Mid Canterbury Cricket has been blindsided after the Ashburton Domain oval pavilion and indoor nets were red stickered on Friday by the Ashburton District Council. The notices, taped to all entrances of the building, are printed on bright red paper with bold black writing, which clearly labels it an “Unsanitary Building”. The notice is addressed to the Ashburton Domain Oval Pavilion Charitable Trust; all users of the pavilion and any person who has an interest in the land the building is on. Several senior officials at Mid Canterbury Cricket were not clear yesterday about what had happened, with club chairman Mike Southby saying he had only been made aware of the notice via a

message whilst travelling on Friday. “I know nothing at all, I went down for a look at it yesterday (Saturday), it doesn’t actually say what it is for, just that it is an unsanitary building under whatever section of the building act and that is all I know until I can talk to somebody at the council,” he said. “We have had no correspondence from the council, just all of a sudden this red sticker appeared.” The notice is not clear why the building has been stickered, with the meanings of an insanitary building and dangerous building given in sections 121 and 123 of the Building Act 2004. All users of the building have been set an ultimatum to remove their sports equipment from the building, with access only permitted until October 29. No access is permitted after that date.

The council warns that a failure to comply could result in the Ashburton District Council considering the option of exercising further enforcement powers, including initiating a prosecution under the building act 2004. A person failing to comply with the notice presented to them could find themselves liable for a fine not exceeding $200,000, or if convicted, could find themselves fined an extra $20,000 for every day or part of day during which the offence has continued. It is also considered an offence to remove or deface a notice, which could result in a fine not exceeding $5000. The Mid Canterbury senior representative side are set to play their first game on the oval on November 19 against the Canterbury Country Cricket Association in a 60-over match.
