AsuitbroughtbyMrs.VashtiMcCollum,a32yearsoldmother,who callsherselfarationalistoratheist, seekstohalttheclasses,andisnow fordecisionbeforethethreejudgesof theIllinoisSixthJudicialDistrict. SupportersofbothMrs,McCollomand theChampaignSchoolBoard,defendantinthecase,declare,however,regardlessoftheoutcome,thecasewill beappealedtothenation'shighest court.

Testimonytakenduringafive-day trial,rangedfromexplanationsof varyingreligiousbeliefstodeclarationsthat"thereisnoGod."The latterassertioncamefromMrs.McCollum,her10yearoldson,James Terry,andherfather,ArthurG.Crowell,ofRochester,N.Y.

Atissueinthecasearevoluntary religiousclassesofferedinChampaing publicschoolsduringthelastfive years,underjointsponsorshipofCatholics,ProtestantsandJews.Each ofthethreegroupsprodidesthirty minutesofinstructionweeklytochildrenwhoseparentshavesignedcon. sentcards.Childrenarereleased fromotherclassesduringthereligious instruction,whichistaughtinschool buildings.

TheonlyCatholictotestifyatthe trialwastheRev.ClarenceJ,Higgins. pastorofHolyCrossChurch.Champaign,whoexplainedthatseparate classesaregivenforCatholicchildren. FatherHigginsdescribedtheteachingas"religiousandmoral."Ileemphasisedthattoleranceofotherbeliefs"isapartoftheCatholicreligion."

MostofMrs.McCollum'sfirewas centredontheProtestantclasses.To establishherclaimsthattheclasses violate"freedomofreligion"provisions ofStateandFederalconstitutions,and are"sectarian,"herattorneyinterrogatedthereligiousteachersatlength onthesubjectmatteroftheirclasses.

Thenhecalledrepresentativesofthe Presbyterian,Methodist,Lutheran, ChristianScience,Unitarian,andsocalled"non-denominational"churches tocomparetheirbeliefswiththeteachings.ARabbialsowasquestioned. Religiousteachersinsisted,however, thattheymerelytell"whattheBible says,"anddonoturgeparticularbe. liefsonthechildren.

TheSchoolBoard'sattorney,John I.,Franklin,presentedadozenother studentstotestifytheydidnottake religiouseducationandhavenever beenembarrassedbyit.Thosewho knewJamesTerrysaidtheynever heardanyone"tease"himabouthis disbelief. NoEmbarrassment.

Inclosingarguments,Franklincontendedthatthedecisionwhetheror nottheMcCollumboywouldtakereligiouseducationsubjectedhimtono moreembarrassmentthana"Catholic childwhopassesupmeatintheschool cafeteriaonFriday."

Asthecasewassubmittedtothe threejudgessittingenbane,Mrs.McCollum'sattorneydeclared:"Whenwe begintoletchurchesusepublicschool funds,wearelettingthemfeedoutof thepublictrough.Likepigsata troughthelittlechurcheswillbe crowdedoutbythebigones,and eventuallywewillhaveonlyone churchleft.Thenwewillbeback tothedarkageswithaunionof ChurchandState."

Franklinconcludedbydeclaring Chapman'sanalogy"badtaste,"but, hedeclared:"Thisisacornbeltcounty whereweknowlittleaboutatheists andmuchabouthogs.Weknow thatwhenpigsarefedatatrough,one alonedoesnotgetfat.Theyalldo.

Soifwemustusethisanalogy,wesay,'Letthemallgrowfatatthe troughtogethep.'"

AlliesRespectVatican ConcordatwithGermany

"ThetermsoftheConcordatof1933 willberespectedbytheoccupying Powers,andwillbestrictlyobserved," sassRegulation5900.ofthe"WrittenLawsforGermany,"thatgovern theadministrationoftheAmerican zone,aspartofthemanualformilitary governmentofficers.

SincetheGermanHierarchyhadexpresseditsdesireattherecentFulda ConferencethattheConcordatconcludedwiththeHolySeein1933remaininforce,thereappearstobefull agreementbetweentheGermanCatholicBishopsandtheAmericanoccupationalauthoritieswithregardtothe applicationofthisbasicdocument.

AActually,accordingtothelaw,a personmaynotobtainadecreeofdivorceonthegroundsoffiveyears' separation,whohasbeenguiltyof adulteryorothermatrimonialcrime duringthattime.

But,leavingthataspectaside,there arestillobjectionstodivorceonthe groundsmentioned.

