DuringtheweekthemembersoftheLegislative Assemblyagreedtothepassageofaprivatebillenablingamantomarryhisdivorcedwife'ssisteranda womantobemarriedtoherdivorcedhusband'sbrother.Onlyonedissientvoice-thatofDameFlorenceCardell-Oliver-washeardduringthedebateon legislationwhichisagrossaffronttotheChristian andnationalconscience.

ThesordidbusinesswasintroducedbyMr.Watts, leaderoftheCountryParty,onthemostcuriouspretext.Heisreportedassayingthattheprovisionsof thepresentproposedlawwereinadvertentlyomitted fromthe1948legislation.Wefeelfreetodoubtthis assertion,andtobelievethattheomissionwasmade soasnottojeopardisethepassageofameasurefurtherwideningthegroundsofdivorce.

However,evenifMr.Watts'explanationisentertained,itstillremainsdifficulttoseethenecessityof thepresentmeasureinviewofthelegalhistory,qwit- edfromareportoftheSolicitorGeneral,bytheMinisterforJusticeandMr.Watts.

OnSaturdaymorning,from10a.m.to12a.m.will Oct.17,thefirstofthealsoincludesomeinterestchildren's'programmeswilling"shorts"andcartoons beshownattheCapitolallofwhichprovideexceltheatre.Theventureis sponsoredbytheAdult EducationBoardwhohave alreadyinvitedmembersof interestedorganisationstoa previewofsomeofthefilms available.

Fromthefilmsseenat thispreview,atwhichrepresentativesoftheChurch andtheCatholicSchools werepresent,alivelyopeningprogrammehasbeen selected.Thefeaturefilm "CircusBoy"hasenough adventuretobeequally goodentertainmentforboys orgirlsandenoughordinaryeverydayrealismto makeitringtrue.

Therrysocietymembers heldtheirseconddayof recollectionfortheyearon Sept.20attheLoreto convent,Osborne.Once againthesocietyisindebted tothenunsforthegeneroushospitalitytheyofferedto membersofthesocietymakingtheretreat.

TheRev.R.J.McDonald C.M.conductedtheexercisesandspecialthanksgo tohimformakingtheday suchaworthwhileonefor theretreatants.

AttheNorthPerthhome ofMr.andMrs.P.R. Goerkeaneveningwas givenrecentlyforthedual purposeofraisingfunds forthecurrentTherryproductionandforpro- vidingaveryentertaining eveningforallpresent. Squaredancing,which roundedofftheactivitiesof theevening,wasverypopularwithyoungandold.

Thesocietyisnowplan-ningforitsChristmaspro- ductionanditiswiththis endinviewthatallmembersareaskedtoattend theirweeklymeetingto discussthevariousideasso farprojectedfortheChristmasplay.

Twonewclassrooms, measuring22ift.x24ft., havebeenaddedtotheexistingbuildingerectedin 1923whichhasbeenextensivelyremodelledand renovatedthusproviding twoclassrooms23ft.x 24ft.makingfourinall.

Onthenorthsideaverandah9ft.6inwide runsthewholelengthof thebuilding.Theverandah isenclosedateachend providingacloakroomfor bothboysandgirls.

Theclassroomsarewell lightedandventilatedand giveamaximumofcomfort toteachersandpupils.Accommodationhasbeenmade ultimatelyfor200pupils.

Sunday,Sept.27wasan occasionunprecedentedin thehistoryofSt.Jerome's church,Spearwood,when onehundredandfive(105) childrenandadultswere confirmedbyHisGracethe Archbishop,assistedbyRt. Rev.Mgr.J.J.Rafferty, Adm.,Rev.R.Boylan,and theRev.J.Chokolich,the parishpriest.

CongregationStands

Becauseofthesizeofthe congregation,andinorder thatallmightwitnessthe ceremony,theseatswere removedfromthechurch, andMass,Confirmationand Benedictionwereobserved, standingandkneeling,this factaddingtothesolemnity oftheoccasion.Itisestimatedthat500people gainedentrytothechurch,

ThatcontentionisthattheAdministrationofJustice(Divorce,etc.)Actof1863leavesadivorcedpersonfreeinthesamewayasifdeathhaddissolvedthe marriage.AnActof1876permitted,forthefirst timeinthisState,marriagewithadeceasedwife's sister.Thelegaleffectofthecombinationofthese measuresis,accordingtotheargument,identicalwith thelegislationnowbeforetheLegislativeCouncil.

