JOHNS CREEK, Ga. — Police are investigating a Dec. 6 home burglary at Holly Trail.

The homeowner told police she left shortly before 6 p.m. for three hours. When she returned, the homeowner heard voices upstairs.

Check stolen in mail used in forgery attempt JOHNS CREEK, Ga. — Police met with a Johns Creek man Dec. 2 after he discovered a suspicious withdrawal on his bank account.

In October, the man said he had placed a check for the Fulton County Tax Commission in his mailbox. Two months later, the man received a letter from the county notifying him that his taxes had not been paid.

The man then checked his bank account and noticed a fraudulent $1,000 withdrawal. The check used in the withdrawal had the same checking and routing number as the one the man had sent to the Fulton County Tax Commission.

Cash, jewelry stolen in residential burglary JOHNS CREEK, Ga. — Police are investigating a Dec. 7 home burglary at Stapleford Lane.

The homeowner said she had left the house between noon-9 p.m. When she returned, she saw that a window, which had previously been shut, was open. She called police.

The glass back door was shattered, and officers found several rocks nearby that they said the suspect could have used to gain access to the house.

Inside, the rooms were ransacked.

A male suspect confronted the woman and pushed her down before he and another suspect ran out the glass rear door of the house, which had been shattered.

Police arrived soon after and cleared the area. Some jewelry, watches and a strong box were missing.

About $3,500 in cash was taken along with several pieces of jewelry worth $30,000 total.

Household goods stolen from man’s storage unit JOHNS CREEK, Ga. — A Duluth man contacted police Dec. 5 when he realized that his storage unit on Abbotts Bridge Road has been burglarized.

The man visited his storage unit that day and noticed that it was secured by an unfamiliar lock. An employee of the company cut the lock off of the unit so the man could inspect it.

Inside, the man found that 20-30 boxes of miscellaneous household goods were gone. The remaining items showed signs they had been rummaged through.

Management said they were reviewing security camera footage.

Parcels taken off porch at woman’s residence JOHNS CREEK, Ga. — A Johns Creek woman met with police Dec. 5 after her packages had been stolen from her porch at Virginia Pine Lane.

The woman said she returned home from shopping and saw two packages on her porch. She went inside to put away her items first. When she returned to her porch, however, the woman was unable to find the packages.

DUI arrests Kelli Marie Brassard, 47, of Appaloosa Trail, Norcross, was arrested Dec. 6 on State Bridge Road in Johns Creek for DUI–drugs and suspended registration.

Amit Ahuja, 39, of Dunbarton Crest, Cumming, was arrested Dec. 5 on State Bridge Road in Johns Creek for DUI. realized he had become the victim of identity theft.

Around mid-November, the man received a letter from SunTrust Bank stating that he had been denied for a credit card. He received additional letters in the days that followed form Wells Fargo, Target and BB&T with similar messages.

The man had not applied to any of these institutions for a card.

He contacted police to make a report for his bank.

Man employs trickery to swindle local cashier JOHNS CREEK, Ga. — Police are investigating a Dec. 5 incident at the Chipotle Mexican Grill where a man is suspected of swindling an employee.

That afternoon, the man gave a $100 bill to the employee to pay for his meal.

While the employee counted up the change for the man, security footage showed the man take the $100 back.

He also accepted the change from the employee.

Woman finds card fraud while buying pizza JOHNS CREEK, Ga. — An Alpharetta woman contacted police Dec. 5 after she realized she had become the victim of credit card fraud.

In late November, the woman received an alert regarding a new credit card. Then, on Dec. 2, three of the woman’s credit cards were declined when she attempted to buy pizza.

The woman contacted her bank and learned that new cards had been issued to an unfamiliar address. There was also a $4,000 accepted cash advance she had not made on one of the accounts.

Johns Creek launches investigation into mayor’s aide

By CARSON COOK carson@appenmediagroup.com JOHNS CREEK, Ga. — Johns Creek Mayor Mike Bodker has called for an independent investigation into his executive aide, Craig Kidd.

The probe comes after blog and social media posts circulated that allege Kidd used his city-owned phone and laptop to conduct personal business and matters related to his role as the first vice chair of the Fulton County Republican Party.

City Councilman John Bradberry introduced the item for discussion at the Dec. 9 council work session, saying he wanted to give the mayor an opportunity to address the accusations publicly and to establish expectations for what action could be taken.

