Four Ashburton people will face manslaughter charges when they appear in court this week. The charges relate to the death of 34-year-old AJ Gairns, whose body was found in a drainage runoff area behind commercial premises on West Street, on June 1. A post-mortem report revealed he had drowned. Po-

lice allege he was assaulted in the early hours of May 29. At the time it was understood Mr Gairns had left home to meet up with a friend, shortly before 3am that morning. During the following week four people were arrested and charged with assault with intent to rob Mr Gairns. On July 3 Desmond Kapi Marshall, 46, of Netherby, admitted the charge in the Timaru

District Court. Judge Joanna Maze declined to enter a conviction against Marshall and remanded him in custody, where he has been held since his arrest on June 7. He was due to be sentenced in the Timaru District Court on August 28. The remaining three accused appeared on the same day, but offered no plea to the assault charge. Name suppression for

all four had lapsed and Judge Maze permitted publication, but strictly suppressed evidence presented by the police prosecutor from the draft summary of facts during Marshall’s appearance. Olivia Toby Frances Lucas, 26, formerly of Wellington, Kooly Managki Te Tomo, 26, of Ashburton and Verdun Ashley Perry, 24, of Mayfield, were remanded on bail without plea.

They were due to answer the assault charge tomorrow. Yesterday detective senior sergeant Marion Neill, of the Timaru police, confirmed manslaughter charges had been laid against the four accused. The assault with intent to rob charges still stand. The four accused will appear in the Timaru District Court tomorrow where the fresh charges will be presented.
