TheStateisNotAboveMoralLaw
ThefollowingisthetextoftheJoint StatementissuedrecentlybyArchbishopBeovicb,theAnglicanPrelateRt.Rev.B.P.Robin,andthePresidentoftheCouncilofChurches-the Rev.J.C.Hughes.
Thecrisiswhichconfrontstheworld transcendsallpolitical,economicand militaryconsiderations;itisessentiallymoralandspiritual.Whatisat stakeisnothinglessthanthemaintenanceordestructionofthefundamentalprinciplesofChristianityas controllingidealsinthelivesofpeopleandnations.
Therefore,withoutcompromiseof anythingdistinctiveinourrespective doctrinesweareinfullagreementregardingthenecessityofstatingand applyingtheprinciplesofChristianity insuchawayastosecuretheireffectiveinfluenceinthehandlingofsocial, economic,andcivicproblemsbothnow andinthecriticalpost-warperiod.
Weareconvincedthatthewarought nottoberegardedasanisolatedevil.
Ratherisitonesymptomofadeepseatedmaladyreachingtothevery soulsofmenandsocieties.Thismaladymaybebrieflydiagnosedasa widespreadandgrowinglossoffaith intherealityandcharacterofGod andthetruenatureanddestinyof man. ChristianPrinciples.
Webegin,therefore,withasummaryrestatementoftheseChristian principles:-
GodistheCreatorandSustainerof allthings:Heisalsotheuniversal FatherandLord.AllmenareHis childrenandunderobligationtolove andobeyHim.Itthereforefollows that
(1)Theprimaryrelationshipofhuman lifeistoGod.
(2)Theprimarypurposeofhuman lifeisthatforwhichGodmade it.
(3)TheprimarylawofhumanWeis thatlaiddownbyGod.
Wethereforedeclarethatnosocial structurecanendure,andnonewordercanbeeffective,whichisnotconsciouslybasedonandcontinuallyrelatedtothesethreefacts.
TherelationofmantoGodcanbe maintainedonlybythefulfilmentofa twofoldobligation
(a)Adoration,praise,andreverence forGod.
(b)Obediencetothepurposeandlaw ofGod.
SincemenarechildrenofGod,and, therefore,brothersoneofanother,this obligationofworshipandobedience requiresbothindividualandcorporate expression.Thesocialexpressionof religioninworshipistheessentialbasis ofthesocialrelationshipsoflife.Since thisobligationtranscendsallother loyalties,theState,intheinterestof itsownstability,mustencourageand protectitscitizensintheirfulfilment ofthefirstlawandrightofhuman life.Itmustrecognisethatreligious freedomisthefoUndationofallfreedom.
ThePurposeandLawofGod.
Fromthisprimaryrelationshipof mantoGodarisethethreerelationshipsofmantohisfellows:-
(a)Asamemberofthefamily.
(b)AsamemberoftheState.
(c)Asamemberofthewholefamily ofnations.
InalltheserelationshipsGod'spurposefortheworldistheunitingof allmankindintooneorganicBodyin theunityofHisSpirit.Thispurpose isachievedonlywhenallsocialrelationshipsarecontrolledbytheLawof GodcontainedintheScripturesandset forthintheTenCommandmentsand, aboveall,inthelifeandteachingof OurLordJesusChristtheSonofGod. Tothislawtheconscienceofman hearswitness.Thislawistheulti-
Fromtheprinciplesalreadystated certainsocialobligationsinevitably arise.Theindividualhasobligations asparentandchild,asacitizenof theStateandasamemberofthe largerfamilyofmankind.Heis boundtorespectthelife,personand propertyofhisfellowmenofevery socialpositionineveryraceandnation,tobehonestandtruthfulinall hisdealings,togiveajustreturnin workorgoodsormoneyforvaluereceived,tocontrolhisappetitesinrespectoffoodanddrink,tousehis sexualpowersandimpulsesonlywithin thebondofmarriage,toobeyjustly constitutedauthority,andtoexerthis influenceinfavourofhonestadministrationandtheattainmentofsocial justice.