“It appeared — and I stress the word ‘appeared’ because we don’t have all the facts at this point — it appeared that there were texts, emails and activity on city time that went beyond the city responsibilities, that were, I would say, personal and political,” Bradberry said.

Bodker, saying he recognized he could not objectively conduct an inquiry involving himself and his aide, instructed Acting City Manager and Police Chief Ed Densmore to oversee an independent investigation.

“I’m not speaking with anyone who is conducting the investigation until it’s complete, so that there will be no chance that it is not done as objectively as possible,” Bodker said.

“In fact, I won’t even know who is performKIDD ing it.”

He said the scope of the investigation would look for criminal wrongdoing, breach of the city charter and violations of the city’s staff policies.

Bodker also said once he reviews the findings of the investigation and decides what, if any, action he will take, he BODKER intends to share the full findings with the rest of the council.

“I’m happy the mayor’s having an independent person take a look at this,” Kidd said in a phone interview following the announcement. “I believe that when a fair and reasonable investigation takes place, it will show that I did not do anything that was unethical and did not do anything using city resources to influence a campaign.”

The city charter allows the mayor to appoint an executive aid who receives a salary in line with department heads.

The aide reports directly to the mayor and serves at the pleasure of the mayor.

The aide’s responsibilities are up to the mayor’s discretion so long as the duties pertain to city business.

Densmore said he will approach this like any other investigation and let facts steer the findings. He said the city may hire an outside party to conduct the investigation.

The majority on the City Council indicated that they wanted to wait until the independent investigation uncovers the facts before deciding if further action is needed.

“We’ll get the report and then if we want to take action, we’ll take action,” Councilman Lenny Zaprowski said.

Bradberry said he hoped the matter would be resolved quickly.

“My goal is not to vilify or prosecute anyone, but rather just get to the bottom of it so we can put it to bed,” he said.

Councilwoman Stephanie Endres took a different stance.

“I think there is enough here to warrant the council to be able to look at an inquiry and investigation to have a better appreciation for what is happening,” she said. “It’s a huge breach of trust for

the residents, as well as a huge issue for transparency.

Per the charter, the council can investigate any city office and may subpoena witnesses and require the production of evidence to that end.

Other council members said that a council-led investigation would be too extreme an option at this time and could inject personal or political bias, or at least the appearance of bias, into the investigation.

“It’s simply business,” Bradberry said. “It’s not personal. I hope that it’s clear I have no personal axe to grind, but I have an obligation to make sure everything is above board.”

Accusations against Kidd first surfaced in an anonymous article on johnscreekpost.com, a blog where a small group of Johns Creek residents editorialize about matters pertaining to the City Council and local development.

The blog alleges Kidd used his city phone and laptop to recruit candidates to run in this year’s City Council election and on work pertaining to his role with the Fulton County GOP. The blog reportedly obtained this information through an open records request of texts, emails and internet activity from January to October.

Council keeps ‘significant difference’ rule in zoning procedures

By CARSON COOK carson@appenmediagroup.com JOHNS CREEK, Ga. — For the second time, the Johns Creek City Council failed to pass a change to the city’s zoning procedure that the city attorney says conflicts with state law.

After nearly two hours of discussion Dec. 9, the final vote was 6-1 to deny the change, with Mayor Mike Bodker casting the lone vote in favor.

The policy in question deals with reinitiating a previously denied land use petition. Under the current code, a landowner must wait 12 months and demonstrate that the proposed land use is “significantly different” from the previously denied petition before they can reapply.

The policy requires a developer who wishes to reinitiate a previously denied land use petition to first come before the City Council, and the council votes on whether the new plan is significantly different.

If it is deemed different, the petition goes through the regular zoning process and would eventually return to the City Council for approval or denial.

If the plan is deemed not different enough, in theory, the petition would die there.

However, Assistant City Attorney Ron Bennett has advised that to reject a zoning petition before it goes through

the regular zoning procedure opens the city to a lawsuit. State law requires cities take certain steps before making a zoning decision, like holding a public hearing and posting notices in a local newspaper.

“When you decide something isn’t significantly different, you have foreclosed that applicant from ever having the opportunity to file that application,” Bennet said. “You have definitively said you can’t use your property in the way that you are proposing, and you’ve done it without any due process.”

To fix the potential conflict with state law, the City Council reached consensus in work session to remove the “significant difference” language and to extend the waiting period to 18 months.

