Consents costing farmers thousands

Mid Canterbury farmers are spending hundreds of thousands of dollars to prepare the information required for a resource consent so they can continue farming.

From January 1, Environment Canterbury requires all farmers in nutrient red zones to have land use consent by 2017, so it can attempt to manage nutrient losses to waterways. Most of Mid Canterbury is red and some farmers are scrambling to comply because their farming systems are very complex for the software programme that assesses nitrate loss.

A complex farming system may include; multiple soil types, multiple crops, combination of crops and livestock, different water sources or span different nutrient management zones.

Ashburton Forks farmer Chris Allen said each farmer was spending thousands of dollars on applying for a resource consent, creating a Farm Environment Plan and a nutrient budget.

In Chris’ view that money would be much better spent on farms actually taking additional on farm steps on improving the environment rather than on the cost of trying to meet challenging compliance rules.

The costs of compliance will be annu-

al with auditing and updates required.

Overseer is the software used to calculate nitrate leaching - it is geared more for dairy farms and has difficulty calculating losses on farms that run a combination of livestock and crops. In many cases a “human workaround” is required involving false input.

Allen said farmers were very passionate about the environment and not averse to farm plans. But they had become so difficult they needed consultants to work them out.

Treat for car lovers

Modified car lovers certainly had their fill yesterday at the Ashburton Hop Run Festival at the Ashburton Domain.

Hundreds of people found out what made the classic, and often modified, car engines tick as the owners showcased their vehicles.

Ashburton Hop Run Festival organiser Barry Pinnell had an “open-door policy” for the owners of the vehicles who could come into the domain and leave when they wanted.

All visitors were asked to donate a gold coin which will go to

the Ashburton Cancer Society.

“It’s a great cause for the money to go towards,” Pinnell said.

It was the second year the festival had run and there was a good turnout with over 150 vehicles on display throughout the day.

Car owners travelled from Christchurch and Timaru to display their beloved cars.

The owner of a 1979 Ford F100 named “Mr Sicko” Steve Saul came from Christchurch for the festival and it was his first time.

“It’s great. There’s some good cars here.” Pinnell said the chances are high for the event to continue next year.

Resource consents costing farmers thousands From P1 This is not what farmers were told at the outset of the land and water plan.

He said most farmers were already using good management practices when it came to applying fertilisers and water, adopting irrigation scheduling on an “only when you need it” approach.

“They are very worried in the way Overseer is being used at the moment, given the huge cost and the industry resources to get a nutrient budget done.

It is a good tool with many strengths when used for the right purpose.”

Allen said there was a level of angst amongst farmers because of the uncertainty of the software. Farmers challenge the wisdom of having to pay for a

nutrient budget if their farming system is at good practice, or be forced to comply, until the capabilities of the model and the requirements of the regulatory plan mesh in a cost effective way.

He says water quality is about being out on the land and identifying what could reasonably be done and then prioritising when to do it. Farmers that are part of irrigation schemes or supply milk companies are completing their farm environment plans as part of industry group exercises; farmers outside these groups are fending for themselves.

Around 150 farmers in the Barrhill Chertsey Irrigation Scheme have spent $300,000 in the past six months to become compliant. Another 450 farmers

use water from Rangitata Diversion Race schemes.

DairyNZ is helping 161 farmers in the Ashburton district with Sustainable Milk Plans (the dairy equivalent of Farm Environment Plans) and says they are making good progress with 36 completed and 19 out with consultants. Farmers have to answer a 27-page questionnaire that takes around three hours as part of the process.

ECan has allowed a six-month grace period until June 30 next year for farmers to become compliant.

Allen said he hoped the regional council would take a pragmatic approach when dealing with farmers using good management practices but failing to make the software fit their operations by the deadline.

have to get two land use consents so we are just getting on with it, but I don’t see it will achieve anything.”

Clark said his first Overseer baseline data report was 148 pages long and just when the work was finished, another version of the software was released. “It is more than frustrating, it is money down the drain.”

He said the software was a great management tool but had inherent variabilities within the model and ECan was using is in a rigid manner it was not designed for.

“I am not opposed to environmental management or rules, but ECan has come up with rules that a farmer can reasonably be expected to comply with.”

New life for Wakanui Beach

Wakanui Beach could be one of the Ashburton District’s undiscovered bio-diversity gems.

A plan ticked off by the Ashburton District Council could see the area’s special qualities recognised and protected through a management plan that would ensure the beach and the surrounding area is surveyed and ultimately comes under the control of a management plan.

Council open spaces planner Bert Hofmans has worked with

landscape architect Ines Stager on a report that outlined the steps that were needed to ensure the site was enhanced and restored.

The beach area covers 6.3 hectares and is made up of two parcels of land owned by the Ashburton District Council. It straddles an area of riverbed.

Hofmans told councillors on Thursday that the enhancement project would start with an invertebrate survey and asked the council to pay $4400 for the work.

The survey would identify the species inhabiting the area.

A vegetation survey has already been completed as part of the council’s ongoing ecological surveys of the plains.

The invertebrate survey was the next stage in gaining a better understanding of this area, Hofmans said.

Councillor Neil Brown, however, questioned what the survey would achieve.

“If there are no invertebrates found then do you plan not to do the planting; why don’t you go ahead and just plant it anyway?” he said.

What was planted depended on the species found as each had its own specific habitat, Stager said.

Brown might not have been keen on the project but councillor Selwyn Price was.

“It’s a project that involves a lot of stakeholders and that includes local schools and landowners. It’s a very special area that needs to be looked after.

“There have been mistakes made in the past and this is an opportunity to improve on that,” he said.

“This is only a survey; we’re not

saving anything,” Brown replied.

When it was put to a vote, Brown was supported in opposing handing over $4000 for the survey by only Peter Reveley.

Once the survey is completed the main focus of enhancement and restoration will be to extend areas of native vegetation and to rehabilitate areas where native plants are present but threatened by week infestation.

The beach is well documented as having housed Ngai Tahu food gathering settlements.

Ashburton Santa Parade thrills crowds

Thousands of parents and children looked on in awe as floats of all shapes and sizes were on display at the Ashburton Santa Parade on Saturday.

From Thomas the Tank Engine to Santa’s own sleigh, the variety of floats were all embracing the Christmas spirit. The floats started from Mona Square and travelled along East Street to Cameron Street and back around again.

Ashburton Santa Parade organiser Carol Johns said there were too many floats entered to count.

