When the state legislatures swing back into action in early 1970, liberalization of the abortion law will be a pertinent matter in at least 22 states. But the proponents of "easy abortion" are apparently unsatisfied with the tedious and generally unsuccessful efforts of past years, and within the past six months there has been a turn toward the courts, with the hope of striking down the present laws as unconstitutional. In California, New York and the District of Columbia there are cases that could easily move to the Supreme Court of the United States, where the final judgment would have repercussions in almost every state. The first of these court cases involves a California physician, Dr. Leon Belous, who was convicted under the 1850 California statute forbidding abortion "unless the same is necessary to preserve new life". Dr. Belous had referred a young woman who wanted an abortion to a person not licensed to practice medicine in California. Belous appealed the conviction and the Supreme Court of California reversed the judgment on the grounds that the terminology of the law was so vague that men of reasonable understanding, including physicians, must guess at its meaning. While the Belous case was being adjudicated, the legislature passed a new law in California, which is not affected by this particular judgment. Early in October, four separate groups challenged the constitutionality of the present New York law. A small group of doctors asserted that the law impedes them from practicing medicine in a proper way, and the other three groups contested the law as prejudicial to woman's rights, prejudicial to the poor, and as restrictive of the individual's free choice. There will be a trial in a Federal District Court before a three-judge panel, and the four challenges will probably be consolidated into one suit on behalf of the physicians. Appeal from this trial could go to the Supreme Court of the U.S. The third challenge to the constitutionality comes from the District of Columbia. Dr. Milton Vuitch and Shirley Boyd, a nonphysician, have attacked the D.C. law in separate suits. Judge Gesell dismissed the indictments against Dr. Vuitch on grounds

In doing so, Judge Gesell ruled that the state has a right to make laws regarding abortion, but he stated that he felt that the D.C. law needed revision. Within a week of Judge Gesell's ruling, Dr. Vuitch was sentenced to one year in jail and $5,000 fine for violating the law in Maryland, and the ruling judge reprimanded him for his apparent lack of concern about the whole matter. The newspapers report that following the D.C. ruling, Dr. Vuitch had advised people to give him a week or two before he would be able to resume his activity. These developments in California, New York, and the District of Columbia make a Supreme Court case practically inevitable. The cases in California and Washington both involve criminal charges against a specific person, while the New York case is an effort to get a declaratory judgment

against the law, thereby leaving the state with practically no law at all. Each of these cases has far-reaching implications, not only as regards constitutionality, but also as an attempt to pressure legislatures to adopt some type of liberal legislation in the coming year. Nor does the pressure stop here. At its 1967 convention the American Medical Association issued a policy statement generally endorsing the model statute of the American Law Institute. The debate at the Convention was rather inconclusive, and many doctors expressed strong reservations about the policy statement. Almost a year later, the American College of Obstetricians and Gynaecologists took an even more guarded position on abortion law change, emphasizing that abortion is a serious operation and that the College opposed considering it for purposes of birth limitation or allowing it freely on the decislon of the patient.

Notwithstanding the serious and un resolved questions expressed by the AMA and the College of Obstetrics and Gynaecology, at its annual convention in early December the AMA will have a resolutirr placed before it calling for the Associatiu: to rescind its present position and "go or record as recommending the repeal of a. state abortion laws (except those restricting abortion to qualified physicians) So t hat all women, for whatever reason, can have abortions performed under safe, healthful conditions by qualified prartioners of medicine." (cf. American Meci: cal News, 11-17-69). The courts are now looking at the lay. prohibiting abortion from the standpoint of their restrictiveness and legal terminology, and the physicians are centring on who may be allowed to perform them and where. Legislators are subject to pressure from radical feminist groups, civil libertarians, and some population control zealots. Meanwhile the ev:dence mounts in favour of human life being present in t: foetus from conception onwards, and we are now able to treat the foetus in ti w omb, to conquer threats like German measles by vaccination, and in light of the latest discoveries in genetics—to look forward to correcting genetic disorders in the near future. Nevertheless we face an erosion of our value of human life, and the effort to liberalize abortion laws is a classic example. We are no longer discussing the question of whose life is to be saved, that of the mother or the child, but rather, at what point of inconvenience should we allow a woman, a doctor, or society at large to determine that the life of the child in the womb is now expendable.