This proposal drew opposition from many Johns Creek residents. Opponents argued removing the re-initiation clause would lead to community fatigue because the same zoning cases would apply again and again.

The Johns Creek Community Association, an organization that collectively represents local homeowner associations, opposed the proposed change, as did Preserve Johns Creek. The Planning Commission recommended denying the amendment in a 4-2 vote.

Some council members said the residents’ fatigue fears were unlikely to become a reality, because the 18-month

waiting period would encourage developers to bring their best plan the first time they apply, or else move on if they are denied.

Bodker said keeping the current policy is actually worse for the residents.

Under the current policy, the same case could keep coming up every 12 months, because the council has no choice but to allow them to reapply. Under the proposed change, residents would have an additional six months of reprieve.

“Keeping the language, I think actually creates the very concern I’m hearing the public express, which is what I call resident fatigue,” Bodker said.

In the past two years, there have been three cases in which a previously denied property owner requested to reapply. All were allowed.

Three residents spoke against the proposed amendment during the public hearing, although one was in favor of the change, former JCCA President Marybeth Cooper. Cooper recently stepped down from her position to run for City Council, but while president, she asked the City Council to fix the re-initiation clause on multiple occasions.

“Council has sat on this issue for 18 months since you were told it is illegal,” Cooper said. “The first attempt to remove the amendment failed because this council failed to provide a viable alternative.”

The council previously considered

changing this text in the zoning procedure in June 2018. Several residents spoke against the change then, and the decision was tabled.

During the debate, Councilwoman Stephanie Endres repeatedly tried to steer the conversation to talking about a unified development code, arguing that the council needed to comprehensively reevaluate its zoning process.

“We keep putting band-aids on different symptoms, but we are truly not addressing the overall cause,” Endres said.

A unified development code essentially combines all zoning and development regulations — such as design standards, sign regulations and stormwater management — into one document to create clarity for developers and landowners.

“It has no impact on a re-initiation clause,” Community Development Director Ben Song said.

The American Planning Association says unified development codes are especially beneficial for communities experiencing rapid growth, can provide stakeholders more predictability in the development process, but can be timely and expensive to produce.

This spring, when the council ranked its priorities for the Community Development Department, a unified development code placed in the middle of the list.

Johns Creek approves gateway marker design

By CARSON COOK carson@appenmediagroup.com JOHNS CREEK, Ga. — The Johns Creek City Council narrowly approved plans Dec. 9 to place an artistic gateway marker at the intersection of Kimball Bridge Road and State Bridge Road.

The final vote was 4-3, with council members John Bradberry, Chris Coughlin and Stephanie Endres opposed. The approval was conditional on an agreement that covers the cost of replication,

intellectual property rights and clear style guidelines for the placement and materials of the monument.

The gateway project has been more than a year in the making. Last winter, the Johns Creek Convention and Visitors Bureau’s top ask for tourism product development spending was to place artistic monuments at entrances to the city.

Johns Creek Chamber celebrates the holidays

The fun kicked off with a special Business After Hours on Dec. 10. Once a month the chamber gathers for a casual, evening networking event at a local business, but for the month of December, the chamber celebrates the season with an ugly sweater contest, holiday-themed games and giveaways.

This year the ugliest sweater winners were Meryl from BusMax and Lauren from Keep the Beat Going for their twoperson sweater ensemble.

The Chamber thanked its vendors for the event: Kendra Scott jewelry, Mary Kay, Scout and Cellar wine consultants, Finest Events, Chili’s and Axtell Productions.

Bodker agreed political activism should be kept separate from city business but said it was not itself unethical.

“Political advocacy is something you do on your own time, not on city time,” he said. “We have to recognize that folks are individuals, and what they do outside their work as employees, they have a First Amendment right to do that.”

With regard to the City Council race, Bodker said throughout the spring he tried to encourage people to run for office and made himself available to answer potential candidates’ questions.

Once the qualifying period finished, he said he refrained from any activity that could be perceived as endorsing candidates.

“I get accused of looking for a lot of people that are puppets or yes-people,” Bodker said. “That couldn’t be further from the truth, What I’m looking for are people who will objectively evaluate the information that’s in front of them and

not come with a personal agenda … The whole thing was done to try to find good people to run for City Council, which is no crime.”

This is not the first time Bodker has tangled with fellow council members.

