ChristourLordraisedMarriagetothedignityofa Sacrament.Thereforemarriagesbetweenbaptised personsaregovernedbythelawofGod,and,exceptingcivileffects,cannotrightlyberegulatedandadministeredbythewillofcivilrulerscontrarytothe lawsoftheChurch,whichalonehastheofficeof teachinginsacredmatters.Nohumanauthoritycan dissolvethebondofvalidChristianmarriagewheneverthishasbeenconsummated.Evenwhenthe partiesarenotbaptised,marriagelegitimatelycontractedisasacredthinginthenaturalorder,and civilcourtshavenopowertodissolveit.

ThreatToStabilityOfSociety

InourdaycivilGovernmentsinmanycountries, includingAustralia,thinkandactasifitwereotherwise.Theyhavepassedlegislationandhavesetup courts,notmerelytodealwiththepurelycivileffects ofmarriage-whichiswithintheircompetencebutalsotosunderthebondofvalidmarriage,grant divorceandpermitre-marriage.Withthepassingof yearsfacilitiesfordivorcehaveincreased,untilinour daythenumberofdivorceshasbecomesogreatasto threatenthemoralstabilityofcivilsociety.

OpposedtothisstandstheunalterablelawofGod, fullyconfirmedbyChrist,alawthatcanneverbe deprivedofitsforcebythedecreesofmen,theideas ofapeople,orthewillofanylegislator:"WhatthereforeGodhasjoinedtogether,letnomanputasunder."

(Matt.XIX,6)Andifanymanactingcontrarytothis law,attemptstosunderthebondofvalidmarriage, hisactionisnullandvoid,withtheconsequenceso clearlyexpressedbyChrist:"Everyonewhoputs awayhiswifeandmarriesanother,commitsadultery; andhewhomarriesawomanwhohasbeenputaway fromherhusbandcommitsadultery."(LukeXVI, 18.)Moreover,thesewordsrefertoeverykindof marriage,eventhatwhich,becausethepartiesare notbaptised,isvalidwithoutbeingsacramental.

Facedwiththecircumstancesthatexistinour country,weexhortyoutostandforthelawofGod andthesanctityofmarriage.WhereforeCatholics mustupholdfirmlythesethreefundamentalpoints: **Theycannotcontractatruevalidmarriageexcept accordingtotheformprescribedbytheChurch. *Marriagevalidlycontractedbetweenbaptised personsisaSacrament.

God'sGraceIsSufficient

Thisvalidmarriagebetweenbaptisedpersons,once consummated,cannotforanycausebedissolvedby anypoweronearth,butonlybydeath.

Toavoidorovercomedifficultiesinmarriedlifeit isnecessarytousethespecialhelpthatGodhasgiven. Knowingthefrailtyofhumannature,ChristourLord inHisloveforusraisedmarriagetothedignityofa Sacrament.Ifthepartiesmakeproperuseofthe GracereceivedintheSacramentofMarriage,this Graceissufficienttoconquerthedifficultiesofmarriedlifeandtoraiseupholyfamilies.ThattheGrace ofmarriagemaybeeffectivelyused,weexhortfamiliestolivetheirFaithandpractisetheirreligion.We urgethemtoseekDivineassistancebyfamilyprayer especiallytheRosary,byMassandtheSacraments,

CatholicHierarchy,thefollowingstatementsetsoutincisivelytheteachingoftheCathoforthclearlythedutiesofCatholicjuristsintheadministrationoflawsonthesematters. alwaysnourishingandpreservingaloyaland thoroughlysinceredevotiontoGod.Wecommend alsoandencouragePre-CanaandCanaConferences forengagedandmarriedcouples;Engagementceremonies;ChristianFamilyMovements;andinspecial cases,CatholicMarriageGuidanceandConciliation Councils.

Itremainsforustoexplainandclarifythemoral positionregardingtherelationofCatholicsingeneral. andCatholicjudgesandCatholiclawyersinparticular tocivildivorcecourtsinAustralia.

PermissionOfBishopNeeded

A.MoralpositionforCatholicsingeneral.

