More than $360,000 was paid out to lawyers in legal aid fees for Ashburton cases last year, a $28,000 decrease from the year before. In the financial year spanning 2013-2014, over $360,000 was claimed by lawyers for cases involving legal aid, 7 per cent less than the $389,000 claimed between 2012-2013. The number of legal aid cases in Ashburton also decreased over that period, from 299 to 276. The decrease comes as the total crime rate for the Mid South Canterbury area dropped, falling by 7.6 per cent in the last financial year. Russell, Moon and Fail Lawyers staff solicitor Paul Bradford believed the number of pre-charge warnings and alternative resolutions offered by police may also have contributed to the drop in legal aid cases, with fewer people going through the court system across the country. Legal Aid Services general manager Michele McCreadie said the number of adults charged in court in 2013/14 was the lowest number since 1980/81.
“It naturally follows the amount of criminal legal aid work has also reduced,” she said. More than 89,000 adults were charged in New Zealand court last year, a 12 per cent drop on the year before. Ashburton police sergeant Janine Bowden said there had been a “significant reduction in the flow of charges into the court system”, and the result was more time for police to spend patrolling. “If you free up that court time, that frees up more time for the guys to be walking the beat.” The Ashburton legal aid system has been under pressure in recent times, with lawyers having to come from as far afield as Timaru and Christchurch to take on local legal aid cases. Mr Bradford is the only Ashburton lawyer still willing to take criminal legal aid cases, and he told the Guardian last week it was not cost-effective for lawyers to take them any more. The fixed fee model of payment introduced in 2012 meant lawyers had to predict the number of hours they were going to work on legal aid cases, although lawyers can seek additional fees if they felt they were justified.
