Heconsidershisworkasaprofessorofcomparative lawattheLateranUniversity'sschoolofcanonand civillaw"amission."Withoutafirmgraspofthe essentialdifferencesbetweenthetwolaws,hesays,a manmayencounterdifficultieswhenheappliesRoman- bredcanonlaw,thelawoftheChurch.

FatherLaffertysaysthattheproperfunctioningof theChurchinEnglish-speakingcountriesdependsin goodmeasureonanunderstandingofthespiritofthe twolaws.ToEnglish-speakingpeoples,governedbya civillawthatisdesignedforallpersonswithoutexcep- tion,theprovisionsofcanonlawcanseemmerciless.

"Canonlaw,likeRomanlaw,isframedinthe narrowestpossibleterms,"hesays."Itisanexpression ofprinciple,anditisexpectedthatexceptionswillbe madetoitinindividualcases.

FatherLaffertypointsoutthatthepracticaldiffer- encesbetweenthetwolawscanbetracedtotheway eachoriginated. "Romanlaw,'whichwastheforerunnerofcanonlaw, beganasaseriesofedictsfromtheemperor.Dispensa-tionsweregrantedfrequently.

FatherLaffertyemphasisesthatthesamewording canhaveadifferentmeaningineachofthetwokinds oflaw.Forinstance,theprincipleofcanonlawthat "strictlawsarestrictlyinterpreted"meansthatsuch lawsarestrictlyinterpretedagainstthemselves.

LittleRock'spriest-lawyerhasspentallhislife studyingorteaching,withtheexceptionofsevenyears practisinglawinLittleRock.Hegraduatedfrom GeorgetownUniversity'sschooloflawin1924,opened hisofficeinLittleRockandlaterdonnedthebluetrimmedcassockofaseminarianofRome'sNorth AmericanCollege.Hewasordainedherein1935and afterthewarreturnedtoearnadoctorateincanon andcivillawattheLateranUniversity.

AfterreceivinghisdegreeheremainedinRomefor the1950HolyYeartohelpattheNorthAmerican College'saudienceoffice.Itwasthenthehewasfirst approachedaboutteachingcomparativelawatthe Lateran.ButhereturnedtoLittleRockbeforefinal arrangementsweremadeanddidnotbeginhisteaching careerinRomeuntil1953.

OurcorrespondentrevisitsGeraldtonafter manyyearsandfindsseveralimprovements. Oneofwhichstandsinhismemorysufficient toexpresshimselfonthisimportantaspectof developmentintheDioceseofGeraldton.

Oneofmywar-year memoriesisofSt.Patrick's College,Geraldton.Frankly, Iwasappalledattheidea ofhavingaboardingschool set,asitseemedtome,on sanddunesthatofferedlittlescopefordevelopment.

Iwasscepticalwhenone oftheCollegestaffenvisagedawell-appointedCollegewithin20years.Though Iadmiredhiscourageand enthusiasm,Idismissedhis ideasasthoseofanunpracticalvisionary.

Recently,however,an opportunitycametovisit Geraldton.Iwasimpressedfirstbythesignsofdevelopmentinthetownand district.

AsanOldBoyofthe ChristianBrothers,albeit thousandsofmilesfrommy ownAlmaMater,Icalled ontheBrotherstopaymy respects.Whatmetmyeyes filledmewithrespectfor the"unpracticalvisionary" of17yearsago.

Anamazingandheartwarmingtransformationhas occurred,andGeraldton cannowboastofhavinga CatholicBoys'Collegewith amenitiesthatcompare favourablywiththoseof mostsimilarinstitutions, Ifoundthreesports ovals,half-a-dozentennis courtsandfourbasketball courtswherepreviouslyhad beenasandywaste.

quietlyforgingaheadinthe spiritualandacademic fields.Hereagain,St.Patrick'sCollegehasbeenfulfillingitspurposenobly.

IleftGeraldtonfullof admirationforyetanother ofourBrothers'Colleges. ScatteredupanddownAustralia,theselighthousesof theFaitharespreadingthe illuminationofChristinto everycorner.

St.Patrick's,Ibelieve,is theonlyCatholicBoys' CollegebetweenGeraldton andDarwin.Thescattered peopleofthisareacanbe proudtohavesuchanoble institutiontoprovidefor theirboys.Nodoubt,as theNorthWestdevelops, Brothers'schoolswillfollow thepopulation.But,until thattime,St.Patrick'sCollegestandsasanoutpostof Catholiceducation.

Itgivestheboysofthe scatteredfarms,stations andminingtownseveryadvantageenjoyedbytheir fellowsinthemoreclosely settleddistricts.

Itisratherdifficultforus,wholiveinalandoflarge spaces,inreasonablecomfortandsecurity,toimagine thecongestion,discomfortandfearofthefuturewhich mustnecessarilybeassociatedwiththetermrefugee.

Inbroadterms,arefugeeisonewhoisseekinga placewhereheorshecanfulfilthedestinyofahuman beingwithoutfearofintrusiononrights,withoutfear ofwant.Refugeesarenotonlypeoplefleeingfrom overpopulatedareas,butthosealsowhoarerelicsof war,oppressionorplainlynotwantedbytheirown.

Therehasalwaysbeenemigrationfromonecountry toanother.Itspringsprobablyfromman'scuriosity, desiretoimprove,orbroughtaboutbyforceofonekind oranother.

Todaytheworldisfacedwithaproblem.Notonly istherethequestionofthe2.7billionpeopledivided roughlybetweenAsia(nearlyhalf),Europe(aquarter) andthetwoAmericas,OceaniaandAfrica(aquarter), butthereisthe"hardcore"ofsickrefugeesstillin Europe,refugeesfromoppressionandeconomicwant whomnobodywantedinthefirstpost-warplansof migration.

