ThemillsofCommunist"justice"havebeengrinding inSofia,Bulgaria,andBudapest,Hungary,where13more prisonsentenceshavebeenimposedbythepeople'scourt. Thefreeworldiscontinuingitsprotests,but,otherwise, isapparentlywithouteffectivemeansatpresenttohalt suchproceedings.

TwopriestsandaJesuitlay brotherwereamongthe13persons'tried"inBudapestand sentencedtoprisononcharges ofillegalcurrencydealingsina "conspiracy"with Cardinal Mindszenty.Msgr.ImreBoka, formertreasurerofthearchiepiscopalchancery,wassentenced tofouryearsinprison,lossof politicalrightsforanotherfive years,andafineof1,000 forints.TheReverendJosef Vid,identifiedasthetreasurer oftheJesuitSocietyinHungary,andJohnVaradi,aJesuit laybrother,weresentencedto threeyearsandnineyearsloss ofpoliticalrights. ThehighestsentencewasimposedonDr.GaborHorvath, formersecretaryofDukePaul Esterhazy,oneoftheco-defendantsofCardinalMindszenty, whodrewsixyears'imprisonment. Therearecountlessindicationstodemonstratetheworthlessnessofthe"confessions"ob-

tainedbyCommunistsecretpoliceandprosecutorsfromthe15 accusedProtestantclergymenin Sofia,Bulgaria,andfrommost ofthe13persons"tried"in Budapest,Theexactnatureof themethodsusedinorderto forcenormallystaunchmeninto incriminatingthemselves,protestingtheirloveanddevotion fortheCommunistregimes,and cringinglypleadingformercy, continuestobeobscure.But nobodyisdeceivedbythepretenceoflegalproceedingsstaged inSofiaandBudapest.Statementsbyleadersofpublicopinionaroundtheworlddemonstratetheclearrecognitionof thefactthatthese"trials"area partofaworld-widecampaign aimedatdestroyingtheChristianchurchesbymakingthem willingtoolsoftheCommunist regimes.

BRUSSELS,March5.-Thecontinueddeepinterest ofHisHolinessPopePiusXII.inthemovementtoward aunitedEuropefoundstrikingexpressioninamessage addressedbyhimtotheInternationalCouncilofthe EuropeanMovement,whichhasjustconcludeditsfirst plenarysession.ThemeetingswereattendedbyArchbishopFerandoCento,ApostolicNunciotoBelgium,who servedasrepresentativeoftheHolySee.

ThePapalmessage,readat theclosingsession,wasasfollows:

"Promptedbyhispaternalinterestineveryinitiativeaiming atunionandsolidarityamong thenations,theHolyFatherexpressedhisheartfeltwishesand praysGodtoblessthediscussions ofthedelegatestotheCouncil oftheEuropeanMovement,that theireffortsmaycontributeto theestablishmentofajustand lastingpeaceamongthenations."

ReadbyP.J.S.Surrerens,PresidentoftheCatholicPeople's PartyoftheNetherlands,the Pope'smessagewasunanimously applaudedbythe140delegates representing23countriesand variousgroupspromotingEuropeanunity.Amongthemwasa delegationfromwesternGermany.TheCouncilwascreated atTheHagueinMay,1948

ArchbishopCento,addressing themeeting,saidthat"asrepresentativeoftheSovereignPontiff,Iconsideritmydutytounderscorethecompletesuccessof thehistoriccongress."

"TomakeEuropeone,constitutesatthismomentoneofthe highestideals,"hecontinued. ReferringtoapreviousstatementbyPaul-HenriSpaak,PremierofBelgium,thatthisEuropeanunityisbecomingareality, thePapalNunciocontinued: "WhyshouldtheChurchnotrejoiceatthis?Thecivilisationof EuropeisbasedonChristianity. ThisexplainstheheartfeltsympathywithwhichtheHoly Fatherhasfollowedyourwork. Itwillaffordgreatjoytometo informHisHolinesshowthe

workaccomplishedherewasanimatedwiththebestfeelingand anunshakablefaith."

