Theyhadadistinctlyreligiousas wellassocialchatacer.infact'he ideaofsocialservicewasinextricablyblendedwiththatofreligion. WhenDrumcondrawascutofffrom theoldparishanderectedintoone itselfintheyear1902,Father Byrnereceivedthenewappointment.Thenewpastor,tousea homelyphrase,hadhisworkcut outforhim.Hehadnochurchand hadtobecontentforawhilewith .a.smallwoodenchapel..Withcharacteristiczealhesettowork,and ifalthoughtheresidentsofthedistrictweremostlyofthemiddle andhumbleclasses,hesucceededin erectingoneofthemostornate andsplendidchurchesinDublin, whichisdedicatedtoSt.Columba.InduecoursehewasappointedparishpriestofDrumcondra.A mostlovablecharacter,hegrew intotheaffectionandesteemofhis people.Foralongtimehefought bravelyandpatientlyagainsta painfulillness,buthisdeclining dayswereconsoledbythekindattentionsofmanyfriends,bothclericalandlay.Agoodpriest,akind friend,aculturedgentleman,he passedawaytoreceivethereward ofanunselfishlifespentintheserviceofhisDivineMaster.

REV..TOHNO'LEARY, CORK.

ThestruggleonthePonsonbyestaterousedhimtoaction,andhe continuedtoespousethecauseof thetenantryuntilhisdeparture forMeelinin1887.AtMeelinthe PlanofCampaignwasjustestablished,andFatherKennedyagain stoodbythetenants,who,mainly underhisguidance,adoptedthe "NoRent"manifesto.Holdings wereraidedbybailiffsandpolice. Foremostamongthosewhopleadedthecauseofthetenantswere Messrs.\Vm.O'Brien,M.P.;J.C. Flynn(thenM.P.forN.E.Cork), D.Sheehy,M.P.andthelateDr. Tanner.Inthevariousencounters "theMeelinCavalry,"organisedby FatherKennedy,tookaprominent part.

THECOERCIONACT.

AftertheCoercionActcameintoforceFatherKennedywasthrice prosecuted,andinall,wassentencedtoeightmonths'imprisonment,servingsixmonthsofthe eight.Whenhewassentencedin October,1889,the"MeelinCavalry"werewithdifficultyrestrained fromstormingtheheightonwhich thecourthouseissituated.Hewas releasedinDecember,amidscenes ofextraordinaryenthusiasmand rejoicing.InJanuary,however,he wasagainintheclutchesofthe law,whenhewassentencedto threemonths'imprisonment,his releaseandthatofhisfellow-prisonersbeingmadetheoccasionof furtherrejoicings.Sounrighteous hadhisconvictionbeenregarded thatthelateMr.\V.KGladstone wrotehimlettersofsympathyand regretinreferencetohistreatmene andinhisroomFatherKennedy hadaportraitofMr.Gladstone signedbythedeadstatesman.He hadthesatisfaction,however,to seethecausewhichheespoused victorious.Maytheirsoulsrestin peace.

InCork,onMarch6th,took placethedeathofRev.John O'Leary,retiredparishpriestof Ballyferriter.Oyongtoillhealth, FatherO'Learyrssignedthepastorshipwithwhichhewasentrustedsomeyearsago,andlived,-,pietlyinthecityontheLee.Coming fromatypicalIrish-speakingdistrict.hewasesplendidIrishscholar.andanardentNationalist. Michsemsatlivisextendedtohis relativesontheirbereavement.

Inhisaddresstothejuryforthe plaintiffsMr.AlexUre,LordAdvocate,saidthatasanexampleof debasedanddisreputablejournalismthecase,ashisexperience went,waswithoutparallel.Sometimesthecolumnsofanewspaper werefoundtocontainaslanderous andfalsearflelewhichhadfound itswaytherebypuremishapor inadvertence.Theerrorwasin suchcasefollowedbyahandsome apology,andfullamendsforthe injurydone.Sometimesalsonewspaperswerethevictimsofmisrepresentationanddeception,forthe businessofadailynewspaperwas conductedundersuchconditions thatitwasimpossibletoavoid mischanceofthatkind.Whenever thatoccurredarespectablenewspaperofferedanapologyandmade amends.Atothertimes,somehot headedpoliticalpartisan,sweptoil hisfeetforthemomentbysome causeofpoliticalanimosity,oversteppedthedearlydefinedline whichexistedbetweencriticismon men'spubliccharacterandconduct andattacksupontheirprivateconducthut,addedMr.Ure,when thegusthadpassedaway,andthe temperaturehadgonedown,a handsomeapoloe-wasusuallyoffered.Thiscase,however,stoodin markedcontrastanddistinctionto thosehehadlivered.Theonedefencethatcouldhavestoodforthe chargeswasthattheyweretrue, andthatdefencewasopentothe "DundeeCourier."Itwasacompletedefenceifitcouldhavebeen stated.betitwasneverputforward.

Thearticlewasafabricationfrom beginningtoend.Itwasalying chargeagainsttheplaintiffs,deliberatelycirculated.Neitherthe Tlishosnorhisclergywouldhe worthytoretaintheirsacredcallingiftherewereavestigeoftruth inthecharges.Theywouldbedespisedsndviewedwithhatredand contemptbyeverymanofright feeliueifthestatementsweretrue. This,continuedtheLordAdvocate,wasnotacaseinwhichthe Bishueandclergywereeagerfor money.buttherevasnoother courseopentothemforthevindicationoftheircharacter.

Noapolopsorexpressionofregretwasoffered,and,therefore,it wasacaseforsubstantialdamages.Astothemotivesofthe writerofthearticle,theyhadnothin"todotherewithpoliticsor creed.Politicalintentdidnotentitleamantomakeashameless andinfamousattackuponother men'sPrivatecharacter.Thosein public:lifewereoftensubjectedto veryunmannerly,cruel,andoften unfair.criticism.Thatwasinevitable.butthelawshould'protect themagainstattacksupontheir private,haracter.