Back in 2011, the council reduced the mayor’s appointment power, stripping him of the authority to name a city manager and city attorney. A year later, the council publicly criticized Bodker for speaking with a new council member about a bridge project over the Chattahoochee River that the council had already discussed and voted down three times.

Most famously, during his 2013 bid for reelection, the council hired a law firm to investigate Bodker for allegedly sharing privileged information discussed in executive session. That investigation ended in January 2014, a month after Bodker was reelected and two new council members were sworn in.

Milton considering ban on vaping in parks

By JOE PARKER joe@appenmediagroup.com MILTON, Ga. — Milton is considering legislation that will ban vaping in its parks and any city-owned property.

At its Dec. 9 work session, the City Council discussed whether it should extend its ban on the use of tobacco in public places to include e-cigarettes.

Because vaping does not fall under the Georgia Smokefree Air Act — which bans smoking tobacco in most public places — vaping is permitted in Milton’s parks.

“The question is, is vaping smoking, and the answer in all reality is likely no,” City Manager Steve Krokoff said. “If vaping is not smoking, it potentially leaves vaping unregulated outdoors or in closed places.”

However, the city enacted its own ban on smoking in parks to supplement the state regulations, and it could use its municipal ordinance to ban the use of vapes in parks by adding vaping to its definition of smoking.

Milton will also consider a vape ban on any city-owned property.

Councilmember Rick Mohrig said the city taking an “initial step” to ban vaping in parks can send a signal that the city has a concern for the well-being of residents.

Councilman Joe Longoria was also in favor of the ban.

“We understand what the carcino-

gens and the toxins and what components are derived from second-hand smoke,” Longoria said. “We have no clue what comes out of an e-cigarettes, and that’s the worry.”

Krokoff said the city could later decide how it can enforce the ban, either by signage or having police enforcement in parks.

Mayor Joe Lockwood said he hopes enacting the ban and adding signage would raise awareness, and he believes most people would self-impose the restriction in city parks.

Unless a sign specifically bans their use, vaping is permitted at many public places because it does not fall under the state’s smoking regulations. However, City Attorney Ken Jarrard said the Legislature will likely be taking up the issue during its next session, including excise taxes and health and safety issues.

“I can’t see any statewide vaping regulations being more extreme than, or more pervasive than what applies to general, traditional smoking, but it very well may mimic it,” Jarrard said.

Earlier this year, Milton voted to ban any new vape shops from operating within the city. Milton defines a vape shop as any business as having at least 25 percent of its sales from vaping-related products.

Alpharetta and Johns Creek soon followed suit by enacting their own bans on vape shops mirroring Milton’s ordinance.

City pulls funding for Old Soldiers Day Parade

By PATRICK FOX pat@appenmediagroup.com ALPHARETTA, Ga. — One of Alpharetta’s largest and longest-running events lost a key sponsor Monday when the City Council voted unanimously to cease funding for the annual Old Soldiers Day Parade.

“This is a damn shame,” Mayor Jim Gilvin said at the Dec. 9 meeting. “We’ve come to the point where, as a government entity, we can no longer ensure that events sponsored by us remain something supported by our neighbors in bringing us together as a community.”

The Old Soldiers Day Parade, which traces its origins to 1920, has been held continuously on the first Saturday of August since 1952. The event, sponsored by American Legion Post 201 in partnership with the city, regularly draws thousands to downtown.

This year, however, the parade almost didn’t happen.

Three days before the Aug. 3 event, Richard Leake and Michael Dean filed suit in U.S. District Court seeking an injunction against the City of Alpharetta for refusing to allow the Roswell Mills Camp Sons of Confederate Veterans from displaying the flag in the parade.

Citing public safety concerns, the city

argued that such flag displays had been linked to violence and disorder at similar events across the country.

Less than 24 hours before the parade was scheduled to start, the judge denied to act on the plaintiffs’ request, basically upholding the city’s position for the time being.

Judge William M. Ray II pointed out that while the parade was originally organized as a tribute to Civil War veterans, it has since evolved into an event that “honors all war veterans, especially those from Alpharetta, who have defended the rights and freedoms enjoyed by everyone in the United States of America.”

In a footnote, Ray said he found it ironic that Confederate soldiers who fought for secession sought to be part of a parade that honors soldiers who fought in support of the United States.

Nevertheless, the judge was not dismissive of the group’s free speech claim.

