Police investigate threats to homeowners group JOHNS CREEK, Ga. — Employees at Abberley Towneship called police July 21 after an interaction with a man over alleged homeowners association violations turned heated.

The two women told police they were walking the neighborhood making inspections for HOA violations when they came across the homeowner on Bossier Drive. During the conversation, the women said the man became “loud, aggressive and verbally threatening,” screaming profanities loud enough for neighbors to hear.

Police met with a nearby neighbor who witnessed the exchange, and she confirmed the man yelled profanities at the women and called them names.

Police went to the man’s home but were unable to contact the resident.

Residents report burglary upon return from vacation JOHNS CREEK, Ga. — Police are investigating after a couple returned home July 26 and found their residence on Royal Dornoch Drive shot up and ransacked.

The couple told police they were out of town for a few days, and when they returned home, they discovered the back door shattered with bullets and glass all over the floor.

A desk inside the home had all its contents removed, including $10,000 taken by whoever broke into the house. A pearl necklace and pearl earrings, valued at a combined total of $13,500, were also stolen from the master bedroom.

JOHNS CREEK, Ga. — A man called police July 25 after an altercation with a man in a parking lot at the Retreat at Johns Creek.

The resident at a State Bridge Road apartment complex told police he exited his car earlier in the day and noticed a

JOHNS CREEK, Ga. — A Johns Creek man was charged with criminal trespass July 22 after allegedly damaging another vehicle in a traffic altercation.

Police said the incident began when a motorist noticed a van speed by him on Jones Bridge Road. He told police he noticed the van driving erratically the past few days at the same time, so he pursued the car to say something to the driver.

He told police he caught up to the van at a stoplight, got out of his car to confront the driver, eventually banging on the front driver window.

The Black woman inside the van told police the man was yelling profanities and racial slurs, so she called authorities. At that point, the woman said the man kicked her van, leaving a noticeable dent, as he walked back to his car.

Multiple witnesses at the intersection corroborated the woman’s story, and police charged the man with criminal trespass.

City Council debates process for appointing chief of police

By ADAM DARBY adam@appenmediagroup.com JOHNS CREEK, Ga. — The Johns Creek City Council is discussing the process by which the city hires its chief of police and how much say the public should have in the matter.

At its July 27 work session, city officials debated how much say they — and the public — should have in the matter.

Currently, the authority to appoint a chief of police rests with the city manager. In an effort to restore trust in the police department, however, the council is looking to promote greater citizen involvement in the process.

Councilwoman Erin Elwood presented a proposal to grant the council the authority to appoint the police chief, but that would require an amendment to the City Charter establishing the council oversight and transferring duties from the city manager.

“All of that power rests solely in the hands of the city manager…I’m trying to shift some of the power out of the hands of the city manager…to the citizens,” Elwood said. “In this situation, we as the council members represent the citizens.”

The issue arises from the employment status of current Police Chief Chris Byers, who has been placed on leave since he posted controversial social media posts about the Black Lives Matter movement in June. In his posts, Byers claimed that pastors and religious lead-

In-class learning proposal spurs angry backlash

By PATRICK FOX pat@appenmediagroup.com JOHNS CREEK, Ga. — A Johns Creek City Councilwoman issued an apology to residents July 27 for any misunderstanding that may have come from a resolution she co-sponsored encouraging in-person learning to the Fulton County School District.

The measure was co-sponsored by Councilwoman Stephanie Endres and Councilman Chris Coughlin.

District officials announced in mid-July that, contrary to earlier plans, classrooms will not be open to in-person learning when school resumes later this month. The district had earlier floated a plan whereby families had a choice of either in-class or remote learning this fall. But the in-class option was withdrawn shortly after a surge in coronavirus cases surfaced in the Southeast.

Speaking at the council’s work session, Coughlin said that the sole purpose of the resolution was to ask Fulton County Schools to come up with a plan for getting students who wish to attend classes in person back into schools.

“We were not concerned with property values,” he said. “We were not mandating in-person schooling. We were supporting the decision made by the superintendent of Fulton County

Local runoff races to be settled Aug. 11 FULTON COUNTY, Ga. — Registered voters in Fulton County go to the polls Aug. 11 to select the final candidates for the Nov. 3 General Election and for nonpartisan seats.

