The demand for legal aid in Ashburton is greater than the amount that can be provided, says a local lawyer. Marilyn Gilchrist, from Everist Gilchrist Lawyers in Ashburton, said there were not enough lawyers doing legal aid work to meet demand. In the 2015/16 year only three law firms in Ashburton were paid for legal aid. They were Everist Gilchrist Lawyers, Amicus Legal and Russell, Moon and Fail, which were paid $97,175, $2914 and

$79,900 respectively. However Gilchrist, who does family rather than criminal legal aid, said often lawyers had to be brought in from Christchurch or Timaru to meet demand. Legal aid is a community service which is funded by the Ministry of Justice and makes lawyers available for people who otherwise might not be able to afford it. Some lawyers have claimed the flat fee for legal aid is not enough for most cases. Gilchrist said she thinks it’s hard for lawyers to make a profit out of legal aid clients, let alone break even.

She said a lot of work goes into a legal aid case but lawyers are paid on a fixed rate. “From talking to other lawyers and from my own experience lawyers put a lot of time into their clients and they aren’t always paid enough,” she said. Legal aid also requires experience, new lawyers cannot just finish their studies and go into legal aid.
