Frustrating day in Tully trial The trial of double-murder accused Russell John Tully will resume at 10am this morning after a “frustrating” day for jurors in the High Court in Christchurch yesterday. The Crown’s closing address was expected to begin yesterday morning, however much of the day was spent in legal debate in closed court – the details of which cannot be reported. Tully, 49, is accused of murdering Work and Income workers Peggy Noble and Leigh Cleveland and attempting to murder their colleagues Kim Adams and Lindy Curtis in the agency’s Cass Street office on September 1, 2014. The jury of seven women and four men did not enter the courtroom until 2.55pm where they remained seated for barely five minutes.

Justice Cameron Mander apologised for what he said it had been “very frustrating day” for the jury. “We are reaching a critical stage of the trial – I am anxious to avoid any misstep,” Justice Mander said. He said it was important not to provide jurors with any information extraneous to their function, before asking them to retain their good spirits and dismissing them. Tully was only present in the courtroom for a total of four minutes during the first seven days of his trial. However, he had a change of heart on Friday when he spent the full day before the jury. He was also present while Justice Mander spoke to the jury yesterday. Tully has elected to defend himself,

assisted by amicus lawyers Phil Shamy and James Rapley. Crown prosecutors Andrew McRae and Mark Zarifeh called 72 witnesses to the stand over eight days. At the conclusion of the Crown’s evidence on Friday, Justice Cameron Mander asked whether Tully intended to call evidence or witnesses. He declined both opportunities. Tully is also on trial for the illegal possession of firearms and ammunition and setting a mantrap. A large contingent of the murdered women’s families and co-workers had gathered in the public gallery to hear yesterday’s closing addresses, including Work and Income witnesses and Ministry of Social Development CEO Brendon Boyle.
