Police on curfew notice Ashburton police have been put on notice over allegations of entering private property to check a person on bail curfew without licence. Simon George Williams, 31, appeared in the Ashburton District Court yesterday, to ask for a variation on a curfew, imposed as a bail condition at an earlier hearing. Williams is charged with breaching a protection order
and threatening to kill, and is due back before the court for a case review hearing later this month. His lawyer Roz Burnside told the court the conditions of the curfew had become intolerable for the couple whose address Williams was bailed to. “This goes further than police coming onto their property and shining lights through the windows at all hours,” she said.
Both Williams and the couple concerned had spoken to police to ask for a more considerate approach. “An officer told the complainant he does not care about the disturbance caused by the door knocks and he would do it anyway,” Ms Burnside said. Judge Joanna Maze ascertained there was no court-imposed condition for Williams to present at the door on file.
“I would not have imposed one without the consent of the property owners,” Judge Maze said. “They (the police) might find themselves the subject of civil litigation.” Williams was granted permission to leave Ashburton on December 24, but must be back on January 4. If he returns earlier he must report directly to the police station and resume the current curfew.
After delivering her decision, Judge Maze issued the following warning: “Police are warned they do not have express licence to enter and check curfew, nor do they have implied licence to enter the property, and from now on you are on notice.” Neither Canterbury nor Ashburton police responded for a request for comment on this matter before the Guardian deadlines last night.
