Vienna,July18-HisEminenceJosefCardinalMindszenty- forthepastsixandahalfyearsChristianity'snumberonemar- tyrofCommunism-hasbeenreleasedfromprisonbutnotrestoredtofullfreedom,accordingtoaHungarianradiobroadcast.

Thebroadcaststatedthat theHungarianregimehad "interrupted"theCardinal's confinementatthepleaof theHungarianBishopsand becauseoftheprelate's stateofhealthandadvanced age. ItstatedthattheCardinal-PrimateofHungary wouldbepermittedtoresideataplaceofresidence providedforhimbythe HungarianBishops.Thebroadcastindicatedonlya temporaryandqualifiedre- lease.

CardinalMindszentyhas beenthefocusofinternationalattentionsincehis arrestand"trial"bythe Budapestregimeoncharges of violationtreason,espionageand offoreignexchangeregulations.Hewas sentencedtolifeimprison- mentonFebruary8,1949.

Therewasnoimmediate confirmationfromChurch sourcesinBudapestthatthe Cardinalhadbeenreleased. ButitwaspointedoutherethattheHungarianBoardof Bishops,headedbyArchbishopJuliusCzapikof Eger,haslongbeennegoti- atingwiththeRedregime fortheCardinal'srelease.

Atthesametimeitwas pointedoutherethat,if confirmed,theCardinal's releasedoesnotnecessarily meanaretreatbytheHungarianregimeinitsper- sistentwaronreligion.It isnotedthattheideological offensiveagainstreligion hasactuallybeenintensiaed inrecentmonths.

Informedsourceshere pointtogreaterpressurethanever garianbeingputonHunparentstokeeptheir childrenfromtherestricted religiouseducationstillper- mittedintheschools.

TheRedannouncementof theCardinal'sreleasecame asthe"summit"conference oftheBigFouratGeneva wasabouttobegin.Itwas generallyregardedhereas aCommunistgestureofconciliationdesignedtoimpressthewesternleaders.

TheCardinalhaslong leenreportedinillhealth. Heissaidtohavebeen sufferingfromheartcomplicationsasaresultofa chronicthyroidConditionfor whichhereportedlyunderwentanoperationin1954.

Howeverarecentreport slatedthattheCardinal's conditionhadgreatlyimproved.Hewas63years (IdunMarch29thisyear.

Prayersforhisliberation havebeenofferedcontinuouslythroughouttheCatholicworldeversincehia imprisonment.Thestoryof hislongordealatthehands ofredinquisitorsandhis subsequentcondemnationat theendofa"showtrial" hasbeentoldinbooks,in Elms,onthestageandon television.

Sixotherdefendantswere triedwithCardinalMindszenty.Amongthemwastha Cardinal'ssecretary,Mar. AndrewZakar,whowas sentencedtoasix-yearimprisonment,andwasreleasedfromgaolinJune,

1953.Hehassinceresumed parishworkinBudapest.CardinalMindszentywas arrestedalmostthreeyears tothedayafterhewas madeamemberofthe SacredCollegebyHisHolinessPopePiusXII.

AlthoughHungaryatthat timewasnotundercompleteCommunistdomination,CardinalMindszenty experienced considerable difficultyingoingtoRome fortheConsistoryofFebruary18,1946.Heactually arrivedafterithadbegun,aboardtheaeroplaneofan Americanarmygeneral.

Fifty-sixyearsoldatthe time, hadCardinalMindszenty alreadyseentheinside ofaprison,havingbeenarrestedbytheNazisatthe closeofWorldWarII.

Hewasgarbedinhisfurl episcopalrobeswhenhe wasmarchedofftoprisonin retaliationforhisdeterminedstandagainstNazism.

Borninthevillageof CzehimindszentonMarch 29,1892,ofafamilyof pious,simplefarmers,Cardinal ordainedMindszentywas in1915,andconsecratedBishopofVeszprem inMarch,1944.Inthefall of1945,hewasmadeArchbishopofEsztergom,Hungary'sprimatialSee.

WhenhewasmadeaCardinalhisrelationswiththe newCommunist-dominated regimehadalreadybeen markedbycontroversies overagrarianreformthe banningofCatholicorgani-sations,theconfiscationof Catholicschoolsbythe State,andthecollectivisationofthefarms.

