Whatisthisprinciple?Itiswhatisgenerally knownasthe"doctrineofthematrimonialoffence." Certainactsareregardedasbeingfundamentally incompatiblewiththeundertakingsenteredintoat marriage.Thecommissionoftheseoffencesisbelievedtogivetheoffendedpartytheoptionofhaving themarriageterminatedbydivorce.
Twoexceptionstotheprincipleofmatrimonial offenceareinsanityandpresumptionofdeath.These areclearlyspecialcasestowhichotherconsiderations mustbeapplied.Butdivorceonthegroundofseparationislittlemorethananextensionofdivorceby mutualconsent.That,ofcourse,isfundamentally incompatiblewiththewholeideaofmarriageasa unionforlife.Theexponentsofbothoftheseproposalsarehenceforcedtointroduceanewprinciple basedonthebreakdownofmarriage.

Thatitshouldbeadvancedatallarguesavery limitedconceptofmarriage,evenonthelegalistic side.Marriagedoesnotmerelyconcernthetwo originalparties.Iftherearechildrentheirinterests mustbeconsidered.Butevenifthemarriagebe fruitless(andone-thirdoflocaldivorceswere betweenchildlesscouples)theStateisconcerned,in theinterestsofthecommunity,inthemaintenance ofamarriageandintheinstitutionitself.

Iflawisnotradicallyapreceptofhumannature butmerelyarationalisationofsocialconvention,dependingforitsvalidityonthewillofthelegislator, itissmallwonderthatanInternationalCourtofJusticecannotbesetintrain.LikewiseitisnotsurprisingthattheuniversalDeclarationofHuman Rightshashadonlyqualifiedsuccess,foritisbuta "compromiseofideologicalconflicts."Andsincethe UnitedNationsdidnotpretendtogranttheserights butmerelytorecognisethem,theystruckaninferentialblowatpositivismandindirectlyreassertedthe naturallaw.
Itisnottoomuchtoassertthatthedenialthat humanrightsstemfromnaturallawhasgreatlyex- tendedthehorizonsoftyranny.Foriftheyarenot rootedinnaturebutaregivenatthewhimoflegis- lators(whethertheybetotalitarianorpaternally democratic),thentheymaybetakenawayarbitrarily. Thisistodestroythewholeconceptofjusticeasthe receiptbyeverymanofwhatisduetohimbynatural right.Theold,traditionalnotionofabsoluteand imprescriptiblerightsattachingtoamanprecisely becauseheisapersonisbeingreplacedbythefalse (and,inthelongrun,fatal)ideathatmanholdswhat hehasbythegraceandfavourofanomnipotent State,whichisthesourceandfoundationofall rights.
Soitisincreasinglytherightandthedutyof citizenstoreverttotheold,rationalprinciplethat humanlawsarevalidandbindingonlyinsofarasthey correspondandreinforcethenaturallaw.Practically thatmeansconstantvigilanceandscrutinyofall legislation,forlawswhichdisregardorconflictwith naturallawarenullandvoidandhavenobinding powerontheconsciencesofcitizens.Itissomewhat alarmingtoreflectthatagooddealoflegislationin ourmodernsecularisticsocietycomesintothis category.Itisevenmorechillingtocontemplatethe ephemeralnatureofmuchprojectedinternational law-making.
Butevensupposingnaturallawwerestillthebasis ofpositivelawandjustice,particularlybetweencommunitiesandnations,itwouldstillbetruethatthe lawkillethandthespiritquickeneth.JusticeunrelatedtoChristiancharity-andeventohuman compassion-isamonstrousthing.Withoutdivine helpmancannotevenaspiretoaclearknowledgeof naturallaw,stilllesstoimplementitinpersonaland socialrelations.Ifthesetwinvirtuesfailtoinform society,statetheBishops,"bruteforceandmight willinevitablyprevailintheworld."Theworld's historyofthepasttwodecadesillustratesthatreflectionalltoopainfullytopermitofmuchoptimismor complacencyregardingthefuture.

Lourdes,Aug.15.-Some300priestsallofthemeithersickorafflicted-made upanunusualpilgrimagetoLourdestooffer theirsufferingstothe TravellingfromItaly,the sickandinfirmpriestswere accompaniedbyfour bishopsandanumberof otherclergywhoarein goodhealth.
About5,000sickItalians whowerenotabletomake thejourney,wereassociatedwiththepilgrimage throughtheirprayersand sufferings.

Itwouldberareindeed thatbothpartieswouldexperiencesuchavocation.If theydid-andthedesire ofonepartyonlywould notbeenough-thenthe Churchsaysthat,providedanychildrentheymay havehadaresettledinlife andnolongerneedtheir care,theyarefreetoseparate,entersuchreligious ordersasmaybewillingto receivethem,andtaketheir religiousvowsinaccordancewiththeRulesofthe Community.

Hewasaccompaniedby thechieffirebrigadeofficer.
FatherBurkettplacedthe BlessedSacramentinthe tabernacleoftheconvent chapel. Thefiredestroyedmost ofthechurchinterior,includingthemainaltar,two sidealtarsandsomestatuary.
Thecauseofthefireis notknown,butitisbelievedtohavestartedinthe
altarboys'roomatthe backofthechurth.
FatherBurkettsaidthe mainaltarandtwoside altarshadbeentotallydestroyed,andfourofthefive statuesinthechurchhad beensobadlyscorchedthat theycouldnolongerbe used.Theotherstatues couldpossiblybecleaned andrestored.
Thepewshadbeenbadly scorchedbutwouldbefit foruseagainaftertheyhad beensandedandpolished. Theconfessionalinfrontof thechurchsufferedthe samedamage.

Whenthetwinsreachedtheirhometheyfound thatthereweretwothingsaboutwhichtheirparents wereveryhappy.
ThefirstwasthattheirguestBillhadbeenable togetajobinthecountry.Hewastoleavethenext day.Hetoldthemhowmuchhehadappreciated theirkindnesstohim,andthathewouldcertainly writetothemandgivethemallhisnews.
ThesecondwasanairmailletterfromthePhilippines,wheretheeldestofalltheO'Reillychildren, FatherPatrick,wasaSt.Columbanmissionarypriest. Hetoldthemalotabouthowmanyconvertsthere were,andhowbadlytheyneededmorepriestsout there.