Ifthiscontentionislegallysoundandpolitically honest,onemayenquirewhythepresentmeasureis necessaryatall.Ifcitizenshaveenjoyedthismonstrousrightforthepast75years,whylenditnowa confirmatorysanctioninlaw?

Whenonesurveysthedevelopmentofcivillaw duringthepast400yearsintheaspectofitsprogres- sivenegationofChristianprinciplesoneisstruck preciselybythegradualismofaprocessclearlydesignedtoconditionpeoplelivinginthepenumbraof theChristiantraditionforthepaganassaultsyetto come.

ThetruismisevenmorestartlingwhencontrastedwiththeEnglishscenewhere"reform"ofthissort isconstrainedbyvirtueoftheestablishmentofthe EnglishChurchandbythepoliticalpowerofthe LordsSpiritual.

Whenthenewspiritualestablishmentwasmade inEngland,the"reformed"Churchtookoverthe canonsoftheOldFaith.Inthismatterofthepro- hibiteddegreesinmarriagetheforbiddencategories ofaffinityweresetoutin1563,andaregiveninthe PrayerBook.TheEnglishlawof1835simplyadoptedthese,andupto1907itwasillegalforamanto marryhisdeceasedwife'ssister.Evento-daya manmaynotmarryhisdivorcedwife'ssister.

InAustralia,however,theprocessofmoral ecaywasaccelerated.InthisStatetheEnglishlaw ofthedeceasedwife'ssisterwasanticipatedbysome 31years.

TheprovisionsofthepresentBill,whilenot directlyprovidinganewgroundfordivorce,certainlyintroduceintofamilylifeaspeciesoftemptation whichpasttimesconsideredshouldnotevenbespecu- latedupon.

Everybodyrecognisesthatthereisacertainreverenceowingtorelativesandparentswhichisopposedtosexualintercoursebetweenthemeveninmarriage.

Ifnearrelationsareencouraged,astheycertainly arebytheproposedBill,tocontemplatemarriage. thewayismadeplainforpromiscuousimmoralityof amosthatefulkind.Inthesedaysofthehousing shortage,theissueisverypracticalandpressing, whenverymanyfamilieshavecloserelationsliving withintheirdomesticcircle.

Iftheseedofsuspicionisplantedandtheproximityofoccasionprovidedonthefamily'sveryhearth. awholefloodofunhappinessmaybeunloosed.The mutuallove,confidence,trustandrespectbetween bloodrelationsandthoserelatedinthefirstdegreeof affinitywillbeconstrained,weakenedandfinally brokendown.

DameCardell-Oliver'soppositiontothisunnaturalproposalistobeheartilycommended,asisthe constantendeavourtocheckthewideningofthe groundsofdivorce.Butitmusthavebeenastrange spectaclethatonlyonememberoftheHouseof41, andthatoneawoman,thoughtitnecessaryordesirabletospeakinthedefenceofmarriedlove,home life,thesanctityofthebond,andevenofnaturalaffection'However,inthevoting,eightmenlenttheir weight,unavailingly,towardsnegativingthemeasure.TheywereMessrs.J.Brady,J.Hegney,W. Hegney,Manning,May,Nalder,O'Brien,andBovell. ThisabominableBillisnowbeforetheCouncil, andonlypromptandvigorousactioncanbringabout itsdefeat.Inthis,asinsomanyothermattersnearlyaffectingtheChristianlife,itisatonceunphilosophicandaderelictionofduty,tocomplainafterthe event.Wedeemitaresponsibilityinconscience, andanimperativeoneatthat,forallCatholicorganisationsandindividualstoprotestwithoutdelayto theirparliamentaryrepresentativesagainstthismeasurewhichsomilitatesagainstthefamilyandthe home.

Howmanyofuscansay thatourliveshavehelped otherstoglorifyOurFather, or,inotherwords,have helpedotherstobecome ChristianandCatholic themselves?What,then, havewedonetohelpthe situation,exceptperhapsto growlaboutit?