Werejectthedoctrinethatthe Statecanbeabovethemorallawor exemptedfrommoraljudgments.
Manhasaninherentrighttofreedom.Hehasarightalsotohold suchprivatepropertyasmaycontributetothefulnessofhispersonaland ,ociallifewithoutimpairingtherights ofothermen.
ItisthereforethedutyoftheState ti,respectanddefendthefreedom andrightoftheindividualtolivein accordancewiththelawofGodinrelationshipwithhisfellow-menandto controlandrestrainhimonlywhere heisindangerofinfringingthesame rightsinhisfellow-men.
ItisthedutyoftheStatetotake measurestoabolishgraveinequalities inwealth,toprovideequalopportunitiesofmoral,mentalandphysicaleducationforeverychildandtoassistin securing,subjecttotherightsofconscientiousobjectors,thatalleducation shallbebasedonitsonlytruefoundation,theChristianreligion.
ItisthedutyoftheStatetosafeguardthefamily,whichisthedivinelyordainedbasisofhumansociety,to upholdthesacrednessandpermanence ofthemarriagebondandtoencourage theraisingoflargefamiliesunderconditionsofeconomicsecurity.
ItisthedutyoftheStatesotoregulateprivateenterpriseandtheconditionsofcommerceandindustryas tomaintainthedignityoflabour, whethermentalormanual,toensure itsjustrewardandalsothatcondi-
tionsoflabourshallnotbedetrimentaltophysical,mentalandmoral health.
ItisthedutyoftheStatetorecognisethatthenaturalresourcesofthe StateareGod'sprovisionforthe needsofthewholecommunityandto seethattheseresourcesaredevelopeel, butnotabusedordestroyed.

ThelawofGodisbrokenif:
(a)TheStateinfringesman'srightto T' God.
(b)TheStatewhollysubordinatesthe individualorthefamilytothe State.
(c)TheStateallowsindividualsor groupstoexeroisepowertothe detrimentofindividualorcommonrights.
TheLawasBetweentheNations. Nopermanentpeaceispossiblebetweennationsunlesstheprinciplesof theChristianreligionaremadethe foundationofinternationalrelations aswellasofsociallife.
WeacceptthefivepointsofPope PiusXII,ascarryingoutthesaprinciples:-
1.Theassurancetoallnationsof theirrighttolifeandindependence. Thewillofonenationtolivemust nevermeanthesentenceofdeathpasseduponanother.Whenthisequality ofrightshasbeendestroyed,attacked orthreatened,orderdemandsthatreparationshallbemade,andthemeasureandextentofthatreparationis determined,notbytheswordnorby thearbitrarydecisionofself-interests butbytherulesofjusticeandreciprocalequity.
2.Thisrequiresthatthenationsbe deliveredfromtheslaveryimposed uponthembytheraceforarmaments andfromthedangerthatmaterial force,insteadofservingtoprotectthe right,maybecomeanoverbearingand tyrannicalmaster.Theorderthusestablishedrequiresamutuallyagreed organicprogressivedisarmament,spiritualaswellasmaterial,andsecurity fortheeffectiveimplementingofsuch anagreement.
3.Somejuridicalinstitutionwhich shallguaranteetheloyalandfaithful fulfilmentofconditionsagreedupon andwhichshallincaseofrecognised needreviseandcorrectthem.

Justastheworldisaccustomedto showmarksofesteemtoitsgreat statesmen,generals,poets,inventors, etc.,soitislawful,praiseworthyand meritorioustohonouranyonewhom weknowwithcertaintytohavedied inthegraceandfriendshipofGod TheChurchencouragesCatholicsto praytoOurLadyandtheSaints,providedthereisnothingobjectionable intheformofhonourpaidtothem.

ThefactthatsomeCatholicsofthe Basqueprovinceswereinacertainway alliedwiththeRedsprovesnothing againstthegeneralcharacterofthe war.ThosemisguidedBasqueSeparatistscommittedagraveerrorbyal'lowingafewirresponsibleleaderstoimposeuponthemamonstrousalliance withtheswornenemiesoftheirreligionandoldcivilisation.Theydisobeyedtheirbishopsandtarnishedthe glorioustraditionofagenerousand mostreligiouspeople.

Notlongagoafriendofmineasked meifIhadreadDon,Madariaga'sbook on"Spain."Inthecourseoftheconversationmyfriendtoldmethata friendofhis,wellcultured,endowed Withasoundjudgment,andoccupyingahighposition,fullyagreedwithMadariaga'sviewsabouttheCivilWarin Spain.Well,tosaythatIwasthunderstruckistosaytheleast,butmy notionsofsoundjudgment,logicalperceptionandcriticalknowledgesuffered aterribleandshamefulconvulsion.
DonMadariaga'sbookisnicelyprinted,extremelyexpensive-Ipaidtwo guineasforit-butisisgoodonlyfor lightingthefire.