“While the court is not ready to issue an injunction at this time, that is not to say one may not be issued in the future,” Ray wrote. “The court has real concerns over the defendants’ position, and should an injunction later issue, such an order could also include an award of damages and/or attorney’s fees to the plaintiffs, should the plaintiffs prevail on the merits of their claim.”

As a result of the ruling, proponents of the flag display were allowed along the parade route but were not permitted to march in the procession.

The Dec. 9 City Council action does not prohibit the Old Soldiers Day Parade, so long as it is organized under private sponsorship and funding. The city estimates it contributed more than $20,000 to assist with the parade.

In a statement issued following the vote, the mayor said recent lawsuits by those affiliated with the Sons of Confederate Veterans have caused additional financial burdens to Alpharetta taxpayers while creating unwelcome distractions which defeat the whole purpose of public support for an event intended to unite our community.

“Sadly, a wonderful event that brings the people of Alpharetta together to celebrate United States veterans has become a platform for outside groups to champion their own personal agendas,” Gilvin stated.

The American Legion, which depends on sponsorships to help stage the parade, expressed regret at the turn of events.

“We are obviously disappointed in last night’s vote to end a nearly 70-year partnership to honor America’s veterans and active duty military,” said Alpharetta American Legion Post Commander Pete Esker.

Marker: Continued from Page 4 nage was one of the city’s key shortcomings. After months of back and forth between the CVB and City Council, the council allocated $64,000 to create a single marker at State Bridge and Kimball.

The visitors bureau partnered with artist William Massey and Urban Catalyst Lab, a nonprofit that helps cities integrate art with urban planning. Throughout the summer, Massey held public meetings to help determine the design. This fall, four designs were put to an online vote.

The winning design features Rogers Bridge over the Chattahoochee River. Between the trusses of the bridge are images that represent eras of local history, such as Native Americans, farming, gold mining, education and technology.

The CVB has requested funding for a second gateway marker as part of the 2020 tourism product development budget, but as of Dec. 9, the council had not approved that funding.

As part of the online survey, 50 percent of respondents said all future monuments should use the same designs. Council members have indicated they are waiting to approve funds until they know the bridge design could be replicated

in a cost-efficient way.

The council has already approved the tourism board’s suggestions to allocate $70,000 for Phase II of the installation of the Wall That Heals and $56,000 for improvements at Autrey Mill.

The council also indicated it would allocate some of the tourism product development funds to a Chattahoochee River greenway study. Coughlin said he would like to see all of the remaining funds go to the Chattahoochee study.

In other business at the Dec. 9 meeting, the council approved a $3.6 million contract for the construction of a new fire station to be located on Kimball Bridge Road just west of Jones Bridge Road. The station will serve the central and northern portions of Johns Creek, with the aim to reduce response times in that area.

Although members of the City Council have clashed on the fire station in the past, the vote to approve the construction contract was unanimous.

For Councilman Steve Broadbent, who formerly served as an emergency responder, passing the contract was a momentous occasion. This was his and Councilman Jay Lin’s last meeting as members of the council.

“I said I would get it passed before I left office,” Broadbent said. “We got it done at midnight at my last meeting, but we got it done.”

Lifeline Animal Project hosts record-setting adoptions DEKALB/FULTON COUNTY, Ga. — LifeLine Animal Project’s fifth annual Black Friday adoption weekend placed 472 animals in new homes.

In time for the holidays, 288 dogs, 182 cats and two guinea pigs found families through the event. The nonprofit’s previous Black Friday adoption weekend record was set in 2016 with 376 adoptions.

All of LifeLine’s shelters participated in the event, including DeKalb and Fulton County Animal Services, the LifeLine Community Animal Center and the LifeLine Cat Adoption Center.

“We asked the Atlanta community for their support, and they responded by turning out and adopting more animal ever before during a Black Friday Weekend,” said Lara Hudson, LifeLine Fulton County animal services director. “To say we are grateful is an understatement.”

LifeLine DeKalb County Animal Services Director Kerry Moyers-Horten said the adoption weekend was meaningful for employees.

With 40 to 60 animals arriving daily, there are many animals to choose from at Lifeline shelters, and the low adoption fees include the animal’s spay/neuter, microchip and vaccinations, are always a bargain.

Law enforcement agencies provide holiday safety tips, services

By JULIA GROCHOWSKI julia@appenmediagroup.com NORTH FULTON, Ga. — The holidays are fast approaching, but it’s no reason for people to let their guard down. Some crimes become more common while people enjoy their time off.

