A lease is a LEGAL DOCUMENT. Before you sign one, we want to make sure you understand what leases are and how they work. Written leases are binding contracts that are difficult to break once signed! A lease may be called a “rental agreement” or some other name, but any document that meets the definition of a “lease” is a legal document and is subject to the Arizona Residential Landlord and Tenant Act.
A lease can be written or verbal, but we highly recommend that you always get your lease in writing. A written lease fixes all terms of the agreement so that no changes can be made during the term of the lease, unless both the landlord and tenant agree to the changes in writing. Make sure you read the lease thoroughly and understand what it says. These are a few (but not all) important components to look for in your lease – • Can I move out before the end of the lease? Is there a penalty? • What is included in the lease? Utilities? Furniture? Washer/Dryer? • What are the expenses I will incur? Deposit (refundable or not)? Utilities? • Are there “rules and regulations” or other policies I need to abide by? Are there fines for violations? • For what reasons can the landlord evict me? The law can be found on the City of Tucson’s website under City Code, Unruly Gatherings. So what is an unruly gathering ? The ordinance defines it as “a gathering of five (5) or more persons on any private property in a manner which causes a disturbance of the quiet enjoyment of private or public property by any person or persons.” Disturbances include, but are not limited to: • Excessive noise or traffic • Obstruction of public streets by crowds or vehicles NORTHPOINTE • Drinking in public APARTMENTS • Service of alcohol to minors • Consumption of alcohol by minors • Fighting • Disturbing the peace • Littering

It’s no big deal ... Well , it could be. The Tucson Police Department has agreed to forward red tag reports to the University of Arizona Dean of Students office. The reports will be reviewed to determine if 1) the host(s) of the party is a University of Arizona student, 2) other University of Arizona students attended the party and 3) there is a clear nexus to the university. Generally, state universities cannot discipline off-campus behavior merely because a person is a student. Instead, there must be a clear “nexus” between the misconduct and the health, safety or academic integrity of the campus itself. A nexus is present when there is sale or distribution of illegal drugs or controlled substances, violence, or underage service of alcohol at an offcampus party hosted by a university student. These behaviors present a clear danger to the safety of the university community. Once these criteria are met, students will have an opportunity to discuss the incident with the Dean of Students, which could result in educational sanctions.