Firstofall,tothosewhodonot countenancedivorce,suchastheCa tholicChurch,thisreasonfordivorce isobno,;olisongeneralgrounds

Secondly,itmeansawideningofthe groundsfordivorce,whichis°Heetionableeventomanywhodocountenancedivorceincertaincircumstances. Furthermore,thereisanotherstrong objection.Itisthis:Incompatahility isvirtuallyadmittedasareasonfor divorce.Thismightnot,perhaps,apnearatfirstsight:butthatitissous shownbyananalysisoftheproposed

Butheisfirstandforemostanaboriginal.Heisconversantwithandobedienttohistriballawsandcustoms. ConcerningtheprimitivepeopleofCentralAustralia,Mr.Mountford,whohas livedamongthem,hasthistosay:

"Theyareapeacefulfolk.Organistedwarfare,withitsattendanthorrors anddesolation,doesnotformpartof theirculture.Andbecausethereare noarmiestolead.therearenochiefs orkings.Thepowerofthetribeisin thehandsofthewell-informedoldmen, notthepsysically-activeyouth.

Albert,asheisgene-rallycalled,was skilfulatanumberofoccupations fromhisearlydays.Hisartisticsense manifesteditselflongbeforehelearnedtherudimentsofartintheEuropeanstyle.Hisfirstdrawingsand carvingsexhibitbothaflairfordraftsmanshipandanaturalabilityfordecorativedesign.Buttheturningpoint inhiscareerwasreachedwhen,with somethreehundredothernatives,he witnessed,atHermannsburgMission Station,anexhibitionofthepaintings ofRexBattarbeeandJohnA.Gardiner.Thesubjectsofthepaintings weremostlystudiesoftheMacdonnell Ranges,andthetwoartistsfaceda severetestinsubmittingtheirwork forinspectionbypeoplewhowerethe naturalinhabitantsofthecountrydelineated.Theypassedthetestwith flyingcolours.

TheimmediateresultoftheexhibitionwasthatAlbertaskedtheMission Superintendenttobuyartist'smaterbialsforhim,sothathecouldpaintlike thewhiteman.Longbeforethematerialscametohand,however,Messrs. BattarbeeandGardinerhadle-ftthe district,andafterafewunsuccessful attemptsonhisown,Albertputaway hispaintandbrushesanddevotedhis energiestoseekingoutthebestspots forBattarbee'spictureswhenthatartistshouldreturn,ashehadpromised.

Mr.VaughanHanly(violinist)and Mr.RichardWatson(bass)werethe artists,whileMrs.DorisTylerprovided outstandingaccompanimentsforboth. Theprogrammewascarefullyselected, sothat,whilenothinginferiorwasoffered,thesimplicityotheclassicschosen, combinedwithlEcidexplanations, broughtthemusicwithinthegraspof theleastadvanced.

Mr.Hanly'smostinterestingcontributionwasthefinalmovementfrom Mendelssohn'slovelyConcerto.Even withthememoryefMenuhein'srenditionofthesameworkinPerth,Mr. Hanlyacquittedhimselfadmirablyof adifficulttask.Hislegatoplaying wasanespecialdelight.Thenthere wastheSonatabyTartini,whoischieflyknownamongusforhis"Devil's Trill." 1hankstoMr.Hanly'sremarks,onewasabletofollowthis beatitifolly-roundedcompositionwhich heplayedwithgreatfeelingandadmirabletechnique.Theevergreen "AveMaria,"bySchubert,andthe well-knownRondowithitsrecurring themeinvariationswerewellreceived. Kreisler's"PraeludiumandAllegro" wasontheweightiersideandnotable

foritsdemandsontheplayer'sprowess withthebow.AsanencoreKimskyKorsakov's"BumbleBee"wasneatly performedandenthusiasticallyreceived.

The,Adelaidebass.Mr.Watson,providedaveryvariedandinterestingprogramme.Hisfirstgroupofexcerpts fromVerdi'searlyoperaswasinthe natureofsamplesofItalianlyricism, notedforclassicrestraint.Perhaps theoutstandingsongwasSchubert's famous"Wraith,"withitsslow,majesticmeasure.Ourenjoymentofthis andoftheothernumberswasenhancedbytheprovisionoftheEnglish wordsinadvanceThepopular"LindenTree"wasalsorenderedandshowedoffMr.Watson'srichtonesanddistinctenunciationexcellently.

Tchaikovskywasrepresentedby "TotheForest"and"NoneButthe LonelyHeart.'Theformerwasmagnificentlyinterpretedandsuitedthe truerangeofthebassvoicetoperfection.Thelatterwasofintensepoignancy,beingasnotal-lefortheaccompanimentasforthemelody.Loewe's "Edward"wa=somewhatspoiled,asremarkedinotrierreviews,bytheprematuredisclosureofthedenouement. Butapartfromthat,itseemedtolack thedramaticinsightandforceofTibbett'sinterprhtation.In,Gounocrs "Mephistopheles'Serenade"Mr.Watsonwaswellsuitedindeed,andgave avividperformance.Thepopular "SimontheCellarman"concludedthe programmeandleftanimpressofa versatileandpolishedartist.