TheCounciloftheEuropean MovementarosefromthedecisionlastyearofsevenEuropean organisationstounitetheirefforts towardbringingaboutEuropean unity.Thesesevenorganisationsare:(1)TheEuropeanFederalistUnion;(2),TheUnited EuropeMovement,ledbyWinstonChurchill;(3),TheEconomicLeagueofEuropeanCooperation,ledbyPaulvanZeeland,formerBelgiumPremier; (4),TheFrenchCouncilfora UnitedEurope;(5)LesNouvellesEquinesInternationales,a groupingofmenandpartiesof Christan-democraticorientation; (6)TheEuropeanParliamentaryUnion,and(7)TheSocialist MovementfortheUnitedStates ofEurope.

HUE,Annam,Indo-China, March3.-(NC-Fides).-Ayoung priesthasbeentakenasahostagebytheCommunist-ledVietminhmovement,andthefateof anotherpriestandtwoseminariansisunknov.nafterVietmihn membersambushedatrainand killedthepassengersortook themprisoner. Arrestsandassassinationsof mayorsandleadersinChristian communitiesarebecomingmore frequentinthecentreofAnnam. Indicationsarethatthisincreasedterorismhasbeenorderedby highVietminhleaders.

antswithdrewtheir"confessions"orpartsofthem,chargingpoliceintimidationinthe pre-trialhearings,Oneofthe defendantsdeclaredthathis nerveshadbeenbrokenbybeing keptaloneinacellforawhole month.

However,beforethe"trial" reacheditsconclusion,oneof thesedefendantsfeltobligedto withdrawhisrepudiationandto askthecourt'sforgiveness,sayingthat"thephysicalandmentalpainofthetwomonths spentinprison"causedhis"behaviour"incourt.

Msgr.Bokawassaidtohave pleadedguiltytothechargeof having,ontheCardinal'sinstruction,givenforeigncurrencyto variousbankersandbrokersfor saleontheblackmarket,He emphasised,however,according toBudapestreports,thatthe profitswereexclusivelyusedfor charity.FatherVidandBrotherVaradiwerereportedto havealsoadmittedthe"crimes" chargedtothem.FatherVidis saidtohaveemphasisedthat,at thetime,hewasnotawareof theillegalityofsuchtransactions andthathisonlymotivewasto strengthenthefundsofthe order.Herefusedtoaskmercy forhimself,butaskedthecourt tobelenientwithBrotherVeradi,whohadsavedthelivesof manyJewsduringtheyearsof Nazioppression.

InSofia,thingswentsmoothly fromtheCommunistpointof view.Fourteenofthe15Protestantclergymenpleadedguilty tothechargesofespionage,treasonandblackmarketdealings. SecondsonofanotableCatholicfamily,Mr.Dunphywas bornin1907.Educatedatthe ChristianBrothers' College, Perth,hewasadmittedtothe Barin1932,Attheageof30 hewasappointedCrownSolicitorandParliamentaryDraftsman.In1943hetooksilk,being theyoungestKing'sCounselin theCommonwealthatthetime.

PriortojoiningtheCrownLaw Department,Mr.Dunphyhad specialisedinindustriallawand workers'compensationcases.So that,upontheretirementofMr. WalterDwyerfromtheArbitrationbenchin1945,Mr.Dunphy waswellqualifiedtobecomehis successor.

DuringhistermasPresident foralmostfouryears,hehas deliveredmanyimportantjudgmentsandhashadnotablesuccessindealingwithindustrial disputes.