MadariagapraisesRightandLeftand atthesametimereproachesthemfor sacrificingtoomuchbloodtotheir ideals.Theidealiststatesman,after drivinghispoorcountrytowarand ruin,doesnotnoticethatitisutterly unjusttoapplythesamestricturesto theincendiariesandgangstersaswell astothedeefndersofreligion,family andcountry.Hetriestoaccomplish theimpossible:hetriestocompromise. TherecanbenomistakeforinHisinfinitewisdomandtruthOurLordhas saidplainlyandmostemphatically: "Nomancanservetwomasters.For eitherhewillhatetheoneandlovethe other.orhewillsustaintheoneand despisetheother."
Thesecondbookisentitled"Freedom'sBattle,"writtenbyAlvarezdel Vayo.Thewholebookisatravesty iiihistory."VayoisaCommunist, though,likemanyCommunists,hedoes notweartheredstaronthelapel,"says hisfriendandadmirer,Madariaga.And inanotherplace:"Vayo,thechief CommunistagentinsidetheSocialist Party,inco-operationwithCodevila, theagentoftheComiterninSpain,had succeededinunifyingtheCommunist YouthsandSocialistYouths,both Marxistorganisations."Andagain, "SenorAlvarezdelVayowasmoreover atthetimeGeneralCommissarforthe army,apointwhichshouldbenoted, sincehehadbeenforyearsthechief agentofBolshevisminSpain?'I hopethisisenoughtojudgetheman andhisbook.
Butinspiteofallthemaliciouspropagandascatteredallovertheworld, Catholicsshouldnothaveanytrouble infindingoutWhichpartywasright andwhichonewrong.
Theecumenicaltestimonyofthe Spanishbishopsandallthebishopsof theworldshouldbeasureguidancein thismatter.
ThisworldadherencetotheSpanish Hierarchywasnotapurematterof courtesyoramarkofcondolencefor thedamagessustained,oranauguryof peaceandtriumph.ItwastherecognitionofthejusticeoftheNational Movement,whichwasnotarebellion againsttheconstitutedAuthorities,but apatrioticmovementagainstthemost tremendoustyrannies,outragesandinjustices,absolutelynecessarytosafeguardthemostsacredthingsofthe Spanishnation-faith,civilisation, morals,science,art,traditions.
Theyacknowledgedtheuniversal transcendencyoftheNationalistcause forChristiancivilisation.Itisevident.Leninhassaidit:"FirstRussia,thenSpainafter...."
Inprescribingforthefaithfulthe lineofconducttheyhadtofollowin thiscase,andthelike,theecclesiastical authoritydoesnotgobeyondits spiritualfunction,doesnotmakepoliticsdoesnottrespassthelimitsofits competence;itonlyfulfilsitsproper missionwhichconsistsinwatching overtherightsoftheChurchandthe welfareofsouls.
Whatis,then,theobligatoryattitudeofallCatholicsbeforetheuniversalandconclusivetestimonyofthe CatholicHierarchy?
PiusXIforbadeallcompromisewith Communism.TheHierarchyofthe wholeworldrecognisesthatNational SpainstatestheprincipleoftheuniversalstrugglebetweenChristiancivilisationandRedatheism.Consequently,fromthepointofdiscipline, CatholicscannottakesideswithRed SpaininalliancewithCommunism.
Moreover,thecommunionofprinciplesmanifestedbetweentheSpanish bishopsandthoseofthewholeworld hasadogmatictranscendency.There isinthiscaseanextra-conciliarconsensus,morallyuniversal,thatdefines adoctrine.Thereforetothinkthatit ispossibletodefendtheprinciplesof RedSpainistoactagainsttheconsensusoftheuniversal,teaching Church.
Thisarticlewouldbeincomplete withoutsayingafewwordsaboutthe leaderoftheCrusade,GeneralFranco.

The1943SpeechNighta6theChristianBrothersHighSchool,Highgate, washeldintheParishHallonMondayweeklast,inthepresenceofa crowdedaudience,includingseveralof theclergyandChristianBrothers.Very Rev.FatherWallace,Adm.,presented thetrophies,andwassupportedin hisremarksbyPresidentWalter Dwyer.Priortothedistributionof prizes,adelightfulmusicalprogramme underthedirectionofRev.Brother Collopywassubmitted,consistingof choral,dramaticandmusicalitems. Alltheitemswerethoroughlyenjoyed bytheaudience,andshowedunmistakeableevidenceofthehighmusical andculturalstandardprevailingamong thepupils.

