Drug rip-off plan in Gairns’ death The jury trial of Kooly Managki Te Tomo opened in the High Court sitting in Timaru yesterday before Justice Gerald Nation. Te Tomo is accused of causing the death of Arran (AJ) Gairns by manslaughter in the early hours of the morning of May 31, 2014. He is further charged with assaulting Gairns with intent to rob him. A jury of four men and eight women will be asked to decide whether Te Tomo, who was jointly charged with three other people, caused Gairns’ death by causing him, by fear or threat of violence, to do an act which caused death, thereby committing manslaughter. Prosecutor Andrew McRae opened by outlining the evidence that will be given over the next week in support of the Crown’s case. The Crown alleges the group con-
spired to rob Gairns of about half a gram of methamphetamine. One of the party lured Gairns to a workshop behind the Hunting and Fishing store on West Street in Ashburton on the pretext of buying meth from him. The three others were lying in wait ready to ambush him. In attempting to escape, the Crown attests Gairns first hid in a nearby creek. One of the group retrieved his vehicle from the roadside and drove in to the area to “shine some light” on the situation. A security light on a nearby building activated, giving Gairns’ position away. His assailants dragged him from the water, threatened and assaulted him, knocking him back into the creek. They then stood over him demanding the drugs. Gairns managed to break free and fled
into the darkness. Despite an extensive search of the area Te Tomo and the two others were unable to locate Gairns and left the scene. His body was not found until shortly after 3.30pm on Sunday, some 36 hours after he was thought to have died. McRae said expert witnesses would prove Gairns drowned in a storm water collection area behind the buildings. Gairns’ former partner was the first witness to take the stand yesterday. She described her concerns about his meth use, and after a break in the relationship, an agreement was made to abstain from using the drug for three months.