TheMalthusiantheoryclaimsthatifworldpopulationcontinuestoincrease,therewillnotbesufficient naturalresourcestofeedit.Somescholars,accepting thetheoryofMalthusandgoingfurtherthanhedidin theirremedies,talkoffecundityasa"socialill"and thatnationswhich"sufferfromit"shoulduseany meanstocureit.Hencegreatpropagandaonbirth controlbymainlyimmoralmethods.

TheChurch,ontheotherhand,teachesthatonesure wayofoffsettingpopulationpressureisbyabroader policyofemigration.

Man'srighttodecidefreelywherehewantstolive onthisearth,toworkandsupporthisfamily,isderived fromtheverypersonalitygiventohimbyhisCreator. Itisnotsomethingwhichcanbedeterminedbyagroup oraState,butshouldberecognised,encouraged,protectedasanaturalinheritance.Ifthisisdonebythe communityofnations,recognisingtherightsofman andnotjustseeingthecolourofhisskin.andwhile admittingthatfairconditionsmaybehonestlylaid downforthecommongood,thereiseveryreasonto believethattheproblemcanbeovercome.

Australiahasplayedquiteagoodrolesofar.In proportiontoourpopulation,wehaveledtheworldin acceptingrefugeesforresettlement.Duringtheperiod 1945-1948inclusivewereceived1,383,882long-termand permanentarrivals,ofwhom17percentwererefugees including182,159displacedpersons.Inotherwaysalso theGovernmenthasassisted.

Wecandomore,notonlyonaGovernmentlevel,but onafamilyandindividuallevel.Attitudesofindifferencemustbeovercomesimplybecauseotherpeopleare foreignerstousorthatwehavesomepreconceivedand oftenwrongideasaboutthem.Wemustrecogniseeach individual'srightandthatofhisfamily.

Itisnotallone-sided,asmanypeoplethink-the migranthastodohisbitinfittingintothecountryof hischoice.Manyhave,anddoneitwell.Wherecharity isexercisedinitstruesenseagreatnumberofobjectionsfallbythewayside.Catholics,inprivateandas publicbodies,shouldlendtheirsupportandgoodwill tothisproblem,overcomingevilsolutionstotheworld's populationproblembythethoroughunderstandingof thisproblemandthemoralmeanstosolveit.

TheSovietclaimsoffreedomofreligionarehollow whenoneviewstheactualsituationinMoscow.Besides theCatholicChurch,thereartwosynagogues,aBaptist church,aMoslemmosqueandsome55Orthodox churches.

ManyofthemnevercompletelylosetheirFaith, however.Butiftheywishtogetaheadintheirjobor profession,theyhavetotoethepartyline.

Whentheyreachtheagesof40or50,someSoviet citizenshaveprogressedasfarastheyeverwill,either intheirjobsorintheCommunistparty.Hencethey havenothingtolosebyreturningtochurchattendance. Theverynextdaythereappearedaviolentattackon theOrthodoxChurch,itsbishopsanditspriests.The attackwaswrittenbyayouthwhosaidhewasaformer believer.Heaccusedhislocalbishopofallkindsofvile immoralities,addingsomechoicevilificationsagainst hisOrthodoxpastor.

TheconstantattackontheCatholicChurchisreflectedinarecentarticlepublishedinaSovietmagazine onscienceandreligion.AcertainComradeChidlov wrotethat"contemporaryCatholicisminthebourgeois countriesiscloselyconnectedwithimperialismand playsareactionaryrole."

ThiswritercomplainedthatthoughintheSoviet UnionthemajorityofCatholics"areloyaltotheSoviet Stateanddonotpropagatetheoriesalientosocialism," noneofthem"saysopenlythattheydonotagreewith thedefenceofcapitalism."

Butevenwithoutthestatisticsitisobviousfrom experienceoflifethatapercentageofdelinquency arisesoutofgood,religioushomes.Thereisnopoint blinkingthefactthatacoupleofsincere,practical Catholicsmayleavempchtobedesiredasparents.

Itseemstomethatsentimentalityisthesourceof therotinthegoodhome.Solongasnosinisinvolved, someparentsthinkitessentialtoparentalaffectionto pandertoeverywhimofchildren.Thereisapainfully generalignoranceofthesheerneedoftrainingchildren inself-denialoflegitimatepleasures.Itisalackwhich assumesalarmingproportionsintimesofprosperity suchasthepresent.

Therearetwoaspectsofthismatter-thepunishment offaultsandthegeneraloutlookonrelaxation.Asfor theformer,modernpsychologyhasmadedamaging inroadstowardsbuildinguprepugnanceagainst physicalchastisement.

DevelopingIndividuality

Mereabnegationofitselfissterile.Thereisno pointindoingwithoutthings,evenforgoodnatural motives.WedonotwanttobreedStoicsinwhom sensitivityiskilled.Butself-denialfortheloveofGod, practisedinsmall,pleasurefulthingsinchildhood,will logicallyformamanorwomaninwhomself-control ishabitualandwillnotfailincrises.

Thechiefenemyofvoluntaryself-denialisthe slavishconformismwhichmarksoursociety.Everyone mustwearthesamekindofclothes,singthesame mindlesssongs,studythesamecurriculum,playthe samesportsandgotothesameplaces.Neverwasthere anhistoricalperiodwithsuchapotentialforvariety andindividuality;neveratimewhenlifemanifested sodeadalevelling.

ThepercentageofCathoLc compared withthoseatStiteschools inthoseyearswas10.3per cent,11.8percent,and12.4 percentrespectively.

Thetotalnumberofchildreninallschoolsthisyear was196,990-ofwhom 162,345wereatState schools;23,025,Catholic schools;and11,630atother independentschools.