Early voting continues through Friday, Aug. 7, 8:30 a.m. to 6 p.m. Weekend voting ended Aug. 1.

This year, Fulton County has 20 early voting locations, including State Farm Arena in Atlanta, which was opened in partnership with the Atlanta Hawks to accommodate for social distancing. The arena is touted as Georgia’s largest voting location.

Fulton County has ensured that at least three early voting sites are available in each commission district.

Registered voters may cast their ballot at any Fulton County polling location during early voting. If residents choose to vote on Election Day Aug. 11, they must report to their assigned polling place, which can be found at mvp.sos. ga.gov.

Stormwater dominates Johns Creek budget talks Council members debate funding for major upgrade

By PATRICK FOX pat@appenmediagroup.com JOHNS CREEK, Ga. — Johns Creek officials are still hammering out details of the city’s 2021 budget, a $59 million spending plan set for adoption later this month.

That hammer became a gavel at times July 27 when debate grew heated among City Council members over funding for the city’s massive overhaul of its municipal stormwater system. Various proposals under consideration call for spending anywhere from $10-$31 million over the next 10 years to set the system right.

City Councilman Lenny Zaprowski teed off the discussion saying, even during this time of budgetary restrictions, the city cannot ignore its commitment to residents for a sound stormwater system.

“I just want to have an honest conversation with our residents about what we’re doing here,” Zaprowski said.

The councilman said he is concerned the city is not preparing itself for the running cost of upgrading the system. Nor, he added, is it facing the fact that it will require more money than is currently available to continue the upgrades.

Right now, Zaprowski said, the city has $2.5 million in its accrual account

and another $750,000 available in the proposed budget for the upcoming year’s upgrades. That’s just enough to keep the city on schedule for the 10-year upgrade, he said.

After that, what? He asked.

“For us to sit on our hands — and I don’t know what the budget’s going to bring next year — if I’m serious and I want to go forward, I want to be able to pay for what we say we’re going to do. I don’t want to take two years off. I want to be able to live up to my promise.”

Help may be on the way There was some pushback from Councilman John Bradberry who argued the city has enough money to begin the work now. There are prospects that by next year, the city will have a stormwater utility in place through which the city can bill property owners for the service, he said.

“To me, this is a very reasonable path forward,” Bradberry said. “I think in the next year, we need to have the help of staff, communications and Community Development and Public Works to outline exactly what are the problems, what are the effects they’re having on the community and what is it going to cost to the average homeowner.”

Up to now, Bradberry added, stormwater has been something everyone has

benefitted from, but no one has been paying for. It’s time to change that, he said.

Councilwoman Stephanie Endres said the whole issue of stormwater boils down to choices. She said the council is obligated to tell the public which promises it intends to keep and how it plans to pay for them.

“We aren’t just a rich population here where everyone kept their jobs — and they can’t afford that,” she said. “We have to balance all these constraints and recognize our prioritizations, and reel in the importance of those accruals…It’s a hard discussion that has to be had.”

Bradberry charged back, saying Endres was accusing the council of falling short of their duties. He said stormwater was funded sufficiently in last year’s budget until a campaign to lower the property tax rate won the day, a tax cut he, himself, voted for.

He charged Endres with presenting an argument based on facts from “an alternate universe.”

Real money may be 2 years out Mayor Mike Bodker said the council ultimately has to agree on how to implement a stormwater system. But, he added, even if a utility is in place by next year, and property owners begin receiving bills, it will be two years before that

COVID surge pushes Emory Johns Creek into diversion status

JOHNS CREEK, Ga. — City officials were notified by residents recently that Emory Johns Creek Hospital had gone on diversion status over the past week.

Diversion status is a temporary condition in which a health care facility notifies local emergency medical services that its beds are full and it cannot take new patients. A spokeswoman for Emory Healthcare said the hospitals continue to see a surge in hospitalized patients with COVID-19.

said. “We are also monitoring the capacity of our hospitals within the Emory Healthcare system, and at times, our hospitals may need to go on diversion status as standard operating procedures when we see a surge in volume.”