The floats, and onlookers, filled up the streets, she said.

Johns said it was a huge success and there were more people at the event compared to last year.

It is an event specifically for the community, who all got stuck into it, she said.

Preschools, schools, Hakatere Marae, and every other part of the community were all involved.

Everyone got into the spirit of the day, she said.

It was quite a hot day though, with some people under the costumes feeling the heat.

However, it is all worth it, she said.

“We do it for the children… They loved it.”

Children methodically sort through hay to be the first to earn a prize, just one of the several activities at the Ashburton Borough School Fete on Saturday.

Borough fete ‘a jolly good day out’

About 800 people enjoyed a day of Chirstmas fun at the Ashburton Borough School Fete on Saturday afternoon.

From children’s performances, meeting Father Christmas to a Tongan ukelele group and a myriad of food

and craft stalls, there was plenty to do for all the families who walked through the gates.

On entrance, attendees were asked to donate a gold coin in which more than $1000 was fundraised for the school.

Ashburton Borough School principal Sam Winterbourn said it was a

great day for the school and everyone who attended had fun. It was the first time the fete had followed on from the Santa Parade and it proved successful, he said.

The activities available suited both parents and children with even a skydiving group on display. “It was a jolly good day out,” he said.

Grant boosts project funds

Arrest after fight A 20-year-old man has been arrested and charged with common assault after he allegedly hit a man after a fight broke out in Allenton, early yesterday morning.

Ashburton police were called to Creek Road at 12.30am after nine residents reported a group of people in their twenties fighting in the street. Police believe the fight was started after one of the men entered the other’s Creek Road property and assaulted them.

Witnesses rushed out of their homes after what many believed they heard what sounded like a window smashing. The 20-yearold arrested was bailed and will appear in court at a later date.

Inquiries into the incident are continuing.

Methven’s public library and historical society have been big winners in the latest round of donations made by the Community Trust of Mid and South Canterbury.

At its latest meeting, the community funder handed over $500,000 in donations, with $75,000 of this going to the two Methven groups to be used for building and fit-out costs for their new, purpose-built combined library and museum.

The donation will go a long way towards helping complete the project and ensuring that when it opens its doors it will be ready for use, spokesperson for the two groups, Julie Barlass, said.

“We’re delighted. This donation ensures we can complete the building so it can be open and used by the stakeholders.”

The project had an original completion date of Christmas but there had been a number of delays along the way that would push this out, Barlass said.

Among those were extra work required on consents and permits and recently delays with roofing iron deliveries from Auckland because of the Kaikoura earthquakes.

“We’ve had delays and holdups but they’ve all been out of our control,” she said.

Quake shakes south A magnitude 5.5 quake has been recorded in the upper South Island of New Zealand. The quake occurred about 4.15pm yesterday and was recorded as strong by GeoNet. It was at a depth of 25km and was centred 20km east of Seddon.

The new purpose-built building is divided into four unequal quadrants, the library at the

street-front on the north-western corner, and the museum is positioned at the opposite, southeastern quadrant.

Barlass said the project had also received funding of $100,000 from Advance Ashburton on behalf of Alma Lochhead and the Lochhead Trust, and other donations from the Methven Pottery Society and Methven Rodeo.

The body of a young man has been found in the Waikato River.

The clothed body was found by a member of the public near Anzac Parade Bridge at about 7am yesterday, a police spokeswoman says. He is believed to be Asian and aged in his late 20s or early 30s.

Car crashes into cafe A person has been taken to hospital after a car crashed into a cafe in the Waikato town of Cambridge. The car crashed into the Robert Harris Cafe in Victoria Street about 11.15am yesterday, a police spokeswoman says. A person, who was initially trapped in the car, was taken to hospital for treatment.

Southern travellers need more time Road repairs south of Ashburton could mean delays for motorists on both State Highway One and State Highway 79 between Geraldine and Fairlie.

All work is weather dependent but motorists should allow a little longer for journeys over the coming weeks, says NZ Transport Agency journey manager Lee Wright.

Bridge the sealed surface will be removed over two nights. New asphaltic concrete levelling courses will then be laid on the bridge deck later in the week and this work should be completed by December 11.

The new surface will be left to cure for around eight weeks after which a final chip seal surface will be installed in February 2017.

When the initial resurfacing task is complete, a temporary speed limit of 70km/h will remain in place until the final seal surface is applied in February.

On State Highway 79 between Geraldine and Fairlie at Skipton’s Bridge some essential summer road and bridge repair/remediation work will be carried out over the next few days.

The bridge approaches will be remade and a new asphaltic con-

crete levelling course will be laid over the bridge deck, requiring eight weeks to cure.

More energy than you can measure

River Samuela has more energy than you can measure.

The 10-year-old darts from one place to the next, full of momentum and vigour, ready to tackle whatever challenge comes next – in or outside the classroom.

It is time on the sporting field that the Hampstead School student relishes.

From T-ball to miniball, volleyball and soccer, River enjoys being part of a team and putting all his effort into every game.

It is rugby, however, River spends most of his time playing.

Whether it is as winger or lock for the Hampstead School team, to facing off against his four brothers and sister, he loves it.

There is one team River looks up to the most and hopes, if all goes well, to play for the Broncos.

Like many New Zealand children River has an idol, his is

Ma’a Nonu. He loves the way Nonu plays and tries to emulate it, he said.

River’s life goals do not end at rugby, though.

He wants to follow in his father’s footsteps and work under the hood of a car.

He spends a lot of time with his father who is his inspiration and has played rugby because his father used to and also goes on fishing trips with him.

“I like going fishing. Dad gives me a go. He says ‘keep your eye on the line’.

“I always ask him if I can go along with him.”

Hampstead principal Peter Melrose said River is a pleasure to have in the classroom and he looks out for his fellow classmates.

River thinks friends are one of the most valuable assets a person can have.

“They help you up when you’re down.”

River said he will to do his best and continue competing with passion and energy that cannot be stopped.

Hampstead School student River Fuluasou, 10, is an appreciated member of the school and loves all things sporty, but particularly rugby.

Mt Roskill win for Labour Michael Wood

Labour’s reinforced lesson from a hefty win in the Mt Roskill byelection is to keep things simple and make sure they are talking about things people care about, says new MP Michael Wood.

Mr Wood trounced National’s Parmjeet Parmar with 11,170 votes against her 4652 amid low voter turnout in the Auckland electorate on Saturday.

