TheconcordatwasrepudiatedwhentheNazistook overAustriain1938.Since theendofthewarits validityhasbeenamatter ofcontroversybetweenthe nation'stwomajorparties.
TheCatholic-oriented People'spartymaintained thattheconcordatwasvalid becauseithadbeensigned bytwointernationallyrecognisedgovernments.It admitted,however,thata numberofitsprovisions werenolongerapplicable.
TheSocialistpartyheld thattheconcordatwasvalid "onlyintheinternational sphere."ButtheSocialists claimeditwasnotvalid"internally"becausetheregime ogEngelbertDolfuss,which negotiatedit,wasan"illegal"government.

HehadalsobeensecretaryoftheNationalSociety fortheEducationofthePoorinIreland.
In1829RogerTherrywasappointedCommissioner oftheCourtofRequestsforN.S.W.,largelythrough theinfluenceofCanning'sfriendsandhiswidow.
HesailedfromEnglandinJuly,1829,ontheconvictshipGuildford,andarrivedinSydneyonNovember4,1829.Thepopulationofthecolonywasabout 50,000,ofwhom34,000wereinN.S.W.-15,000of theminSydney.
HisimpressionsofSydneyonthedayofhisarrival werefavourable-widestreets,well-stockedshops, parrotsandcockatoosincagesateveryFhopdoor, comfortablehomes,pleasantgardens,colourfulmilitarybarracks.
ButthenextmorninghesawtherealSydneywhen theconvictsweremarchedoutoftheirbarracksand whenheheardthescreamsofconvictsbeingflogged inthebarracksatHydePark,andsawthemcarried tothenearbyhospitaltorecover;andwhenhelearnt ofNorfolkIsland,bushrangers,themaladministrationoflaw,themalpracticesofthemagistratesand soon.
Soon,too,theInjusticesaffectingCatholicswere impresseduponhim.Hequicklyrecognisedthatthe Catholiccolonistsandconvictswerenotreceiving justtreatment,andhesetouttousehispositionof influenceinthecolonytopromotereform.
Hisrolewasimportantbecause,previously,there hadbeennoinfluentialCatholiclaymen-public officials,forexample-whocouldhelptheCatholic cause.
Fortunately,thebeginningsofRogerTherry'swork coincidedwiththeperiodinofficeofthebenevolent GovernorSirRichardBourke,aProtestantlinked byfamilytieswithEdmundBurke,whowasinoffice from1831to1837.
GovernorBourke,wholaidthefoundationsfor religiousfreedominthecolony,succeededGovernor Darlingwho,duringhisperiodofofficefrom1825 to1831,hadbeenanoutrightpersecutor,ofCatholicism. HOTEL

GovernorBourkefoundedaGovernmentpolicy towardsreligion,bywhich,inRogerTherry'sword "impartialassistancewasaffordedtotheseveral denominations notaccordingtotheState'sjudg- mentonthecorrectnessoftheircreeds,butaccordingtotheextentoftheirrespectiveexigencies."
AsTherryhimselflaterwrote,atthetimeofhis arrivaltherewerenothalfadozenCatholicfamilies inthecolonybelongingtotheclassof"gentry."Most CatholicswereIrish,largelyex-convicts.Every officeofimportancewasfilledbynon-Catholics.
InfluenceOnAidToSchools
TheCatholicbodyhadasmallfreeelement.Catholicswereregardedasasubordinateclass.They weredeniedreligiousandsocialequalitywithnonCatholics.
In1833,forexample,theGovernmentspent £19,701toassisttheAnglicanclergyandschools,and £800onequivalentCatholicneeds,althoughthe numberswerealmostequal.
RogerTherry'srepresentationsandinfluencewere animportantfactorinthedevelopmentofGovernor Bourke'spolicybywhichtheCatholicChurch,with thecomingofBishopPolding,DoctorUllathorneand othersinthethirties,wasabletogrowandextend.