Catholicswhohavecontractedavalidsacramental marriagebeforeGodandtheChurchandwhosemarriagehasbeenconsummated,mayneverpetitionfor adivorcewiththeintentionofre-marryingorofenablingtheotherpartytore-marry.

ItwouldbegravelywrongforCatholicswithout theexpresspermissionoftheBishoptoapproacha civilcourttoprocureadivorceorjudicialseparation whateverythecause.

Toobtainsuchepiscopalpermissionitisnecessary that:(a)Aswornpromisebemadenottore-marryin thelifetimeoftheotherparty,unlessthepresentmarriageshouldfirstbedissolvedordeclarednullby ecclesiasticalauthority;(b)Apromisebemadeto resumenormalmarriedlife,unlesstherebeadultery, iftheguiltypartyshowssignsofgenuinesorrow.

Itwillbeunderstoodthateveninacasewhere adulteryhasbeencommittedtheinjuredpartywill oftenbemovedbycharitytoresumemarriedlifewith thepenitentguiltypartyeventhoughnotboundby anypromisetodoso.

Whenthebondofmarriageisvalid,theabove mentionedpermissionoftheBishopisnormallygiven onlyforajudicialseparationforwhichthereisa seriousandgravecause.Toallowpetitionfordivorce ingrantingadivorceitisnothisintentontoexempt ordinarycausewouldberequired.

B.MoralpositionofaCatholicJudge.

*ACatholicjudgemaygrantadivorcetoacouple notvalidlymarried.Hemayalsograntadivorcewhen heismorallycertainthatneitherofthepartieswill attemptre-marriage,butseeksthedivorceonlyfor thesakeofcertaincivileffects.

Inthethreeyears1784-6, hewrotetwelvepianoconcertos(Nos.14to25),developingthemediumtoits highestperfection.Since 1786pianoconcertoshave notbeenbetter,theyhave justbeendifferent.

AgainHaeblerisbeyond reproachbuttherearebetterrecordingsoftheorchestralpart.

Thisdisccanonlyhe criticisedonthescoreof coupling.Theearlierconcertoisrarelyperformedor recorded;collectorswantingtobuyitarelikelyto havetheK491coupledwith somethingelse.

ThosewantingtheK491 onlywouldpreferacouplingofalaterconcerto suchasK488.

Heine's"AufFlugelndes Gesanges"setbyMendelssohnwaspopularinVictorianEnglandas"On WingsofSong."Poetrybeinguntranslatable,the Englishisbanalcompared withtheoriginal.

Thesameappliesto Goethe's"NerwerdieSehnuschtkennt"whichhas beenvulgarisedas"None buttheLonelyHeart,"set byTchaivoskyand"Ich liebedich"setbyGrieg.

Althoughalongwayoff thebestofLeiderandnot Germanintheirmusicat all,theoriginalsaremuch lovelier.TraeumebyWagnerand"ZaertlicheLiebe" byBeethovenareevenmore worthwhile.Thereisalso ashortsongbyLiszt.

Thisisalongreviewfor suchalittlerecordbutin suchacasethedetailis necessary.Thisiswell worthconsidering,therecordingisverygood. Verdi:HighlightsfromLa Traviata.Decca,57/6.

Ifoundthisoneofthe mostrewardingofthe Decca"Highlight"series withTebaldigloriousas Violetta.Forgettingtheabsurdityoftheoperathat makesagirldyingofconsumptionbawlatthetop ofhervoice,herdyingcry waselectric.

PoggiasAlfredowasalso excellent,witharestraint thatmadehisoccasional outburstsstandoutinclear relief.ProttiasClermont wasverysolid.

Everythingwasgood,the bestoftheoperaselected andthepowtrfuldenunciationscene,Verdi'sstrongest writing,admirablycarried off.

Stronglyrecommended.