With two recent nationwide polls giving Labour 28 per cent and then 23 per cent, the party badly needed a boost.

Mt Roskill was a safe Labour seat – Phil Goff held it with a majority of more than 8000 in the last general election before he stood down after winning the Auckland mayoralty.

Mr Wood’s win probably exceeded Labour’s expectations in an electorate where the party vote went to National in 2014.

It showed that Labour could win people’s trust and votes with strong, simple messages around a small number of key issues that people really care about, he told

RNZ on Sunday. That was also one of the lessons learned from the general election loss in 2014, which would be taken on board for next year’s vote.

“You can’t throw a thousand different policies out there and hope that one of them will stick, which is a little bit what we did last time.

“You’ve just got to keep it simple and make sure that those issues are the ones that people are actually thinking about, actually caring about.”

Mr Wood, who spent six years on the local council board, said his focus would be on affordable housing, crime and the desperate need for public transport investment.

Mt Roskill is the only part of Auckland without mass transit, such as a rail line or bus lanes, he said.

“As this place grows, man, if we don’t put the proper investment in mass transit in, we’ll have problems.”

■ KAIKOURA QUAKE

Clearing the back country of wilding pines Images Thanks to the efforts of 25 volunteers, Mid Canterbury’s back country has hundreds fewer wilding pines competing for space with native vegetation.

The Ashburton District Council organised a clearance day with open spaces planner Bert Hofmans saying the work undertaken had made significant inroads into clearing the renegade pines that were spreading across the landscape around Lake Camp.

“Days like this simply can’t work without the community’s help and we are very appreciative of everyone’s commitment to eradicating this noxious weed and supporting our district’s biodiversity,” he said.

Lake Clearwater hutholders, Environment Canterbury staff, Ashburton Biodiversity Working Group members and council staff were amongst the group who braved rough weather conditions to remove the invasive, introduced trees.

“We targeted young wilding pines, as this is more effective and cost efficient than attempting to remove the mature trees. Just one or two young trees can turn into a dense forest within 15 to 20 years,” Hofmans said.

Wilding pines threaten natural ecosystems, farm productivity and landscape values, and if left unchecked, can spread over large expanses of high country in a relatively short period of time.

A concept plan for the management of Wilding Pines and shelter around Lake Camp and Lake Clearwater settlement was also discussed at the removal day.

United States space agency NASA has released satellite images showing land lifted from the sea near Kaikoura by the magnitude 7.8 earthquake last month which may “stay put”.

An image from the European Space Agency’s Sentinel Two satellite shows the newly exposed land ringing the Kaikoura Peninsula.

NASA provided an pre-quake image when the tides were about the same for comparison.

The quake on November 14 (NZ time) lifted the seabed by 0.5 to 2m along a 20km stretch of the Kaikoura coast. In one area, the uplift was 5.5m.

While beaches raised by earthquakes occasionally sink back down gradually or get pushed down by other earthquakes, the New Zealand coast is full of historical examples of earthquake uplifted land staying put, NASA says.

“Most likely, the new land along the Kaikoura coast is there to stay.”

Ashburton-born illustrator David Elliot has released his imagination into the fantastical world of Lewis Carroll for his latest book.

Snark is based around two poems by the Britsh 19th century author, The Hunting of the Snark and Jabberwocky.

The hard-cover 220-page book features the two poems as well as Elliot’s illustrations and additional text, in which he adds his own creative touches to build a whole new story around the works.

It starts with a found sketch book, and includes a foray into Australasia as the hunt for the snark unfolds, and details of an ongoing expedition which culminates in a tragic aftermath.

“I’ve tried to keep the integrity of the poem, and its mystery. It’s a strange book, it breaks all the rules,” Elliot said from his Dunedin home.

It was not a children’s book, nor exactly an adult’s book, and the publisher was describing it as a children’s book for adults.

“It’s something that’s intrigued me for a very long time,” Elliot said of the classic Snark poem.

The traditional description of a nonsense poem did not do justice to the darker intricacies of

Snark has been a labour of love for David Elliot over four years.

The book was a labour of love over four years, and hundreds of

illustrations fill its pages.

Those drawings include one on page 160, of the fabled snark itself.

“Everybody has their own idea of what a snark is, I can’t claim to have nailed it,” Elliot said.

He believed dedicated Lewis Carroll followers, of which there are many in the United Kingdom and America, would appreciate his deconstructionist approach.

Although he was not sure how they may take the fabled expedition including a journey to the South Pacific.

In researching for the book, Elliott visited English areas which had Carroll and Victoriana associations, including Oxford’s Museum of Natural History.

He believed Carroll would have been inspired in his work with some of the Australasian species on show in the 1800s, such as platypus which people at the

time had not thought were real.

“I don’t think it’s too far-fetched that in his imagination, when he sent his expedition to find the snark, that he sent it down to the South Pacific,” Elliot said.

Among those welcoming the book’s release is the Ashburton Art Gallery, which is the custodian of Elliot’s collection of drawings.

It will be showing the original works from Snark in an exhibition in September next year.

The gallery also has signed copies of the book in its gallery shop, and books bought before the end of January 2017 will win an Elliot limited edition Jub Jub Bird print.

Wilderpeople Empire’s best movie of 2016 Taika Waititi’s hit movie Hunt for the Wilderpeople has topped Empire magazine’s list of 25 best movies of 2016.

The UK publication, which describes itself as world’s biggest movie magazine, ranks the Kiwi production above the likes of Leonardo DiCaprio’s The Rev-

“It’s a small, charming, utterly delightful film, from a tiny island on the other side of the world, and it deserves to take the world by storm,” Empire says.

ry Crump’s novel Wild Pork and Watercress starring Sam Neill and a 13-year-old Julian Dennison, is “perfectly balanced”. “Emotional without being overwrought, quirky without being twee, hilarious without losing touch of the story or the characters.”

Wilderpeople broke the local

record for an opening weekend when it was released in New Zealand in autumn and has gone on to critical success, also earning more than $US22 million ($NZ31m) around the world.

It is ranked the 92nd best movie of all time by website Rotten Tomatoes.

in a bowl and stir to combine.

Add the ■ Tegel Fresh Chicken Skinless Thighs and stir, making sure the chicken is well coated in the marinade.

■ Cover. Marinate in the fridge for upto 1 hour.

■ To make the sauce, put all the ingredients in a food processor

and blend until smooth.