Johns Creek City Manager Ed Densmore, who served as the city’s chief of police for 13 years, told city officials that diversions are not uncommon in the healthcare industry. In certain cases, he said, there may be a multi-injury accident where one hospital does not have the resources to treat all victims.

In such a case, he said, the hospital will notify emergency services to divert other injured patients to another hospital.

Emory Healthcare said it continues to work to ensure the safety of patients and the community.

North Fulton Chamber retools as pandemic endures Business group plans more timely initiatives to aid area employers

By PATRICK FOX pat@appenmediagroup.com NORTH FULTON, Ga. — Stoked by a widespread surge in coronavirus cases, the Greater North Fulton Chamber of Commerce has stepped up efforts to assist local businesses weather an uncertain economy.

The chamber hosted its first in-person event in three months July 16 at the Chattahoochee Nature Center — outside, of course, celebrating the center’s butterfly exhibit. The Business After Hours event was limited to 50 people, and there was a standby list.

“People are ready to get back to inperson visits,” said Chamber President Kali Boatright. “We want to make sure our business members are confident that if they come to one of our events, that we’re following all the right guidelines and doing all the right things.”

The Greater North Fulton Chamber BOATRIGHT mounted initiatives in the early stages of the pandemic, teaming with the Forsyth County Chamber to present a series of virtual job fairs throughout May and June.

It also assembled a series of business workshops online free to members and non-members. The topics were timely, dealing with topics like financing, securing Payroll Protection Program assistance and how to promote consumer confidence. One event featured a town hall with all five mayors from major North Fulton cities.

Charity group names new executive ROSWELL, Ga. — North Fulton Community Charities has named Marten Jallad the new director of operations. In his role, Jallad will oversee all operations and lead the facilities management and thrift shop teams.

Jallad has extensive experience in retail store management with big box retailers and thrift stores. His skill set includes the management of both large facilities and teams.

The Chamber also teamed with economic development heads from four cities to survey local businesses about conditions, layoffs and sentiment. The first survey was conducted in April and drew responses from more than 500 local businesses. Another survey was conducted in May, and a third survey just wrapped up in late July.

“I believe, and what I’m hearing from other chambers all over, is that the economy, at this point, is really in the hands of consumer confidence,” Boatright said.

“Are folks ready to get back out there?”

On July 28, Lt. Gov. Geoff Duncan spoke at the monthly Wellstar Chamber Luncheon series, outlining highlights of the unusual 2020 Legislative Session that had been interrupted by the pandemic.

Boatright said the free seminars, keyed toward business interests, will continue through August.

“As a regional chamber, one of the blessings is we have connections to a lot of excellent speakers and knowledgeable experts,” she said. “There’s so much information out there, it’s very difficult to cull through all of it.”

More recently, the Chamber has formed its own Economic Recovery Task Force made up of public and private leaders from throughout North Fulton.

It has five functions: • Cash flow and liquidity – advising businesses on current sources of funding, such as the Payroll Protection Plan and other assistance.

• Small business and entrepreneurism – a group of legal and financial experts available to assist those wishing to start their own business.

• Workforce and unemployment – repurposing “It’s an exciting time for Marten to join NFCC,” said NFCC Executive Director Holly York. “He brings years of experience in facilities management to our team and has expertise in retail and thrift operations.”

Finally, plans are underway to retool the Chamber’s Emerging Leaders Program, a student leadership course that launches each fall and runs until May. The Chamber is reshaping its curriculum to accommodate the school district’s decision to offer online only classes. If students are not going back to a school setting, then the program will be offered online as well, Boatright said.

Fulton Schools presents plan for phased re-opening of classrooms Looney says COVID data will guide local decisions

By CANDY WAYLOCK candy@appenmediagroup.com NORTH FULTON COUNTY, Ga. — Fulton County Schools leaders admit the playbook for managing education in a COVID-19 crisis is changing constantly.

Plans made become plans discarded as data comes in.

A month ago, Fulton was planning a return to in-school instruction, with a virtual option for those not ready to return. Weeks later, the school district was forced to scrap those plans and implement district-wide remote learning as COVID+ cases soared.

School officials are now finalizing plans for a phased reopening, perhaps as early as mid-September, if the downward trend of COVID+ cases continues.

