Silver Fern Farms has been found to have acted unlawfully during a staff restructure at its Fairton Meatworks plant. The Meatworkers’ Union complained to the Employment Relations Authority (ERA) following concerns that the restructure in 2015 was not genuine and that the meat processing co-operative used it as a rationale for reducing wages. The complaint was the subject of an ERA hearing in March this year. In its ruling the ERA said there were 14 staff working in the animal assembly department at the plant, who rotated

through various roles prior to the restructure. The assembly department unloaded, washed and tallied stock before driving them into pens for processing. The ERA found Silver Fern Farms had acted on concerns about the operating costs within the department and proposed the restructure on this basis. The change meant the lower-paid labourers in the department were able to be rostered on more frequently than higher paid shepherds. ERA member Peter Van Keulen said as a result of the change, staff hours and hourly wages were reduced even though

the actual job and the skills required remained the same. The ERA accepted the union’s submission and concluded that the restructure was flawed and Silver Fern Farms had acted unlawfully. Van Keulen said that the company failed to meet its obligations to adequately consult with the union. “I am satisfied that Silver Fern Farms’ actions do amount to a breach of the duty of good faith,” Van Keulen said.