■ Heat a dash of oil in a small heavy based saucepan and add the paste. Cook the paste on a medium heat, stirring to avoid the mixture sticking and bring to the boil. Reduce heat and simmer for 5 minutes. Adjust the consistency by adding water, if required. Set aside to cool until required or store in the fridge, but serve at room temperature.

■ When ready to cook the satay, slide the pieces of chicken onto the wooden skewers. Cook on a hot barbecue or under a hot grill for 10 minutes or until well browned on one side. Turn over and cook for a further 5 minutes or until browned and cooked through.

■ Serve the satays on a platter with the peanut sauce.

Nine killed at dance party Firefighters struggled to get to bodies in the rubble yesterday after a fire tore through a converted Oakland warehouse during a late-night electronic music party, killing at least nine people and making the charred structure unsafe for emergency crews to enter. Officials said at least two dozen more were missing in the rubble of the building.

Officials described the scene inside the warehouse, which had been illegally converted into artist studios, as a death trap that made it impossible for many partygoers to escape the fire. And a day later, the maze of debris and devastation was complicating efforts to extract the bodies.

“It was just a labyrinth of little areas. We knew people were in there, and we were trying to get them out. But it was just a labyrinth,” Oakland deputy fire chief Mark Hoffmann said.

He said that firefighters had to stop their search and rescue operation yesterday for safety reasons and shore up the structure, but they expected to resume later in the day. The building’s roof had collapsed into the second floor, which in places fell to the bottom floor.

Oakland officials said they had opened an investigation just last month into the warehouse after numerous complaints filed by neighbors who said trash was piling up outside the property and people were illegally living in the building, which was zoned as a warehouse.

Darin Ranelletti, of the Oakland Planning Department, said the city opened an investigation November 13 and an investigator went to the premises on November 17 but could not get inside the building.

The city has not confirmed people were living inside.

One survivor, however, said that 18 artists lived inside the warehouse.

Bob Mule said he was one of the artists living in the collective space. He told KGOTV that he and another person smelled smoke and spotted the fire in a back corner and started yelling.

“The fire went up really, really, really quickly,” he said.

Mule said he tried to help someone who had an injured ankle but couldn’t. “There was a lot of stuff in the way, the flames were too much,” Mule said, trailing off. “I hope, I hope he’s OK.” Online records listed the building’s own-

Granger Smith breaks ribs Country music artist Granger Smith was able to continue performing after falling from a stage in New Jersey, but was later hospitalised. A spokeswoman said Smith shared on Twitter that he fell while singing at the Starland Ballroom in Sayreville at the weekend. Smith was being treated for two broken ribs and a punctured and partially collapsed lung.

Smith was standing on an audio monitor when it gave way and he fell into a metal barricade. He got back up and continued performing. He says he took a pretty hard spill but hopes to be out of the hospital soon to head home.

The warehouse was known as the Oakland Ghost Ship. Its website showed pictures of a bohemian, loft-like interior made of wood and cluttered with rugs, old sofas and a garage-sale like collection of pianos, paintings, turntables, statues and other items.

It’s unclear what sparked the fire. But officials said the clutter served as a tinderbox and there were no sprinklers inside.

“Something as simple as a cigarette could have started this,” Alameda County Sheriff’s Sgt. Ray Kelly said, adding that people either escaped from the building or died inside, where the only way down from the second story was via a stairwell constructed entirely of wooden pallets. “It appears that either you got out or you got trapped inside.”

Rescue crews had recovered nine bodies from the building and said about two dozen were still unaccounted for. None of

the nine dead have been identified.

About 50 to 100 people were believed to have been at the party when the fire started, officials said.

Oakland Fire Chief Teresa Deloach Reed said at least 25 people were unaccounted for. The victims were believed to be people in their 20s, Kelly said. He said as many as 40 may have perished and that the coroner is preparing for a “mass casualty event” that could include victims from other countries.

Searchers brought in cranes and heavy equipment to search through the night.

“We know there are bodies in there that we can’t get to — that have been seen but not recovered,” Kelly said. “There’s bodies that are trapped in there, that need to be cut from the wreckage.”

Monica Kat, a paralegal, feared four of her friends perished in the fire.

“I texted one of my friends immediately and you know, people were checking in on Facebook, we were all checking in looking for them and they’re still not accounted for and I can only think the worst at this point,” she said.

Prince Harry

Crown for Harry Prince Harry has been crowned with a headdress of feathers while touring Guyana’s tropical forests and was treated to the sight of one of the world’s most spectacular waterfalls. Villagers from the remote indigenous community of Surama honoured their royal guest with the colourful Macaw feather gift, and later Harry saw Kaieteur Falls – one of the highest freefall waterfalls in the world.

Harry, who is coming to the end of a 15day tour of the Caribbean, spent the day flying by light aircraft around the Guyana hinterland, where hundreds of kilometres of pristine tropical forest cover plains, hills and mountains.

May’s Brexit plans face UK court test Prime Minister Theresa May’s government is set to launch a challenge against a court ruling that it requires parliamentary approval to start the process of leaving the European Union, a decision that could upset Britain’s Brexit plans.

If the Supreme Court, the United Kingdom’s highest judicial body, dismisses the government appeal it could derail May’s timetable for triggering Article 50 of the Lisbon Treaty and leaving the EU. The government’s legal fight comes against a backdrop of claims by some politicians and newspapers that establishment judges want to thwart the Brexit process.

It will be the most high-profile and complex case the court has considered since it came into be-

ing seven years ago and is due to last for four days.

For the first time all its 11 justices will sit on the panel with the verdict due later in January.

If May wins, she can proceed with her plans to invoke Article 50 by the end of March.

But if she loses, parliament could in theory block Brexit as most MPs supported staying in the EU in a referendum in June, though few observers expect such an outcome.

Even so, MP approval could open the process to greater scrutiny and delay.

Investors believe the greater parliament’s involvement the less chance there is of a “hard Brexit” in which tight controls on immigration are prioritised over Euro-

pean single market access. The pound surged after November’s High Court ruling.

In a sign of how thorny the process could be for May, the opposition Labour Party plans to table an amendment to any Article 50 bill to try to keep market access to the bloc, its leader Jeremy Corbyn told Sky News on Saturday.

The addition of amendments could risk derailing May’s timetable, although the BBC has reported that the government has prepared a very short bill which would be “bomb-proof” against changes by lawmakers who may try and add conditions to the approval.

