Whatisthisprinciple?Itiswhatisgenerally knownasthe"doctrineofthematrimonialoffence." Certainactsareregardedasbeingfundamentally incompatiblewiththeundertakingsenteredintoat marriage.Thecommissionoftheseoffencesisbelievedtogivetheoffendedpartytheoptionofhaving themarriageterminatedbydivorce.

Twoexceptionstotheprincipleofmatrimonial offenceareinsanityandpresumptionofdeath.These areclearlyspecialcasestowhichotherconsiderations mustbeapplied.Butdivorceonthegroundofseparationislittlemorethananextensionofdivorceby mutualconsent.That,ofcourse,isfundamentally incompatiblewiththewholeideaofmarriageasa unionforlife.Theexponentsofbothoftheseproposalsarehenceforcedtointroduceanewprinciple basedonthebreakdownofmarriage.

Therearemajorobjections,prescindingaltogether fromreligiousandmoralconsiderations,totheintroductionofsucha"principle"toFederallaw.Primarilythecasefordissolutionofmarriageformere desertion,mustfaceuptothesituationthatitwould beunjusttothepartnerwhohadcommittednomatrimonialoffence.Inadditionitwouldmultiplythe sufferingofchildrenandingeneralwouldbedisastroustothestabilityofmarriage.

LimitedConceptOfMarriage

Thatitshouldbeadvancedatallarguesavery limitedconceptofmarriage,evenonthelegalistic side.Marriagedoesnotmerelyconcernthetwo originalparties.Iftherearechildrentheirinterests mustbeconsidered.Butevenifthemarriagebe fruitless(andone-thirdoflocaldivorceswere betweenchildlesscouples)theStateisconcerned,in theinterestsofthecommunity,inthemaintenance ofamarriageandintheinstitutionitself.

TheBishops,in,thisstatement,deliberatelyexclude ccnsiderationofpositivelaw,humananddivine, althoughtheyinsistthatthenaturallawrequiresthe buttressingofpositivelawtoremovedifficultiesand uncertaintiesandtheneedforcomplexreasoning frommanyunabletoundertakeit.Perhapsthemost strikingaspectoftheStatementisthatwhichshows howmodernlegaltheoryhasdepartedfromnatural lawasitsfoundation.Initsplacehasbeensubstituted thewillofthelegislativeauthorityasthesourceof law.Suchanotionisobviouslyfraughtwithallkinds ofperilasregardsthepreservationofrightsderived fromnaturallawandoflibertyitself.

Iflawisnotradicallyapreceptofhumannature butmerelyarationalisationofsocialconvention,dependingforitsvalidityonthewillofthelegislator, itissmallwonderthatanInternationalCourtofJusticecannotbesetintrain.LikewiseitisnotsurprisingthattheuniversalDeclarationofHuman Rightshashadonlyqualifiedsuccess,foritisbuta "compromiseofideologicalconflicts."Andsincethe UnitedNationsdidnotpretendtogranttheserights butmerelytorecognisethem,theystruckaninferentialblowatpositivismandindirectlyreassertedthe naturallaw.

Itisnottoomuchtoassertthatthedenialthat humanrightsstemfromnaturallawhasgreatlyex- tendedthehorizonsoftyranny.Foriftheyarenot rootedinnaturebutaregivenatthewhimoflegis- lators(whethertheybetotalitarianorpaternally democratic),thentheymaybetakenawayarbitrarily. Thisistodestroythewholeconceptofjusticeasthe receiptbyeverymanofwhatisduetohimbynatural right.Theold,traditionalnotionofabsoluteand imprescriptiblerightsattachingtoamanprecisely becauseheisapersonisbeingreplacedbythefalse (and,inthelongrun,fatal)ideathatmanholdswhat hehasbythegraceandfavourofanomnipotent State,whichisthesourceandfoundationofall rights.

Soitisincreasinglytherightandthedutyof citizenstoreverttotheold,rationalprinciplethat humanlawsarevalidandbindingonlyinsofarasthey correspondandreinforcethenaturallaw.Practically thatmeansconstantvigilanceandscrutinyofall legislation,forlawswhichdisregardorconflictwith naturallawarenullandvoidandhavenobinding powerontheconsciencesofcitizens.Itissomewhat alarmingtoreflectthatagooddealoflegislationin ourmodernsecularisticsocietycomesintothis category.Itisevenmorechillingtocontemplatethe ephemeralnatureofmuchprojectedinternational law-making.