FatherTherryandRogerTherryweredestined toenjoyanunbrokenfriendshipof30years,onevery dayofwhichthepriestrememberedhisfriendatthe altar.FatherTherrylaterappointedRogerTherry executorofhiswill.
OnSeptember20,1830,RogerTherry'snamewas onalistofsignatories,addedtothatofFatherTherry, seekingGovernmentaidinthecompletionofSt. Mary's.
IntheensuingyearsthenameofRogerTherryis linkedwithallmajordevelopmentsaffectingthe CatholicChurchinSydney.
Itwaslargelyduetohisrepresentationsthatin 1830afterthedeathofFatherDavidPower,the officialchaplain,FatherTherry,thoughnotfully restoredtoofficialstatus,wasallowedtoactina generalsenseaschaplain,untilanofficialchaplain arrivedinthepersonofFatherC.V.Dowling,O.P.
OnMarch30,1832,RogerTherrypresidedata publicmeetinginSydney,inwhichhereviewedthe positionoftheChurchinthecolonyandadvocated thedrawingupofamemorialtotheauthorities.
ThiswaspreparedandpresentedonAugust17,1832 byadelegation,whichincludedMessrs.Therryand PlunkettandFathersTherryandMcEncroe.Not everyaimwasachievedbut,asArchbishopO'Brien hasputit,"anewerafortheChurchinAustralia wasinaugurated."
PracticalContactsInEngland
RogerTherryproceededfromtheoutsettouse hiscontactsandinfluenceinEnglandtoadvancethe welfareoftheChurchinAustralia.Hisfriendsat home,likeBlountandJosephHume,werearmedwith dataaboutaffairsinthecolonyandralliedtoaction.
EventheecclesiasticalauthoritiesinLondonwere promptedtoincreasedinterestinthecolony.
Undoubtedly,thearrivalsofFathersDowlingand McEncroe,andlaterthefoundationBenedictines, receivedanimpetus,tosaytheleast,fromthemovement.
Inspecificways,RogerTherrycontinuedtobe linkedwiththegrowthoftheChurch.Hewasone ofthesixtrusteesofSt.Mary'sCathedralproperty appointedafewweeksafterthearrivalofDr.Ullathornein1833.
In1836hisserviceswereobtainedbyagroupof representativeCatholicsinSydneytoassistthereinstatementofFatherTherryasanofficialchaplain.
AtthemeetingintheoldCourt-Housebuildingon June1,1840,toplantheerectionofSt.Patrick's Church,RogerTherrymovedtheresolutiontofound asocietytocollectfunds.

Therrywassoonafterwardsinvolvedinanother historicincident,whichstemmedfromtheonejust mentioned.
Mudieandothers,tospiteTherry,persuaded theTreasurerofthecolonyandExecutiveCouncil member,Mr.Riddell,toopposeTherryinanelection, inwhichthelocalmagistratesvoted,tofillthepost ofchairmanoftheQuarterSessions.
GovernorBourkeheldthatthepositionswereincompatibleandultimatelyresignedhisgovernorship ofthecolonybecausehissuspensionofRiddellasa memberoftheExecutiveCouncilwasnotupheldbyLordGlenelg,SecretaryfortheColonies,whohad merelydirectedthatRiddellshouldapologisetothe Governor.
In1841RogerTherrywasappointedacting Attorney-General,JohnHubertPlunkett,hisCatholic colleague,occupyingt.ieseniorpost.

In1843hewaselectedrepresentativeofCamden, defeatingMr.Cowper,inthefirstelectionsconducted fortheLegislativeCouncil,whichmetonAugust1, 1843.Mr.E.D.ThompsonwasColonialSecretary andMr.W.C.WentworthleaderoftheOpposition.
RogerTherry'snameislinkedwithanothercontroversialincidentinAustralianhistory.
In1838Therrywascounsel,withMr.Plunkett,in twotrialsofsevenwhitemen,involvedinthemassacreof28,possiblymore,aborigines,including children,ontheDangarpropertyatMyallCreek.
Thesevenmenwerefoundguiltyofamurder chargeandexecutedinthefaceofmuchcriticism andunrestinthecolony.
FromFebruary,1845,toFebruary,1846,Roger TherrywasResidentJudgeatPortPhillip,adifficult post.
"Hewasbound,"helaterwrote,"toextend,in hissinglecapacityofjudge,theprotectionofthe lawtoallpersonsinthecommunityandwashimself theonlypersonunprotectedbyit.
"Thejudgethusbecameatargetforallthelibpls withwhichanyunprincipledwritersthoughtproper tovilifyhim.Hisstatuswaslittlebetterthanthat ofbeingconsignedtoaconditionofindividualoutlawry."

InFebruary,1846,RogerTherrywasappointeda JusticeoftheSupremeCourtofN.S.W.,whichhad beenfoundedin1824.HebecamePrimaryJudgein Equity.
In1847hevisitedEnglandandIreland,andafter afinalperiodof12yearsinthecolony,retiredand wenttoEngland,wherehesettledpermanently.
In1863hepublishedhis"ReminiscencesofThirty Years'ResidenceinNewSouthWalesandVictoria," whichappearedinarevisededition-notanexpurgatededition,asissuggestedattimes-shortly afterwards.
Thoughinaccurateinsomerespects,his"memoirs" areanimportantsourcebookontheperiod1829to 1859.In1869hereceivedaknighthood.
SirRogerTherrydiedonMay17,1874.Hiswife died10dayslater,severalchildrensurviving.Heis oneofthemostimportantCatholiclaymeninthe historyofAustralia,andhisnameisonethatCatholicsshouldalwaysregardwithhighhonour.