In1947theCardinalvisitedtheUnitedStatesand Canada.Onhisreturnhome theRedpropagandacam-paignagainsthimsharpened.

WhenRedinducements failedtosilencehisoutspokencriticism,especially ofthegovernment'splanto nationalisetheschools,the Communistsdecided to arresthim.

Duringtherecentnewspaperstrikein Sydney,"TheCatholicWeekly"madeits rotarypressavailablefortheprintingofthe compositedaily-"TheClarion."Below, theeditorgivesthereasonswhythiswas done.

Lastweekwehadrelativeslivingatourplace.

Theyweremembersof theAustralianJournalists' AssociationandthePrintingIndustryEmployees'Unionwhoworkonthepro- ductionofSydney'sfourdailypapers.

Whentheyweredismissedforrefusingtobreaka long-establishedtradeunion principle,theproprietors decidedtoproducea"composite"dailypaperwiththe helpofseniorexecutive officerswhowerenotinvolvedinthedispute.

Thedismissedjournalists aridprinters,togetherwith menandwomenwhohad been"stooddown,"forthwithdecidedtoproducea dailypaperoftheirown.

Theyhadtworeasonsfor doingthis.Firstly,they wantedthepublictoget thenewsoftheday;secondly,theywantedtousewhateverinfluencetheycouldto secureasettlementofthe disputeonjustandreasonableterms.

Thesetermsweresimply areturntoworkonthe conditionsexistingbefore thedispute,withnovictimisation.

Whenthejournalistsandprintersdecidedtoproduce adailypapertheyhadno resources,noofficeorprintingfacilities.

Theirownassetswere theirprofessionalskills, theircourage-andthetemporaryuseofapublictelephonebox.

TheCommunistPartyimmediatelyofferedtheuseof itsprintingplantandoffices,butthenewspaper employessdeclinedtheofferwiththanks.

Tohaveaccepteditwould haveputthemunderatremendousobligationtothe communists.

So,fromapublictelephonebox,arepresentative oftheJournalists'Associationcalledtheeditorof "TheCatholicWeekly"and askedfortheuseofthis company'srotarypress.

Thecompany'sdirectors consideredtherequestand, onbeingassuredthatthe menwerenotengagedin atny'illegalstrikeandthat thealternativewouldbeto leavetheafternoonnewspaperfieldfreetotheCorn-

munistParty,theygave theirThepermissionwillingly. AustralianWorkers' Union,whichprints"The Worker,"alsoagreedtocooperatebysettingupand printingpartofthenewspaper,whichwasgiven thenameof"TheClarion."

Thenthemenwentto work,andin12hoursflat thefirstissueof"The Clarion"wenttopress.

Itwascrazy,butitwas magnificent.

NoonelsebutAustralianworkerswouldhaveattemptedit.

Mechanicalproblemsthat wouldhavedauntedthe biggestandmostmodern' organisationinAustralia weresolvedasquicklyas theyarose.

Inthecircumstances,it mighthavebeenexpected thatsomehot-headed chargeswouldbethrown about.

Nosuchthinghappened.Thetoneofthenewspaperwascalm,soberandresponsible.Nopersonalabuse marreditscontent.Each editorialwasanappealto theproprietorsforaresumptionofworkineach ofthefouroffices.

Everymanon"The Clarion"workedvoluntarily andwithoutpay.Butnever wasthereahappieror moreenthusiasticstaff.

Forthreedaystheystay- edonthejobuntilthedisputewassettled.

backThenquietlytheywent totheiroldjobs.

Ourrelativeshaveleftus now routineandthequiet,orderly ofCatholicweeklynewspaperproductionhas beenresumed.

Buttwothoughtslinger.

TheproprietorsofSyd-ney'snewspapersshouldbe evergratefulthatthemen whoworkforthemare capableofsuchdevotionto principles,suchtremendous initiative,skillanddetermination.

Andthesecondthoughtisthis: Maythesewallsvibrate againtotheroarofarotary pressturningoutadaily newspaper-aCatholic daily,operatinginactive competitionwiththeexistingpapersandconducted inaccordancewiththe higheststandardsofmodernjournalism.