Phone scams are one example.

“Scams are very prevalent at any time of the year, but during the holidays, we need to be on an even higher alert,” said Roswell Police Public Information Officer Sean Thompson. “Most people are in a ‘giving’ mood, therefore, scammers will likely play to that.”

Thompson suggests vetting charities before donating. One sign of a legitimate charity, Thompson said, is a secure website with an “https://” in the address and a padlock symbol.

People should also avoid providing Social Security numbers or bank account information over the phone.

“Remember, no one, not even ‘law enforcement’ or the ‘Social Security Administration’ will ask you of this

you for any reason,” Miller said. “This time of year, criminals will try various methods to distract you with the intention of stealing purses and other belongings… Shop during daylight hours, if possible. If you must shop at night, do so with a friend or family member.”

As people migrate online for holiday gift shopping, package thefts from cars and porches tend to increase this time of year as well, he said.

Some ways to minimize the risks, Thompson said, is to avoid placing empty packaging or boxes by the curb, because it can signal what you have to a potential thief. Instead, people can break down the packaging or use a recycling facility.

And residents should ensure mail and packages don’t pile up while they are away for the holidays, Thompson said.

“Traveling equals time away from our homes,” Thompson said. “If available, have someone check your home daily for mail and packages. If no one is available, leave some sort of lights on and contact the USPS to hold mail. If you’re expect-

ing any packages, change the delivery to an office pick up.”

Other tips include securing homes and cars before leaving.

“Holidays are extremely busy, and our minds can be in a million different places,” Thompson said. “But taking simple steps can prevent us from becoming victims.”

For those traveling over the holidays, local law enforcement agencies provide some security and peace of mind with a vacation watch.

The Roswell Police Department requires residents to fill out an online form at roswellgov.com. The department also puts up alerts about scams or crime sprees in the city on its social media pages.

The Alpharetta Department of Public Safety offers similar services for residents at p2c.alpharetta.ga.us/p2c and on its social media pages.

The Johns Creek Police Department likewise offers vacation patrols, which citizens can request through the police to citizen portal at p2c.johnscreekga.gov.

Residents celebrate Founders Day Parade in new location

By ADAM DARBY adam@appenmediagroup.com JOHNS CREEK, Ga. — Johns Creek held its annual Founders Day Parade Dec. 7, this time in a new venue.

Unlike previous years, the parade was moved to Technology Park along Lakefield Drive and Johns Creek Parkway. Technology Park is home to the new City Hall and a future city park. The move is part of an effort to establish a town center for community events and social gatherings, in line with the city’s 10-year Comprehensive Plan.

The celebration started at 10 a.m. with CBS 46’s Karyn Greer serving as the emcee announcing the oncoming floats and participants from the reviewing stand. Since 2007, the parade has served as an important community tradition showcasing colorful floats and displays from local businesses, schools, charities and organizations. As in past years, children collected the handfuls of candy thrown their way by parade participants. Members of the community, like resident Ed Waldner, have made the parade an annual tradition of their own.

The city staged the event at the new location to familiarize residents to the site.

“The primary objectives of moving the parade to the Technology Park area are

to begin familiarizing residents and visitors with the new Town Center area… as well as to have the parade on a route that does not require a halt or detour for traffic along a primary and heavily trafficked corridor,” said Johns Creek Communications Director Bob Mullen.

coordination from the city every year, the parade continues to be a community favorite celebrating the anniversary of the city’s incorporation. The paradeday involvement from the city’s fire and police departments also ensures a safe

55+ apartment community opens on Medlock Bridge

By CARSON COOK carson@appenmediagroup.com JOHNS CREEK, Ga. — The small number of for-rent apartments in Johns Creek increased by 140 units this year with the opening of EVOQ Town Flats, a 4-floor community aimed at downsizers.

The developers say the property fills a niche in the housing market.

“We saw a demand that was being unmet for a luxury community for empty nesters who don’t want a mortgage,” said Dave Dixon, the project manager with One Street Residential. “They want the freedom and flexibility of leasing, and they’re not ready for an assisted living community.”

The initial idea for the project came about in 2015. Through finding financial backing, legal battles with the city and designing the complex, it was a long road to get here. Dixon said they went through more than 50 site plans.

“This was our dream, but we didn’t know what it would look like,” Dixon said.

The 6.6-acre property on the corner of Medlock Bridge Road and Bell Road almost became a funeral home in 2014.