Butevensupposingnaturallawwerestillthebasis ofpositivelawandjustice,particularlybetweencommunitiesandnations,itwouldstillbetruethatthe lawkillethandthespiritquickeneth.JusticeunrelatedtoChristiancharity-andeventohuman compassion-isamonstrousthing.Withoutdivine helpmancannotevenaspiretoaclearknowledgeof naturallaw,stilllesstoimplementitinpersonaland socialrelations.Ifthesetwinvirtuesfailtoinform society,statetheBishops,"bruteforceandmight willinevitablyprevailintheworld."Theworld's historyofthepasttwodecadesillustratesthatreflectionalltoopainfullytopermitofmuchoptimismor complacencyregardingthefuture.

Heimmediatelydescribesthissocietybyanother metaphorasthe"bride,"becauseheavenlyhappiness willresultfromspiritualunionwithChrist.There isnoreference,therefore,toanymaterialcity,with itsstreetsandbuildingscomingdownfromthesky. Theparishpriest,V.Rev. FatherB.T.Burkett,under aprotectivestreamof waterfromfirebrigade hoses,rushedintothe churchtorescuetheSacred Speciesfromtheblazing altar.

Hewasaccompaniedby thechieffirebrigadeofficer.

FatherBurkettplacedthe BlessedSacramentinthe tabernacleoftheconvent chapel. Thefiredestroyedmost ofthechurchinterior,includingthemainaltar,two sidealtarsandsomestatuary.

Thecauseofthefireis notknown,butitisbelievedtohavestartedinthe

altarboys'roomatthe backofthechurth.

FatherBurkettsaidthe mainaltarandtwoside altarshadbeentotallydestroyed,andfourofthefive statuesinthechurchhad beensobadlyscorchedthat theycouldnolongerbe used.Theotherstatues couldpossiblybecleaned andrestored.

(Afterhavingteawithalonelyoldlady,the twinsdecidethatwhentheygrowuptheywill liveneartheirparentsandcareforthem).

Whenthetwinsreachedtheirhometheyfound thatthereweretwothingsaboutwhichtheirparents wereveryhappy.

ThefirstwasthattheirguestBillhadbeenable togetajobinthecountry.Hewastoleavethenext day.Hetoldthemhowmuchhehadappreciated theirkindnesstohim,andthathewouldcertainly writetothemandgivethemallhisnews.

ThesecondwasanairmailletterfromthePhilippines,wheretheeldestofalltheO'Reillychildren, FatherPatrick,wasaSt.Columbanmissionarypriest. Hetoldthemalotabouthowmanyconvertsthere were,andhowbadlytheyneededmorepriestsout there.

Hisfamilywereverygladtoknowthathewaswell anddoingsuchgoodwork,thoughitwasnaturalthat theymissedhimverymuch.Whentheyallkneltto saytheFamilyRosarythatnight,theysaidadecade especiallyforvocationstothereligiouslife.

WhiletheywereprayingMarywaswondering whethersheshouldtellherparentshowmuchshe wantedtobecomeaSt.JohnofGodSister.Shehad neverevendroppedthetiniesthint.

Mostofthegirlsweremadonclothesandmake-up, whichsomeofthemworewhentheywerenotin school,anditmadeMaryfeelold-fashionedtohave suchdifferentinterests.

ADayOutWithFatherMartin

Whentheygotupnextmorningthetwinswentoff tothePresbytery,withanotefromtheirmotherto theirparishpriest,FatherMartin.Initsheenclosed the forhimtosee.

FatherMartinwasawonderfulparishpriest.He kneweverysingleoneofhisflock,alltheirinterests, hopesandtroublesandhemadethemhisown.He wasdelightedindeedtohearfromthemthatBillhad foundworkinthecountry.

"Iwanttoseeyourmother,"hetoldthetwinsand hedrovethemhome.

WhenhereachedtheirhousehesaidtoMrs.O'Reilly thatitwashis"dayoff"thenextdayandhethought ofgoingforadriveandhavingapicnicinthebush. Howwouldtheyallliketocome?

"ButFather,Ihaven'tanythingsmarttowear,"she gasped.

"Whowantstobesmartonapicnic?"helaughed. Thenhetoldthemthathewasveryproudoftheir familyandwantedtogivethemallalittletreat, especiallytoshowhisgratitudeforthewaytheyhad welcomedthestrangerBill.