InconnectionwiththediscussionsoftheAustralianTeachers' Federationregardingtheeffectoffilmsonchildren,itisopportune torecallwhattheLeagueofDecencyhasdonetowardssuppressingtheuseofthescreenasamediumofimmoralpropaganda.The cinemareallystandsinmodernlifeforwhatfolk-literaturestood inthepast.Itisthechiefpopularformofentertainment,but withthisdifference,thatthemodernsonlywatchtheentertainmentinsteadofmakingit.Thisalsoappliestoorganisedsport andtosomeextentexplainsitsgradualdecayintoawelterofprofessionalism.Thesetwoimportantfunctionsofmodernlifeare, however,"faitsaccomplis,'andthoughtheyarecertainlypoorsubstitutesforwhatprecededthem,theonlypracticalattitudeisto makethebestofthemandtoensurethat,sincethepublicdepends uponanexpertminorityfortheirentertainment,thatminoritydoes notimposeuponthemideasthataresubversiveeitherofChristian doctrineormorals.Nowthescreenmagnatescertainlyranamok untiltheLeagueofDecencyremindedthembyanattackontheir solevulnerablepoint-theboxoffice-thatthereyetremainedin theworldtheideaandtheidealofdecency.andthatthepeople withalittleencouragement,insteadofadeliberatelyorganisedopposition,andthegraceofGod,wouldstrivetoreachthoseessentialheights.

WeconsiderthattheLeagueofDecencyhasachieveditspurpose,thatthepreponderatingmajorityofrecentfilmshasbeen notmerelynegativelyacceptable,butevenhelpfultoChristian ideals.Linharpily,throughlackofeducationandcontamination withthenon-Cathoiiccultureandphilusuphy,someCatholicsremaininfectedwithatouchofPuritanismwhichbreaksoutinthe directionofbanningtheuseoftheimmoralasafoiltothemoral. SomehaveimaginedthatitwastheaimoftheLeagueofDecency todemandthetotalsuppressionoffilmswhichtreatedofn.aritial infidelityandpassionandcrimegenerally.Thisisnotso.That Catholicobjectionagainstthesethemeswasprimarilyagainsttheir treatment.Afilmwhichattemptsto,justifyadultery,forexample, isimmoral.Butthemerefactofthesinofadulterybeingthe themeofa"picture"isnotnecessarilyevil.Recentfilmshave tendedtodemonstratetheultimateunhappinessresultingfromthis sin,andinthiswayservetheveryusefulandmoralpurposeofgivingthepublicatruerealismwhichstripsfromsinthefalseglamour withwhichtheolderfilmssurroundit.

Thecinema,asthechiefformofpopularentertainment,ishere tostay.Itwieldsaverysignificantinfluencewhich,Catholics cannotaffordtoignore.Itisnecessary,then,thatCatholicsbe quitesureofwhattheywantandofwhattheyobjectto.Wedo notdemandamerelynegativetypeoffilmwhichcompletely avoidsthetreatmentofmoralmatters.Muchoftheimperishable inartandliteraturehasfounditsinspirationinsuchthemes.In theNewTestament,forexample,fewincidentsaremorehumanly movingthantherepentanceoftheMagdalenorChrist'sdefenceof theadultressagainstthehypocriticalPharisees.Wherethemoralityorimmoralityisconcernedisinwhatimpressiontheproducer leavesonthepublicmind.Ifitdoubtsordeniesvirtue,orit praisesvice,wehavecauseofcomplaintandtheweaponofdefence isinourhand.Thereisanothermatter.WhileCatholicsdonot demandthatpicturestreatofreligiousthemes,whentheydoso theyshouldtreatthemintelligently.Someportraytheinnocence ofmaidensasasortofanaemicignorancecompletelyincompatible withnormalenjoymentorexercise.Inthesemattersourquarrelisnotsomuchwiththemoralityoftheproducersaswiththeir commonsense.Letthemrememberthatchastityisnotsomething colourlesslikewater,butsomethingpositive,strongandrichlike wine.Chesterton.wefancy,claimedthatitssymbolwastherose farmoreappropriatelythanthelily.

Themajesticappearanceofthemale lioniscrownedbyagreatmane,sometimesblackbutalwaysdarkerthan thetawnyskin.Addedtothatithas themoststupendousvoiceinnature; itsground-shakingroarsunnerveanimalssothattheyareincapableof flight.

Theevening'sprogrammebeganwith racesforthekiddies.Thesewere underthecapable-directionofMessrs. Dunne,O'Connor,H.DunneandHilton.Hereallrunandallreeciveda prize.Aftertheracesicecreams, cakes,drinks$andlolliesweredispensed underthedirectionofacapableladies' committeedirectedbyMrs.Dunneand Mrs.Hilton.Thenfollowedthehighlightoftheevening,whenthechildren gatheredaroundthemonsterChristmas treeplantedbyMr.Dunnemanyyears ago.Thiswasladenwithbeautiful presents,mostofwhichwerevaluable andusefulbooks.Hereagainallgot aprize.