Entertainmentsfortheyearwere broughttoaddsebyaFeteheldin theSchoolontheeveningsof16th. 17th.,and18th.ofthismonth,and eventhoughitnecessitatedagreatdeal ofwork,theeffortsofthepeopleconcernedwerewellrewardedbyhugesocialandfinancialsuccess.
TheChildrenofMary"hightea,"held onSunday,December19,wasavery jollyaffair,andalthoughsocialactivitieshavebeenveryfewduringthe year,theoldcrowdralliedaroundfor thewind-up.
WewishtoconveytoMrs.V.Egan oursinceresympathyinthelossofher husband,'whowasaccidentallykilled afewweeksago,andtohissorrowing family,whoalsowillfeelhislossagreat deal.R.I.P.

FortheCatholic,themidnightMass atChristmas,andeveryMassforthat matter,istheIncarnationonceagain, andthechurchinwhichhekneelsbecomesanotherBethlehem-another "houseofBread,"fortheChristwho comesonearthagain,comesthistime hiddenbeneathawaferofbread.
ThatiswhatChristmasmeansto'a Catholic-somethingmorethanjusta longsleep-in.

TheannouncementoftheestablishmentinMexicoofaSpanishSupreme CouncilstatedthatitwasforthepurposeofconsolidatingSpanishMasons whoarerefugeesinthevariousAmericanRepublicsandthateightformer membersoftheCouncil,nowinMexico,willconstitutethenucleusofthe newCouncilwhichhastheapprobation andsupportofMexicanMasons.

WhileLegionariesgenerouslydoall intheirpowertosowtheseedsofgood, theydependabsolutelyonMaryfor thegracesthatalonecangivetheharvest.
"ToJesusthroughMary,"then,has everbeentheinspirationofthegreatestsaintsandapostles.Itisthe strongbattlecryofMary'sLegiontoday.Popesanddoctorsandsaints havetaughtusthatsuchisGod'sPlan. WhetheryoupraytotheFather,orto theSon,ortotheHolyGhost,ora Saint,itisalwaystobeprayerin unionwithMary.Sherepeatsthe wordswithyou.Herlipsandyour lipsformthewordstogether,andin everythingshehasapart.Thusshe isfarmorethanatyouside.Sheis, asitwere,inyou;yourlifeisyouand shetogethergivingtoGodallyou jointlyhave.
AlwayswilltheLegionarybearin mindthatheisvisitingnotasasuperiortoaninferior,notasoneequal toanother,butasaninferiortohis superior;forineachoneworkedfor thetrueLegionaryseesandserves Christ.IthasbeensaidthatthespecialgloryofCharityistounderstand others.Thereisnogreaterneed,in thissadworld,thansuchagift.For themaiorityofpeopleseemtosuffer fromasenseofneglect.Theyareunhappybecausenobodytakesthemin hand,becausenobodyisreadytoaccepttheconfidencestheyoffer.
OnlyononeofHiscreatureshas Godconferredapowerborderingon theOmnipotentandtheuniqueprivilegeofattainingthehighestperfection thatahumanbeingcouldpossibly reach.ThatcreatureisMaryImmaculate,inwhosehonourwearegatheredhereto-davandunderwhose mightystandardweserve.Thoughit ispossibleforGodtoformacreature moreperfectthanMary,forwithall hergreatprivilegesshewasstillbut acreatureandfinite,andthepower ofGodisinfinite-stillitwouldbein acertainsenseimpossibleforGodto raisehertoahigherdignity.TheattributesofGodareinfinite;acreature isabsolutelyincapableofpossessing them.Bethatcreatureeversohigh andholyandexalted,itmustforever remainacreatureand,therefore,it musthe,forever,infinitelyinferiorto God.Therefore,itisthatbetween GodandtheBlessedVirginthereis aninfinitythatcanneverbespanned Herholinessandwisdomandpurity comparedwiththeholinessandwisdomandpurityofGod,arenomore thanadaycomparedtoeternity,ora