Moreimportantly,itisobvious(andadmittedontheGovernment'sside)thatthesecrecy whichnowsurroundsapatient's confidencestohisdoctorwillgo b"theyboard,Informationon suchmattersastransmissible disease,pregnancyandillegitimacy,V.D.,insanity,etc.,will havetobeaccessibletogovernmentdoctors,clerks,inspectors, etc.,unlessthefinancialsideof theActistobebasedonhope. Thiswouldbesociallydisastrous andimmoral.Itisallverywell forMinistersoftheCrowntobe assuringusthatnosuchthing couldhappen,forithappened' thisweekwhentheMinisterfor theArmycommittedtheenormityofrevealingtheconfidential healthhistoryofamanwho/is provingembarrassingtothe Government.Thisisanissue whichwillnotonlyimpederecruitmenttotheArmedServices butwillunderminepublicconfidenceingovernmentalassurancesofsecrecy. Politically,thelawsunder whichthisschemewilloperate arenotfullyknown,eventothe ParliamentwhichpassedtheAct, foritisanexampleofoneof thegreatestevilsofthebureau_ craticState-"governmentbyregulation."ThereisaDirector GeneralofHealthwithundefined powers,subjecttotheMinister; butthereisnorealcontrolby Parliament.Itofferstheplannersofthenewtyrannyunlimitedpowersofregimentationand "control."Inademocraticsetup,allessentialconditionsshould beexplicitlystatedinActsof ParliamentSenatorNash,of thisState,advertedtothedangerofthisprocedureduringthe Senatedebate,andwiselydeclaredthatParliamentshould alwayshavesubstantiallegislationtocoversuchimportant matters.Itisplaintoseethat inthefinalresultgovernmentby regulationwouldcompletelydestroyParliamentasadeliberativebody,ItisaviciousprinciplethataMinistershould havevirtuallylegislativepowers toadministerbyregulationa wholenationalscheme,suchas thatdealtwithintheNational HealthServiceAct.Here,asin othermatters,theGovernment hasgonetoofarandtoofast alongthepaththatleadstothe ServileState.Itisallthe greaterpitywhenwereflecthow theimportantmatterofhealth couldsoeasilpbehandledona nationalbasiswithoutrecourse tocoercion,regimentation,and ulteriorpoliticaldesigns.

/Thereisoneaspectofthisinquiry,however,thatcannotbe passedoverinsilence,and=at isthesectarianmotivationwhich seemedtounderliemanyofthe charges.WittinglyorunwittinglythememberofParliament whobecamethemouthpieceof themalcontentswaslendingfs prestigetothefoulmuck-ringofwhichthenotorious "Rock"newspapermakessucha specialty.Forwellovertwelve months,thisrabidgutterjournalventeditsspleenagainst PoliceCommissionerDoyle,In theseverecensuresofJudge Bookagainsthis"traducers," "TheRock"managementmay seeanofficialcondemnationof whattheman-in-the-streetpopularlythinksofitscontents,policiesandtacticsIffornoother reasonthanthis,theStateGovernmentsetuptheRoyalCommission,itwasamplyjustified, becauseoncetheweepingulcer ofsectarianismispermittedto developunchecked,itwilintime infectawholecommunityand breedaspiritofhatred,lying andspyingwhichsurpassesanythingelseforblindnessand venom.ThankGod,our'communityintheWesthasbeen largelyfreeofthismaliceofignorance,anditistobehoped thatJudgeBook'sfindingswill allayitinoneofitschief haunts.

InthepressreportsoftheevidenceitwasreportedthatSergeantKendalldeniedthathe haddirectlygiveninformation to"TheRock,"butconsidered thatpapertheequalof"TheRecord."Idonotwishtoquibble abouttheworthoftheSergeant'sliteraryevaluations,but I(10thinkhemightdowellto markthedifferenceinourspirits, evenaswewillbeanticipatinga differenceinhis.

Whileitwouldseemthatconscriptionofdoctorscannotbe accomplishedwithintheConstitution,itisplainthatwhatcannotbedonepositivelycanbeachievednegatively-byeconomic compulsion,Thisisbrought aboutbysettingthepatient's financialinterestinoppositionto thedoctor's.

