a report done by an inspector who has professional indemnity insurance and carries out their work in accordance with the New Zealand Property Inspection Standard. Although this all costs money, it will save you more in the long term. Sellers may occasionally provide some of this information for you. If this happens, check

The day can be made unnecessarily stressful for clients, agents and the solicitor when it comes to the handing over of keys and each party’s expectation as to when this might happen during the day.

This statement can arrive in our inbox anytime from 4am to 1 pm on the day depending on where it falls in the bank’s queue.
We try to be careful not to give our clients false hope as to when settlement will be completed as so many steps in the settlement process are out of our control. Where a transaction is part of a chain of settlements and our involvement is at the end of the chain it can be even more unpredictable – 5 or 6 sales and purchases may need to be completed before we can settle. Nevertheless, we still seem to get calls from clients at 1 am to tell us the furniture truck is all packed up and they are ready to move to their new house. We thought it would be useful to outline the steps we need to go through before keys can be released.

After we receive the repayment statement we provide the purchaser’s solicitor with our undertaking that we have signed and certified the e-dealing and on receipt of the settlement funds we will release the documents in land online, and will authorise the release of keys. We also provide a copy of the signed Deed of Assignment of EQC Claims where required.
•
Once these stages are completed we wait until we receive both an undertaking from the purchaser’s solicitor that they have paid the settlement funds and confirmation from our bank that the funds have been paid into our trust account by same day cleared payment.
Acting for the vendor: •
•
All documentation is signed, we have provided a settlement statement to the purchaser’s solicitor and we will (hopefully) have an authority from the bank (if any) to discharge any mortgage. These steps happen before the settlement date. Where there is a mortgage to repay, on the date of settlement we will receive a repayment statement from the bank and check we have enough funds to repay the mortgage from the sale proceeds.
•
At this stage settlement is complete and we are able to call the agent to advise that the keys can be released
to complete the purchase. These steps usually happen prior to the settlement date. •
There is nothing further we can do until we receive the mortgage funds from the bank. Again, the funds can arrive in our account anytime between 4am and 1 pm (sometimes even later). It will depend on how busy the bank is on the day.

We receive an undertaking from the vendor’s solicitor that they have signed and certified the e-dealing, and on receipt of settlement funds will release the documents to us in land online. The agreement was signed, and that all the chattels and fixtures listed in the agreement are

present and in reasonable working condition. The purchaser must give reasonable notice to the vendor of when they intend to carry out this inspection. It is important to stress that only issues or damage that has arisen since the date of the agreement should be of concern, not any issues or damage which existed when the agreement was signed. Recently a dispute occurred on the date of settlement where a vendor had removed a wall bracket leaving a small hole in the wall. The purchaser refused to settle without a retention of funds, claiming the vendor had damaged the wall, while the vendor argued that the hole existed at the date the agreement was signed so no damage

had occurred. Eventually both parties agreed to a small retention of funds, but both had incurred significant additional legal fees in the process. If there are any issues with the property, we strongly recommend you have the parties obtain written quotes for any work that is required, and take multiple photos of the damage or malfunctioning chattels. If the parties disagree as to the amount of compensation, the lawyers will inevitably ask for proof of written quotes and photos of the damage or chattels. Possession is given on settlement. This means any incomings and outgoings in respect of the property are to be received and paid by the vendor. It may pay to remind both parties of this when
transferring a property that has a tenancy that will continue on from the settlement date. Unless otherwise agreed, the vendor is entitled to receive rental income on the settlement date.
Settlement Clauses 3.5-3.10 of the agreement detail the responsibilities and processes that the lawyers for the purchasers and the vendors need to abide by to complete settlement. One of these responsibilities is to obtain the necessary authority and instruction forms to enable the lawyers to complete the transfer, and the required tax statements that accompany the transfer. It is important to be aware that your client will need a New Zealand IRD number
to complete the transaction. If your client is based overseas, or is acting in their capacity as a trustee or company director, they will need a valid IRD number in order for settlement to occur. Despite what is often believed, clients cannot use their individual iRD numbers if they are selling or buying the property through an entity. Obtaining an IRD number can be quite a time consuming process and is something any purchaser should be aware of when looking at buying a property and negotiating timeframes under a contract.

as any settlement which occurs between 4:00pm and 5:00pm on the settlement date. If the purchaser causes delays which mean last minute settlement occurs, the purchaser will owe the vendor one day’s interest, calculated at the default interest rate on the front of the agreement. If the day following settlement is not a working day, interest will accrue every day until the next working day. If a transaction is looking unlikely to settle on the settlement date, the parties have until 5:00 pm at the absolute latest to complete the transaction (although where completing settlement by same day cleared payment generally you will only have until 4.30pm as these payments can’t be processed after 4.30pm).