The High Court challenge was brought by investment fund manager Gina Miller with hairdresser

Deir Tozetti Dos Santos the second claimant. The case hinges on whether the government can use a historical power known as “royal prerogative” to invoke Article 50 without lawmakers’ assent.

The challengers argued that Britons would inevitably lose rights granted under an act of parliament when leaving the EU, and that under Britain’s unwritten constitution such rights could only be taken away with parliamentary approval.

The High Court agreed with this, rejecting the government’s assertion parliament had given its approval by allowing a referendum and that it was established the executive alone could make or leave international treaties.

At least 17 killed in China mine blast licensed colliery in the city of Qitaihe in northeastern China.

Media reports said the Qitaihe mine boss and three managers were being questioned by police on Saturday as China launched a nationwide safety overhaul in response to the recent surge in mining accidents.

China has averaged two colliery accidents a month this year until five accidents in November including a gas explosion that killed 33 miners in Chongqing.

An explosion has killed at least 17 workers at a coal mine in northern China and 10 others remain trapped.

There were 136 people working underground when the blast occurred at the Baoma Mining Company mine in the city of Chifeng, Inner Mongolia yesterday, Xinhua news agency reports.

It says 109 miners managed to escape.

Top tourist attraction Titanic Belfast has been crowned the best tourist attraction in the world. The museum, which opened in 2012, staved off competition from Ferrari World in Abu Dhabi, the Las Vegas Strip and Peru’s Machu Picchu to clinch the accolade at a ceremony for the World Travel Awards in the Maldives. It is the first time any attraction from Ireland, north or south, has won in the 23-year history of the awards, dubbed the Tourism Oscars. Tim Husbands, Titanic Belfast’s chief executive, said they were delighted. The new title puts the Belfast landmark on a par with previous winners such as the Taj Mahal in India and the Egyptian pyramids.

Edward VIII’s abdication ‘saved monarchy’ Edward VIII would have been a “useless king” had he stayed on the throne and his abdication saved the British monarchy, an historian says.

As the 80th anniversary of the constitutional crisis of 1936 approaches, Professor Richard Toye of Exeter University says Edward, later the Duke of Windsor, has become a romanticised figure over his devotion to American divorcee Wallis Simpson.

But he argued that, rather than giving up the throne for love, Edward VIII was actually looking for a way out from a role he “fundamentally couldn’t stomach”.

Next weekend marks 80 years since the abdication – one of the most difficult periods in the history of the British monarchy.

The Queen’s uncle renounced the throne in December 1936, after just 11 months as sovereign, in order to marry Simpson, leaving his brother the Duke of York - the Queen’s father – to take over as George VI. “You can argue that it saved

Edward VIII the monarchy and it was an important assertion of the primacy of the elected government over the monarchy, which was established, but Edward was trying to push the limits of that,” Prof Toye said.

“He had been frankly not very interested in doing the job. You have to ask yourself whether this whole episode was really about his most incredible, profound love for Mrs Simpson or whether he was perhaps subconsciously looking for a get-out.

“He was a very egotistical per-

son who always wanted what he wanted.”

The womanising Prince of Wales, as he was before he became king, met Simpson when she was still married to her second husband Ernest, at a house party given by his then mistress, Lady Thelma Furness, in 1931.

He acceded to the throne in January 1936 after George V died and seven months later Wallis Simpson filed for divorce from her husband. Neither the royal court, the government nor the church would accept a twice-divorced American as Queen.

Edward pushed for a morganatic marriage where his wife would have no claim on his rights, but the government would not accept this and the king decided to abdicate.

“I’m sure he did love (Simpson), but he was, to a degree, looking for a way out from a role he didn’t find very congenial,” Prof Toye said.

“Obviously it’s a great story: The king who gave up his throne

for love. There’s been TV series and dramas over the years. Probably the romanticisation started pretty soon after he’d given up because he could be presented as having done the honourable thing for love. That was a way of glossing over some of the more reprehensible parts of his character.”

Prof Toye said Edward VIII would have proved to be a terrible monarch in the long term, and his brother, the shy, stammering George VI, was much better.

“I think he would have been completely useless. George VI fitted the bill very nicely. He didn’t particularly want to do it ....

George VI lacked the charismatic personality of the kind that Edward undoubtedly did have, but in the circumstance that was really pretty perfect for what was required,” he said.

Unsurprisingly, the royals are not expected to mark the anniversary of this turbulent time.

Balcony collapse Three people have been hospitalised after they plummeted four metres to the ground following a balcony collapse in Melbourne. Emergency services were called to a Point Cook home before 4pm yesterday and treated two men and a woman at the scene before taking them to hospital. A man aged in his 60s was taken to Royal Melbourne Hospital with a cut to his head.

Two others, a man aged in his 40s, who hurt his knee, and a woman aged in her 20s with a shoulder injury, were taken to the Western Hospital. All three are in a stable condition.

Tenants have right to live in peace James Ford

s house prices continue to soar, a generation of renters has emerged.

There’s no denying that young people, unless they get help from the bank of mum and dad, will have difficulty buying a house in the present climate.

Renting is by no means the worst thing in the world, especially if you are one of the lucky ones, like me, that gets a good landlord.

You don’t have to worry about maintenance or rates and it’s much easier to move, but it can also be a literal nightmare.

A recent case in the United States of a landlord having sex with a stranger in his tenants’ bed is an example of this.

The Colorado renters were in “complete and utter disbelief” after a notification from their security system.

The landlord is now facing a felony trespassing charge.

This is a particularly bad example of the trials renters face, but an insight into the dynamic none the less.

Not all are like this, my recent landlords have been great, but I have also had those that turned up unexpectedly to “fix” broken ovens and another that pretended to be the gardener in order to scour the property (often people won’t know who their landlord is because they go through a rental company).

It is understandable that landlords have a vested interest in the property, but tenants have a right to live in the house as if it is their own, without being disturbed.

There are also the countless places that are so dirty and not maintained that I wouldn’t want my worst enemy to live in them.

I once rented a flat in which a bedroom wall became so mouldy that I was told not to use the room.

The landlord never thought to lower the rent to reflect the use of one less room.

This probably wasn’t legal but it’s unlikely that most renters know all of their rights and there are undoubtedly many who are being taken advantage of.