Itisnotinappropriatethatthegatheringofjudges andlawyersforthefirstLegalConventiontobeconvokedinourStateCapitalshouldhavecoincided withthepromulgationhereofthestatementofthe AustralianHierarchyonmarriageanddivorce.For inthisfieldofhumanrelations,perhapsmorethan inanyother,isevidencedthedepartureofthemodern secuarStatefromtheNaturallawwhichhasbeen andoughttobethebasisofallhumanlaw-making andadministration.Itis,therefore,praiseworthy thataRedMassshouldhavemarkedtheopeningof .ieConvention,fortheCatholicparticipantsthereby gavewitnessoftheirbeliefthathumanlawsmustbe subordinatetotheDivineLaw,oratleast,mustnot contradictit.

St.ThomasAquinasdefinedlawasaregulationin accordancewithreasonpromulgatedbytheheadof acommunityforthesakeofthecommonwelfare.In thisconcept,lawisapracticalprincipleaimedat orderingtheactinsofthemembersofthecommunity. Lawhasbecometheinstrumentofpolitics.

Itispleasingtonotethatwhiletheobjectivityof thelawhasbeenpreservedinthedemocracies. materialisticconceptshavestillcreptin.Itistobe "egrettedalsothatthemodernStateseemsincapable offunctioningwithoutamultiplicityoflawswhich inevitably,butoftenunnecessarily,curtailhuman freedom.Itmightbesaidthattheaccretionoflaws atheveryacidtestofbadgovernment.Forthe multiplicationofexternalregulationsarguesthatthe civicspiritismoribundandthatcitizensareapathetic. Itwasalatewinterafternoon,bittercoldandsnowing.Twomenonskisweremakingtheirwaycross-countrytowardthetownofWurzburginthesouth-centralpartof WestGermany.Theystillhadalongwaytogo,andsinceitwasalsogettingdark, theydecidedtoheadforaroadclosebyandhitcharide.Severalcarspassedbeforea pick-uptruckfinallypulledovertothesideandstopped.Thedrivereyedthehusky strangerswithopensuspicion."Ifyouwantaliftwithme,"hesaidfirmly,"it'llhave tobeintheback."Cheerfullythetwostrangersdidastheyweretold.

hitch-hikers,whowereshiveringfromthelongride inanicywind,scrambleddownwiththeirskisand poles.Oneofthem-theshorterandstockierone -camearoundandpolitelythankedthedriver.Then, withachuckle,headded:"Youknow,I'mreallynot asdangerousasImaylook.I'monlyyourbishop."

WhenthetruckreachedWurzburg'stownsquare,theChurchcampaignlaunchedinEastGermanyduring thepastyear.TheCommunistleaderbehinditallis generallybelievedtobeWalterUlbricht,goateed partysecretaryandtherealpowerinthepuppet Government.Hisaim:underminetheconfidenceof CatholicsandthusleadthemawayfromtheChurch's authority.

Theskiingprelate,whohadbeenoutfortheafternoonwithoneofhischaplains,wasJuliusDoepfner. Ifthetruckdriverhadn'trecognisedhim,itwas quiteunderstandable.Thelighthadbeenpoor,the strangershadn'tintroducedthemselves,andfew bishops,afterall,arenotedfortheirzestforskiing. Thisone,moreover,wasextremelyyoung-when appointedtoheadthedioceseofWurzburgin1948,he was,atthirty-five,theyoungestbishopinallEurope.

Todayforty-six-year-oldJuliusDoepfnerhasan evenmorenoteworthydistinction.Heistheyoungest member-byeightyears-oftheSacredCollegeof Cardinals.AndheadministersoneoftheChurch's mostvitalandhard-pressedoutposts:thedioceseof Berlin.Thedioceseistrulyanoutpost,surrounded by,andmainlycomposedof,Communistterritory (seemap).

Amuscular,bespectacledmanwithadetermined jawandnotraceofgrayinhisblackhair,Julius CardinalDoepfnerrefusestoregardhiselevationto theSacredCollegeasanythingbutatributetothe staunchnessofBerlin'sCatholics,whosebishophehas beensinceearly1957."Thishonourgoestothem," heinsistsquietly,"inrecognitionoftheirdaily struggletokeeptheirCatholicFaith."

Theirstruggleiscarriedonintheshadowsofthe freeworld'sdeterminedeffortstokeepWestBerlin frombeingsnatchedbytheCommunistsfortheir empire.Berlin'sresistancetoSovietintimidationis seeninthefirmstanceofCardinalDoepfnerhimself.