“This is complicated,” said Superintendent Mike Looney. “There’s not a book I can reference…so I’m talking to as many informed people as I can in the health, education and government [fields].”

Even that comes with challenges, Looney noted, citing the differing opinions on what is best for kids. He relies mainly on information from the Fulton County and Georgia departments of health, and he emphasized data drives the decisions.

The information today was not readily available in March when Fulton became the first district in Georgia to shutter schools because of COVID-19. It was a decision Looney said “was a quick decision” and perhaps a rash one as well.

Plans to transition instruction to a virtual platform in March were not fully in place, resources and technology issues surfaced, and learning suffered.

provement,” Looney said.

Chief Academics Officer Cliff Jones said remote instruction this fall will not mirror the experiences student’s had last spring.

“Be assured, universal remote learning will be a different experience, with provisions that allow more rigor and more concern for the learning environment,” Jones said.

Emphasis will be placed on teachers maintaining connection with students, daily live instruction, more time spent in the “virtual” classroom, and mitigating instances of academic dishonesty and cheating.

“The lessons [from last spring] were not missed on us,” Jones said, noting that safeguards have been put in place to ensure students are present.

During the July 23 meeting of the Fulton County Board of Education, a reopening strategy for the school year was presented. School begins Aug. 17 with teachers in schools and students learning from home.

A Phase 1 reopening could begin as early as after Labor Day if the number of COVID-19 cases continue to decline from the summer surge. Face-to-face would start with PreK–2 and for special need students who could return to schools in small numbers for meetings with their teachers. Students in grades 3-12 could arrange for one-to-one conferences with their teachers.

From there, depending on data, those options could expand through Phase 4. Full face-to-face instruction will reopen when the number of COVID cases remains at or below 100 per 100,000 population for two weeks. Students may still opt to continue virtual learning.

Currently, cities in North Fulton, including Alpharetta, Johns Creek, Milton and Roswell, are the closest to hitting the goal of 100/100,000. Cities in South Fulton are considerably further away from that benchmark. The city of Atlanta has nearly half the number of positive cases in the entire county.

The decision on whether clusters of schools, or sections of the district could be in different phases at the same time is still under discussion. Looney said reopening will be done in a measured way, based on data, that maximizes safety.

“The worst thing we can do is open and close [again], and have this rubber band effect that upends people’s lives,” Looney said.

Teachers return to work Aug. 3 for two weeks of pre-planning. Provisions have been made for those teachers unable to return for “legitimate” reasons, but Looney emphasized short-term subs will not be available.

Chief Talent Officer Ron Wade noted the anxiety of teachers returning to work is primarily based on safety.

“We have put in place safety measures, [including] they will be wearing masks, schools will follow CDC guidelines, daily health checks, [virtual staff] meetings and limiting visitors into the schools,” Wade said.

Board Member Gail Dean noted some teachers have concerns about returning to schools when they have children at home.

Looney responded it was a situation that parents of all 95,000-plus students are also dealing with in this situation.

“I hope the teachers understand it is very difficult to strike a balance, and we are trying to make this situation as fair as possible,” Looney said.

The press, and who’s going to know?

Covering city council and county commission meetings tends to be, let’s say, tedious at times.

With some exceptions — like when a developer is asking for a multitude of variances to increase RAY APPEN the number of units Publisher Emeritus ray@appenmediagroup.com they want to build — covering government meetings tends to be routine, quiet, and frankly, a snooze.

Attendance tends to be sparse. Today, most council and commission meetings are streamed, so you can sit in your home and check out what your elected representatives are up to. I will suggest however, that in normal times the number of people who actually watch online is less than the number who attend in person.

Hatcher Hurd who reported for Appen for so many years, always used to sit in the front row, week in and week out, notebook in hand, listening to every detail. For many meetings, he was part of an audience of less than five. But he always showed up.

Sitting in the front row, Hatcher became something different than just a body in a chair. He became a “check and a balance.” Council members always knew that he would check up on their decisions and would make sure that everything passed the smell test — the balance.

Because he had more institutional knowledge than most council members, there wasn’t much that slipped past him. He knew the rules. He knew the history. He knew who to call. He knew enough of the law to know when it was being manipulated. For all practical purposes, his function at those council meetings was akin to a referee at a football game. Everyone abides by the rules, or he calls it.

