Marriage,inasmuchasitisanaturalcontract,leadsusbacktothe originofthehumanrace,whenit wassanctionedbyDivineordinence, aswereadinthesecondchapterof Genesis.Welearnfromthesacred narrativethataccordingtoitsprimitiveinstitution,marriageisanunion ofmanandwomanfortheendthat theymayassisteachotherunderthe difficultiesofthepresentlifeanunionofwhichGodHimselfistheauthor; anunioncloserandmore bindingthanthatwhiohnatureitself hasplaced'betweenmanandthose Whogavehimbirth;anunionwhich nothingbutdeathcandissolve,since noearthlyauthoritycanseparate thosewhomGodhasjoinedtogether. UndertheChristiandispensationthis naturalcontracthasbeenraisedto thedignityofaSacrament.TheDiRineRedeemer,astheCouncilof Trentteaches,"hasmeritedbyhis passionthegracenecessarytoperfect thisnaturallove,tostrenethenthis indissolubleunion,andtosanctify themarriedpair."Andthesame greatCounciladds"Whereforematrimony,withoutceasingtobewhat ithadbeenfromthebeginningshas beenmadebesides,bytheappointmentofChristourSaviour,the meansofbestowingsuchspiritualsuecoursasarenecessaryinorderto livevirtuouslyawlholilyinthemarriagestate."ToillustratethistearhingitcitesthewordsofSt.Paul, "ThisSacramentisgreatinChrist andintheMurat"Meshes.v..52), andthuscontinues"Marriageunder theEvangelicalLaw,beingmoreexredlentthanthemarriageofold,on accountofthegracewhichitconfers throughJesusChrist,itiswithlust reasontheHolyFathers,theCouncils,andtheuniversaltraditionsof theChurch,haveatalltimestaught thatitshouldberankedamongthe theSacramentsoftheNewLow."

TheeffectsofthisSacramentmay betoldinafewwords.Ttproduces

sacrificinglovewhichshouldsubsist betweenthehusbandandwife.As theApostlewrites,ourSaviourcleansedtheChurchthatliemiehtunite ittoHimselfasaspotlesschosen bride,andHeperfectsandsanctifies theunionofthehumanheartand soul,thatelevatedandpurifiedbythe sacramentalgracesitmaybecomethe antitypeandsymbolofHisunion withHisChurch.Henceitisthat themarriedcouplemaygoconfidentlytoGodforeveryhelptheyneed intheholystatetowhichGodhas calledthem,forHeHimselfhassealedtheirunionbyagreatSacrament oftheGospel.ConsideringthisfeatureoftheSacrament.Tertullianexclaims'Whatwordscansufficeto tellthehappinessofthatmarriage whettheChurchunites,theoblation confirms,andtheeless'ngseals,the angelsannounce,theFatherachnowledges," Itwillhereheremarkedthat throughsacramentalmarriagethe Christianfamilybecomesitsifa churchinminiature,andlikethedese tinyoftheChurchitself,itshould haveforitsmainpurposetoprepare soulsforheaven.St.Francisde SalescallsMatrimonythenurserygroundofChristianity,destinestotill theearthwithbelievers,andtocompletethenumberoftheelectinhatIyen.SomefeaturesoftheChurchare 'mightintoholdrelief.AstheBride ofChristisone,soamanMsbut onewife.AsChristandtheChurch laveinseparablyunited,sotheunion ofthemarriedcoupleisperpetualand indissoluble.SincetheunionofChrist andtheChurchisacovenantof grace,soalsoistheunion(dhitsband'andwife.ChristandtheChurch areanimatedbyonespirit,andsoit shouldhewithIr,shandandwife. ChristneverabandonstheChurch, andtheChurchcanneverheunfaithfultoChristsomarriedpeoplemust neverIreiinfeitefeltooneanother. ThusChristianmarriageshouldin

moralityinregardtowhichthe State,whoseprovinceispurelyin thingstemporal,canhaveaopossible competence.Henceinthemakingor unmakingofthemarriagecontract, theStatehasnocontrol.Itcannotmaketwopersonsmanandwife beforeGodneithercanitunmake them.Ithasbeenwellsaidthat "theState,ofitsownauthority,can nomoremakeamarriagevalidor invalidintheeyesofChristthanit canforgivesinsoroffertheSacrifice oftheMass."ItistotheChurch andnottotheStatethatChristhas giventheadministrationoftheSacraments,anditistotheChurch, andnottoanydeetribunalthatHe hasleftthepoweroffixingtheconditionsoftheirvalidity,andhasaddressedthedivinewoods"Whatsoeveryoushallbinduponearth,shall beboundalsoinheaven."