TheprovinceofBrandenburg(mostofwhichcomprisestheBerlindiocese),isnotapredominantly CatholicregionofGermanyliketheRhinelandor Bavaria.Only12percent.ofBerlin'spopulationis Catholic(comparedto44percent.forallWestGermany).Butthediocesenonethelessnumbers600,000 personsandhasmoreCatholicchurches(345than anyothercityinthecountry.

Likethecityitself,Berlin'sdioceseisradically dividedintotwoparts.FortypercentofBishop Doepfner'sflockliveinthefreedomofWestBerlin. Theremaining60percent.liveinCommunist-ruled territory-eitherinEastBerlinitselforinthemuch biggerareaentirelysurroundingthecity.

Theareaisknownasthe"Zone"(i.e.theSoviet Zone).Itisadministeredbytheso-calledGerman DemocraticRepublic,theCommunistpuppetGovernmentsetupbyMoscow.ToentertheZoneisnot aneasymatter.AWestBerlinermaycrossintoRedrunEastBerlinwithoutdifficultyorformality.But toenterthesurroundingZone,hemustbearavisa grantedbyRedauthorities.

SinceMay,1958,Berlin'sCardinalDoepfnerhasbeen refusedsuchavisa.ThustheEastGermansatellite Governmenthasstretchedanironcurtainbetween himandone-thirdofhisdiocese-some200,000persons.

Thestandardsocialistfuneralceremonyisnoless atheistic.ThereisnomentionofreligionorGod; deathistheabsoluteend.Areligiousfuneral,East Germansaretold,isonlya"vestigeoftheexploiting classes."

ButthemainRedpropagandagunsinthiscampaign areturnedontheyouthofEastGermany.Froman earlyagechildrenareexposedtoanincessantbarrage inState-runschools.Thereisnoescapesinceprivate schoolsarestrictlyforbidden;Catholicparochial schools,withtheexceptionofascatteringofkindergartens,havebeenclosed.

Thisresultsinaparticularlytragicsituationfor Catholicparents.Take,forexample,theaveragecaseofaCatholicchildwe'llcallPaul.Providing thereisaCatholickindergartenintheneighbourhood, heisusuallyallowedtospendoneyearthere,then offhemustgotoaState-runschool.

HisindoctrinationinCommunistmaterialismbeginsonhisveryfirstday.Adelegationofolderschool childrenpickhimupathome,handhimabouquet offlowers(redforpreference)andperhapsalittle redflagtocarry,andthenescorthimtoschool.

OneEastGermanteacherreportedproudlynotlong agothatshehadtakenheryoungpupilsastep further.Notonlyhadtheylearnedtolovetheir

Inanefforttoaddcredencetothiscampaign,East GermanCommunistsarrestedfiveJesuitpriestslast Decemberontrumped-upchargesofespionage.A "people'scourt"sentencedthemtoprisontermsofup tofiveyearsathardlabour.Ataboutthesametime, elevenmenfromthetownotRathenow,locatedinthe ZonenearBerlin,werearrestedastheywerereturningfromaCatholicmeetingheldinWestBerlin. Intheory,theEastGermanconstitutionguarantees allcitizenstherightoffreedomofworshipandreligiousbelief.Inpractice,however,EastGermansare constantlybombardedbyStatepropagandaurging themtomarktheimportanteventsoffamilylifebirths,confirmations,marriage,deaths-byceremonies thatareatheistic.

Socialist"Sacraments"Substituted

Anyoreexpressingreligiousreservationsabout takingpartinsuchceremoniesisblandlyassuredthat nothinganti-religiousisintended.Thetruthisquite thecontrary.TheState'srealintent:substitute atheistic"socialistsacraments"forChristiansacraments.

Take,forexample,thecaseofanEastGerman fatherwhogoestothecityhalltoregisterthebirth ofachild.Theclerkstronglyurgesthatthechild begivena"socialistbaptism"atthecityhall.The fatherisassuredthattheceremonyisnotanti-religious-"justasimpleformality."