Over the past 30 years, we’ve had an Appen reporter at around 4,000 city council meetings by my estimate. And we’ve reported on every single one.

We’ve had to throw that yellow flag onto the field more than a few times.

Recently we threw one on the City of Roswell for withholding information that, by law, belonged in the public domain.

It ended up in court, and ultimately the information became available once again to the public.

Last year, we threw the yellow flag when the Forsyth County Commission approved an item in open session — a matter earlier discussed in executive session— that they provided no details for.

Nothing.

They subsequently reintroduced the item, providing more details before casting a second vote.

Over the past 30 years, we’ve had an Appen reporter at around 4,000 city council meetings by my estimate.

And we’ve reported on every single one.

We also wrote an article last year on Forsyth County’s plan to finally make their agenda documents available to the public online in advance of meetings. We were told it was “in the works,” but now, over a year later, still no agenda packet available online.

Gwinnett County made their agenda packets available online more than 10 years ago. Fulton has had its agenda documents available online before meetings for years, as well. So has Cherokee County.

The public needs reasonable access to public business. If access to online agenda items were ever needed, it is now when everyone is sheltering in place or avoiding unnecessary crowds.

We’ll keep you posted on Forsyth County’s online agenda packet availability.

Meanwhile, we’re still awaiting word from the Georgia Attorney General’s Office over a request we made two months ago.

It related to Forsyth County’s probe into a commissioner’s alleged circumvention of open records protocols. The county has yet to release the emails we requested.

City councils, county commissions, school boards, all public institutions make decisions that impact your lives.

They spend your tax dollars as they see fit. They award contracts paid for with your money and they do this in compliance with established law. One primary reason they comply with the law is because there is a newspaper reporter sitting in the front row listening.

Years ago, after a city council meeting had ended, our reporter was getting ready to go home. It was late. Two council members were still in chambers having a conversation. One councilman said to the other, “Why don’t we just go ahead and approve that? Who is going to know?” In response, the other council member replied, pointing to our reporter a few feet away, “he will.”

If the day arrives when there is not a reporter sitting in that front row, it will be a game with no referee. How do you think that will go?

Johns Creek residents march for racial unity

By ZACH SHUGAN zach@appenmediagroup.com JOHNS CREEK, Ga. — The phrase has been used repeatedly in the wake of protests over racial injustices in the United States: “It’s not a moment. It’s a movement.”

More than two months after the death of George Floyd at the hands of Minnesota police, Metro Atlanta residents remain motivated to rally against racial injustices and push for unification among races.

In that vein, the Johns Creek Community Unity March was held July 25, featuring speeches from community leaders and a march around town. The event, held at City Hall, was sponsored by the Johns Creek Moms for Community Unity, a local group of moms calling for solidarity and unity among members of the community.

Speakers included South Gwinnett High School Principal Dorothy Jarrett, Johns Creek City Councilman and former police officer Brian Weaver, the Rev. Lee Jenkins, pastor of Eagles Nest Church in Alpharetta, and U.S. Rep. Lucy McBath.

Jarrett, the cousin of slain Mississippi youth Emmitt Till, urged community members to come together and have what may seem like tough conversations about race and racial inequities.

“It’s all about having conversations and people coming together to really look at the social injustice and heightened racial tensions and starting to talk about how can we turn around this systemic racism and discrimination,” Jarrett said.

She shared the infamous story of Till’s murder in 1955 at the hands of two White men in Money, Miss., after the 14year old Black boy allegedly whistled at a white woman. The two men were found not guilty by an all-White jury, and the

woman later admitted she made up most of the story of Till flirting with her.

After the trial, it was a White farm owner who helped Jarrett’s family escape the town and any possible threats over testifying against Till’s killers.

Jarrett’s family worked as sharecroppers on the farm in the small Mississippi town. The landowner provided funds for Jarrett, a young child at the time, and her family to move north to Michigan.

“I just wanted to share that a community coming together and building unity works,” Jarrett said. “I’m a product of that. We have to do everything we can to eliminate looking at color instead of looking at the heart. So much of how people act is associated with fear, and we have to bring love to the forefront.”

What began with the killing of George Floyd in May, followed by passionate protests and riots across Atlanta and the rest of the country, has been a critical

time for all races in the United States.

