Thedefencecounsel'scase challengedalmostevery elementinthedecisionthat washandeddownbythe lowercourtonMarch3, 1958.
Intheappealtheclaim wasmadethattheBishop's pastoralletterdealtsolely withthe"religiousreputation"oftheBellandicouple. Itstatedfurtherthatsince thisreputationdoesnot comewithinthecompetence ofthecriminalcole,the accusedshouldhavebeen acquittedbecause"theact didnotconstituteacrime."
Otherwise,theappeal said,onemustconclude thattheItaliangovernment assumestutelageofaman notonlyasacitizenbut alsoasasubjectofthe Church.

DuringaSundaysermon, inwhichtheBishopdidnotrefertotheBellandisby name.hesaid reversal ofthelowercourtdecision shouldnotbetalkedofin termsofvictory.
"IfsometimestheChurch mustremindthefaithfulof theirduty,orexpressreproach,itdoessowithsorrow,"theBishopasserted. "Itdoessoinordernotto betrayitsmandate."
TheBishopnotedthat therehadbeenonlyone civilmarriageinhisdiocesesincethecasefirst cametolight.HesaidstatisticsforItalyshowedthat forthefirstninemonthsof 1958civilmarriageshad fallenoffby25to50per cent.andweredown33per cent.inRome.
Duringthebriefappeal trial,theStateProsecutor joinedBishopFiordelli's lawyersincallingforareversalofthelowercourt's decision.Hesaidthe