Iftheparentsaccept(andtheyareoftengivento understandthattheremaybetroubleiftheydon't), theygetarudeshock.Forthisceremonyinvolves avowontheirparttogivetheirchilda"socialist education."Theymustsignanaffidavittothiseffect, asmustthegodparents.The"simpleformality"becomesakindofswordofDamocleshangingover theirheads.

TheCatholicknows-for hisowngloryorundoingGodhasgivenhimfree will.Andthatonedayhe willberewardedforits rightuse("Come,goodand faithfulservant")orpunishedforitsill-use.

Evenifhewandersoff thenarrowpathbypre- ferringhiswillagainst God'sheknowsthatGod ishisFatherwillingtoforgive-forthisisChrist's wholepointbehindthestory oftheprodigalson.

FortheCatholicallthis ismoreorlesstakenfor granted.Yetnotsoforhis paganneighbourwhofinds thecaseofthemoralstatisticianveryattractive.

Forhimthereisnopriest, noconfession,nosacramentallife.ThereisnoChurch toteachhimwhatisright andwrong:heisleftinthe dark.Inmanywayshehas ceasedtoexercise.the powersofhissoul,forsunk inthedeadlydiseaseof materialism,hedoesn'tbelieveinthespiritual.Withoutthespiritual-without God-thepagansuffers fromtheemptinessofhis life.

Andinhisagonyhecan soeasilyfindanoutletin crimeandsin.Hecanbecomeaslavetohispassions. Butyetheisstillfreeto riseabovehisownsad state.

Inoneplace,astronghold ofMehodism,thepeople mademeverywelcome,and weremostpressingintheir invitationsthatIshouldgo totheirChurch.Ideclined politely,andwhentheydiscoveredthataCatholichad landedamongstthem,it wassuchashocktothem thatonecouldhavecutthe airwithaknife.However thisdidnotpreventthem fromstillbeingfriendlyand sociable.

Peoplewerealwayshelpfulaboutgettingmeto Mass.Ihavedrivenwith Freemasonsgoingtotheir meetings,whotookmeto Mass,introductdbetoother Catholics,andgenerally madeiteasyformetokeep thefaith.

Thehighlightsofmy careerhavebeenhelping tobringtheSacramentof Baptismtoeightchildrenof onefamilyandpreparing childrenfortheirFristCommunion.Alsoanothergreat eventwashavingMass belligerenttones:"Ihaven'tcelebratedonSaturdaysin seenyouatMasi." myschool.

Duringthesameyearan intensivedrivewasMadein theparishsolicitingdonationsoffurnitureforthe nearlycompletedchurch. Theresponsewasexcellent andfurnitureofatotal valueof£3,500wasdonatedbymanygenerousparishioners.

Theclimaxandredletter daywasreachedonthe FeastofChristtheKing, 1957,whenthenewchurch wasblessedbyHisLordship,theAuxiliaryBishop, MostRev.J.J.Rafferty.

PriortothearrivaloftheRedemptorist Fatherstowardstheclosingoftheyear1899, theHighgateHillparishwasadministered fromtheCathedral.

Rev.FatherDuffwasthepriestwhousuallyattendedtotheneedsofthissparselypopulatedsuburb.

Thechurchwasanironstructuresituatedinthe presentconventgroundandalthoughverysmalldid nobleserviceasachurch,schoolandparishhallfor over40years.

Itwasfrequentlyaddedtoandrepairedtillits finaldemolitionin1938,whenanewparishhallwas built.

InOctober,1897,theSistersoftheInstituteof NotreDamedesMissionarrivedfromNewZealand toestablishschoolsinthearea.

Theytookuptemporaryresidenceinasmallhouse inVincent-streetandstartedschoolinthelittlechurch withanattendanceofthirty-eightpupils.

InJune.1898,thefoundationstoneofthenewconventwaslaidbytheRt.Rev.Mgr.Bourke,assisted byRev.Martelli.

AnappealforfinancewasmadebyRev.Fr.John, C.P.,andaddressesweredeliveredbythePremierSir JohnForrestandotherleadingcitizens.

ThecompletedbuildingwasblessedonJanuary22, 1899byMgr.Bourke.