While renting can have its drawbacks, it is the way of the future for a large proportion of a generation and their right to live in a comfortable and peaceful home, regardless of whether they own it, should be respected.

ach year on November 25 we focus on stopping violence towards women with White Ribbon Day, an International day which focusses on family violence perpetrated by men.

In reality every day is the right day to work towards stopping violence in the home and to speak out against the family violence and sexual violence which is far too common in New Zealand.

On this year’s recent White Ribbon Day I met the White Ribbon Riders at Roncalli School in Timaru and listened to the messages they delivered to the students there about respectful relationships, one of the key themes for this year’s White Ribbon Day. I was given the opportunity to extend the welcome to the White Ribbon Riders. In doing do I told the students and others that I absolutely believe that every New Zealander has the right to feel safe in their own home, and community too.

November with riders visiting schools, marches and a variety of events to promote the non-violence towards women message.

Each year I make time in my diary to participate in White Ribbon events and in the past this has included meeting the White Ribbon Riders, marching in the Ashburton White Ribbon Day parade and signing the pledge to speak out about violence towards women.

Responding to family violence in particular is an area the Government is heavily committed to and where there is a determination to limit the devastating impact it has on New Zealanders.

New Zealand’s statistics around domestic violence are poor. Around half of all violent

offence charges in our courts relate to family violence and half of all homicides are the result of family violence.

Up to a third of all New Zealand women will experience partner or sexual violence during their lifetimes. Over 3500 convictions are recorded against men for assaults on women each year.

More than 110,000 family violence investigations were carried out by Police in 2015, around one every five minutes, while responding to family violence accounts for 41 per cent of a frontline Police Officer’s time.

New Zealand needs to do better, and will, but laws and governments alone cannot change behaviour.

So what is the Government is doing to help turn family violence around?

The National-led Government has been taking action across the board to better protect families and victims of family violence.

We’ve increased the penalty for breaching Protections Orders. We keep up to 1000 victims of family violence safe each year in their

own homes with the National Home Safety Service.

Ministers from across 16 portfolios have come together to form the Ministerial Group on Family and Sexual Violence, which will oversee a whole-of government strategy for addressing family and sexual violence.

We’re overhauling our family violence laws. Almost 500 individuals and organisations made submissions on the discussion document. Options are being explored and more announcements around changes will come.

But it’s not just about the law.

We have improved judges’ access to information in family violence cases by improving information sharing regulations.

Alongside Police and the judiciary, programmes have been running in Porirua, Christchurch, Wellington, and Northland to give judges who are making bail decisions a family violence summary report on the defendant’s family violence history. Under the initiative, Justice and Police are working closely together to provide relevant, timely, and

consistent information to judges and registrars for every family violence bail application.

A new disclosure scheme (the Police Family Violence Information Disclosure Scheme) has also been created to make it easier for Police to release a person’s violent criminal past to a concerned partner or friend. This gives people the ability to do something to help protect their loved ones. The new Scheme has been accessed 113 times since it was launched in December 2015.

Police can also proactively release family violence information if they believe someone is at risk from their partner.

White Ribbon aims to end men’s violence towards women.

Government is working comprehensively towards making women and children safer in their homes. Together we can make a difference.

There is family violence happening in the Rangitata Electorate. The more there are of us who take action to call for it to stop, the better. Respectful relationships are a great start!

Fremantle’s Little Creatures Brewery is a must-see, even if you don’t stop to sample the wares.

A day in the life in Fremantle I

t’s essential that any trip to Western Australia includes a visit to Fremantle, after all, this is a city that British comedian Ben Elton calls home and it’s where Tame Impala frontman Kevin Parker lives.

With just a day to spare, it’s possible to find out what makes it such an attractive place to live.

First things first, find a place to lay your head in anticipation of a long sleep after a busy day exploring.

The Hougoumont Hotel, on the stylish Bannister Street is just a five-minute walk from the train station or the harbour if you decide to take the scenic cruise to Freo from Perth.

The boutique hotel is named after the last ship to transport convicts to Australia, and the rooms are compact, built from sea containers, in keeping with the hotel’s theme.

Be warned, it can take a while to leave this hotel as they have some unique reading material – a list of the convicts who were on board the Hougoumont are printed on the wall of the recep-

tion. It’s easy to get caught up reading what these men were convicted for, where they came from and then trying to figure out if they’re any relation.

The hotel happens to be on the same street as some of Freo’s best coffee shops – The Attic and Stable Hands – so with accommodation and caffeine sorted, a walking tour is a great way to start the day.

The city is pretty compact, and the guys at Two Feet and a Heartbeat have got a selection of walking tours that take in its history with some including a few beer stops along the way – after all, this is the home of the Little Creatures Brewery.

Two Feet and a Heartbeat co-founder Ryan Zaknich has an engaging way of telling Fremantle’s history, explaining how it came to be colonised in 1829 by Brits while painting a clear picture of the personalities and issues involved in the process. But a highlight has to be the stop at Fremantle Prison and the story of the ingenious escape of an Irish man called John Devoy.

In brief Big welcome for Ruiz Andy Ruiz Jr, the man standing between Joseph Parker and a heavyweight world title, has arrived to a uniquely New Zealand welcome yesterday. As Ruiz Jr walked into the international arrivals area at Auckland airport, one of his entourage shouted, “the champ is here”. But for the next 15 minutes Ruiz Jr watched and listened intently as a kapa haka group gave an intense powhiri, a welcome which attracted the attention of many others in the airport. Fairton serves up an upset

After dominating round one in emphatic style, Allenton’s 100 per cent record in Mid Canterbury Tennis’ open grade interclub competition was dashed on Saturday.

Allenton were downed by a determined Fairton.

With both sides taking three matches each, Fairton snuck the win on a countback of sets 8-7 to claim the spoils in a thrilling encounter.

Former Gala Cup champion Rhys Cromie and Sam Bubb downed Fairton’s Neil McCann and Peter Leonard 6-2, 2-6, (310), while Connor Brosnahan and Tyler Leonard levelled pro-

ceedings with a 2-6, 6-1, (10-3) victory over Allenton’s Aaron Reid and Mary Anne Martin.

Cromie then saw off a defiant McCann 6-7, 6-4, (6-10) in singles play and Bubb was convincing against Brosnahan 6-1, 6-1 to swing the tie in Allenton’s favour, but wins for Leonard over Reid 6-4, 6-3 and a default victory for Martin saw Fairton through to the upset.

Hampstead began round two in second place on the points ladder, and have now made major inroads into Allenton’s lead at the top with a four match to two win over Southern.