“I think people are realizing now that we have to come together because it’s all of our problems,” Weaver said. “You can’t just say it’s a White problem or Black problem. It’s a people problem. In order for us to become a better country as one human race, we’re going to have to work together to get rid of some of the disparities in healthcare, economic opportunities and social injustice.”

The crowd of around 150 people, along with the guest speakers and event organizers, marched along the streets of Johns Creek. The group made its way from City Hall down Johns Creek Parkway to Medlock Bridge Road and Findley Road.

Halfway through the march, the procession paused for 8 minutes and 46 seconds, the length of time prosecutors say George Floyd was pinned under the knee of the police officer when he died.

Coughlin said backlash over the proposal, and how it was perceived, hit him close to home when his children were mentioned in the flurry of angry comments.

“Call me what you want,” he said, choking back tears, “but stay away from my children.”

The resolution sought from the district a detailed plan with contingencies including other programs to address neglect, abuse, hunger, daycare, respite, grading, outreach to children at risk and instruction materials. The resolution also called for the plan to be backed with sound rationale to inform the families the detailed plans and processes to get students back to schools so families and teachers can prepare, plan and set clear expectations.

In her remarks at the City Council meeting, Endres said she regrets that the purpose and scope of her intentions were misrepresented by the media.

“At the end of the day, all Chris and I were looking for was on the day that the decision was made, every student or parent that had chosen to go either in-person or virtual, everyone had clarity and had facts to make their decisions on,” she said.

The school district decision, Endres said, left parents who had planned to have their children attend class out in the cold with no information to work on.

“So Chris and I merely put together a resolution to highlight the calls that we were receiving and have a voice for those families since the decision was made with no letter or mail or information so those families could effectively make decisions,” she said.

Coughlin asked to withdraw the resolution because the school district had issued a plan that addressed nearly all the issues sought. major expenses, like street resurfacing, that can cost millions.

Complicating matters is the fact the city faces almost certain declines in sales tax revenues because of the coronavirus-induced soured economy. One secure way to ensure more revenue is to raise taxes on property, something elected officials are loath to do always, but especially during an economic downturn with high unemployment.

The council is expected to resume budget discussions Aug. 10. A special meeting has been scheduled at 11 a.m. to set and discuss the tax rate — or mill levy — for this year. A second hearing will be held later in the evening at the council’s regular business meeting at 7 p.m.

movement because it “seems to support the killing of my brothers and sisters.”

Byers, who became chief in March, was quickly placed under investigation and administrative leave for his statements.

In light of the incident, city officials are now evaluating the hiring process for the position.

Members of the City Council were vocal about their reservations to allow themselves greater authority in the selection process.

“I feel strongly that we [the council] can’t interfere with our day to day…I think that elected officials, in and of itself, have created a lot of distrust in this nation,” said Councilwoman Stephanie Endres. “I would not want this council or any council being in charge of the police chief.”

All council members agreed on the vitality of citizen involvement in the process. The use of a citizen interview panel is currently in discussion to serve as an alternative method for the next police chief appointment.

No official action was taken during the work session, and Elwood said she will meet individually with city officials to draft a proposal that focuses less on council oversight and more on public participation throughout the appointment process. The council hopes to continue discussing the issue in upcoming meetings once a concreate plan is drafted.

Bodker delivered an opening statement at the council’s formal meeting later that night expressing his thoughts on police appreciation and citizen equality.

“You can hold two beliefs and they’re not necessarily in conflict with each other and that is, you can absolutely be against any form of police misconduct… and you can still love the police,” Bodker stated. “Equality cannot be an aspiration. It must be a reality.”

The council fielded a number of public comments about the issue, via email and in person, at the meeting.

One resident, Tana Welch, told council members a local group of residents, calling itself Johns Creek United, has launched a petition calling for the immediate firing of the police chief. The group is also seeking formation of a citizens advisory board to have a say in local law enforcement matters.

So far, she said, the petition has some 450 signatures, all but a few from Johns Creek residents, and all of a variety of races.

“We’re here, and we’re not going away,” Welch told the council. “I don’t mean that as a threat. I mean we are here to hold you accountable to the things you said earlier.”
