Firearm laws questioned Botched evidential disclosure and the murky waters of New Zealand’s firearms laws made for a complicated court case in the Ashburton District Court this week. Richard Lincoln, 56, of Timaru denied charges of unlawfully possessing restricted weapons – a Panther DPMS semi-automatic rifle and a Hatsan Escort 12-gauge
semi-automatic shotgun, and possession of cannabis. He also incurred a charge of obstructing police. Police alleged the two firearms constitute military style, semiautomatic firearm (MSSA), which require an E-category endorsement on a firearm’s licence. Defence counsel Michael Starling argued against the charges
on technical grounds and impropriety, concerning the police handling of the case. Lincoln was travelling through Ashburton on September 17, 2015. An MSSA firearm, an empty magazine fitted, was stored in the passenger foot well of Lincoln’s vehicle, when he visited a service station and stopped to use the
public toilets in Ashburton shortly after 9am. In accordance with the Arms Code, firearms cannot be left unsecured in a vehicle, therefore Lincoln took the gun with him. Two witnesses called police to report a man carrying a “machine gun”. Police communications relayed the registration number of his vehicle.
Lincoln was pulled over in an armed stop near Dunsandel by three officers from the Rolleston police station. He was ordered out of his vehicle and on to his knees on the roadside.