ThespiritoftheLegionisthespirit ofMaryherself.Thisisasublime thoughtand,therefore,worthyofour mostseriousconsideration.Ifdoctrinewithoutpietyhasnowarmthand littlepowertosanctify,soneitherwill pietywithoutenlightenedandsolid doctrinehavethestayingpowerfor one'sownspirituallife,norforcenor efficacyfortheapostolate.
TheessenceofLegionworkisitsdesiretoreacheveryindividual,not merelytheneglectful,notalonethe HouseholdoftheFaith,notonlythe poorordegraded,butall.Itistobe emphasisedthattheeffectingofreal andlastinggoodcanbehopedforonly astheresultofintensivevisitationdirectedtowardstheestablishingofa bondoffriendshipbetweenthevisitors andthevisited.TheLegion'smethod ofparochialvisitationisnotsomuch amanpowerraid,orareconnaisance,as thequietandconstantworkofaresidentfifthcolumnforGod.Touse OurLord'sownmetaphor,itisaleaveninthecommunityraisingallits memberstonew,highlevelsinthe spirituallife.Thisisnoeasyor quickwork.Propervisitation,done accordingtotheschemeandinthe truespiritoftheLegion,isslowbut steadyeffort.
Thepriest,whohasnotonlythe -welfareofhisparishatheart,butalso arightunderstandingoftheLegion ofMary,willstress,repeatedly,this principlewhichisthebeginningand theendoftheLegionapostolate.Patientlyandwithgreatperseverancebe willstrivetodevelopthisspiritoftrue charityineveryLegionaryunderhis direction.liemayhavesomefailures andhisshareofdisappointments.Some Legionarieswillnotalwaysliveupto thehighidealshesetsbeforethem, and,asaresult,thewholeLegionmay tobearthebruntofthecriticism whichsuchindividualfailuresarouse. Thetoastofthe wasSocproposedbyBro.T.Burke,M.H whosaid heregardeditasagreathonourtoproposethetoastoftheHibernianSociety.Ithadsprungfromahumble beginning,andhadgrowntothesize astheyknewthatday.Itsthree separatefunctions-thereligiouswelfareofitsmembers,theireconomic welfare,andtheirsocialwelfare,were definitelyinterwoven.Thedemonstrationthatmorninghadprovedthat thefirstofthesehadnotbeenforgotten;itspositionto-daygaveproofthat theeconomicwelfareofitsmembers hadbeenjealouslyguarded;andthose attendingthatCommunionBreakfast andthesocialeventsconductedbythe Societyknewtheextenttowhichthe socialaspecthadbeendeveloped.He congratulatedtheSocietyonitssuccessgenerally,andwisheditacontinuationofthatsuccess.
TheGrandSecretary,Bro.Edwards inresponding,heartilycongratulated Bro.Burkeonattaininghishighambition-electiontotheHouseofRepresentatives.AlthoughthisSocietywas non-political,itwasnaturalthatthey shouldrejoice.whenoneoftheirmembersattainedsuccessinthepolitical field.Afteranappealtothememberstocarrytheirenthusiasmaway fromthisfunctionandapplyittothe activitiesandmeetingsofthebranches,heintroducedBro.LeoO'Connor, whoalsorespondedonbehalfofthe Society. ,BrotherO'Connorwasgreetedwith applaute.HesaidthatwhenhearrivedinthisStatehehadnoideathat hewouldhavethepleasureofattendingsuchafunction.HecongratulatedBro.Burkeonhiselectiontothe FederalParliament.Hisspeechthat morningwasacredittohimself,to Australia,andtotheHibernianSociety,fromhisassociationwithwhich hisdebatingabilitywas,tosomeextent, attributable.Hejoinedwith theotherspeakersinofferinghiscongratulationstotheLordMayoronhis re-electiontothathighoffice.Hepaid atributetothebeautiesoftheCity ofPerth,andcommendeditscontrollersintheirforesightinsettingaside thesplendidKing'sParkandtheriver foreshore.Theyhadcertainlydone agoodjobinthematterofParkreservations.Hecongratulatedthe membersonthegreatsuccessofthe function,andhewasverypleasedto heartheremarksofHisGraceinrelationtotheSociety.Onhisreturnto Queenslandhewouldtellhisfellow.

TheSociety,byitsdemonstrationthat morningsuggestedaneworderbased onChristianprinciplesandthepracticalcarryingoutofthetenetsofthe CatholicFaith.IfSocietyto-daycould beconductedonthebasisof"render untoGodthethingsthatareGod's, andtoCaesarthethingsthatareCaesar's,"thenthesacrificeofhumanlife wouldnothavebeeninvain.They hopedthatthewarwouldendinvictoryforourArmsandthatpeacewould beofatrulyChristiancharacter;and thatthosewhowouldguideourdestinieswouldturntoGodintheirefforts tosecurealastingpeaceandthepreventionofhorriblewars.
