Guilty verdict A jury took just two and a half hours to find two people guilty of causing the death of Ashburton man Arran James Gairns, known as AJ, by manslaughter yesterday. Justice Gerald Nation then convicted Olivia Toby Frances Lucas and Verdun Ashley Perry, both of Ashburton, and remanded them in custody pending a sentencing hearing in Timaru on May 26. Both Lucas and Perry were convicted of assaulting Gairns with intent to rob him in the early hours of Sunday, May 31, in Ashburton. The jury of six men and six women subsequently found their actions resulted in his death. Lucas admitted the

assault charge on day one of the trial. The High Court trial was in its seventh day. Following Justice Nation’s closing address yesterday, in which he outlined legal considerations, the jury retired for deliberations at about 11am. The members took an hour-long lunch break at 1pm, and the court reconvened at 2.30pm. Grief and stress was palpable as Gairns’ family and supporters filed back in to court to hear the jury foreman deliver the unanimous verdict on all three charges before the court. His mother sat quietly crying, holding her husband’s hand. Others were also mopping up tears. Sobs erupted from the public gallery

as family members absorbed the news. Outside the court they spoke of the ordeal of waiting almost three years to hear those words. The case was prosecuted for the Crown by Andrew McRae, assisted by Matt Beattie. Two other people were also charged with the same offences as Lucas and Perry. One pleaded guilty early in the piece, and awaits sentencing in custody. The trial of the other person is set down to take place next month and until a verdict is reached, strict suppression orders prevent the publication of any evidence presented during Lucas and Perry’s trial.