Patentlythatstatementdestroysthegroundon whichtheArchbishoprestshiscase.Ifthereis roomfordoubt,thenthecontraryviewmaybe correct.Itisnotsufficientmotiveforactionthat theArchbishop,howeverlearnedandholy,holdstooneoftwopossible"views."Foranotherprelate, equallygoodinhisperson,mightleantotheoptional opinion.AndnoChristiancanbeexpectedtobase hisconductonsomebody'spersonalpredelictions.

TheNewTestamentreadingsonthesubjectof divorce,eveniftakenaloneasaguidetomoral conduct,donotadmitofthealternativeinterpreta- tionputforwardbyArchbishopMoline.ChristOur Lorddidnotventureanervoussuggestiononthe subject.Hesaidplainlyandoutrightlythatwhoeverputawayhiswifetomarryanothercommitted adultery.Noexceptionisadmitted.Amanmay separatefrombedandboardforthereasonof unchastitybutremarriageisjustnotpossible.

Whatpuzzlesoneisthataprelatewhoisso"High Church"inhisoutlook,shouldseeminglyfallintothefundamentalisterrorofleaningonScriptureas thechiefsourceofguidance.Forifthereseemstobe anyambiguityaboutScripturaltextsthesurest meansofarrivingatcertainconclusionsisnotby exegeticalargumentbutbyreferencetothetradition oftheChurch.WhatdidtheApostlesandtheir earlydisciplesbelieveandpracticeinthematter?

Inthepresentinstancethehistoricalreference leavesnoshadowofdoubt.Thecontinuousunvary- ingtraditionoftheChurchisuncompromisinglyfor indissolublemarriage.Whatevervicissitudesbeset otherarticlesoftheChristianfaiththereisnomajor challengetotheteachingofChristonmarriagefor 1,500years.

WhenitcamewithLutherandHenryVIIIit emanatedasadenialofwhateveryCouncilofthe ChurchandalltheFathershadtaughtfromatleast thefourthcentury.Itwasheldasacertain,universalrule,anintegralpartoftheDepositofFaith andthePopeconsentedtoloseallEnglandbecause hecouldnotadmitofasingleexceptiontotherule ofindissolubleChristianmarriage.

Dr.MolinegoesontosaythatwiththesecularisationofmarriageandtheadmissionbytheStateof divorce,theChurchofEnglandhadtore-examine itspositionanumberoftimes.Ithadpermittedonly oneexceptiontotheruleofindissolubilityinthe LambethConferenceof1888.Thisdecisionwas, however,reversedin1908bythesamebody.

Butoneexceptionisonetoomany.Itisthe exceptionwhichruinstherule.Andinanycaseit4, issurelyremarkablethattheChurchofEngland shouldfeelimpelledtochangeitslawstosuitthe vagariesofthesecularStateifitslawsarereally Christ's.Andifitcanchangeitsmindonceona fundamentalquestionofChristianbelief,whynot again?Iftheissueofindissolublemarriageisdivine truthitmustnecessarilybeimmutable.

Whatismoretothepoint,however,isnotwhat theChurchofEnglandteaches-onenotesthatthe Lambethdecisionof1908wasarecommendationbutwhatitpractises.Onerecalls,withoutmalice, thataChurchofEnglandminister"married"the DukeofWindsor.Onewondershowmenofthe opinionsofthelateDr.BarnesofBirminghamand DeanHewlittJohnstonwouldregardthesuggestions ofLambeth.ItiscertainlypossibleforChurchof Englandclergymentousetheir"discretion," especiallywheretheissueoftheinnocentpartyis concerned.

ArchbishopMolinehasdonelesstoestablishthe needofindissolublemarriagethanhehastounderlinethesheerneedofanauthoritativeteachingbody toexpoundwithcertaintyandwithoutexceptions whatisthetruthofChristianity.Weak,pusillanimousguidanceisoftenenoughworsethannone. Menwillbreachdogmas,buttheywillscarcely consideritabreachiftheirconductconflictswith mere"views."IfGodhadnotestablishedanauthoritativeteachingbody,itwouldhavebeennecessary eventuallyformentoinventone.