A mixed third round has left Tiger Woods tied for 10th in the Hero World Challenge in the Bahamas.

Woods fired a two-under par 70 yesterday and trails runaway leader Hideki Matsuyama, who carded a seven-under par 65, by 11 shots with a round to play. Socceroos star Tom Rogic’s stocks continue to soar after he scored another blistering goal to give Scottish giants Celtic a 4-3 league victory over Motherwell. ABs ‘still the best’ Who’s the best team in world rugby right now?

That might seem like a no-brainer for some Kiwis, but with England beating Australia this morning, the argument’s got a little less clear.

England’s 13 wins from 13 tests this year was the first time they’ve had an undefeated season during the professional era.

Meanwhile the All Blacks dropped one against Ireland to go 13 from 14.

But those are just records, and the only way to know for sure is to have the two teams face each other.

Unfortunately for us, that’s not going to happen until at least 2018, says New Zealand Rugby chief executive Steve Tew. “We’ve got a huge year for our team next year with three games in Europe already locked and loaded,” Tew said.

But with the 2017 Lions Tour and another demanding Super Rugby season ahead, Tew has confirmed there is absolutely zero chance England will appear on that list – and zero chance the All Blacks will get the opportunity to shut Eddie Jones up.

“We’ll take that all into account early in the new year and finalise a fourth game but it won’t be England, no.”

He also confirmed the All Blacks would not be playing any matches before the Lions Tour next year.

But Miles Harrison, one of the leading commentators for British rugby, doesn’t think we need that fixture to answer the question at all.

He has no doubt – the All Blacks are by far the best team in the world, and England would admit it.

“Globally, there is no doubt in my mind.

“New Zealand are there still to be chased down, they are still outright number one,” he said.

“New Zealand have been the better team, England will totally and utterly accept that.

“There was the blip for New Zealand in Chicago, but that also points to how good of a team Ireland are.”

The three matches confirmed for next year include Wales, Scotland and France. - NZME

England lead Jamie Walker drew a shot within centimetres of the jack and the Australians couldn’t move it or better it despite a couple of close attempts.

It gave England their first ever World Championship gold in the men’s triples.

Culture report next year The investigation of the culture inside New Zealand rugby is expected to be finished early next year, with the review’s heavyweight panel holding its first meeting last week.

In a season which saw the national game hammered by a number of high-profile scandals, NZ Rugby is under pressure to repair the sport’s battered image and improve basic values such as respect and responsibility. The nine-person panel held their first meeting last week and a draft report is expected around March-April.

Kiwi raiders both in final

By AdAm HAmilton Both New Zealand horses have qualified for the $1.1 million Perth Inter Dominion final after a dramatic last round of qualifying heats at Gloucester Park.

Smolda found his way to the front when main danger Simply Susational broke at the start and trainer-driver Mark Purdon was then able to dictate terms.

Purdon pinched a cosy 60.9sec middle half then ripped home in the quickest closing splits of the night – 55.5 and 27.3sec – to easily hold-off the brave placegetters Beaudiene Boaz and Bling It On. It was a vastly different story with the luckless Franco Nelson, who looked like missing the final when he was buried in traffic then stormed home late for fifth to Run Oneover in his heat.

Caretaker trainer-driver Dexter Dunn looked ashen-faced after the race, fearing he didn’t earn enough points.

“I got to fourth, but ran out of room an Cyamach nabbed me on the line so I ran fifth.

“I think I’m in trouble,” he said.

Huge relief came just 25 minutes later when the two horses

Cambridge trainer Shaune Ritchie was a nervous man as the field for Saturday’s PDL Iconic sponsored 1400 metre event entered the starting gates at Ellerslie. Ritchie admitted he had thought long and hard before deciding to start his enigmatic galloper, Sultan Of Swing, after he had finished seventh at the venue just a week earlier. However, in the end, there was no cause for concern as an outstanding ride by apprentice Sam Weatherley helped guide the Bachelor Duke gelding to a narrow but convincing victory.

Purdon was as much relieved as anything after Smolda’s return to winning form.

“He finally drew well and the race changed in the space of 100m when Simply Susational galloped.

Luckily I had enough speed to push through and get the front,” he said.

“Those first two hard heat runs had taken a bit out of him so to get an easier run and win is a real help.

“He’s run three great races in the heats.

“He’s so honest and now we have a week to freshen him right up again for the final.”

It was a big night for Purdon with two wins and a luckless second from his three starters at Gloucester Park.

Mr Mojito worked to the lead, star-gazed at the times, but easily won the Group 2 4YO Championship, while A Piccadilly Princess was stuck in a pocket and flew home late for second to Ideal Alice in the mare’s feature race.

Both Mr Mojito and A Piccadilly Princess have Group 1 targets at next Friday night’s Grand Final meeting.

Simply Susational broke at the start of the race and lost all hope, while Ultimate Art charged home from a hopeless position to finish fifth.

“Phew,” Dunn said.

“I’m absolutely rapt he’s made it through.

“I really feared he was going to miss out, but he hit the line well in his heat and he’s come through it really, too.

“The owners sent him a long way and really hoped he would make the final. I’m thrilled for them.

“The final is going to be tough so we’re really going to need some luck in the barrier draw.”

Ready to step up Promising stayer Five To Midnight showed he was ready to step up to greater challenges over the coming weeks with a comprehensive victory at Trentham. The Lisa Latta-trained galloper has been nominated for the major northern staying features over the summer months. Big sprint an option Consistent mare Volks Lightning could be headed back to Ellerslie on New Year’s Day for a Group One challenge after she gained a deserved victory at the venue on the weekend. The four-year-old mare powered home to defeat a quality line-up of rating 75 rivals over the 1200 metre distance in one of Saturday’s qualifying heats for Ellerslie’s new Boxing Day feature, the Dunstan Feeds Rising Stars Championship.

Stakes placed twice at Group Three level as a three-year-old, Volks Lightning was on Saturday registering just her second career victory.

In between times they had to settle for third with two-yearold filly Melody Belle in the Gr.2 Wakefield Challenge Stakes while Abidewithme ran on late to finish midfield in the Gr. 1 Captain Cook Stakes.

Echezeaux is a five-year-old Encosta De Lago mare and is the

daughter of multiple Group One winner Grand Echezeaux, making her a half sister to champion galloper Darci Brahma.