Intheexerciseofherspiritual authoritytheChurchforbidsclandes. tinemarriages,anddeclaresthemto beinvalidthatistosay,theyare nomarriageinthesightofGodand ofHolyChurch.Thereareotherdefectsalsowhichrenderthemarriage contractnullandvoid.Forinstance, ifthecontractingpartiesbewithin theforbiddendegreesofkindredor affinity,oriftheybesubjecttoany oftheotherinvalidatingimpediments whichtheChurchhasdecreed.

Thematterofclandestitrity,however,demandsparticularattention, foritisspeciallyaffectedbythenew MarriageLawwhichwillthineinto forcenextEasterSunday.

CLANDESTINEMARRIAGES.

Bishoporapriestdemitassebyhim. meetsalltheregeinementsofthelaw. Itis,however,tothepriestholding parochialchargeoftheplacewhere !teemarriageiscelebrated,oranotherpriestwithhispermission,that thedutyandprivilegeofassistingat themarriagespeciallybelong.Bid letussupposethatthecontracting Partiesdonotbelongtothatparish ordistrictordiocese.Evenso,their marriagewillbevalid.Mayitbe saidthenthatthepriestofaparish ordistrict,orhisdelegate,maycelebratethemarriageofallCatholics owhocometohim? Thereplyis, thathevalidlyassistsatallsuch marriages;but,asamatteroflaw andgoodorder,heisboundnotto assistatthemarriageunless0016of thetwoalternativeconditionshave beenfulfilled,namely(1)eitheroneof otherofthepartiesmusthaveadomicile,orhaveresidedforatleasta monthintheparishordistrictwhere themarriagetakeisplaceor(2)one orotherofthepartiesmusthave obtainedfromthepriestorOrdinary underwhosejurisdictionheorsheresides,thenecessarypermissionto havethemarriagecelebratedthere.It is'decreed,however,thatincasesof gravenecessityeventhispermission maybedispensedwith.Tosumup thepositionbriefly,letussuppose thattwoCatholics,freefromimpediment,wishtogetmarried.Ifany priesthavingparochialchargeofa district(oranyotherpriestauthorisedbyhimorbytheOrdinary-ofthe diocese)consentstomarrythemWith inhisparochialdistrictinthepresenceoftwowitnesses,themarriaee isvalid,andthepartiesarereally

TWOEXCEPTIONALCASES.

ThenewMarriageLewrefersto

Clandestinemarriageshavealwaysmanandwife.Buttheyareboundto beencondemnedbytheChurch,butitconformtothefollowingsimplereguWasreservedfortheGeneralCouncillotions,notasaconditionofvaliseTrentto&daresuchmarriagesdity,butasamatterofliceityand sullandvoid.Theexperienceof300gocsrlorder.Themarriageoughtto yearshasprovedthewisdomofthetakeplaceintheparishofthebride Councilinitsenactment,andhasunlesstherehesomejustcausefor iustilieditsrigourinenforcingit.notobservingthisrule)otherwisein TheTridentinedecree,however,wastheparishoftheintendedhusband. notpublishedinmanycountries,andIftheydesiretobemarriedillanitwasfarfrombeinguniforminitsotherparochialdistrict.theymuse relationtonon-Catholiccommunities.alethepriestinchargeofthatdistilthenewMarriageLaw,Glandes-tricttomarrythem,and'theymust tinitycontinuestobeadirenctitim-haveobtainedadomicile,orlived'for pediment.butitsconditionshavebeenatleastonemonthinthesaiddismodifiedsoastorenderthelogisla-triet.Theywillhave,ofcourse,to tionoftheChurchuniformforalltodinproofoftieingfreetomate thefaithfulthroughouttheworld,,ry,andtocomplywiththeother whilstatthesametimeitmakesusualconditionsforreeei'inctheSacmoreplainandintellielhlethecon-ref-tientofMatrimony.Shouldthe ilitionsunderwhichmarriaeeshallcontractingpartieshavenofixedaspiremanwithahigher!tenseofnisiverywherebecelebrated.Thenewbodeandhetravelledthroughthe anincreaseofsanctifyingmicewhere nworthanddignity,,andmake hrthosewhorerceleiginigt im ysigehrte renderedmore himrealisethatheisjoinedina sacredandinlissobiblecovenant,of ofGod.Thiseffectithasincommon withalltheotherSacraments.Fur-eri.hoireih is sthteheC:reur.ch'snionswithher thormore,itimpartsanntemitiantsuppofspiritual tenableATTHEFOTINDATIONOFTITF, thosewhoenterthatholystateto TrRISTTANTTOefel.
