Prison for man with disability A young man cited as having an intellectual disability is waiting out his court remand in prison, because of a lack of custodial options. Brett Allan King, 23, of Tinwald, admitted two charges of burglary, driving while forbidden and two of dishonestly taking a motor vehicle in the Ashburton District Court last month. The offending occurred in March. He was remanded on bail on a 24hour curfew to his caregiver’s address, on the condition he refrained from possessing or using drugs or alcohol. He was due back in court for sentencing on Monday, where reports had been prepared for communitybased sentencing options However, his caregiver had found the arrangement too stressful to continue with. “(Caregiver) can’t house him anymore – she’s done her best but she is finding him increasingly diffi-

cult,” King’s lawyer Michelle Barrell said. “It seems there is no option other than to remand him in custody.” Ms Barrell said she had found an available hospital bed, but Judge Joanna Maze said her hands were tied. “I can’t remand anyone to a hospital – last time I tried that the hospital rebelled,” she said. Ms Barrell said the nature of King’s disability fell outside the criteria for mental health support. Judge Maze ordered an intellectual disability report to be prepared before King appears for sentencing. In the meantime he was remanded in custody. “I have no choice – I have nowhere else to send you to until I get this report,” Judge Maze told him. King’s next appearance will be by video link from prison to the Christchurch District Court next week.