In 2015, the owner presented initial plans for the active adult complex, which were rejected because of a proposed 6-floor height.

The next year, the developers came back with a compromise — a scaled down, 4-story plan —which passed with a 5-2 vote. Council members Lenny Zaprowski and Stephanie Endres voted against the decision.

“Why we had a rough and tumble start, it’s really how you finish that matters, and it’s clear they’ve finished strong,” Mayor Mike Bodker said at the grand opening. “I wish them nothing but the best.”

Johns Creek’s 2018 Comprehensive Plan named expanding senior housing options an objective of the city. The document states that about 19 percent of the city’s population is baby boomers, those born between 1946 and 1964.

That number is expected to decline as they move out of family-style homes.

“If only 20 percent of the city’s current baby boomer population wanted to stay and downsize within the city, approximately 3,000 more housing units (active adult and senior) will need to be developed over the next decade,” the plan states.

who don’t want a house, or didn’t get the house [in their divorce], and want to stay in the area where their friends are.”

EVOQ Town Flats offers one- and two-bedroom apartments ranging from around $1,500 to $3,100 a month.

All apartments come with a patio and washer and dryer.

The complex includes a heated pool, fitness room, dog groomers and concierge service. EVOQ began leasing in October.

In the spring, a new restaurant, The Dutch, will open on the first floor of EVOQ. The restaurant is a new concept from the owners of Dutch Monkey Donuts in Cumming.

The husband and wife team of Arpana Satyu-Burge and Martin Burge said the restaurant will offer donuts and coffee, similar to their existing location, as well as European-style fries and soft serve ice cream.

“There are few things in South Forsyth I’m jealous of, but Dutch Monkey Donuts is one of them,” Mayor Bodker said. “I’m excited The Dutch is opening here.”

Year is over, and we still need more houses Another year has passed and we still do not have enough houses for everyone that wants them.

In fact, 91 percent of the market right now is under-supplied.

Data just reGeoff smith Assurance Financial, leased from Smart gsmith@lendtheway.com Real Estate Data, a leading tracker of data for the Metro Atlanta residential industry, shows that inventory of houses on the market in relation to those that need them is still in an unhealthy place. Housing inventory is measured in the months it is estimated it would take for buyers to buy all of the houses currently listed on the market. It’s called months of supply, and real estate experts say that six months of supply is deemed healthy for the economy. If there are more than six months of supply, then it’s a buyer’s market and housing prices will drop.

If there are less than six months of supply, then it’s a seller’s market and housing prices will rise. According to Smart’s data, 91 percent of the homes in the metro area are under the sixmonth mark.

This low inventory has been exacerbating problems for those looking for lower-priced houses as land, building regulations and materials have made homebuilding too expensive for builders to be able to build anything and sell it for under $300,000 in the metro area. So, with builders not building inventory and demand growing as more people move to Atlanta, prices have risen more in this price-range than most others. Inventory for anything under $300,000 is dangerously low, currently sitting at just over two months.

According to Smart’s data, months of supply goes up for more expensive houses. And up until last June, the equilibrium point (the point at which you get that healthy six months of supply) was right at $600,000. Right now, Smart’s numbers show that the price point has moved up to $800,000. Part of that can be attributed to it being winter, and most people sell their houses in the summer.

So basically, if your house is priced under $600,000, it is likely that your home value will continue to increase. And the further you go below $600,000, the faster it will increase.

If it is over $800,000, you may actually see a decrease – especially if your

home is priced over $1.5 million where there is currently 16 months of supply.

The good news is that supply did indeed improve this year. The average months of supply for detached homes for all markets increased a bit from about 3.1 months to about 3.25 months. For attached homes, condos and townhomes, inventory levels increased significantly. Rising from about 2.25 months to 3 months of supply. The metro area has matured in that there are very few large tracts available for builders to buy and build large neighborhoods like they used to. So instead, they are buying smaller tracts and building up.

The metro area’s population has grown by at least 75,000 a year for the last eight years. It has created almost as many jobs. If it keeps going at this pace, then it will be hard for builders to catch up, especially in the lower-priced markets. If we do get into a recession, it could slow job creation down and actually help cool our low-inventory problem. But more and more, economists are backing off the sentiment that we are headed toward a steep recession.

Atlanta’s economy seems to continually improve. And even if we did drop

into a recession, that could mean more relations to the Atlanta area, which has a lower cost of living than most other major metropolitan cites, and a highly elevated technology and transportation network.

