Gun charges dropped A Timaru man accused of unlawful possession of military-style semi-automatic guns had four charges against him dismissed when he appeared in the Ashburton District Court yesterday. Richard Lincoln, 55, had denied charges of unlawfully possessing restricted weapons – a Panther DPMS semi-automatic rifle and a Hatsan Escort 12 gauge semi-automatic shotgun – and charges of possessing cannabis and obstructing police. Police asserted both were military-style semi-automatic firearms but Lincoln argued they were not. Evidence in the case was heard by
Judge Joanna Maze in the Ashburton court last month and she delivered her reserved judgment yesterday, saying all charges were dismissed. She said the charge of obstruction had not been proven beyond reasonable doubt; there was no case to answer on the cannabis charge because it depended on inadmissible evidence obtained by unlawful search. She said the firearms charges attracted no case to answer because they also depended on improperly obtained and inadmissible evidence. ed hearing and Lincoln himself indicated yesterday he may file for costs and other issues related to the case. The charges resulted in 2015 when the Timaru man was travelling through Ashburton on September 17. A military-style semi-automatic firearm, an empty magazine fitted, was stored in the passenger footwell of his vehicle when he visited a service station and stopped to use the public toilets.