Moreover,despitegovernmentaldenials,thepublicisbeing offeredabribe-semi-freemedicalbenefits-iftheywillforego theirpresentrighttochoosetheir owndoctor.Itisimpossbleto seehowaparticularmedical practitioner,underGovernment controlasasalariedemployee, wouldbeavailableattherequest ofaparticularpatient.Once thepresentintimatepatient-doctorrelationshipisbrokendown, thesickwillbecomemereciphersinagovernmentregister. Theresultwillbethateveryone willthenbetreatedasthepoor aretreatedwhoattendasoutpatientsatapublichospital. Moreisinvolvedherethanthe psychologicalelementsoneces-

AttheresumptionofthehearingbythePrivyCounciloftheCommonwealthGovernment'sappealagainst theHighCourt'sinvalidationoftheBankingAct,tDr. Evattmadeamostcuriousanalogy.Dealingwiththe plenarylegislativepowerofthenation,Dr.Evattclaimed thatthesovereigntyitcouldexercisemustbeinallrespectsthesameasthatexercisedbytheParliamentat Westminster.InreplytoaquestionbytheLordDu ParcqastowhetherParliamentwouldhavecomplete powertoabolishmarriage,Dr.Evattairmedthatit would,andthattheAustralianStatesbeforeFederation hadthepowertodoawaywithdivorce.Wehavehere, inthehighestcourtavailabletoaBritishsubject,the mostbreath-takingarrogationsofpower.Toanythinkingmanitisobviousthatnolegislativepoweronearth hasthepowertoabolishmarriage,anymorethanithas thepowertograntdivorce.Longbeforeitwas,raised byChristtothedignityofaSacrament,marriagewasa naturalcontractbasedontheNaturalLaw.Sinceit supersededtheStateinpointoftimeandtheStatedid notcreateit,neithercantheState,exceptbyalegalfiction,abolishmarriagenorgrantdivorce.

SincetheinstitutionbyChristofmarriageasaSacramentalstate,theChurch(whichHeappointedasthe guardianandteacherofthetruthsHerevealed)hasthe soleprerogativeoflayingdowntheconditionsunder whichChristianmarriagemaybevalidlycontracted,or dissolved.ThepaganisstillboundbytheNaturalLaw, which,allcivilisedmenagree,favourspermanentmonogamyagainstpolygamyandpromiscuity.TheState, therefore,entersthepictureverylateandonlysinceits secularisationhasitpresumedtoexercisepoweroverthe contracticaianddissolutionofmarriage.Inpointoffact, nopositivelawhasanyvaliditywhenitcontravenes NaturalLawandmarriageisaclassicalinstanceofsuch aconflict.Hence,theactionoftheStateregardingdivorce,forexample,ismerelyanemptygesture,apretence, foravalidmarriageremainsabindingcontractbetween bothpartieseventhoughtheStatehasdeclaredthebond dissolved.Itisinterestingtonotethatthemodern State,being"freed"ofanyChristianorevenmoralrestraints,feelsnoneedtodefenditsrightstoexercisecertainpowers.Itsimplyassumesthemasthoughitwere thesourceofitsownauthority.IntheChristianview, onthecontrary,thedemocraticStatederivesitspower indirectlyfromGodthroughthevoiceofthepeople.

Thesereflectionsareparticularlypertinentinregard tothecurrentcontroversiesregardingAustraliansoldiers whohavemarredJapanesewomen.Itisreportedthat themilitaryauthoritieshaveforbiddenandactuallypreventedtheseunions.Whatevernationalorsocialconsiderationsinclineustofeelisinthebestinterestsofthese menandwomen,itiscertainthatmarriageisanatural rightwithwhich,exceptinthecaseofChristians,noone mayinterferelegitimately.TheStatehasacertainjurisdictionoverthecivileffectsofmarriage,buttopresumetointerferewithitsinnernatureisaclearusurpationofpower.Hence,thoughtheCommonwealthand militaryauthoritiesmaydislikesuchunions(andthey may,indeed,bearegrettablematterinmanyinstances), theycannotcontravenetheNaturalLawbyprohibiting them.Alreadyfartoogreatencroachmentshavebeen madeonpersonal,individualliberty.Letusatleast preservesacrosancttheinalienablerightofamanto choosehiswife,tobefaithfultohertilldeath,tobring childrenintotheworld,andtherebyfulfiltheDivine plantoperpetuatehumankind.