Much was expected from her when she first stepped onto the racetrack however the slow maturing type took awhile to hit her straps.

“She has been very slow to develop and really still has some

maturing to do,” explained Autridge. “When she first stepped out she battled a bit and people started to write her off but we knew she just needed some time.

“She has now won three of her last six so her record is starting to shape up. I think with another six months on her she is going to prove to be a very handy galloper.”

The hard way

By Dale BuDge Kiwi Supercars driver Shane van Gisbergen had to overcome a horror start to move to claim a vital third place in Saturday’s 250km race on the streets of Sydney and secure a maiden Supercars championship.

After a horror start where he dropped five spots from pole position at the first corner and then got hit with a pit lane penalty for spinning Mark Winterbottom the New Zealander dropped to the rear of the field.

But a smart strategy, fast car and timely safety car intervention allowed the Red Bull Racing driver back into the game and he capitalised on fresher tyres during the closing stages of the race to make some key passing moves to collect enough points to take an unassailable lead in the title race ahead of yesterday’s finale.

Team-mate and title rival Jamie Whincup eased to victory but van Gisbergen did enough to ensure he becomes the third New Zealander and first since Jim Richards in 1991 to win the championship.

A delighted van Gisbergen admitted he did it the hard way.

“Pretty amazing feeling,” van Gisbergen said after the race.

“Sorry to Mark [Winterbottom] – I went up the inside and just didn’t commit. It was his right to turn in there and my fault.

“Awesome car and to come through like that – lucky safety car – but good racing.

“It has been an amazing year.

“I just want to do a burnout but we will do that tomorrow.”

The 27-year-old said that his main thought in the last few laps of Saturday’s race, when he fought his way through the field from sixth, was helping team-mate Craig Lowndes as Red Bull chasing a championship trifecta.

“I tried to get in front of Scotty to minimise the damage to Craig,” he said.

“Hopefully he can have a good day and he can get himself back in front.”

Van Gisbergen, who has dabbled in other motorsport categories over the years, recommitted himself to Supercars after his championship victory on Saturday.

He said his overseas racing was all done to improve his performances in Australia.

“I really think as a driver I’ve improved doing all the extra-curricular stuff.

“Every time I go overseas I experience cool things, but the best level of driving, the best series is always V8s.

“I’ll come back and try and defend next year.”

Shane van Gisbergen Whincup did all he could but conceded the task was just too big.

“We gave it all we could like we have done all year,” the six time series champion said.

“Big congratulations to Shane and all the #97 crew.

“The winner of the championship is the most consistent and they have been the most consistent.

“Not quite our year but I hope everyone enjoyed the battle.”

The Holden Racing Team duo of Garth Tander and James Courtney collected second and fifth respectively in what will be the team’s final round with Holden factory backing.

New Zealander Scott McLaughlin finished fourth in his Volvo in his final round with the GRM Team as he jumped Craig Lowndes for third place in the championship. Lowndes was sixth on Saturday.

Starting from pole van Gisbergen made a terrible start to the race and was swamped

by Whincup off the line and then by the chasing pack at the first corner.

He dropped to sixth place but settled down and found some rhythm after that.

But just as he looked to be working on getting into an all-important top-five spot he couldn’t quite make a successful move on defending champ Mark Winterbottom and spun the Ford driver around.

The Kiwi was handed a pit lane penalty as a result that dropped him to the back of the field.

Super Black Racing’s horror weekend continued with Chris Pither suffering serious damage to the back right corner of the car after being turned around at the first corner and his race was over.

The New Zealand team have announced they will take a year out of the sport next season.

Barkley in hot water NBA legend Charles Barkley said something he shouldn’t have, and ESPN personality Rachel Nichols is making sure he knows about it. Nichols, who returned to ESPN last year after three years at TNT, took exception to her former colleague’s comments, in which Barkley said the Golden State Warriors play “little girly basketball.”

Nichols took a few minutes to discuss Barkley’s comments, addressing the dangers of equating femininity with weakness, of which Barkley was guilty of doing. “I did text him last night, and I said, ‘Chuck, think about how it feels for girls watching you to hear you use ‘girly’ or ‘girls’ as a substitute word for weak or lame? It’s not OK”.

Ashburton batted first and amassed 218/9 after their innings with contributions from throughout the team, particularly Liam O’Connor’s 48 off 28 balls and a crucial supporting

effort from the lower order.

St Thomas’ struggled to get going as Will Graham’s three for 31 and Gareth Hunt’s two for 14 ripped through the top order.

Connor O’Grady chipped

away at the middle and lower order to grab three wickets for 23 runs.

It was all over for St Thomas’ after 35 overs, being bowled out for 144.

Punters should be prepared to pay at the door to watch Joseph Parker’s heavyweight world title fight at the pub next weekend. At least one popular central Auckland bar is already advertising entry fees for next Saturday’s fight night in an attempt to claw back higher-than-usual costs for commercial licences – a move which is outraging fans. Auckland’s Empire Tavern is already telling customers a $10 entry fee will be in force for the bout.

Breakers hit rock bottom

They found it in Melbourne yesterday afternoon.

A fourth straight loss, 98-74, left the Kiwi club in last place in the Australian NBL, completing a truly forgettable fortnight for coach Paul Henare and his players.

A slump that began with ignominy in Illawarra ended with misery in Melbourne, with the Breakers bookending a 31-point

humbling against the Hawks with a 24-point thrashing against a United side who had previously occupied the bottom rung on the competition ladder.

The nadir of this losing streak arrived on either side of the halftime break at Hisense Arena.

The Breakers had held a 33-30 advantage midway through the second quarter, having started strongly on defence for the first time in four games.

Then it all went wrong.

Ten minutes and nine turnovers later, the Breakers suddenly trailed 60-40, having allowed

The Breakers were never able to recover from that impotent stretch and the 74 points they eventually managed represented their second-worst return of the campaign.

But, if those failings were cruelly fitting, such a performance was still surprising.

Corey Webster was welcomed back and made all five of his shots for 10 points in the second quarter alone.

That followed a 12-point explosion from fellow shooting guard Kirk Penney in the first and, when both of the Breakers’ guns are firing in such a fashion, the Melbourne side certainly seemed to have reason to worry.

But those offensive outbursts would prove aberrations as the visitors finished the game shooting a woeful 19 per cent (five-of-26) from beyond the arc, with Webster and Tom Abercrombie combining to make only one of their 11 attempts from deep.