If the metro area is to continue to grow, it will have to figure out how to house everyone that is going to keep moving here. It’s a good problem to have.

Certainly much better than the other problem, where so many people are leaving cities that have too many houses on the market. The fact is, there is never really any balance, and it would be boring if all markets were right at the healthy six months of supply. So as rivers erode mountains, so must we try to balance the housing industry.

Northern Ridge District announces December Eagle Scouts NORTH FULTON, Ga. — The Northern Ridge Boy Scout District — which includes the cities of Roswell, Alpharetta, Johns Creek and Milton — recently announced its newest Eagle Scouts. The Scouts who passed their Board of Review on Dec. 4 at Alpharetta Presbyterian Church are: Christopher Elza, of Troop 9962, was sponsored by Ed Isaackson YMCA. He designed and installed six bat houses and 12 hammock poles for Hembree Park.

Lorin Tady, of Troop 40, was sponsored by the Roswell Ward of Church of Jesus Christ of the Latter-Day Saints.

He renovated all four trail map kiosks for the Milton High School Cross Country Trail. Tady also landscaped the area around the kiosks.

Luke Tucker, of Troop 143, was sponsored by Johns Creek United Methodist Church. He renovated he playset for the Norcross Cooperative Ministries. Tucker also constructed a swing for babies, replaced the rotten roofs of the playset and built a cover for the sandbox.

He designed and constructed a composting area and three composting bins for The Place of Forsyth County.

For calendar year 2020, individuals can contribute as much as $3,550 to an HSA, families can contribute $7,100—and there’s even a $1,000 “catch-up” provision for individuals 55 and over.

Health savings accounts are available to individuals and families who are enrolled in high-deductible health plans (HDHPs). True to their name, high-deductible plans come with higher out-ofpocket expenses than other insurance offerings. HDHPs set a maximum limit on the amount a covered person could need to pay for care during a plan year.

With out-of-pocket maximums set at $6,900 for self-coverage HDHPs in 2020, there’s no doubting that consumers need all the help they can get in accumulating savings to cover planned and unplanned expenses. HSAs offer three tax benefits: 1. Contributions are tax deductible: Like a 401(k), you contribute pre-tax

dollars, which reduces taxable income.

2. Earnings grow tax-free: Investment earnings on HSA contributions are not taxed.

3. Withdraws are tax-free so long as they’re used to cover qualified medical expenses. You can find a list of qualified expenses on the IRS’s website.

Unlike a Flexible Spending Account (FSA), participants can open an HSA at any time during the year, change contribution rates or even invest a single lump sum.

Money contributed to an HSA has no expenditure time limit. Funds not used during the contribution year can build over time, and contributions can be added from different income sources.

This makes the HSA particularly valuable as a secondary retirement savings vehicle.

How do HSAs benefit employers?

By offering a tax-advantaged HSA plan, a business provides its employees with a convenient way to accumulate pre-tax medical savings, and the employer can make its own contributions to these accounts as part of an overall benefit plan.

Still not convinced? Here’s one more benefit: Once you turn 65, money can be withdrawn from an HSA for reasons other than health care, though such distributions will likely be taxable.

Johns Creek teen wins national writing award JOHNS CREEK, Ga. — Sarah Lao, a resident of Johns Creek and junior at Westminster School, was recently named a 2020 National YoungArts Foundation Finalist in Writing/Poetry.

Lao was recognized for her artistic achievement and was one of 150 finalists selected from more than 7,000 applicants from all over the United States as one of the nation’s most accomplished artists in the visual, literary and performing arts.

Lao was selected by a discipline-specific panel of artists through a rigorous blind adjudication process. YoungArts award winners gain access to one of the most prestigious programs for emerging artists in the United States in which

they will have opportunities for creative and professional development throughout their entire careers.

“It’s such an incredible honor to have been recognized, and I’m so grateful to YoungArts for hearing my voice,” Lao said.

Lao will receive a cash prize of up to $10,000 and will participate in National YoungArts Week in January, the organization’s signature program providing artists with a weeklong program featuring master classes, workshops and mentorship from leading artists in their fields.

At National YoungArts Week, Lao will have the opportunity to learn from 2020 master teachers, including MacArthur “Genius” Claire Chase, Grammy-nominated jazz vocalist René Marie, New York Times Best Selling author Joan Morgan,
